I joined SSB on 15.12.2005 and I was posted to 37th Bn SSB, Mangaldoi (Assam) w.e.f.
11.08.2022 and serving in the Battalion till date.

I, UIN-12050602 HC/GD Ikram Hussain of D Coy have been performing the duty of Kote
NCO at D coy in Bn Hqr wef. 17.09.2021. On dated 22.02.2023, at about 0610 Hrs, I was going
towards toilet area for getting freshen up, where, I slipped on the ground accidently and fell down
which caused injury in my left hand. It caused swelling and severe pain in my wrist joint. I
underwent treatment at Unit hospital, Mangaldoi civil hospital and Narayana Hospital Guwahati
due to this injury. Owing to my fracture in wrist joint, a surgery was performed at Narayana
hospital under which a titanium plate was implanted in my wrist joint. (I hereby produce copy of
medical documents, as Exhibit- )

Questionnaire :-
Q.1. when did the incident regarding your hand injury occur?
Ans. Sir, on 22.02.2023 at about 0510 Hrs.
Q.2. How did this incident take place?
Ans. Sir, When I was going towards toilet area for getting freshen up in the morning . My feet got
slipped on the ground as the ground was slippery due to rain which caused injury in my left hand .
Q.3. Why did you follow the wet/slippery path ?
Ans. Sir. As there was no other such path.
Q.4.What did you do after you got injured in your hand?
Ans. Sir, I went to A.I.R.T barrack and narrated whole incident to CT/GD Swar Din. Where he
helped me to change my clothes then after I rushed to unit Hospital alone for first aid treatment.
Q. 5. When did you reach at Unit hospital?
Ans. Sir, Approx 0530 Hrs.
Q.6. Did you get first aid treatment timely at Unit hospital?
Ans. Yes, sir
Q.7. what treatment did you get at unit hospital?
Ans. Sir, I was given injection by Dr. Yogita Magarde to get relief from pain.
Q.8. Have you been referred to other hospital ?
Ans. Yes, Sir I was referred to Civil Hospital Mangaldoi on 22.02.2023 for further treatment.
Where X-ray of my injured hand was done for confirmation of fracture/dislocation of bone. After
it I was referred to Narayana Hospital Guwahati on 23.02,2023 for further treatment.
Q. 9. What did doctor diagnose at Narayan Hospital, Guwahati and what treatment did they
suggest?
Ans. Sir, I was diagnosed with comminuted fracture D/E left radius by Dr. Samarjit Khanikar
( Orthopedic specialist) and he recommended for surgery. Consequently, my surgery was
performed on 24.02.2023, in which Titanium-D/R Volar LCP plate was implanted in my wrist joint.
Q.10. When were you discharged from Hospital?
Ans. Sir,On 24.02.2023 (AN).
Q.11. Are you satisfied with the treatment?
Ans. Yes, sir.
Q.12. Are you undergoing any other treatment?
Ans. Yes, Sir, I am taking medicines for thyroid.
Q.13.What is the current status of your health?
Ans. Sir, I am SHAPE-II.
Q.14. What is the current status of your hand injury?
Ans. Sir, my condition is stable and good but I m still in observation under unit hospital.

I joined SSB on 29/10/2011 and I was posted to 37th Bn SSB, Mangaldoi (Assam) w.e.f.
11.01.2020 and serving in the Battalion till date and performing various post duties. On 22.02,2023,
at about 515 Hrs , I was called by HD/GD Ikram Hussain, that time I was sleeping in AIRT barrack
and I woke up hearing his voice at that time. HC/GD Ikram Hussain told me about the incident
how he fell down due to slippery ground.

Questionnaire:-

Q. How did you come to know that HC/GD Ikram Hussain got injured in his hand?
Ans: Sir, at about 0515 Hrs, I was sleeping in AIRT Barrack meanwhile HC/GD Ikram Hussain
woke me up and he narrated the incident that while going to toilet, He slipped on the ground and his
hand got twisted.

Q.2) What did you do after listening about the incident ?

Ans: Sir, I helped HC/GD Ikram Hussain to change his dirty clothes as he fell down, which made
his clothes dirty and he also wished to go to unit hospital quickly for first aid.
Q.3. What was the condition of his hand when HC/ GD Ikram Hussain came inside the barrack?
Ans. Sir, his left hand got twisted with slight swelling.

