Abstract — The "Electronics and Communications
Engineering Act of the Philippines," commonly known
as RA 5734, is amended, and enhanced by the Republic
Act 9292, which is the subject of this paper.
Additionally, this paper offers sample case studies that
are connected to the Republic Act, along with their
analyses and answers.

Republic Act 5734
The title of the legislation, the practice of an electronics
and communication engineer, and the registration of an
electronics and communication engineer are all covered in
the first three sections of Republic Act 5734. This set of
parts lays out the requirements that must be met in order
to be recognized as an Electronics and Communication
Engineer in addition to prohibiting practices without a
certificate of registration. This law will affect any
electronics or communication engineer who has obtained
or currently holds a certificate of registration. The fourth
section of the law establishes a Board of Regents for the
purpose of determining the requirements of a certificate
of registration.
Section 1
This Act shall be known and cited as the
“Electronics and Communications Engineering Law of the
Philippines.”
Section 2
(a) Without possessing a current certificate of
registration as an electronics and
communications engineer, no one may
identify themselves in the Philippines as, or
use the title "Electronics and/or
Communications Engineer," or any word,
letter, figure, or sign that might give the
impression that he is one. He may also not
advertise or otherwise make it known that he
is qualified to carry out the duties of an
electronics and communications engineer.
(b) Without a license and/or under the
supervision of a properly licensed
electronics and communication engineer, the
company, firm, or corporation is not
permitted to offer a service to the general
public as an electronics and communication
engineer.
Section 3
(a) Given that the first Board may issue within
the two-year window following the
composition of the said board, the applicant
must pass the examination and pay the
required fees.
(b) If a member or applicant can show that they
have at least 10 years of experience working
as an ECE, have a responsible personality
that suggests they have been trusted to
perform ECE services, and are a genuine
member of any official registered
association of ECE in the Philippines, they
may be exempt from taking the examination.
Amendments or knowledge about RA 9292
RA 9292 elaborated on the Licensure Examination for
Electronics Engineers. Prior to this amendment, RA 5734
merely stated that the scope of the review will be
determined by the Board's decision. According to Section
15 of Article III of the new legislation, the exam must now
at the very least cover the subjects of Mathematics, Applied
Sciences, Engineering, Economics, Laws and Ethics,
Electronics Communications, Computers and Information
and Communications Technology. According to the same
source, the test is a written exam for electronics engineers
and a mix of a written and practical exam for electronics
technicians.
When was the law approved?
Electronics and Communications Engineering Law of the
Philippines (RA 5734). This Act becomes effective upon
approval. On June 21, 1969, legislation was passed without
the permission of the Executive.
Who can practice the ECE profession?
Section 2
No one may call himself or use the title "Electronics and/or
Communications Engineer" or any phrase, letter, figure, or
symbol that would suggest that he is one in the Philippines
unless he has a valid certificate of registration as one. He
may also not promote or otherwise publicize his
qualification to perform the tasks of an electronics and
communications engineer. The definition of "electronic
engineer" in the law is, as given by the Philippine
Commission on Higher Education, to be “one who is
qualified to perform the following functions as a member of
the field of electronics and/or communications engineering:
design, development, fabrication, installation, supervision,
maintenance, troubleshooting, modification, and service of
equipment, and the conduct of engineering investigations,
as defined by the Commission on Higher Education.” The
Engineering Commission may give special consideration to
persons who are already active in the field of electronic
and/or communications engineering.
The Engineering Commission shall also make provision for
the designation of “Engineering Technician.” The
qualification of the engineer technician shall be such as is
deemed appropriate by the Commission.
(a) The qualification of an engineer, including the
engineering technician, is such as is deemed appropriate by
the Commission. (b) The Engineering Commission shall
appoint a technical board of five engineers to render
recommendations on the qualifications of persons seeking a
designation of "Engineer."
When can a certificate of registration be issued?
Section 3
Any applicant who passes the following examination and
pays the required fees will be issued a certificate of
registration for electronics and communications
engineer:As long as an applicant provides evidence or other
proof that is acceptable to the first Board along with his
application for registration as an electronics and
communications engineer, the first Board may issue a
certificate of registration as an electronics and
communications engineer within two years of the structure
of said Board even without applicant having to sit for the
examination that is herein prescribed for members and
applicants.
Is there an exemption to the exam requirement?
A person or candidate may be excluded from taking an
exam if they would demonstrate that they have at least ten
years of experience working as an ECE, have a trustworthy
personality that suggests they have been trusted to perform
ECE services, and are a true member of any official
registered association of ECE in the Philippines.
What is the requirement of the exemption?
