PERMULAAN
Kecualian prerogatif
5. (1) Duli Yang Maha Mulia Sultan boleh, menurut budi bicara
Baginda, selepas berunding dengan Majlis, menubuhkan suatu
Jawatankuasa Kehakiman Syariah yang terdiri daripada anggota
berikut:
(a) Ketua Hakim Syarie sebagai Pengerusi;
(b) Mufti;
(c) dua orang Hakim Mahkamah Utama Syariah;
(d) Pengerusi Mahkamah Rayuan Syariah; dan
(e) dua anggota yang arif dalam Hukum Syarak atau undang-
undang yang dilantik oleh Duli Yang Maha Mulia Sultan.
Fungsi Jawatankuasa
7. (1) Duli Yang Maha Mulia Sultan boleh, pada bila-bila masa,
membatalkan pelantikan mana-mana anggota Jawatankuasa.
Bahagian III
PELANTIKAN
9. (1) Duli Yang Maha Mulia Sultan boleh, menurut budi bicara
Baginda, selepas berunding dengan Jawatankuasa, melantik seorang
Ketua Hakim Syarie.
(2) Seseorang layak dilantik sebagai Ketua Hakim Syarie jika dia—
(a) seorang warganegara; dan
(b) pernah memegang jawatan sebagai seorang Hakim
Mahkamah Rayuan Syariah.

(3) Orang yang, sebaik sebelum permulaan kuat kuasa seksyen
ini, memegang jawatan Ketua Hakim Syarie di bawah Enakmen
Pentadbiran dan melaksanakan fungsi-fungsi kehakiman hendaklah,
pada permulaan kuat kuasa seksyen ini, terus memegang jawatan
Ketua Hakim Syarie seolah-olah dia telah dilantik di bawah
subseksyen (1).
10. (1) Duli Yang Maha Mulia Sultan boleh, menurut budi bicara
Baginda, selepas berunding dengan Jawatankuasa, melantik lima
orang Hakim Mahkamah Utama Syariah.
11. (1) Duli Yang Maha Mulia Sultan boleh, menurut budi bicara
Baginda, selepas berunding dengan Jawatankuasa, melantik tujuh
orang Hakim Mahkamah Rayuan Syariah.

(2) Seseorang layak dilantik sebagai Hakim Mahkamah Rayuan
Syariah jika dia—
(a) seorang warganegara; dan
(b) pernah memegang jawatan sebagai seorang Hakim
Mahkamah Tinggi Syariah atau Ketua Pendakwa Syarie.
12. (1) Duli Yang Maha Mulia Sultan boleh, menurut budi
bicara Baginda, selepas berunding dengan Jawatankuasa, melantik
Hakim-Hakim Mahkamah Tinggi Syariah.
13. (1) Duli Yang Maha Mulia Sultan boleh, menurut budi bicara
Baginda, selepas berunding dengan Ketua Hakim Syarie, melantik
Hakim-Hakim Mahkamah Rendah Syariah daripada kalangan
pegawai syariah Persekutuan atau Negeri.
14. (1) Duli Yang Maha Mulia Sultan boleh, menurut budi bicara
Baginda, selepas berunding dengan Jawatankuasa, membatalkan
pelantikan mana-mana Hakim yang dilantik di bawah seksyen 9,
10, 11 dan 12 Enakmen ini.
15. Duli Yang Maha Mulia Sultan boleh, menurut budi bicara
Baginda, selepas berunding dengan Ketua Hakim Syarie, melantik
seorang Ketua Pendaftar Mahkamah Utama Syariah, Pendaftar
Mahkamah Rayuan Syariah, Pendaftar dan Timbalan-Timbalan
Pendaftar Mahkamah Tinggi Syariah atau Penolong-Penolong
Pendaftar Mahkamah Rendah Syariah daripada kalangan pegawai
syariah Persekutuan atau Negeri.

(3) Walau apa pun seksyen 11, Ketua Hakim Syarie boleh
mengarahkan mana-mana Hakim Mahkamah Tinggi Syariah untuk
menjadi seorang anggota Mahkamah Rayuan Syariah bagi mana-
mana prosiding yang tertentu jika Ketua Hakim Syarie berpendapat
wajar berbuat demikian.

