This RENT AGREEMENT is made at GURUGRAM, HARYANA on this

2023 between Mr. Baljeet Rathee ( Aadhar No.4254 2164 9093 & PAN -
AGYPS9826J ) S/o Sh. Chhotu Ram Rathee R/o E-5/5, DLF City - I ,
Gurugram, Haryana and Mr. Rajesh Kumar Nagpal ( Aadhaar No.4740 7400
4874 & PAN - ACBPN5113E ) S/o Late Sh. Kanwal Kumar Nagpal R/o 6101,
DLF City - IV, Gurugram, Haryana, hereinafter collectively called the
LESSOR/LANDLORDS (which expression shall where the context so admits,
includes their heirs, executors, administrators or legal representatives and/or assigns)
of the ONE PART.
AND

Ms. P.S Luxury registered office address at Back Portion Third Floor, Plot No.
10, Road No. F-9, DLF Qutub Enclave, DLF Phase 1, Gurugram, Haryana-
122002 through its prop. Ms /Mrs. Swati Chaurasia (Aadhar No9599 7786
3354 & Pan No. ANPPC0307C) W/o Pankaj Arya R/o P-73, Near Metro
Hospital, Sector-11, Noida, Gautam Buddha Nagar, Uttar Pradesh-201301)
hereinafter called the LESSEE/TENANT (which expression shall where the
context so admits, includes his heirs, executors, administrators or legal representatives and/or
assigns) of the OTHER PART.

WHEREAS the LESSORS/LANDLORDS are the owner of ENTIRE Basement


of House No. 4001, situated in the residential colony known as DLF City Phase -
IV, formerly known as DLF Qutab Enclave Complex , situated in and around
villages Chakkarpur, Tehsil & Distt. Gurugram ( Haryana ) and is in possession
of the said property Vide Sale Deed Vasika No 13355 dated 08.12.2021 Duly
Registered in the office of Sub Registrar Wazirabad, Gurugram, Haryana
(Hereinafter Called the PROPERTY).
AND WHEREAS the DEMISED PREMISES is let out to the LESSEE/TENANT
by the LESSORS/LANDLORDS on the following terms and conditions mutually
agreed upon between both the parties: -
NOW THIS AGREEMENT WITHNESSTH AS UNDER: -

1. That the Tenancy has commenced from 01.10.2023 for a period of Five years
i.e. up to. 30.09.2028 , hereinafter called the TENANCY PERIOD, if both
the PARTIES agree for further renewal of TENANCY PERIOD for next
Five years, the monthly Rs 1,80,000 ( Rupee One Lacs Eighty Thousand only
) for first Three Month and after Three months Rent will be Rs. 2,00,000/-
( Two Lacs Only) Rent shall be increased by 15% of after three years the
last drawn rent with the mutual consent of both the parties.

a) That the LESSEE/TENANT shall pay monthly Rent of the said DEMISED
PREMISES, as per stated above in advance to the

LESSORS/LANDLORDS by way of NEFT/RTGS, but not later than 5 day
of each English Calendar month.

b) That the LESSEE/TENANT will pay electricity charges of the said


DEMISED PREMISES extra to the LESSORS/LANDLORDS directly, as
per the consumption in the bills received from the concerned authorities. That
during the course of TENANCY PERIOD, in case the electricity department
and/or any other authority imposes any sort of penalty, misuse charges etc. on
the said DEMISED PREMISES then the same shall be paid and borne by the
LESSEE/TENANT.
c) That the LESSEE/TENANT will pay water charges of the said DEMISED
PREMISES extra to the LESSORS/LANDLORDS directly.
d) That the LESSORS/LANDLORDS received a sum of Rs. 4,00,000/-
(Rupees Four Lacs only), which is further divided equally in the both owners,
through net banking/cheque as interest-free security in advance from the
LESSEE/TENANT, which will be refunded on the date on which the
LESSEE/TENANT shall vacate the said DEMISED PREMISES.
However, it is made clear that the LESSORS/LANDLORDS are entitled to deduct
any sort of penalty, misuse charges, damages to fixture fittings, properties, monthly rent,
electricity and water dues if pending, from the security amount, at the time of vacation of
the said DEMISED PREMISES.
e) The LESSOR/ LANDLORD will be providing lockable gate on the entrance as discussed.
f) The LESSOR/ LANDLORD will be doing waterproofing of the internal and external wall
off the premises.
2. That the LESSEE/TENANT shall use the DEMISED PREMISES for
RESIDENTIAL PURPOSE ONLY and the LESSEE/TENANT shall not
use the said DEMISED PREMISES for any other activities which is
contravention of laws in force during the subsistence of the present Rent
Agreement.
3. That there will be a locking period of Three Years from the date of
agreement. In case LESSEE/TENANT vacates the said DEMISED
PREMISES before expiry of this locking period of Three Years t he n t he y ne e d t o pa y
the rent for the remaing m ont hs of t ha t l oc ki ng pe ri od t o t he
LESSORS/LANDLORD.

