Image, Trademark & Video Gallery Terms of Use

Below you will find the i) Trademark Use Guidelines and the ii) Photo, Video and Clip Art
Member License Agreement.

Your use of the Marks, photos, videos, and clip art provided on this site are subject to these
terms and any additional terms that may appear with the Mark, photo, video or clip art.

PADI Member Trademark Usage Guidelines

PADI Member Trademark Usage Acknowledgement:

I have read the PADI Membership Agreement, which includes the Member License Agreement,
and hereby consent and agree to the terms and conditions in their entirety. I also understand
and acknowledge that specific trademark use guidelines, which may be updated periodically,
will be posted here on the PADI Pros’ Site. I agree to accept the terms of such guidelines and
accept that it is my responsibility to stay current with these terms.

General Considerations

The PADI Member License Agreement defines the rights of PADI Members, in legal terms, to
use the PADI and related companies’ trademarks (throughout the rest of these Guidelines,
these will be referred to as the PADI trademarks for ease of reading). The guidelines provided
here will explain the uses of the trademarks in more practical terms.

The basic ideas behind the Member License Agreement’s allowable trademark uses are as
follows:

1. The PADI trademarks are valuable assets of the PADI organization, developed,
promoted, and protected at significant ongoing cost to PADI.
2. PADI provides the licensed right to use the trademarks to PADI members as a benefit of
membership, to assist members in carrying out their dive business activities.
3. The rights to use the trademarks are based upon the ideas that (a) the rights are
personal (given specifically to each member, whether an individual or business); (b) the
rights are non-transferable (meaning the member cannot allow others or other
businesses to use them); (c) the rights are for the purpose of the member being able to
promote himself or itself (whether individual or business) as a source for PADI services
and products; and (d) the general guidelines for use are built upon the concept of each
member being able to use the trademarks to promote the PADI services and products
commensurate with the member’s level and type of membership.

General Usage Guidelines:

1. A PADI Individual Member operating a dive operation (whether virtual, brick and
mortar or vehicle-based) that would not qualify as a PADI dive center/resort association
member:

The Member is authorized to use all PADI trademarks to the full extent allowed by the
Member License Agreement in offering PADI diver training, to the level the Member is qualified,
and personally accompanied dive travel (dive trips or certification trips) or guided tours. If also
renting dive equipment, such rentals must be directly associated with the dive training, or the
guided tours offered.

If the services offered include gear rental outside of the certification/coursework or guided
tours, or gear sales or other diving services of any kind, the Member is not authorized to use
the PADI trademarks in association with the operation, but instructor-level Members are
authorized to use the “PADI Instructor Available” artwork from PADI. The Artwork is authorized
to be displayed on the business website and in advertising materials (flyers, etc.), but is not
authorized for use on any external signage.

2. A PADI Instructor working or contracting for a dive center/resort or other business that
is not a PADI dive center/resort association member:

The instructor is not authorized to use the PADI trademarks in promoting the business but
is authorized to use the “PADI Instructor Available” Artwork from PADI. The Artwork is
authorized to be displayed on the business website and in advertising materials (flyers, etc.),
but is not authorized for use on any external signage. The business must remove the Artwork
from all advertising media if a PADI Instructor is no longer working for or contracting with the
business.

3. A PADI Instructor who owns a dive center/resort or other business that would qualify as
a PADI dive center/resort association member but chooses for the business to not become a
member:

The instructor is not authorized to use the PADI trademarks in promoting the business but
is authorized to use the “PADI Instructor Available” Artwork from PADI. The Artwork is
authorized to be displayed on the business website and in advertising materials (flyers, etc.),
but is not authorized for use on any external signage.

4. A dive business that is a PADI dive center/resort association member:

The business is authorized to use all PADI trademarks in promoting the business’ activities,
to the full extent allowed by the Member License Agreement and to the level the business’
membership is qualified.

5. A dive business that has been expelled or terminated from PADI retail/resort
association membership:

The business has no rights to use any PADI trademarks, business names, signage, etc., even
if a PADI Instructor is associated with the business. PADI Instructors are also not authorized to
use any PADI trademarks, business names, signage, etc. if such use is associated with such an
expelled or terminated business.

6. A dive business that is not a PADI dive center/resort member and does not have a PADI
Instructor working for or contracting with it:

The business has no rights to use any PADI trademarks, business names, signage, etc.

PHOTO, VIDEO AND CLIP ART PERMISSION AND TERMS OF USE

PADI owns, and/or has the legal right to use the photos, videos, clip art and logos offered here
(hereinafter “Media”) and PADI has the right to grant its Members the right to use the Images
for the purpose of promoting their dive business efforts.

The following terms and conditions apply to PADI Members’ use of the Media:

1. Use of the Media is nonexclusive. That is, in addition to active PADI Members, PADI
reserves the right to use the Media itself or to grant the rights to others to use the same
Media.