MAHKAMAH UTAMA SYARIAH
(3) Walau apa pun seksyen 10, Ketua Hakim Syarie boleh
melantik mana-mana Hakim Mahkamah Rayuan Syariah untuk
menjadi seorang anggota Mahkamah Utama Syariah bagi mana-
mana prosiding yang tertentu jika Ketua Hakim Syarie berpendapat
wajar berbuat demikian.

41. (1) Tiada seorang pun Hakim atau seorang lain yang bertindak
secara kehakiman boleh dibawa guaman terhadapnya di dalam
mana-mana Mahkamah Syariah atau mahkamah sivil kerana apa-
apa perbuatan yang dilakukan atau diperintahkan supaya dilakukan
olehnya dalam menjalankan tugas kehakimannya, sama ada atau
tidak dalam had bidang kuasanya, dan tiada apa-apa perintah
bagi kos boleh dibuat terhadapnya, dengan syarat bahawa pada
masa itu dia dengan suci hati mempercayai yang dia mempunyai
bidang kuasa untuk melakukan atau memerintahkan perbuatan
yang diadukan itu.
Kod etika
44. Duli Yang Maha Mulia Sultan boleh, menurut budi bicara
Baginda, selepas berunding dengan Jawatankuasa, menetapkan
secara bertulis suatu kod etika yang hendaklah dipatuhi oleh
semua Hakim.

Part I
PRELIMINARY
(3) Duli Yang Maha Mulia Sultan may appoint different dates
for the coming into operation of different provisions of this
Enactment.

Interpretation
“Mufti” means the person who is appointed the Mufti for the
State of Perak Darul Ridzuan under subsection 33(1) of the
Administration of the Religion of Islam (Perak) Enactment 2004; and

SYARIAH JUDICIAL COMMITTEE
5. (1) Duli Yang Maha Mulia Sultan may, in His discretion, after
consulting the Majlis, constitute a Syariah Judicial Committee
which consist of the following members:
(a) The Chief Syariah Judge as Chairman;
(b) Mufti;

(c) two Judges of the Syariah Supreme Court;
(d) Chairman of the Syariah Appeal Court; and
(e) two members who are learned in Hukum Syarak or laws
appointed by Duli Yang Maha Mulia Sultan.
7. (1) Duli Yang Maha Mulia Sultan may, at any time, revoke
the appointment of any member of the Committee.
Part III
APPOINTMENTS
9. (1) Duli Yang Maha Mulia Sultan may, in His discretion, after
consulting the Committee, appoint a Chief Syariah Judge.
10. (1) Duli Yang Maha Mulia Sultan may, in His discretion,
after consulting the Committee, appoint five Syariah Supreme
Court Judges.
11. (1) Duli Yang Maha Mulia Sultan may, in His discretion,
after consulting the Committee, appoint seven Syariah Appeal
Court Judges.
12. (1) Duli Yang Maha Mulia Sultan may, in His discretion,
after consulting the Committee, appoint Syariah High Court
Judges.
13. (1) Duli Yang Maha Mulia Sultan may, in His discretion, after
consulting the Chief Syariah Judge, appoint Syariah Subordinate
Court Judges from amongst the Federal or State syariah officers.

(2) A person who, immediately before the commencement of
this section, was holding the post of a Syariah Subordinate Court
Judge under the Administration Enactment and was performing
the judicial functions shall, on the commencement of this section,
continue to hold office as the Syariah Subordinate Court Judge
as if he has been appointed under subsection (1).
14. (1) Duli Yang Maha Mulia Sultan may, in His discretion, after
consulting the Committee, revoke the appointment of any Judges
appointed under sections 9, 10, 11 and 12 of this Enactment.
(2) Duli Yang Maha Mulia Sultan may, in His discretion, after
consulting the Chief Syariah Judge, revoke the appointment of
any Syariah Subordinate Court Judge.
Registrars
15. Duli Yang Maha Mulia Sultan may, in His discretion, after
consulting the Chief Syariah Judge, appoint a Chief Registrar
of the Syariah Supreme Court, Registrars of the Syariah Appeal
Court, Registrars and Deputy Registrars of the Syariah High
Court or Assistant Registrars of the Syariah Subordinate Court
from amongst the Federal or State syariah officers.

