THE PUBLIC LIABILITY INSURANCE ACT, 1991


Obligations
 Owner to provide relief, as specified, in case of death, or injury to any person (other taken workman);
or damage to property from an accident occurring while handling specified hazardous substance, on the
principle of no fault.
 Owner to draw insurance policies more than the paid-up capital of the undertaking but less than Rs.
50 Crores, before handling any hazardous substances.
 “Paid-up Capital” implies the market value of all assets and stocks of the undertaking on the date of
insurance.
 Owner to pay additional amounts, as prescribed, to the insurer not exceeding the amount of premium,
as contribution to the Environmental Relief Fund to be established under the Act.
 Owner to provide any information required by the Central Government or agencies authorized by it,
for ascertaining compliance with the provisions of the Act.
 Owner to allow entry and inspection of any person empowered by the Central Government to the
place where the industrial activity involving hazardous chemicals is being carried out at all reasonable
times, to ascertain compliance with the provisions of the Act.
 Owner to pay the amount of an award as specified by the collector in the prescribed manner.
 Comply with the directions issued in writing by the Central Government within the specified time as
mentioned in the order. The directions may include:
1. Prohibition or regulation of handling of any hazardous substances; or
2. Stoppage or regulation of the supply of electricity, water or any other service.

Rights
 Opportunity of hearing by the Direct Collector, before awarding the amount of relief.
 Opportunity to file objections with the Central Government against the proposed directions in the
specified form within the specified time (15 days from the date or service of the notice).
 Central Government to record reasons in writing, in case it does not provide an opportunity to file
objections.

EMISSION REGULATIONS FOR DIESEL GENERATOR SETS: STACK HEIGHT

The minimum height of stack to be provided with each generator set can be worked out by using the
following formula:
H = h + 0.23 √ (KVA)

H = Total height of stack in meter


h = Height of the building in meters where the generator set is installed
KVA = Total generator capacity of the set in KVA.

Based on the above formula the minimum stack height to be provided with different range of generator sets
may be categorized as follows:
For Generator Sets Total Height of Stack in Meters
50 KVA Ht. of the building + 1.5 meters
50 - 100 KVA Ht. of the building + 2.0 meters
100 - 150 KVA Ht. of the building + 2.5 meters
150 - 200 KVA Ht. of the building + 3.0 meters
200 - 250 KVA Ht. of the building + 3.5 meters
250 - 300 KVA Ht. of the building + 3.5 meters
Similarly for higher KVA ratings a stack height can be worked out using the above formula.

The Noise pollution (Regulation and Control) Rules, 2000


(Ministry of Environment and Forests) Notification Dt. 14.02.2000
 Ambient air quality standards in respect of noise for different areas /zones :
 The State Government to categorize the areas into industrial, commercial, residential or silence areas /
zones for the purpose of implementation of noise standards for different areas.
 The State Government to take measures for abatement of noise including noise emanating from
vehicular movements and ensure that the existing noise levels do not exceed the ambient air quality
standards specified under these rules.
 All development authorities, to take into consideration all aspects of noise pollution as a parameter of
quality of life to avoid noise menace and to achieve the objective of maintaining the ambient air
quality standards in respect of noise.
 The ambient air quality standards in respect of noise for different areas / zones shall be as per schedule.

3. Silence zone is defined as an area comprising not less than 100 meters around hospitals, educational
institutions and courts. The silence zones are zones are zones which are declared as such by the
competent authority.
4. Mixed categories of areas may be declared as one of the four above mentioned categories by the
competent authority.
dB (A) Leq denotes the time weighted average of the level of sound in decibels on scale A which is
relatable to human hearing.
A “decibel” is a unit in which noise is measured.
“A”, in dB (A) Leq, denotes the frequency weighting in the measurement of noise and corresponds to
frequency response characteristics of the human ear.
Leq: It is energy mean of the noise level over a specified period.
 Responsibility as to enforcement of noise pollution control measures.
 Restrictions on the use of loud speakers / public address system.
 Loudspeakers shall not be used at night (between 10 PM to 6 AM) in the open premises.
 Consequences of any violation in silence zone / area. : penalty to be imposed
 Complaints to be made to the authority.

CENTRAL MOTOR VEHICLES RULES, 1989 (As notified on 2.6.1989)

92. General-
(1) No person shall use or cause or allow to be used in any public place any motor, vehicle that does not
comply with the provisions of this chapter.
(2) Nothing in this rule shall apply to a motor vehicle: -
a) Which has been damaged in an accident or to a vehicle stopped or impeded owing to shortage of fuel or
other temporary defects while at the place at which the accident or defect occurred;
b) Which is defective or damaged and is being removed to the treatment place of repair or disposal-, or
c) Which is more than fifty years old from the date of its registration and is being driven for taking part in a
vintage car rally:
Provided that where a motor vehicle can no longer remain under the effective control of the person driving, the same
shall not be used in a public place except by towing.

