ORDER GRANTING/DENYING SEARCH WARRANT
CAME ON FOR CONSIDERATION the police officers Order Granting/Denying a Search
Warrant and the Court. Having examined such order and heard evidence thereon, and argument
of police, and being of the opinion that the said order should be granted and the statement
complain. It is HEREBY, ascertained that:
1. The 2022 Florida Statues, Chapter 933.02 indicates that search warrant should be issued
when a property is used as an instrument to commit any crime.
2. There was suspicion that the apartment in question was involved in drug trafficking and
as per the 4th amendment of the U.S Constitution, a warrant of search or seizure should be
issued to protect people from unlawful activities.
3. In the case, Florida v. White the court held that under the Florida Contraband Forfeiture
Act, an officer can contact search and seizer without securing a warrant if they suspect a
house or car is subject to forfeiture.
4. Johann Besch who is the neighbor had reported that the house has suspicious activities.
5. Previous search at the same house the police recovered drugs.
6. It is evident that different cars seen going in and out of the premise have been linked with
drug trafficking before.
7. The police officer has ascertained that the suspect can be involved in drug trafficking
IT IS THEREFORE, ORDERED, ADJUDGED, AND DECREED that the police officers
order grading/denying a search warrant of defendant is GRANTED.
It is further ORDERED, ADJUDGED, AND DECREED that any claim or objection by the
defendant is hereby SUPPRESSED.
