STATEMENT OF CLAIM
COURT DETAILS
Registry Write the location of the court where you will file your claim. For
example, Downing Centre, Parramatta, Dubbo

You will need to select the type of claim that matches your claim, for example:
You can find a full list of matter types on the UCPR website under Table 6.4 Types of claim applicable to Local
Court proceedings.
If you select the incorrect matter type, it will not affect your claim.

RELIEF CLAIMED
1 Write a brief statement of what orders you want the court to make, for example ‘That the defendant
pay the plaintiff the total amount claimed below’ Delete 2 or leave blank
In this section you need to write a clear description of your claim in numbered paragraphs. Refer to yourself as
the plaintiff, and to the person who owes you money as the defendant. You need to include:
• relevant dates – e.g. when money was borrowed, when goods were supplied, when services were
provided
• the reason for your claim (e.g. money lent and not repaid, goods or services provided and not paid for)
• the amount you are owed
• when the amount should have been paid
• the amount of your claim
• whether you are claiming interest and how the interest is calculated

If you do not file a defence within 28 days of being served with this statement of claim:
• The court may enter judgment against you without any further notice to you.
The judgment may be for the relief claimed in the statement of claim and for the plaintiff’s costs of
bringing these proceedings. The court may provide third parties with details of any default judgment
entered against you.

require assistance on how to respond to the claim you should get legal advice as soon as possible.