129. Transportation of goods of dangerous or hazardous nature to human life-


Every owner of a goods carriage transporting any dangerous and hazardous goods shall, in addition to
complying with the provisions of any law for the time being in force in relation to any category of
dangerous or hazardous goods, comply with the following conditions, namely
(i) Every such goods carriage carrying the same type of dangerous or hazardous goods (whether in bulk or in
packages), shall display a distinct mark of the class label appropriate to the type of dangerous or hazardous goods
specified in column 3 of the Table I to rule 137;
(ii) in the case of packages containing goods listed in Table III in rule 137 and which represents two hazards as
given in column 2 thereof such packages shall display distinct labels to indicate both the hazards;
(iii) Every package containing dangerous or hazardous goods shall display the distinct class label appropriate
to the type of dangerous or hazardous, goods specified in column 3 of the Table I to rule 137.

130. Manner of display of class labels -


(1) Where a class label is required to be displayed on a vehicle, it shall be so positioned that the size of the
class Table is at an angle of 45 degrees to the vertical and the size of such label shall not be of less than twenty-
five millimeters square which may be divided into two portions, the upper half portion being reserved for the
pictorial symbol and the lower, half for the text.
Provided that in the case of smaller packages a suitable size of the label may be adopted.
(2) Where the class label consists of adhesive material, it shall be water-proof and where it consists of
metal or other substance on which the pictorial symbol and the text are printed, painted or affixed, they
shall be affixed directly on such material and in every case, the surface of the vehicle surrounding time label shall
be of a colour that contrasts vividly with the background of the class label.
(3) Every class label displayed on a vehicle shall be positioned in such a manner that it does not obscure any
other markings required to be displayed under any other law.
(4) Every goods carriage carrying any dangerous or hazardous goods shall display the class label both in the
front and in the rear in a conspicuous manner.
131. Consignor to supply information about dangerous or hazardous goods.
(1) Every Consignor intending to transport any dangerous or hazardous goods are loaded, supply to the
owner of the goods carriage full and ‘adequate information about such dangerous or hazardous goods so as
to enable such owner and its driver to -
(a) Comply with the requirements of rules 129 to 137; and
(b) Be aware of the risks created by such goods to the health or safety of any person.
(2) It shall be the duty of the consignor to ensure that the information is accurate and sufficient for the
purpose of complying with the provisions of the rules 129 to 137.

132. Owners of the goods carriage to specify classifications of dangerous or hazardous goods
(1) Every owner of a goods carriage transporting any dangerous or hazardous goods shall, before
undertaking the transportation of such goods in his goods carriage, satisfy him that the information
given by the consignor is full and accurate in all respects and correspond to the classification of such
goods specified in rule 137.
(2) The owner of the goods carriage shall ensure that the driver of such carriage is given all the relevant
information in writing as in annexure V to these rules in relation to the dangerous or hazardous goods
entrusted to him for transport and satisfy himself that such driver has sufficient understanding of the
nature of the risks involved in the transport of such goods and is capable of taking appropriate action
in case of an emergency.
(3) The driver of a goods carriage transporting dangerous or hazardous goods shall ensure that the
information given to him in writing under sub-rule (2) is kept in the driver's cabin and is available at
all time while the dangerous or hazardous goods to which it relates are being transported.
133. Driver to take precautions -
Every driver of a goods carriage transporting any dangerous or hazardous goods Shall, observe at all
times all the precautions necessary, for preventing fire, explosion or escape of dangerous or
hazardous goods carried by him while the goods carriage is in motion and when it is not being driven,
he shall ensure that it is parked in a place which is safe from fire explosion and any other risk and is
at all times under the control and supervision of himself or some other competent person above the
age of 18 years.
134. Emergency information panel -
Every goods carriage used for transporting any dangerous or hazardous goods
Shall be legibly and conspicuously marked with an emergency information panel in each of the three
places indicated in the Table below and such panel shall contain the following information namely: -
(I) The correct technical name of the dangerous or hazardous goods in letters not less than 50 millimeters
high;
(ii) The class label of the dangerous or hazardous goods of the size of not less than 260 millimeters
square;
(iii) The name and telephone number of the emergency services to be contacted in the event of fire or any
other accident in letters and numerals that are not less than 50 millimeters high and the name and
telephone number of the consignor of the dangerous or hazardous goods or of some other person from
whom expert information and advice can be obtained concerning the measures that should be taken in
the event of an emergency involving Such goods.
(2) Every class label and emergency information panel shall be marked on the goods carriage and shall
be kept free and clean from obstruction at all times.
135. Driver to be instructed: -
The owner of every goods carriage transporting dangerous or hazardous goods shall ensure to the
satisfaction of the consignor that the driver of the goods carriage has received adequate instructions
and training to enable him to understand the nature of the goods being transported, by him, the nature
of the risks raising out such goods, precautions he should take while the goods carriage is in motion
or stationery and the action he has to take in case of any emergency.
136. Driver to report to police station about accident: -
The driver of a goods carriage transporting any dangerous or hazardous goods shall, on the
occurrence of any accident involving any dangerous or hazardous goods transported by the carriage,
report forthwith to the nearest police station.