4. That no structural additions or alteration shall be made by the


LESSEE/TENANT in the said DEMISED PREMISES without the prior
written consent of the LESSORS/LANDLORDS. Further no alternations /
changes will be allowed in front elevation of the building. However, the

LESSEE/TENANT can make minor changes indoor (temporary), which may
be necessary in respect of his residential needs, on expiry/termination of this
present Rent Agreement, the LESSEE/TENANT shall remove such
equipment as may have been installed by him in the said DEMISED
PREMISES, and remove the changes made, if any by him and hand over the
vacant physical possession of the DEMISED PREMISES as was originally
handed over to him.

5. That the LESSEE/TENANT shall not sublet the said PREMISES or any
portion to anybody else under any circumstances.
6. That the LESSEE/TENANT shall allow the LESSORS/LANDLORDS or
his agent duly authorized on that behalf to enter the DEMISED PREMISES
to view the conditions of the DEMISED PREMISES at reasonable hours and
to carry out major/minor changes or repairs.
7. That day-to-day minor repairs such as leakage of water taps, fuses of LED
lights, electricity & water repairs, cupboard repairs etc. shall be done by the
LESSEE/TENANT at his own cost but any major repairs such as leakage in
electric cable or bursting of sanitary pipes or any damages to the structure,
leaking of roof, security installations etc., the same shall be done by the
LESSORS/LANDLORDS.
8. The same condition at the time of the vacating the DEMISED PREMISES.

9. That all the charges of mis-use of electricity, water and/or any other penalty in
this regard of the said DEMISED PREMISES during the TENANCY
PERIOD will be the responsibility of the LESSEE/TENANT. On default in
any condition of this present Rent Agreement, the LESSORS/LANDLORDS
have the right to disconnect electricity, water of the said DEMISED
PREMISES without any notice, it is clarified that this has been agreed by the
LESSEE/TENANT and no complaint in this regard will be entertained.

10. That if the LESSEE/TENANT leaves the DEMISED PREMISES or goes


out somewhere or puts the lock on the door for 30 days, without any
information, then the LESSORS/LANDLORDS shall evict the DEMISED
PREMISES with the help of the police.
11. That if the LESSEE/TENANT wants to vacate the said DEMISED
PREMISES, then LESSEE/TENANT will serve ONE MONTH Notice in
advance to the LESSORS/LANDLORDS or ONE MONTH rent in lieu
thereof.
12. That if the LESSORS/LANDLORDS wants to get vacated the said

DEMISED PREMISES before the expiry of the TENANCY PERIOD.
Then they will serve ONE MONTH Notice in advance to the
LESSEE/TENANT and in case LESSEE/TENANT doesn’t vacate the said
DEMISED PREMISES after notice his status shall be of a trespasser.
13. That after the expiry of the TENANCY PERIOD the LESSEE/TENANT
will hand over the peaceful vacant possession of the said DEMISED
PREMISES to the LESSORS/LANDLORDS in the same condition in
which has been taken over the property.
14. That in case the LESSEE/TENANT does not vacate the said DEMISED
PREMISES on the expiry of the tenancy or on its earlier termination; the
LESSEE/TENANT shall be liable to pay three times rent per month,
hereinafter reserved till the LESSORS/LANDLORDS is able to get the said
DEMISED PREMISES vacated from the LESSEE/TENANT.
15. That the LESSEE/TENANT shall not create any type of nuisance in the said
DEMISED PREMISES or any part thereof or in the said PROPERTY or
properties nearby during the TENANCY PERIOD.
16. That the LESSORS/LANDLORDS will not be liable for any dues of any
kind pertaining to any facility availed by the LESSEE/TENANT from any
Govt. Financial Institution, Bank etc. in respect of the DEMISED
PREMISES during the TENANCY PERIOD.
17. That the LESSEE/TENANT shall abide by all the rules and regulations of
Society/ Govt. authorities as may be in force from time to time,
18. That the LESSEE/TENANT hereby further undertakes to pay and indemnify
the LESSORS/LANDLORDS all such losses, charges expenses and damages
etc. which may be caused to the DEMISED PREMISES or the said
PROPERTY by him or any other person on his behalf.
19. That if any LESSEE/TENANT rent shall be in arrears/delay or if the
LESSEE/TENANT shall omit to perform or observe any covenant or
conditions of the present Rent Agreement then in such case, it shall be lawful
for the LESSORS/LANDLORDS to terminate the tenancy without prejudice
to any claim, right or action or remedy and under such circumstances, the
LESSEE/TENANT undertakes that he shall hand over the vacant and
peaceful possession of the said DEMISED PREMISES to the
LESSORS/LANDLORDS.
20. That the failure of non-payment of electricity and/or water dues in time shall
give rights to the LESSORS/LANDLORDS to disconnect the electricity and
water connection of the LESSEE/TENANT till such time the dues are paid
with interest and penalty. Under these circumstances the LESSEE/TENANT
has no right to draw the electricity and/or water from any other source.
21. That the LESSEE/TENANT shall not involve himself or his family members

