MEMORANDUM OF DEPOSIT OF TITLE DEED

This Memorandum of Deposit of Title deed executed at Bheemunipatnam on


this the 27th day of August, 2018

By
1. Mr. Palla Venkata Rao (Aadhar No: 5321 5464 6446), S/o Ramananna,
Hindu, aged 28 years, resident of Door No: 5-84, T. Nagarapalem Village,
Gollala Palem, Bheemunipatnam Mandal ,Visakhapatnam District and 2.
Mr. Kanchimani Ramana (Aadhar No: 9067 2218 7122), S/o Pedda
Guranna Door No:17, Annavaram village, Gollala Palem, Bheemunipatnam
Mandal, Visakhapatnam District and hereinafter called the “Mortgagors”
which term shall wherever the context mean and include their heirs,
executors, administrators, legal representatives and assign of the one part;

M/s. Shriram Transport Finance Company Limited, a Non Banking


Finance Company Registered under the companies Act 1956, having its
registered office at Mookambika Complex, No.4, Lady Desika Road,
Mylapore, Chennai – 600 004 and its Administrative Office at 101-105,

Mumbai-400 614 having one branch at Door No.2-26, HIG-228, 1st Floor,
Midhilapuri Colony, Ward No-5, Madhurawada, Visakhapatnam-530041
represented by its Power of Attorney Holder Mr. Maddu Venkata Ravi Kumar
(Aadhaar No: 2263 9060 0350), S/o Venkata Ramana Rao, aged 38 years,
hereinafter called the “Mortgagee” which term shall wherever the context
admits, mean and include executors,
administrators, legal representatives and assigns of the other part;

Whereas at the request of the “Mortgagors” the ‘Mortgagee’ has granted loan
of Rs. 8,00,000/- (Rupees Eight Lakhs Only) towards development of
Business of Mortgagors and in order to secure the repayment of the
aforesaid Loan with interest, Charges and other expenses, the ‘Mortgagors’
has Deposited the document or Title Deed listed in Schedule ‘A’ with the
‘Mortgagee’ to create an equitable mortgage.

NOW THIS MEMORANDUM OF DEPOSIT OF TITLE DEED


WITNESSETH AS FOLLOWS:

That in consideration of the sum of Rs. 8,00,000/- (Rupees Eight Lakhs


Only) received by the “Mortgagors” from the “Mortgagee”, the
“Mortgagors” hereby agrees to pay interest, costs and other charges as
per the agreement. The “Mortgagors” has executed this deed in favour of
the “Mortgagee” as security for the repayment of the said Loan and on
this day deposited with “‘Mortgagee” the Title Deed/s more fully
described in Schedule ‘A’ hereunder as collateral security thereby
intending to create an equitable Mortgage over the same in favour of the
“Mortgagee”.

The Mortgagors confirms that the mortgage shall secure all earlier, present
and future credit facilities granted or continued or that may be granted or
continued under or in respect of the mortgage debt and that it shall subsist
notwithstanding the granting of any additional loans in favour of the
Mortgagor.

The “Mortgagors”, hereby, covenants that the said property is not subject
to any mortgages, lien, charge or any other kind of encumbrance

whatsoever and that, the “Mortgagors”, were the absolute owner of the same
and is well and truly seized of the property. The “Mortgagors” further
agrees to keep the “Mortgagee” indemnified against all claims and
demand whatsoever by any person lawfully or equitably claiming under
them and by any other person whatsoever.

Visakhapatna District, Bheemunipatnam SRO, Bheemunipatnam Mandal,


Nagarapalem Village, Vacant Residential Plot an extent of 370 Sq.Yards or
310.8 Sq.Mts., Out of total Extent of Acres 0.34 cents., covered by Survey
No.47-13-A-2 of Nagarapalem village bounded by:

North: Dry Land belongs to Kodiboyina Raju.


South: Dry Land of Executant.
East: Road.
West: Dry Land belongs to Malireddy Krishnamurthy.

1. Original of Registered Sale Deed No. 650/2018 Dated: 01/03/2018 of


Bheemunipatnam SRO executed by Palla Narasimma @ Narasimhalu and
Two others in favour of Palla Ramakrishna and Kanchimani Ramana.
2. Original Statement of Encumbrance Certificate bearing No.38713883 for
35 years from 01-01-1983 to 24-05-2018 for survey No.47/13/A/2.
