§1 Seminar and service: The provider OSK (hereinafter: provider) provides an online designed
training program on its website, which the prospective course participants (hereinafter: the course
participant) can book for a fee.
§1.1 Program: online preparatory course / preparation for the external assessment examination.

Aufnahmetest Vorbereitung (Preparation Course) or AV: Duration 6 weeks, Mathematics and
Deutsch individually 12 UEs. Mathe and Deutsch can be booked individually.
1 unit is 45 minutes. For each lesson, at least 2 units of preparation and 4 units of wrap-up are
provided. These are marked as self-study. The execution of the self-study is the responsibility of
the participants and is not controlled by OSK.
System requirement:
- Internet connection - wired or wireless (e.g. 4G/LTE).
- Speakers and microphone - built-in or as a USB plug-in.
- A webcam or HD webcam - built-in or as USB plugin
- A headset / headphones
§1.4 Course Schedule: The course schedule will be determined by OSK and communicated to
participants in a timely manner. No training events will take place on German public holidays
falling on weekdays and will not be made up. OSK reserves the right to adjust the order of the
subjects to be taught in the course at short notice, as well as to change the instructors. The
course participant will be informed in due time about a change of time. Classes cancelled due to
illness will be made up in a timely manner.
§1.5 Cancellation by the organizer: If OSK has to cancel an entire program for an important
reason (e.g. too few participants), the entire participation fee already paid shall be refunded.
OSK shall not be liable for any further expenses or other disadvantages incurred by the
participant as a result of the cancellation.
§2 Purpose of the training: The training program offered by the OSK is intended to prepare the
respective course participant for the external assessment test (FSP) at state universities in
Germany. All relevant examination subjects are taught, except German (see § 3 course
description) are taught. In the terms of the contract, the word Studienkolleg represents the
preparatory course for the external FSP.
§3 Duties of the participant: 3.1 The participant himself/herself must ensure that he/she meets
the stated technical requirements necessary for participation in the program.
3.2 For technical and organizational questions, support can be reached by e-mail. Participants
will usually receive a response by the next but one working day.
3.3 The personal access data for the seminar may not be published or made accessible to third
parties.
3.4 The participant undertakes to write the assignments independently and to submit them online
to the lecturer in due time. Deadlines are set by the individual lecturers.
3.5 Video, audio, or other recording or taping of online classes without a prior written
agreement with the instructor by the student is strictly prohibited.
§4 Course Booking / Registration: Any booking of events of the OSK shall be subject to the
following booking conditions:
4.1 The binding booking of a course offered by the OSK shall be made by submission of the
completed and signed training contract by the course participant. The contractual terms and
conditions shall thereby become an integral part of the contract. The binding booking obligates
the course participant to pay the training fees after the booking has been accepted by the OSK.
4.2 In the event that the Course Participant is a minor, the contract shall be concluded with the
legal representative (parent) of the Course Participant, provided that one of the parents signs the
Training Contract and the Terms and Conditions. A copy of the ID/passport of the signing
parent must be submitted.
4.3 The acceptance of the contract by the OSK shall be effected by sending the invoice for the
course fees to be paid.
4.4 The OSK reserves the right to withdraw from the booking/registration for various reasons
(e.g. in case of a fully booked course, lack of German language skills or similar). The
booking/registration refers to a specific course that starts on the date indicated in the
registration. In such cases, any course fees already paid will be refunded to the prospective
course participant.
4.5 The contract shall be concluded in German.
§5 Copyrights / Usage Notes: The participant may use the texts, exercises, program codes and
other contents used in the course in accordance with the purpose of the course, e.g. save, print
and use for own use. Any further use of the contents is not permitted, in particular the contents
may not be duplicated and/or distributed or made publicly accessible. Violations of copyright
law may be prosecuted.
The provider grants the customer a non-exclusive right to use the course content for a limited
period of time. The customer is not entitled to publish the course content and multimedia
content from the website of the provider in unedited or edited form or to grant sublicenses.
§6 Condition of participation: The course language is German. The participant is responsible for
acquiring the necessary German language skills (recommendation: min. B1 German level). The
participant has the possibility to book a free trial lesson. For this purpose the participant has to
send an email to info@onlinestudienkolleg.com with the code: Taster day and will receive a
date proposal by email from OSK. A participant can book a maximum of one free trial lesson.
§7 Liability: §7.1 Due to necessary maintenance work, force majeure and uncontrollable
technical conditions of the Internet, no liability can be assumed for 100% availability, unless the
liability is based on an intentional or grossly negligent breach of duty on the part of OSK.
7.2 Claims of the customer for damages shall be excluded. Excluded from this are claims for
damages of the Customer arising from injury to life, body, health or from the breach of essential
contractual obligations (cardinal obligations) as well as liability for other damages based on an
intentional or grossly negligent breach of duty by the Provider, its legal representatives or
vicarious agents. Material contractual obligations are those whose fulfillment is necessary to
achieve the objective of the contract.
7.3 The Provider shall not owe any specific success. In particular, the provider does not
guarantee that the customer will achieve the hoped-for result when completing a course and that
upcoming examinations will be passed. The Provider cannot guarantee that all subject areas
inquired about in the examinations will be covered by the Provider's offered course content.
7.4 The provider is not liable under any circumstances for late attendance or absence of the
participant in the seminar/course and does not repeat missed topics or tasks. Cancellation of the
booking for such cases is excluded.
7.5 The limitations of liability also apply in favor of the legal representatives and vicarious
agents of the provider, if claims are asserted directly against them.
§8 Streaming: By booking the online course, the course participant agrees to be streamed.
§9 Course Fees and Payment Processing
9.1 The course fees for T,W,M or G are 2499 EUR. Plus registration/reservation fee one-time: 100 EUR
(non-refundable).The course fees for AV are: Mathe 360 EUR, Deustch 480 EUR.
9.2 The course fees are due immediately upon conclusion of the contract (see § 4 Course Booking /
Registration).
9.3 The OSK shall additionally request payment by handing over/sending the invoice to the course
participant.
9.4 If the payment deadline stated in the invoice is not met, the OSK shall be entitled to withdraw from the
training contract. The OSK reserves the right to assert claims for damages due to non-payment.
§10.1 The course participant may withdraw from the booked service at any time.
10.2 In the event of a cancellation of a course booking, the OSK shall be entitled to reasonable
compensation pursuant to § 651 BGB (German Civil Code). The compensation shall be structured as
follows:
- 15% of the invoice amount up to four weeks before the start of the lessons confirmed in the order
- 50% of the invoice amount up to two weeks prior to the confirmed start of the lessons
- 80% of the invoice amount up to seven days before the start of the confirmed lessons
- thereafter 100% of the invoice amount
10.3 The booked course may be postponed once to the immediately following course less a processing fee
of 100 euros, provided OSK is informed in writing (e.g. by email support@onlinestudienkollegs.com) at
least fourteen days before the start of the course. After a rebooking, the conditions for a refund stated in
§10.2 shall not apply and the participant shall not be entitled to a refund.
Cancellation must be sent by email to support@onlinestudienkollegs.com.
§11 Disenrollment: 11.1 Should a course participant violate applicable German laws or commit an
unacceptable breach of commonly accepted ethical standards of conduct, the OSK reserves the right to
cancel the training contract and exclude the course participant from the further course program. The same
applies if a course participant exhibits significant misconduct. Misconduct may include, in particular:
- Participation in the course under the influence of drugs
- spreading discriminatory or radical ideas
- (multiple) disruption of events such as video-audio recording of lessons
A refund of already paid tuition fees is excluded in such cases. The OSK reserves the right to assert any
further claims for damages.
11.2 Absences: Attendance is compulsory at the OSK's course events. Should a course participant have
absences of more than 20% of the total number of units of a course, the OSK reserves the right of
immediate de-registration. Should a student become ill, a sick note must be submitted to the OSK within
three business days.Should a student be more than 30 minutes late to class, the entire class will be
considered missed.
11.3 Exam cheating: An attempted cheat on the respective exams will be considered a fail (grade 6.0).
11.4 Untruthful personal statements: Should a course participant have given untruthful information, or
even submitted incomplete or falsified documents at the time of registration, the OSK reserves the right of
immediate de-registration. Course fees will not be refunded in this case. This applies in particular to
enrollment at other Studienkollegs in Germany, at universities in Germany or other countries, the
secondary school leaving certificate achieved, proof of language level, as well as participation in previous
assessment tests.
§12 Data protection: The OSK respects the personal rights of the course participant. It collects, processes
and uses data only in accordance with the relevant data protection regulations to fulfill the purpose of the
contract and only to the extent necessary. All OSK employees are obligated to maintain data secrecy. The
OSK shall not disclose any data of the course participant to third parties, unless this is done after
consultation with the course participant.
Excepted from this is data that is passed on to the competent foreigners authority in order to help clarify
issues relating to the assessment test or the residence title/visa. The OSK may pass on relevant data to the
competent authority. This includes, in particular, grades of internal examinations, data on participation in
the OSK's courses, payment modalities, data on any misconduct or untruthful statements. For more

