1. In the respective writ petitions, the petitioners herein seek

claim for regularization of the constructions, as made on a Gair Mumkin

johar or pond, at the instance of the petitioners concerned, and, the said

claim is rested upon Rule 12 (4) of the Punjab Village Common Lands

(Regulation) Rules, 1964, as applicable to State of Haryana.

2. However, in some of the writ petitions, other than the

petitions (supra), the relevant claims are also planked upon the above

Rule. However, for ensuring that the said Rule is assigned the fullest

effect, this Court deems it fit to make a direction upon the learned State

Counsel, to on an affidavit, to be sworn by responsible functionary of the

State of Haryana, to bring forth, the factum whether within the ambit, of

the said Rule, the houses as raised on the petition lands, were raised on or

before 31st March, 2000, and, also whether the raising of such houses on

the petition lands, does not result in any obstruction being caused to

vehicular traffic or to passersby.

3. Moreover, the learned State counsel is also directed to ensure

that in the above sworn affidavit, revelations shall also occur in respect of

the Collector rate, hence prevailing at the time when the applications were

preferred under the above Rule, before the Competent Authority

concerned.

4. The affidavit (supra) be ensured to be filed by the next date of

hearing.

5. List on 27.02.2023.

6. To be heard alongwith connected petitions CWP-26643-2019,

CWP-25918-2022 and CWP-25532-2022.