VEHICULAR EXHAUST EMISSION STANDARD


(Standards for emission of smoke, vapor etc. from motor vehicles)
1) Every motor vehicle shall be manufactured and maintained in such condition and shall be so driven
that smoke, visible vapors, grit, sparks, ashes, cinders or only substance.
2) On and from the 1st day of March 1990, every motor vehicle shall comply with the following
standards: -
a) Idling CO (Carbon monoxide) emission limit for all four-wheeled petrol driven vehicles shall not
exceed 3 per cent by volume;
b) Idling CO emission limit for all two and three-wheeled petrol driven vehicles shall not
exceed 4.5 per cent by volume.
c) Smoke density for all diesels driven vehicles shall be as follows:

3) On and from the 1st day of April 1991, all petrol driven vehicles shall be so manufactured that they
comply, with the mass emission standards. The breakdown of the operating cycle used for the test
shall be as specified and the reference fuel of such tests shall be as specified.
4) On and from the 1st day of April 1991, all diesel driven vehicles shall be so manufactured that they
comply, with the mass emission standards based on exhaust gas capacity specified.
5) On and from the 1st day of April, 1991 all diesel driven vehicles shall be so manufactured that they
comply with the following levels of emissions under the Indian driving cycle:
Mass of Carbon Monoxide Mass of Hydrocarbons (HC) Mass of Nitrogen (CO),
Maximum, Grams/KWH. Maximum. Grams per Oxides (NOX),
KWH Maximum, Grams per KWH

6) Each motor vehicle manufactured on and after the dates specified in paragraphs (2), (3), (4) and (5),
shall be certified by the manufacturers to be conforming to the standards specified in the said
paragraph and the manufacturer shall further certify that the components liable to effect the emission
of gaseous pollutants are so designed, constructed and assembled as to enable the vehicle, in normal
use, despite the vibration to which it may be subjected, to comply with the provisions of the said
paragraphs.
7) Test for smoke emission level and carbon monoxide level for motor vehicles:
a) Any officer not below the rank of a sub-inspector of police or an Inspector of motor vehicles, who has
reason to believe that a motor vehicle is by virtue of smoke emitted from it or other pollutants like
carbon monoxide emitted from it, is likely to cause environmental pollution, endangering the health
or safety of any other user of the road or the public, may direct the driver or any person in-charge of
the vehicle to submit the vehicle for undergoing a test to measure the standard of black smoke or the
standard of any of the other pollutants.
b) The Driver or any person in charge of the vehicle shall upon demand by any officer referred in sub-
paragraph (a), submit the vehicle for testing for the purpose of measuring the standard of smoke or
the levels of other pollutants or both.

c) The measurement of standard of smoke shall be done with a smoke meter of a type approved by the
State Government and the measurement of the other pollutants like carbon monoxide shall be done
with instruments of a type approved by the State Government.

