LD. SPECIAL JUDGE (PC ACT) (CBI)-18, ROUSE AVENUE

COURTS, DELHI AND INTERIM STAY OF THE PROCEEDINGS

ARISING OUT OF THE FIR NO.: RC-6(E)/2002-EOW-I/DLI.

MOST RESPECTFULLY SHOWETH :-

1. That the petitioners have filed the present application U/S. 482

Cr.P.C. for Summoning of Trial Court Records of the Criminal

 Case No.-06/2019 pending before the court of Ms. Jyoti Kler,

Ld. Special Judge (PC ACT )(CBI)-18, ROUSE AVENUE

COURTS, DELHI and Interim Stay of the proceedings arising

out of the FIR No. RC-6(E)/2002-EOW-I/DLI, in the interest of

justice, because if the investigation and proceedings are not

stayed by this Hon’ble Court; the very purpose of filing the

present petition shall stand defeated.

2. That all the other Prosecution witnesses have already been

examined before the trial court and Sh. K.G. Satyasinghan is

the last material witness only who remains to be examined as

per order dated 14/12/2022 (ANNEXURE-B) and as such a huge

irreparable loss and injury will be caused to the petitioner in the

event of stay not being granted by this Hon’ble Court.

3. That glaringly the balance of convenience is bent upon in the

favour of the petitioner for the grant of the stay as prayed for.

4. That the facts narrated in the annexed petition are not

repeated herein for the sake of brevity; which are prayed to be

read as part and parcel of the present application in the

interests of justice. Hence the Petitioner is filing this

Application.

PRAYER
In view of the facts and circumstances, it is most respectfully

prayed that this Hon’ble Court may graciously be pleased to:-

a) Summon the Trial Court Records of the Criminal Case No.-

06/2019 pending before the court of Ms. Jyoti Kler, Ld. Special

Judge (PC ACT) (CBI)-18, Rouse Avenue Courts, Delhi.

b) Stay the proceedings arising out of the Case No.-06/2019

pending before the court of Ms. Jyoti Kler, Ld. Special Judge

(PC ACT) (CBI)-18, Rouse Avenue Courts, Delhi and FIR No.

RC-6(E)/2002-EOW-I/DLI, in the interest of justice.

c) Pass any other and/or further orders as this Hon’ble Court may

deem fit and proper in the circumstances of the present case.