2. Use of the Media accessed through this site is for active PADI Members only. PADI’s
permission for you to use the Media will terminate should you cease being a PADI
Member.

3. The Media shall only be used with respect to (a) Printed advertising and promotional
materials, such as newspaper and periodical advertisements, handbills and signs; (b)
Film and video format promotional materials, such as television commercials, slide
shows or promotional videos; and (c) Software, fixed media, such as USB drives, or any
interactive digital or broadcast media or methods, including, but not limited to, internet
or worldwide web sites, with such uses governed by the most current guidelines, as may
be published by PADI from time to time.

4. Use of the Media must be in good taste and acceptable to PADI; no derogatory uses are
allowed. In the event PADI, in its sole and absolute discretion, determines such use is
not acceptable, regardless of the length of time such image may have been in use, you
agree to promptly cease using the Media, even in the event you do not agree with
PADI’s determination. PADI shall be the sole determiner of whether a use is acceptable
or not acceptable.

5. The Media may not be used on any item or product intended for resale.

6. The Media may not be used to promote any activity other than a PADI Member’s diving
business.

7. Use of the Media must include the copyright notice (© PADI [Year]) and any
photographer/videographer credit provided by PADI with each licensed photo or clip
art.

8. As a PADI Member, your right to use the Media is personal to you and/or your PADI
Member dive business, and you may neither sublicense, sell nor otherwise market the
photos, videos, and clip art, nor otherwise allow other persons or businesses any use
whatsoever.

9. Media categorized by certification level or specific PADI programs (i.e., GoPRO images
for Pro level promotions; MSD images for MSD and Con Ed diving promotions, etc.). may
only be used to promote those respective levels of certification or programs. Images not
specifically categorized in this manner may be used for any allowed purpose.

This permission shall extend for the term of membership and shall be terminated forthwith
upon termination of the Member’s membership with PADI

Any rights not specifically granted hereunder are reserved to PADI.

Q: Can anyone use the PADI trademarks?


A: The Trademarks are reserved for PADI Members through the PADI Member License
Agreement.

Q: Are translations of trademarks allowed?


A: Trademarks cannot be translated and must remain in English.

Q: Can a PADI Instructor advertise any type of courses, including PADI courses and fees?

A: A current PADI Instructor has the right to use all the PADI trademarks according to their
membership level/qualification as noted in their membership and license agreement. A
PADI Instructor associated with a non-PADI store or resort can only use the ‘PADI
Instructor Available’ artwork in the store’s advertising. They can also list their name and
instructor number. Once they are no longer a current Member, they must remove the
artwork, their name and instructor number.

Q: What use of Marks do Course Directors have?


A: PADI Course Directors are individual Members and therefore have all rights associated
with individual Membership. Course Directors can advertise Instructor Development
Courses as long as it is being conducted at an Instructor Development Center, Career
Development Center, preapproved Alternate Location or as part of a Career Oriented
Diving program.

Q: Can a PADI Retail and Resort Association Member use competitor names/ logos in
addition to PADI trademarks?
A: There are dedicated trademarks for each membership level. PADI Standards state that 5
Star and 5 Star IDC Members cannot be dual stores (ie have other dive organization
memberships and offer their programs).

Q: Can a Dive Center logo be added to a PADI-created, copyrighted document?


A: The PADI Dive Center must be in current status and submit a written request to
Legal/Julie Cano, julie.cano@padi.com, including information as to how it will be used
and where. If the request is approved, a permission agreement will be created. The
document must be signed by both parties and the requesting party must have the
fully signed agreement in hand before they can move forward with the request.

Q: Can a Dive Center or Resort add the PADI trademark to staff uniforms?
A: With specific, written authorization from the respective licensed PADI Regional
Headquarters, PADI Retail and Resort Association Members may place the PADI diver
and globe Mark on their facility staff shirts, in very limited quantities. Such shirts may
not be resold in any manner, and each such printing must receive separate written
authorization.

Q: Can the PADI trademark be added to merchandise made by PADI Dive Center or
Resort for sale?
A: The PADI trademark cannot be added to merchandise offered for sale unless approved
in writing by PADI Worldwide and a license agreement is provided.

Q: Can ‘PADI’ be used in domain names?

A: The PADI marks cannot be used in any domain names, however, current Members can
use a PADI Mark on a URL which leads to any one of the pages within the website
(example: www.PADIdivecenter.com is not allowed. www.divecenter.com/PADIcourses
would be allowed).

Q: Can ‘PADI” be used in a hashtag in social media?


A: Only current PADI Members can use a PADI hashtag in social media. PADI reserves the
right to request removal if deemed misleading.

Q: Can PADI Members use the PADI marks to improve Search Engine Optimization (SEO)?
A: Only current PADI Individual and Store/Resort Members are encouraged to use the PADI
marks to improve SEO.
