VIOLENCE AGAINST WOMEN AND CHILDREN & RAPE ACTIVITY


QUESTIONS:
1. What violation/s was/were committed by the police officer involved? What kind of
abuses/violence was/were present in this particular case?
2. What is the effect of this case in the image of the PNP?
3. As a law enforcer in your department, what are your plans and programs to end
abuses and violence against the vulnerable sectors of the society?

ANSWER:
1. Police Corporal Louie Jay Lumancas, assigned at Magpet MPS, was
arrested by Kidapawan PNP police for beating his partner and subsequently
threatening the latter’s life by cocking and pointing his gun against the latter on 11
April 2023. This physical and emotional abuse was caught on camera and became
viral online. As seen on the viral video, PCPL Lumancas repeatedly hit his partner
by kneeing, punching and kicking. He was also tweaking the poor woman’s hair
while beating her. Thereafter, PCPL Lumancas took his gun, cocked and pointed
it to her battered partner.
In this case, PCPL Lumancas violated Republic Act No. 9262, otherwise
known as the “Anti-Violence Against Women and their Children Act of 2004.
Section 5 (a) thereof states that causing physical harm to a woman constitutes an
act of violence against the said woman. There is no question here that PCPL
Lumancas has a dating relationship with the woman he was beating in the video,
and there is also no question that he was inflicting physical harm to the said
woman. Another violation he committed is grave threat under the Revise Penal
Code when he drawn, cocked and pointed his gun to his partner.
2. Because of this case, the PNP’s image was once again tainted with
negativity. We are all aware that the image of the PNP to the public is not positively
established, although most of the PNP personnel do good things. In these modern
times, and with the use of mobile device and social media, one simple mistake
committed by a PNP personnel that is caught on camera and posted in social
media, the image of PNP personnel will be tarnished. Particularly in this case, the
public will see the PNP personnel as domestic abusers.
3. Actually, we cannot control the actions of a man. If a man has an urge, or
intent to do a criminal act, he will do so. And if we are not present on a possible
crime scene before a man could commit a crime, we cannot eliminate the
opportunity to commit such crime. In reality, we also cannot eliminate or put an
end the abuses and violence against women and their children because of the fact
that crime is a social phenomenon. The best way to at least lessen the cases of
violence against women and their children, raising awareness through online
and/or face-to-face seminars must be conducted. Through seminars, we can
educate the persons, both male and female and also their children, about the
Republic Act No. 9262. We should also promote good relationship between
partners since the main cause of violation of Republic Act No. 9262 is poor or
unhealthy relationship.