SYARIAH HIGH COURT
18. (1) An appeal shall lie to the Syariah High Court from any
decision of a Syariah Subordinate Court—
(a) in its criminal jurisdiction, by the prosecutor or by the
person convicted, and such appeal may be against an
acquittal, a conviction or a sentence or any of them;
(b) in its civil jurisdiction—
(i) by any person aggrieved by the decision, if the
amount claimed is not less than three thousand
ringgit;
(ii) in all cases involving any decision as to personal
status, by any person aggrieved by the decision;
and
(iii) in all cases relating to maintenance of dependants,
by any person aggrieved by the decision,
but no appeal shall lie against a decision made by consent;
and
(c) in any other case, if the Syariah High Court gives leave
to appeal.
Inheritance certificates
(2) The Syariah Court may, on the application of any person who
claims to be a beneficiary or his representative, and on payment
of the prescribed fee, certify the facts found by that Syariah Court
and its opinion as to the persons who are entitled to share in the
estate and as to shares to which they are respectively entitled.
21. (1) The Syariah High Court shall have supervisory and
revisionary jurisdiction over all Syariah Subordinate Courts and
may, if it appears desirable in the interest of justice, either of its
own motion or at the instance of any party or person interested, at
any stage in any matter or proceeding, whether civil or criminal, in
any Syariah Subordinate Court, call for and examine any records
of such matter or proceeding and may give such directions as
justice may require.

(2) Whenever the Syariah High Court calls for the records of
any matter or proceeding under subsection (1), all proceedings
in the Syariah Subordinate Court on the matter or proceeding
in question shall be stayed pending further order of the Syariah
High Court.
Part VI
SYARIAH APPEAL COURT
22. (1) The Syariah Appeal Court shall have jurisdiction to hear
and determine any appeal against any decision of the Syariah
High Court in its original jurisdiction or appellate jurisdiction.
(3) When leave has been granted by the Syariah Appeal Court,
it shall hear and determine the question allowed to be referred
for its determination and make such order as the Syariah High
Court might have made and as it considers just for the disposal
of the appeal.
(6) Every order made under subsection (4) may, upon application
by the aggrieved party made within ten days after the order is
served, be affirmed, varied or discharged by the Court.

24. (1) The Syariah Appeal Court shall have supervisory and
revisionary jurisdiction over the Syariah High Court and may, if

in any Syariah High Court, call for and examine any records of

amongst the Syariah Appeal Court Judges to be the chairman.
27. (1) The Court shall sit on such dates and at such places as
the Chairman of Syariah Appeal Court may from time to time
appoint:

(6) Every order made under subsection (4) may, upon application
by the aggrieved party made within ten days after the order is
served, be affirmed, varied or discharged by the Court.
33. (1) The Court shall sit on such dates and at such places as
the Chief Syarie Judge may from time to time appoint:
34. (1) If, in the course of any proceeding or at any time before
the judgment is delivered, any Syariah Supreme Court Judge hearing
the proceeding is unable, through illness or any other cause, to
attend and complete the proceeding or otherwise exercise his
Syariah Court (Perak) 25
function as a Judge of that Court, then, if both parties consent,
the hearing shall continue and judgment or reserved judgment, as
the case may be, shall be given by the remaining Judges of the
Court, not less than two, and for the purposes of the proceeding,
the Court shall be deemed to have been properly constituted.
Part VIII
GENERAL
Open Court
36. (1) All trials in the Syariah Court shall, subject to any other
written law and subsection (2), be open to the public.
(2) A Court may order that the whole or any part of any
proceeding to be held in camera if it is satisfied that such order
would be in the interest of justice and propriety.
Language
37. The Malay language shall be the language for all proceedings
in the Syariah Court and all documents and notes of proceedings
may be in the rumi or jawi script.

Jurisdiction does not extend to non-Muslims
Reciprocal action
43. The State Authority may, after consulting the Chief Syariah
Judge, provide for any benefit and allowances suitable to the Judge
and judicial officer commensurate with his rank and position.
Code of ethics
44. Duli Yang Maha Mulia Sultan may, in His discretion, after
consulting the Committee, prescribe in writing a code of ethics
which shall be observed by all Judges.

45. The Chief Syariah Judge may, from time to time give such
directions with respect to Syariah Courts’ procedures, as he may
consider necessary.