§13 Miscellaneous: The contractual conditions and relations between the OSK and course participants are
subject to German law. The local jurisdiction of courts to be called upon is Lisbon.
§14 Right of withdrawal: You have the right to withdraw from this contract within fourteen days without
giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract. To
exercise your right of revocation, you must inform us by means of a clear declaration (e.g. a letter or e-
mail sent by post) of your decision to revoke this contract. You can use the attached sample withdrawal
form for this purpose, which is, however, not mandatory. To comply with the withdrawal period, it is
sufficient that you send the notice of exercise of the right of withdrawal before the expiry of the withdrawal
period. Consequences of revocation If you revoke this contract, we shall reimburse you all payments we
have received from you without undue delay and at the latest within fourteen days from the day on which
we received the notification of your revocation of this contract. For this repayment, we will use the same
means of payment that you used for the original transaction, unless expressly agreed otherwise with you;
in no case will you be charged any fees because of this repayment. The right of withdrawal shall also
expire prematurely in the case of a contract for the provision of services and in the case of a contract for
the delivery of digital content not on a physical data carrier if the Entrepreneur has provided the service
in full and has only begun to perform the service after the Consumer has given his express consent to this
and at the same time confirmed his knowledge that he will lose his right of withdrawal upon full
performance of the contract by the Entrepreneur. In the case of an off-premises contract, the consumer's
consent must be transmitted on a durable medium.

§15 Dispute resolution: The EU platform for out-of-court online dispute resolution can be reached at the
following Internet address: https://ec.europa.eu/consumers/odr/ (2) The provider is neither willing nor
obliged to participate in a dispute resolution procedure before a consumer arbitration board.
§16 Scope of the GTC and changes: 16.1 By booking a course, the customer agrees to the validity of the
General Terms and Conditions.
16.2 Any terms and conditions of the customer are not accepted without written confirmation of the
provider.
16.3 The General Terms and Conditions may be amended by the Provider.
16.4 Verbal side agreements do not exist.
§17 Severability clause: If any provision of these General Terms and Conditions is or becomes invalid,
the validity of the remaining provisions of these General Terms and Conditions shall not be affected. The
invalid provision shall be replaced by a provision that comes as close as legally possible to the intention
of the parties. The same shall apply in the event of a loophole.
