The below-named complaining witness being first duly sworn states the following:

Count 1: DELIVERY OF METHAMPHETAMINE

The above-named defendant on or about Monday, February 13, 2017, in the City of Madison,
Dane County, Wisconsin, did deliver a controlled substance, to-wit: Methamphetamine , in an
amount of 3 grams or less, contrary to sec. 961.41(1)(e)1, 939.50(3)(f) Wis. Stats., a Class F
Felony, and upon conviction may be fined not more than Twenty Five Thousand Dollars
($25,000), or imprisoned not more than twelve (12) years and six (6) months, or both.

And the Court may suspend the defendant's operating privileges for not less than six (6)
months nor more than five (5) years. If the defendant's driving privileges are already
suspended, any suspension imposed must be served consecutively.

Count 2: RESISTING AN OFFICER

The above-named defendant on or about Monday, June 12, 2017, in the City of Madison,
Dane County, Wisconsin, did knowingly resist an officer, while such officer was doing an act in
an official capacity and with lawful authority, when being taken into custody, contrary to sec.
946.41(1), 939.51(3)(a) Wis. Stats., a Class A Misdemeanor, and upon conviction may be
fined not more than Ten Thousand Dollars ($10,000), or imprisoned not more than nine (9)
months, or both.

FACTS:

Your complainant is a Special Agent (SA) with the Wisconsin Department of Justice – Division
of Criminal Investigation (WI DOJ-DCI) and for this complaint is relying on the written reports
submitted by WI DOJ-DCI SA Kyle Dilley.

STATE OF WISCONSIN - VS - John A Owen III

SA Dilley reports on Monday, February 13, 2017, he conducted a controlled buy of 3.4 grams
of methamphetamine utilizing a Janesville Police Department Confidential Informant, herein
after referred to as JP722 and $300 of DCI buy funds from a subject known to JP722 as John
A. Owen III, the defendant herein.

SA Dilley reports JP722, equipped with a covert audio recording/transmitting device, was
dropped off near the intersection of Butler Street and Mifflin Street, in the city of Madison,
Dane County, Wisconsin under surveillance. JP722 later confirmed that the defendant
delivered the suspect methamphetamine in exchange for $300 in pre-recorded buy money at
approximately 4:25 p.m. while JP722 was inside the defendant’s residence at 123 N. Butler
St., Madison, Dane County, Wisconsin.

SA Dilley met JP722 at a predetermined location and obtained the suspect methamphetamine,
which was later tested by SA Leck using the 923 Methamphetamine MDMA (Ecstasy) Reagent
field test on a random sample in accordance with the manufacturer’s instructions as well as the
training received, and the test indicated a positive result for the presence of
methamphetamine. SA Dilley reports the methamphetamine weighed 3.4 grams.

SA Scott Leck searched JP722’s person before and after the controlled buy and both were
negative for contraband.

JP722 is believed to be truthful and reliable as the information provided by UP22 was
corroborated by law enforcement’s own visual observations. The information provided was
also corroborated by audio recording of the controlled buys and calls made up to set up the
controlled buys.

**THIS COMPLAINT IS BASED ON the information and belief of your complainant, who is a
SA for the WI DOJ-DCI, and who learned of the above offense from the reports of SA Dilley
and SA Leck, which reports your complainant believes to be truthful and reliable inasmuch as
they were prepared during the course of the SA’s official duties.

Your complainant believes the statements of the Defendant to be truthful and reliable insofar
as they are admissions against penal interest.