If a candidate or member can prove they have at least ten
years of experience working as an ECE, have a responsible
personality that indicates they have been trusted to deliver
ECE services, and are a valid member of any official
recognized association of ECE in the Philippines.
What is the contained in the certificate of registration?
Every certificate of registration must be approved by all
board members, bear the official seal of the Board, and
include the registrant's full name and serial number. The
Secretary of the Board of Examiners must also certify to
the signatures.
What are the qualifications for examination?
The following must be proven to the Board's satisfaction at
the time the applicant files his application to be admitted to
the electronics and communications engineering
examination:
(a) He is at least twenty-one years of age;
(b) He is a citizen of the Philippines or of a
foreign country qualified to take the
examination under Section twenty-three of
this Act;
(c) He is of good moral character.
(d) He is a holder of the degree of Bachelor of
Science in Electronics and Communications
Engineering, or such equivalent engineering
course from any school, institute, college, or
university recognized by the Government or
the State where it is established, after
completing a resident collegiate course of
not less than four years: Provided, That
within three years after the approval of this
Act, holders of a certificate of Associate in
Electronics and Communications
Engineering or any allied engineering course
or holder of a valid first class
radiotelegraphy or radiotelephony
commercial operator license with at least
five years active practice in electronics,
communications, or allied fields shall be
qualified to take the electronics and
communications engineering examination.
RA 9292. What is the purpose of this law?
An act repealing republic act no. 5734, also known as the
"Electronics and Communications Engineering Act of the
Philippines," and creating a more responsive and thorough
regulation for the registration, licensing, and practice of
professional electronics engineers, electronics engineers,
and electronics technicians.
Amendments made for RA 9292 compared to RA 5734
Republic Act 9292's main objective is to make clear the
modifications and additions made to the Electronics
Engineers of the Philippines' earlier law, Republic Act
5734. Specifically, the modifications were as follows:
(a) Electronics Engineers replaced Electronics
and Communications Engineers in RA 9292,
which had previously used the title
"Electronics and Communications
Engineers." Despite the changes, Electronics
Engineers were still referred to by the
acronym ECE in order to avoid confusion
with Electrical Engineers who used the same
acronym, EE. Even if it was no longer in the
title, communications would still be covered
in the ECE curriculum.
(b) The Licensure Examination for Electronics
Engineers was further explained in RA
9292. Prior to this change, RA 5734 simply
made clear that the Board's decision would
determine the scope of the review. The test
must now at least include the fields
Mathematics, Applied Sciences,
Engineering, Economics, Laws and Ethics,
Electronics, Communications, Computers,
and Information and Communications
Technology, according to Section 15 of
Article III of the new act. The examination
is a written exam for electronics engineers,
 according to the same article, whereas it is a
combination of a written and practical exam
for electronics technicians.
What are the scope of practices of an electronics engineer?
The scope and nature of the professional practice of the
professional electronics engineer shall include all of the
foregoing, as well as the sole right to provide consulting
services as those terms are defined in this Act, and the
capacity to sign and seal electronic plans, drawings, permit
applications, specifications, reports, and other technical
documents produced by himself/herself or under his/her
direct supervision.
What are the scope of practice of a PECE?
The Electronics Engineer mentioned in the previous
question has the same range of practice as a Professional
Electronics Engineer. A PECE can, nevertheless, sign and
seal the following and offer consultations:
(a) Electronic Drawings
(b) Permit Applications
(c) Electronic Plans
(d) Reports
(e) Specifications
What are the scope of practice of an electronics
technician?
Any non-engineering work or activity relating to the
installation, construction, operation, control, tests and
measurements, diagnosis, repair and maintenance,
manufacture and production, sales and marketing of any
electronic component/s, device/s, products, apparatus,
instruments, equipment, system/s, network/s, operations
and processes located on land, watercraft, or in the air shall
fall within the scope and nature of practice of the
electronics technician profession.
What does “Board” mean?
Section 6 of RA 9292
A Professional Regulatory Board of Electronics
Engineering, hereinafter referred to as the Board, is hereby
established under the administrative control and
supervision of the Professional Regulation Commission,
hereinafter referred to as the Commission. The Board is
made up of a chairman and two (2) members who shall be
appointed by the President of the Philippines from among
the three (3) recommendees per position that are selected
and ranked by the Commission, whose recommendees shall
in turn be vetted by the Board.
Who controls the Board?
The Board is subject to the Philippine President's control,
and he or she may propose both a chairman and members.
The Chairman of the Board and other members may also be
subject to suspension or dismissal by the President if they
have violated the law or been negligent in performing their
duties.
