KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement made and entered into by and between

The Department of Agriculture Regional Field Office 10, with principal office address at
Antonio Luna Street, Cagayan de Oro City, represented herein by the Regional Executive Director,
CARLENE C. COLLADO, CPA and hereinafter referred to as “DA - RFO 10”;

The CITY GOVERNMENT OF CAGAYAN DE ORO with office address at Cagayan de Oro City
represented by its City Mayor, HON. ROLANDO A. UY hereinafter referred to as “CDO”;

WITNESSETH

WHEREAS, the President issued Executive Order No. 114 known as the Balik Probinsiya,
Bagong Pag-asa Program (BP2) in response to the issues of population density and urban
sustainability to ensure balanced and equitable distribution of wealth, resources, and opportunities
through policies and programs;

WHEREAS, the City Government of Cagayan de Oro in its desire to help its constituents,
has manifested its continued support and willingness in the implementation of the Balik
Probinsiya, Bagong Pag-asa Program (BP2) to the CDO’s BP2 principal beneficiaries;

WHEREAS, one of the component projects of the BP2 is the Farm Diversification and
Livelihood Development Project, namely, Vegetable Production and Fresh Chicken Egg Production;

NOW, THEREFORE, for and in consideration of the above premises, the parties mutually
agree on the following terms and conditions:

ARTICLE 1

COVERAGE

Section 1. This Memorandum of Agreement (MOA) covers the implementation of projects

Cagayan de Oro City based on the list of BP2 principal beneficiaries by National
Housing Authority with supporting documents herewith attached.

Section 2. CDO shall implement the approved projects as indicated in Annex A of this MOA.

PROJECT RESPONSIBILITIES AND ACCOUNTABILITIES

Section 1. Responsibilities of the Department of Agriculture – Regional Field Office 10

(DA-RFO10).

Section 1.1. Review and assist in the validation of the actual list of principal beneficiaries who
intend to engage in agriculture from National Housing Authority (NHA) &
Department of Social Works and Development (DSWD). To assist CDO to come-up
with the final list of principal beneficiaries qualified to be recipients of the project.

Section 1.2. Allocate funds for the implementation of the projects as indicated in Article 1,

Section 1.3. Procure the goods intended for the project in accordance with R.A. 9184 (The
Government Procurement Reform Act);

 Section 1.4. Ensure that all interventions under this MOA are delivered accordingly and are
appropriately documented.

Section 1.5. Keep track of the progress of the project and shall, from time to time, send its

authorized representative/s for field visits/monitoring of the project.

Section 1.6. Spearhead the conduct of periodic review and evaluation of the project in
coordination with the provincial and municipal agriculture offices.

Section 1.7. Have the right to intervene and institute corrective measures for preserving the
objectives of the project.

Section 1.8. Prepare and submit monthly status/ monitoring reports to its DA- BP2 Central
Office regarding the implementation of the project (s).

Section 1.9. Conduct field validation of the principal beneficiaries from the list submitted by
CDO to come-up with the final list of principal beneficiaries qualified to be
recipients of the project.

Section 2. Responsibilities of the City Government of Cagayan de Oro

Section 2.1. Submit to DA RFO 10 the list of recipient/s of the said PROJECT concurred by the
Local Chief Executive (LCE) in accordance with Annex B (List of Recipient/s) of this
MOA.

Section 2.2. Facilitate the delivery of goods to the beneficiaries by issuing a duly signed
Certificate of Acceptance/ Acknowledgement Receipt/Property Transfer Report.

Section 2.3. Coordinate with DA RFO 10 and the BP2 principal beneficiaries in the hauling of
goods/services from municipality delivery site to the qualified BP2 principal
beneficiaries.

Section 2.4. Designate a technical staff as Focal Person who shall oversee project
implementation and ensure that the project is implemented.

Section 2.5. Provide all the necessary support or assistance in relation to the conduct of the
project during its operation as well as assist the DA-RFO 10 in monitoring and
evaluation of the project.

Section 2.6. Conduct regular monitoring and evaluation of the projects implemented and

Section 2.7. Assume full responsibility in the operation, monitoring, and sustainability of the
approved project herein.

Section 3. Summary of the responsibilities and accountabilities of both parties

OTHER TERMS AND CONDITIONS

Section 1. DA-RFO 10 shall transfer the PROJECT without cost to the CDO after final
acceptance thereof and all required documents are submitted.

Section 2. The parties hereto guarantee to carry out the project using generally accepted
professional standards and practices.

Section 3. Any dispute/cause of action arising out of the implementation of this Memorandum
of Agreement shall be settled and filed in the regular courts or competent quasi-
judicial bodies of Cagayan de Oro, to the exclusion of all others.

Section 4. Any modification or amendments shall be mutually agreed in writing by the parties
concerned.

ARTICLE 4

EFFECTIVITY

Section 1. Effectivity. This agreement shall take effect on the date of the signing hereof of the
parties concerned and shall terminate upon the satisfactory fulfilment of the terms
and conditions and upon issuance of Journal Entry Voucher to CDO.