THE INDIAN WIRELESS TELEGRAPHY ACT, 1933 ACT XVII OF 1933


An Act to regulate the possession of wireless telegraphy apparatus. Whereas it is expedient to regulate the
possession of wireless telegraphy apparatus in India; It is hereby enacted as follows:
1. Short title, extent and commencement.—
(1) This Act may be called the Indian Wireless Telegraphy Act, 1933.
(2) It extends to the whole of India.
(3) It shall come into force on such date as the Central Government may, by notification in the
Official Gazette, appoint.
2. Definitions.—In this Act, unless there is anything repugnant in the subject or context—
(1) ‘wireless communication’ means any transmission, omission or reception of signs, signals,
writing, images and sounds, or intelligence of any nature by means of electricity, magnetism, or
Radio waves or Hertzian waves, without the use of wires or other continuous electrical conductors
between the transmitting and the receiving apparatus;
Explanation.—‘Radio waves’ or ‘Hertzian waves’ means electromagnetic waves of frequencies lower
than 3,000 gigacycles per second propagated in space without artificial guide;
(2) ‘wireless telegraphy apparatus’ means any apparatus, appliance, instrument or material used
or capable of use in wireless communication, and includes any article determined by rule made under
Sec. 10 to be wireless telegraphy apparatus, but does not include any such apparatus, appliance,
instrument or material commonly used for other electrical purposes, unless it has been specially
designed or adapted for wireless communication or forms part of some apparatus, appliance,
instrument or material specially so designed or adapted, nor any article determined by rule made
under Section 10 not to be wireless telegraphy apparatus;
(2A) ‘wireless transmitter’ means any apparatus, appliance, instrument or material used or capable
of use for transmission or omission of wireless communication;
(3) ‘prescribed’ means prescribed by rules made under Section 10.
3. Prohibition of possession of wireless telegraphy apparatus without license.—Save as provided by
Section 4, no person shall possess wireless telegraphy apparatus except under and in accordance with
a license issued under this Act.
4. Power of Central Government to exempt persons from provisions of the Act.—The Central
Government may by rules made under this Act exempt any person or any class of persons from the
provisions of this Act either generally or subject to prescribed conditions, or in respect of specified
wireless telegraphy apparatus.
5. Licenses.—The telegraphy authority constituted under the Indian Telegraph Act, 1885, shall be the
authority competent to issue licenses to possess wireless telegraphy apparatus under this Act, and
may issue licenses in such manner, on such conditions and subject to such payments, as may be
prescribed.
6. Offence and penalty.—
(1) Whoever possesses any wireless telegraphy apparatus, other than a wireless transmitter, in
contravention of the provisions of Section 3 shall be punished, in the case of the first offence, with
fine which may extend to one hundred rupees, and, in the case of a second or subsequent offence,
with fine which may extend to two hundred and fifty rupees.
(1A) Whoever possesses any wireless transmitter in contravention of the provisions of Section 3
shall be punished with imprisonment which may extend to three years, or with fine which may extend
to one thousand rupees or with both.

(2) For the purposes of this section a Court may presume that a person possesses wireless
telegraphy apparatus if such apparatus is under his ostensible charge, or is located in any premises or
place over which he has effective control.
(3) If in the trial of an offence under this section the accused is convicted the Court shall decide
whether any apparatus in respect of which an offence has been committed should be confiscated, and,
if it so decides, may order confiscation accordingly.
7. Power of search.—Any officer specially empowered by the Central Government in this behalf may
search any building, vessel or place in which he has reason to believe that any wireless telegraphy
apparatus, in respect of which an offence punishable under Section 6 has been committed, is kept or
concealed, and take possession thereof.
8. Apparatus confiscated or having no owner to be property of Central Government.—All wireless
telegraphy apparatus confiscated under the provisions of sub-section (3) of Section 6, and all wireless
telegraphy apparatus having no ostensible owner shall be the property of the Central Government.
9. Power of Court to direct payment of fines to prescribed authority.— Ceased to have effect by A.O.,
1937 and repealed by the Repealing and< Amending Act, 1940 (32 of 1940), S. 2 and Sch. I
10. Power of Central Government to make rules.—
(1) The Central Government may, by notification in the Official Gazette, make rules for the
purpose of carrying into effect the provisions of this Act.
(2) In particular and without prejudice to the generality of the foregoing power, such rules may
provide for –
(i) determining that any article or class of article shall be or shall not be wireless telegraphy
apparatus for the purpose of this Act;
(ii) the exemption of persons or classes of persons under section 4 from the provisions of this Act;
(iii) the manner of and the conditions governing the issue, renewal, suspension and cancellation of
licenses, the form of licenses and the payments to be made for the issue and renewal of licenses;
(iv) the maintenance of records containing details of the acquisition and disposal by sale or
otherwise of wireless telegraphy apparatus possessed by dealers in wireless telegraphy apparatus;
(v) the conditions governing the sale of wireless telegraphy apparatus by dealers in and
manufactures of such apparatus.
(3) In making a rule under this section the Central Government may direct that a breach of it shall
be punishable with fine which may extend to one hundred rupees.
(4) Every rule made under this section shall be laid as soon as may be after it is made before each
house of Parliament while it is in session for a total period of thirty days which may be comprised in
one session or [in two or more successive sessions, and if, before the expiry of the session
immediately following the session or the successive sessions aforesaid], both Houses agree in making
any modification in the rule or both Houses agree that the rule should not be made, the rule should
thereafter have effect only in such modified form or be of no effect, as the case may be; so, however,
that any such modification or annulment shall be without prejudice to the validity of anything
previously done under that rule.
11. Saving of Indian Telegraph Act, 1885- Nothing in this Act contained shall authorize the doing
of anything prohibited under the Indian Telegraph Act, 1885 (13 of 1885), and no license issued
under this Act shall authorize any person to do anything for the doing of which a license or
permission under the Indian Telegraph Act, 1885, is necessary.
