Environmental Impact Assessment Law (PD 1586)

- Environmental Impact Assessment (EIA) is a process that involves predicting and evaluating the
likely impacts of a project on the environment (land, water, air, flora, fauna and people) at various
stages (construction, commissioning, operation and abandonment) of the project development.
- Its coverage - facilitate the attainment and maintenance of rational and orderly balance between
socio-economic development and environmental protection.

Toxic Substances and Hazardous Waste Management Act (RA 6969)

- Pursuant to RA 6969 Toxic Substances and Hazardous and Nuclear Waste Control Act of 1990,
this program of the DENR-EMB covers the sound and proper management of industrial
chemicals and hazardous wastes in all aspects of its life cycle, from importation, manufacture,
distribution, transportation, use and disposal.
- The penalties- The penalty of imprisonment of six (6) months and one day to six (6) years and
one day and a fine ranging from Six hundred pesos (P600. 00) to Four thousand pesos
(P4,000.00) shall be imposed upon any person who shall violate section 13 (a) to (c) of this Act
and shall not be covered by the Probation Law.
Clean Air Act Of 1999 (RA 8749)

- The Act provides for the creation of a national program of air pollution management focusing
primarily on pollution prevention; for the promotion of mass media communication in order to
create social awareness and active participation in air quality planning and monitoring.
- The penalties - Republic Act (RA) 8749 provides that for actual exceedance of any pollution or
air quality standards under this Act or its rules and regulations, the Department, through the
Pollution Adjudication Board (PAB), shall impose a fine of not more than one hundred thousand
pesos (Php 100,000.00)
Ecological Solid Waste Management Act (RA 9003)

- The law provides for a comprehensive ecological solid waste management program by creating
the necessary institutional mechanism and incentives, appropriating funds, declaring certain acts
prohibited, and providing penalties.
- The penalties- Any person who violates Sec. 48, pars. (14), (15) and (16) shall, upon conviction,
be punished with a fine not less than One hundred thousand pesos (P100,000.00) but not more
than One million pesos (P1,000,000.00), or imprisonment not less than one (1) year but not more
than six (6) years, or both.
Clean Water Act (RA 9275)
- Republic Act (RA) 9275, the Philippine Clean Water Act of 2004 (CWA), declares that the
State shall pursue a policy of economic growth in a manner consistent with the protection,
preservation, and revival of the quality of our fresh, brackish, and marine waters.

- The Republic Act No. 9512, or the National Environmental Awareness and Education Act of
2008, articulates that the state shall promote national awareness of the role of natural resources in
economic growth and the importance of environmental conservation and ecological balance
towards sustained national development.