in any anti-social/anti-national and unlawful activities which may cause
damage to the LESSORS'/LANDLORDS’ reputation. In any case the
LESSEE/TENANT is found to do such act, the LESSORS/LANDLORDS
will have the right to get the DEMISED PREMISES vacated immediately.
22. That the LESSEE/TENANT shall not keep pets/dogs or any inflammable and
explosive things in the said DEMISED PREMISES in any manner and the
LESSEE/TENANT shall be liable and responsible for any misdeed,
misbehavior injury, theft, fire, accident, natural incident, natural calamity
and/or any other mishappening whatsoever happened/occurred during the
TENANCY PERIOD, for all the intents and purposes and the
LESSORS/LANDLORDS shall not be liable for the same in any
circumstances.
23. That in case during the TENANCY PERIOD, if the
LESSORS/LANDLORDS decide to sell the above said DEMISED
PREMISES to any person, the LESSEE/TENANT will have no objection
for the same and the LESSEE/TENANT will be bound to vacate DEMISED
PREMISES with one month prior notice given by
LESSORS/LANDLORDS.

24. That in case the LESSEE/TENANT fails to vacate and hand over the
peaceful vacant possession of the above said DEMISED PREMISES
immediately after the expiry of the above said TENANCY PERIOD
according to this present Rent Agreement to the LESSORS/LANDLORDS,
in the event, the LESSEE/TENANT shall be liable to pay the penalty of Rs.

exclusive of electricity, water and other charges towards maintenance etc.,
and the additional rent shall be three times of the rent being paid.
25. That on the request of the LESSEE/TENANT the
LESSORS/LANDLORDS has provided the DEMISED PREMISES for
temporarily use only, on conditions that the LESSEE/TENANT will not
obtain any Loan from any Bank or from any financial Institution, at
LESSEE/TENANT above said address in any manner in any circumstances,
in case LESSEE/TENANT will obtain any kind of Loan at above said
DEMISED PREMISES the same shall remain false/fake in all manner.
26. That Police verification of LESSEE/TENANT is necessary by law now a day
and the same shall be done within a week after taking physical possession of
the DEMISED PREMISES by the LESSEE/TENANT
27. That if the LESSEE/TENANT violates and infringes the terms and
conditions of this present Rent Agreement then the
LESSORS/LANDLORDS is fully entitled to get the said DEMISED

PREMISES vacated through court of law under the suit for specific

performance or by any other legal remedies and take possession at the costs
and expenses of the LESSEE/TENANT.
28. That if any information provided by the LESSEE/TENANT in this present
Rent Agreement is found to be wrong, then the above said agreement shall
automatically stand terminated.
29. That the LESSEE/TENANT shall handover the peaceful and vacant physical
possession of the DEMISED PREMISES to the LESSORS/LANDLORDS
on the termination of this present Rent Agreement.
30. That the LESSEE/TENANT shall use the DEMISED PREMISES in law
full manner and in no case the LESSEE/TENANT will use the DEMISED
PREMISES in any illegal manner. The LESSORS/LANDLORDS in no
case shall be held liable or responsible for any act of omission, whether legal
or illegal, of the LESSEE/TENANT during the TENANCY PERIOD.
31. The LESSEE/TENANT in no case shall be conferred or deemed to have
conferred any rights or title as ownership of the DEMISED PREMISES by
virtue of this present Rent Agreement.
32. That both the PARTIES have read over and understood all the contents of
this present Rent Agreement and have signed the same without any force or
pressure from any side.
33. That if any portions of this present Rent Agreement are held invalid and
unenforceable, all remaining portions shall nevertheless remain valid and
enforceable, to the extent they can be given effect without the invalid
portions.
34. That all the expenses of this lease deed such as Stamp Duty, Registration
Charges, writing charges, etc. whatsoever shall be paid and borne by the both
the parties.
35. That in the event of any dispute arising under this present Rent Agreement the
Courts of Haryana shall have jurisdiction.
IN WITNESS THEREOF BOTH THE PARTIES TO THIS PRESENT RENT
AGREEMENT, HAVE SET AND SUBSCRIBED THEIR RESPECTIVE SIGNATURES
ON THIS PRESENT RENT AGREEMENT AFTER READING AND UNDERSTANING
THE CONTENTS OF THE SAME AND WITHOUT ANY PRESSURE, UNDUE
INFLUENCE , MISREPRESENTTAON OR COERCIONIN THE PRESENCE OF
FOLLOWING WITNESSES ON THE DATE, MONTH AND YEAR FIRST WRITTEN
HEREINABOVE
