As we discussed, attached please find an Hourly Fee Agreement. Please print out and review the
Agreement. Mrs. Von Eckartsberg should sign and date the Agreement in front of a witness and have
her signature witnessed. The signed Agreement should be sent to my office along with a check made
payable to Sikov and Love, P.A. in the amount of $2,500.00 for my services, including the possible
preparation of two (2) Special Needs Trusts, one for each of your sons.

Once I receive the retainer, I can complete the drafting of one of the Special Needs Trusts and forward it
for your review and approval. Once one trust is approved, I can prepare the second trust.

Thank for speaking to us recently. My mother and enjoyed speaking with you. We look forward to
meeting you in person soon. In this regard, just following up to ask when we might expect to recieve the
draft documents we discussed? No rush but we do habe a firm offer on my mom's country house so we
prefer to move forward as soon as possible.

Carol,

As of this evening my mother understands the need for special needs trusts for my brothers as well
as the need to revise her will accordingly. With respect to her POA, the primary concern is whether
the lack of an explicit (broad and/or unlimited) gift clause would prevent me as POA from providing for
my brothers in a fashion consistent with my mother's practice for at least the past 20 years to the

extent practical, financially feasible, and or necessary. Of course all of this would be subordinate to
my mom's own potential financial and medical needs going forward.

She would like to move forward on the special needs trust as soon as possible. To this end, would it
be possible for us to set up a brief call tomorrow in advance of our initial in-person meeting so that
you can give my mom more detail on the benefit and desirability of such trusts under the
circumstances? I think the expectation is that my mom would retain you to prepare the trust
documents and the revised Will which she could execute during the initial in-person meeting. I
understand that this may not be feasible given that mom has yet to sign a retainer agreement but
hope you may be able to work with us on this nonetheless. Assuming you are agreeable and
available, please let me know your availability for such a call.

Dear Carol,

Please find attached the letter from my mother’s physician which I understand is sufficient to allow
my mom’s POA to spring into effect. Please also see attached emails between me and AGH
regarding my mom’s and Tonio’s ability to make decisions for Tobias. UPMC h accepted Dr.
Harris’ letter with respect to my mom but are unwilling to remove Tonio as decision-maker based
upon the attached evaluations alone. I have also attached an email regarding communications
between me and AGH regarding my brother’s Tonio’s driving license to flesh out my concerns in
this regard. Stuart Fisk is Tonio’s longtime (almost 20 years) caregiver. Thank you.
