AFFIDAVIT FOR PROBABLE CAUSE

Comes now Officer Wesley Fluke, who hereby swears upon his oath, deposes and says:

1. I am a Law Enforcement Officer with the Fishers Police Department.

2. I am filing this affidavit for probable cause in support of the following charge:

I.C. 35-43-2-1 (1) Burglary of a Dwelling, a Level 4 Felony

I.C. 35-44.1-3-1 (a)(3) Resisting Law Enforcement, an A Misdemeanor
I.C. 35-43-5-2.5 False Government Identification, an A Misdemeanor

against Charly Sneider Benavides Mayorga, a Hispanic male, DOB 9/14/1987, 5 11 180 Lbs.,
brown hair, brown eyes.

3. On 07/04/2022 at approximately 10:37 PM, I, Officer W. Fluke with the Fishers Police
Department, was working regular patrol in a fully marked patrol vehicle wearing a full duty
uniform. I was dispatched to a residential alarm near the 15600 block of Allistair Drive. Dispatch
advised that the alarm was first received at 10:33 PM and consisted of a multizone activation.
The zones indicated by the alarm company was sliding door, upstairs motion, and panel tamper
(3 times).

I was in the neighborhood at approximately 10:52 PM. I was traveling east on Provincial
Lane, which is directly to the south of the residence with the alarm. I had my headlights off and
- pproach to the residence. I did this as a tactical advantage, should a
suspect be in the area.

I observed a male figure, later identified as Jhon Jairo Munoz Lopera, in dark clothing
wearing a baseball hat, on the raised hill to my right. The hill is between Provincial Lane and
East 104th Street. Jhon turned 180 degrees upon my arrival and started to flee the area by a pace I
recognized as quicker than a jog, but slower than a run. The circumstances were suspicious
because we were directly behind/in line with the residence with the alarm. I observed an object
in hand. I was unable to identify what the object was due to the lack of light. John ran
over the hill, crossing East 104th Street, and into the neighborhood directly to the south. I used
my flashlight, and I was able to identify there were two male figures fleeing the area.

identified as Charly Sneider Benavides Mayorga, knowingly and intentionally resisted my verbal
commands to stop after I identified myself as a law enforcement officer. Furthermore, John and
Charly increased their pace while fleeing to a full run.

Jhon and Charly approached a retention pond. Charly fled in a western direction, which
was north of the retention pond. Jhon fled south along the retention pond. I pursued Jhon as he
continued to flee from me. As Jhon passed light sources, I observed Jhon wearing dark clothing,
a dark baseball hat, and Adidas sweatpants.

Jhon ran behind a residence near the 15600 block of Campolina Lane. I lost sight of
which direction Jhon ran due to the angle of approach and the structure obscuring my view. I
waited for a K9 Officer to conduct a K9 search. We quickly found Jhon on the rear deck of a
resident in that area. I placed Jhon in handcuffs, ensuring proper spacing and double locking
them.

I searched Jhon for weapons and found none. John was wearing a fanny pack, a long
green sleeve shirt, black gloves (with one finger of the glove broken, and minor bleeding from
his pinky), Adidas sweatpants, and a black baseball hat. Jhon had a pair of needle nose pliers in
his pants pocket and a pair of white headphones on his person. Jhon was seen and cleared by
medics.

his person and/or in the fanny pack:
- Cell phone
- New York ID

- Columbian Passport

The New York ID had the name Juan David Meneses Velazco with a date of birth of 10/26/1988.
The quality of the ID card was poorly made, as the lamination did not fully fit the ID. The Spain

Jhon knowingly and intentionally possessed a document not issued by a
government entity that purports to be a government issued ID.

Due to public and officer safety concerns, I asked Jhon if his partner had a weapon on
him, and Jhon advised his partner did not.

Officers on scene at the initial alarm advised that the rear sliding door had forced entry by
means of prying the sliding door open. I was also advised that there were clear signs of a
burglary.

An area search was conducted for Charly. At approximately 11:57 PM, Sergeant K.
McFerran and his K9 partner located Charly hiding at the base of a tree in a backyard of a
residence near the 10400 block of Ransford Boulevard. Charly was bitten by the K9. I placed
Charly in handcuffs, ensuring proper spacing and double locking them. I searched Charly for
weapons and found none. Charly was wearing fanny pack, a blue/gray t-shirt, blue/gray pants,
and a black baseball hat. Charly was seen and cleared by medics.

- Venezuelan ID Card

The Venezuelan ID Card had the name Eduardo Hernandez Castro with the date of birth
12/
License had the name Samuel Mayorga Llusep with the date of birth 12/19/1990. The name on
the Columbian Passport was Charly Sneider Benavides Mayorga with the date birth 09/14/1987.
Charly. Charly knowingly and intentionally possessed a
document not issued by a government entity that purports to be a government issued ID.

Due to the circumstances surrounding this incident and the suspects, I believe that Jhon
and Charly are involved with a criminal organization known to operate in the Fishers area.
Fishers Police Department Intel recently advised of South American Theft Groups operating in
the Hamilton and Marion County. The burglaries carried out by these groups involve targeted
thefts of jewelry, cash, safes, but not electronics. The common descriptors of are 2-4 Hispanic
actors 20-50 years old, wearing name brand clothing baseball hats, sunglasses, scarves, and
multi-colored bracelets. They are reported to carry fake IDs, passports, and use rental cars parked
offsite from the crime. Additionally, these theft groups often target Asian business owners, high-
end homes, break rear slider doors or windows, park nearby, and work during evening shifts. The
victim, Daihui Zheng, in this incident is of Asian descent and an owner of an Asian restaurant.
Fishers has seen similar thefts as recent as 02/2022 in areas such as Hamilton Proper which is
within 7 miles to this incident.

Evidence technicians processed the residence that was burglarized. I was advised that the
electrical box providing power to the residence was ripped off the side of the house and
damaged. The rear slider door was pried open, and items from inside the home were missing.
The alarm panel was ripped off the wall of the inside of the residence. A closer look at the area
where I initially observed the suspects flee, Officers located a black crowbar, and a zip up
laundry bag that contained 13 designer purses/wallets, 2 designer belts, and multiple paper
printed on it. The paper envelopes contained a
total of $2,382.25 United States currency. The laundry bag also had loose bills totaling 220
Euros.

Officer K. Farrell and B. Taylor advised that Daihui was out of town on vacation. I was
advised that contact was made with Daihui through a neighbor. Daihui told officers nobody had
permission to be in his residence.

Evidence technicians advised that the items found in the zip up laundry bag were taken
from the same residence. The approximate value of the designer purses and belts taken are
approximately $25,897.00 in United States currency. Gloves identical to the gloves Jhon was
wearing was found approximately 50-100 feet west of where the zip up laundry bag was found.

Evidence technicians located, processed, and placed all evidence into the Fishers Police
Department Property Room.

Jhon and Charly knowingly and intentionally entered a dwelling with the intent to
commit a theft, therefore committing burglary.

All of the above events occurred in Hamilton County, Indiana, except where specifically noted.
