JOINT AFFIDAVIT OF ARREST

We, the following undersigned PNCOs, of legal ages, bonafide members of the
Philippine National Police presently assigned at Station 1 Baguio City Police Office,
Quirino Highway, Baguio City, rendering a tour of duty from 8:00 AM to 8:00 PM and
can be further extended in the exigency of Police service, after having been duly sworn
to in accordance with the law, do hereby depose and state to wit that:

At around 10:05 AM of October 13, 2014, while conducting mobile patrol on


board Mobile 81 along Hamada Road, a male person called our attention who was
shouting for police assistance for a male person wearing pink shirt and red short pants
with a black backpack carted away his I-phone and PHP500.00 cash and that the
suspect fled away towards the creek;

We with the victim immediately chased the suspect on the creek and eventually
caught him up along Hamada Road, Lourdes Subdivision Extension, Baguio City and
requested him if we could open his black bag pack which he consented wherein a silver
touch screen Apple I-phone Pad worth PHP10,000.00 & one (1) PHP500.00 bill was
placed inside which the victim claims to be his own;

Despite wearing our complete uniforms, we identified ourselves as police officers


to the suspect then put him under arrest. I, SPO1 Accosta informed him the nature and
cause of his arrest and likewise read to him his constitutional rights/Anti-Torture Act in
Tagalog language which he fully understands after which asked him if he understood
his rights which he answered on the affirmative;

We then boarded the suspect to our patrol mobile and advised the victim to
follow us at BCPO Police Station 1 for the disposition of the case;

Inside our office, the victim identified himself as Joseph Lozano y Balagbag, 40
years old, born on February 10, 1974 at Bayambang, Pangasinan, married, taxi driver,
and a resident at the place of incident while the suspect identified himself as Christian
Alvar Galag, 19 years old, born on December 13, 1994 at Balanga, Bataan, single,
unemployed, native of Balanga, Bataan and a resident at 33 MRR Queen of Peace,
Baguio City;

We then brought the arrested suspect at Baguio General Hospital and Medical
Center for the conduct of his medico-legal examinations; and,

We executed this joint-affidavit to attest to the truthfulness of the foregoing facts


and circumstances to support the filing of a case against the suspect.