Q.4) Did you report this incident to higher authority?

Ans: No sir, As I thought it was normal injury and HC/GD Ikram Hussain was going to unit
hospital at that time.

Q.5) Do you want to say anything else?

Ans: No Sir, I don’t want to say anything else.

I joined SSB on 12.02.2002 and I was posted to 37 th Bn SSB, Mangaldoi w.e.f. 17.06.2022
and serving in the Battalion till date and performing various duties. On 22.02,2023, at about 630
Hrs , after PT march I witnessed gathering of senior officers and other persons near Adam Block.
Owing to that I rushed to the place where I came to know that HC/GD Ikram hussain has come to
unit hospital due to some injury in his hand. Quickly, I rushed to Unit hospital inside the Adam
block, where I found HD/GD Ikram Hussai with his injured hand. I asked him, How did this
happen? He told me that that while going to toilet, He slipped on the ground and his hand got
twisted.

I joined SSB on 01/09/1989 and I was posted to 37th Bn SSB, Mangaldoi w.e.f. 29/02/2020
and serving in the Battalion till date. I am performing the duties of Insp/Adam from 06.02.2023. On
22.02.2023, at about 630 Hrs , after PT march I witnessed gathering of senior officers and other
persons near Adam Block. Owing to that I rushed to the place where I came to know that HC/GD
Ikram hussain has come to unit hospital due to some injury in his hand. Quickly, I rushed to Unit
hospital inside the Adam block, where I found HD/GD Ikram Hussain with his injured hand. I
asked him, How did this happen? He told me that that while going to toilet, He slipped on the
ground accidently and his hand got twisted. After that HC/GD Ikram Hussain referred to Mangaldoi
civil Hospital for further treatment. At about 0820 Hrs, Ikram hussain was sent to Mangaldoi civil
hospital along with QRT and medics. (I hereby produce GD abstract No. 2666-67 dated
22.02.2023 as exhibit- ).

Q.1) In what capacity have you been serving at Bn HQ?
Ans. Sir, I have been performing duties of Adam/Insp. Since 06.02.2023 at 37 Bn SSB,
Mangaldoi (Assam).

Q.2. How did you come to know that HC/GD Ikram Hussain got injured in his hand?
Ans: Sir, at about 630 Hrs , after PT march I witnessed gathering of senior officers and other
persons near Adam Block. Owing to that I rushed to the place where I came to know that HC/GD
Ikram hussain got injurty in hand.

Q.3) Did you meet HC/GD Ikram Hussain at unit hospital?

Ans: Yes sir.
Q.4.What did he tell you about the incident?

I joined SSB on 14/05/2020 and I was posted to 37th Bn SSB, Mangaldoi on 16/06/2020 and
serving in the Battalion till date. I am presently performing duties of AC/MO at 37 Bn, SSB unit
hospital, Mangaldoi (Assam). On dated 22.02.2023, at about 0630, I was informed telephonically
from unit hospital that HC/GD Ikram Hussain, had come to unit hospital for treatment as he fell
down accidently and got injured in his hand. Consequently, I reached unit hospital at about 0635
Hrs and I asked the reason of injury, HC/GD Ikram Hussain told that he got injured in his hand
becasue he slipped on the ground accidently. I carried out checkup of HC/GD Ikram Hussain and
found that his left hand was not moving properly. His wrist got twisted slightly marked with
swelling in soft tissues, Considering his condition, I administered him injection to soothe his pain
and swelling. Then after, I referred him to Civil hospital, Mangaldoi for further treatment, Where
an X-ray was carried out. For better treatment individual was sent to Narayana Hospital Guwahati
where doctor diagnosed fracture in wrist joint of individual and recommended for surgery. After
surgery, individual got discharged from hospital on 24.02.2023. Currently, HC/GD Ikram Hussain
is under observation and condition of his hand is stable. Individual has given sick rest for four
weeks from 03.03.2023 onwards for speedy recovery of his hand.

Ans. Sir, I am performing duties medical officer at Battalion at 37 Bn. SSB, Mangaldoi Assam).

Q.2) How did you come to know about this incident ?

Ans: Sir, I was informed telephonically from unit hospital staff.

Q.3) How was the condition of HC/GD Ikram Hussain, when you carried out primary checkup?
Ans. Sir, I noticed injury in wrist joint of his left hand. His wrist was twisted slightly and marked
with swelling in soft tissue.
Q.3. What treatment did you prefer considering the condition of HC/GD Ikram Hussain?
Ans. Sir, I administered him injection to pacify his pain and swelling.
Q.4. Did you notice any other injury apart from hand injury?
Ans. No sir,
Q.5. Did you refer HC/GD Ikram Hussain to other hospital for better treatment?
Ans. Yes, sir I referred him to Civil Hospital Mangaldoi and further to Narayana Hospital
Guwahati for better treatment.

Findings:-

After having gone through the statement of witnesses and relevant documents, the court finds –
1. UIN-12050602 HC/GD Ikram Hussain of D Coy have joined SSB on SSB on 15.12.2005 and I
was posted to 37th Bn SSB, Mangaldoi (Assam) w.e.f. 11.08.2022 and serving in the Battalion
till date.[as per statement of W.No.01)
2. On dated 22.02.2023, at about 0610 Hrs, HC/GD Ikram Hussain was going towards toilet area
behind AIRT Barrack for getting freshen up, where, he slipped on the ground accidently and
fell down due to wet path( due to occurrence of rain on previous night) which caused injury in
his left hand. . (as per statement of witness No.01,).

3. First of all,HC/GD Ikram Hussain told this incident to CT/GD Swar Din, who was present in AIRT
barrack. CT/GD Swar Din Witnessed his condition that his left hand was got twisted and swelled up. (as
per statement of witness No.01 & 02).

4. UIN-12050602 HC/GD Ikram Hussain reached to unit hospital alone at about 0530 Hrs for
primary treatment, where he was given primary treatment by Dr. Yogita Magarde, AC/MO. (as
per statement/Exhibit produced by witness No.01,).
5. On 22.02.2023, at about 0820 hrs, HC/GD Ikram Hussain was sent to Civil Hospital Mangaldoi
on referral of Dr. Yogita Magarde, AC/MO for better treatment and further individual was sent
to Narayan superspeciality Hospital, Guwahati. (as per statement of witness No.01 & 5,
Produced as exhibit No- ).
6. On the evaluation of X-ray report, HC/GD Ikram Hussain was diagnosed with communited
fracture D/E left radius and recommended for surgery. (as per medical documents produced b
witness No.01, as exhibit No- ).
7. A surgery was performed on 23.02.2023,at Narayana Superspeciality hospital, Guwahati, in
which Titanium-D/R Volar LCP plate was implanted in wrist joint of left hand of HC/GD Ikram
Hussain.( as per medical documents produced by witness No.01, as exhibit No- ).

8. HC/GD Ikram Hussain got discharged from Narayana Superspeciality hospital, Guwahati, as
on 24.03.2023 (AN). ( c

9. HC/GD Ikram Hussain visited Narayana Superspeciality hospital, Guwahati, as on 03.03.2023

for follow up treatment, where he was recommended to take rest for three weeks. ( as per
medical documents produced by witness No.01, as exhibit No- ).
10. Currently, HC/GD Ikram Hussain has not recovered completely, he is undergoing treatment
and follow ups. Doctor has advised him to take all precautionary measures such as keeping his
hand in one position, wrapping it with bandage etc. ( as per medical documents produced by
witness No.01, as exhibit No- ).

Opinion:-
After having gone through the statements of the witnesses, relevant documents, the Court is
of the opinion that:-
Injury caused to HC/GD Ikram Hussain was accidental, as individual could not recognize whether
the ground was slippery. This incident took place while individual performing bona-fide
government duty. I was evident that there was no concrete path constructed from barrack to toilet
area. It was a human error caused accidently, No fault of any individual appears in this matter.
HC/GD Ikram Hussain could be more cautious, knowing that it was rained previous night.
Individual is satisfied with the treatment , which is offered to him for speedy recovery of his injured
hand.
Suggestions to avoid such incident in future-
Proper path should be constructed from barrack to toilet areas with help of local available
resources. Personnel should be briefed regularly in night roll call to be cautious while making any
movement in areas, where water logging take place during rainy days.
