August 2019. I have applied for renew on
oct2019 and after about 1month they have
issued the certiMcates, I,e on 30 nov19..now
the question is, am I eligible for NCL obc
post for a interview whose last date of
submission of documents is 15 nov19… as I
have got my issued certiMcate after 15 days
of last date though I have applied for it about
1 month back..

Hi Alam,
If your caste does not appear in Central List
of OBCs, then OBC certiMcate serves no
purpose! The certiMcate issued to you by the
authorities of your State may be valid for
posts in the State Govt. Just check-up
carefully, it may be BC certiMcate & not the
OBC one.

My query is am I eligible for NCL CertiMcate :-
1. My mother is an assistant teacher in a govt.
primary school (age 54, no promotions taken)
which comes under M.P. Govt. Her gross salary
including emoluments and allowances is
approximately 850000.

Hi Aman,
I presume that your father retired as Class C
employee from State Government. In case he
was promoted to Class A or B, I presume that he
was not promoted before the age of 40 years. I
also presume that he is not earning more than
Rs.8.00 Lakh per year from other sources
(excluding pension and agricultural income) for
the last consecutive three years. If my above
presumptions hold good, then I think, you are
entitled for Non-creamylayer OBC certiMcate.
Your parents’ income from only other sources,
e.g. bank interest, business etc. for the Mnancial
years 2015-16, 2016-17 & 2017-18 shall only be
taken into account for determining your creamy
layer status. Your and your spouse’s
status/income has nothing to do with issue of
this certiMcate.

I joined in government organization as a class II
OMcer and got promotion which is also class II
oZcer Post and presently working as a class 2
OZcer.My salary is 24 Lakhs per year . My wife is
home maker and does not have monthly income.
But my other source of income is 8500 per month
from house rent and interest earned from FD for
6 lakhs deposits (For my wife account) is around
45000. Putting Altogether other source of income
is 1.5 Lakhs.
Whether my children would be eligible for OBC

DEAR SIR,
My son in law was an All India Service OZcer
(IFS) who expired while in service on 08-09-2018,
leaving behind wife and only daughter. My Grand
Daughter is B.Tech Mnal and wishes to apply for
Civil services.
the following OBC ( NC)criteria may be examined.
i. My daughter and granddaughter are only two
members in the family and my daughter gets
family pension by central Govt and IT Payee for
A.Y 2017-18,2018-19 AND 2019-20.
ii.Excluding Central govt pension and agricultural
income her income is Rs.2,55,521, Rs.2,86,368
and Rs.3,02,105 respectively for AYs 2017-18,
2018-19 and 2019-20 as per IT Returns, forming
other sources income ,interest in come rental
income.
iii.Wealth tax in India was abolished by Govt.of
India w.e.f 28-02-2016. However, my daughter’s
net wealth is also less than Rs.30 lakhs, within
the exempted limit of wealth tax.
iv.My granddaughter being the daughter of an
OZcer under the category of Service Category,
Class I OZcers of AIS who died while on duty and
as exempted from creamy layer as per proviso
(a) to
II.Service Category of OM –
v. My granddaughter is applying for OBC Non-
creamy layer certiMcate.

I need some clariMcation regarding OBC non
creamy layer.
Before applying for OBC non creamy layer
certiMcate , I would like to clarify some doubts.
If you don’t mind , can you please clarify these
doubts.
1. I belongs to KURUBA Community/caste and
we are staying in urban area , Can I apply for OBC
certiMcate if, parents income is with in
limit.
2. For Computing annual income for OBC
certiMcate which of the following duration should
be considered.
(a) Income( from all the sources) from April to
march of Mnancial year should be added up. or
(b) Income( from all the sources) from January to
December of calendar year should be added up
3. My friend would like to apply/try for jobs in
public sector under OBC. Now he is in private
sector job. Now, For OBC, Total Income, should
he considered from parents alone his income
from private company should be added to
parents income.
4. As income limit is changing from time to time,
from Rs. one lakh to 2.5 lakhs, Rs. 2.5 lakhs to
4.5 lakhs, 4.5 lakhs to 6 lakhs etc
I would like to know, income limit changes and
corresponding years, starting from One lakh. ( I
mean ,income limit is amended from what limit to
what limit in Lakhs and corresponding years.)
5. When public sector jobs are called for oZcers,
in advertisement , when I am suppose to submit
OBC certiMcate as per Government directive/
Govt rules, if nothing is mentioned in the
advertisement
( i e when I am applying for the the post( by
submitting application online under OBC) or
when I am appearing for the interview or when I
am joining for the post ,if I got selected.)
6. when job is called for various posts in a
particular date, Is there any rule as per Govt that I
should obtain OBC certiMcate from Tasildar
before some speciMed date. If this is not
speciMed in the advertisement , what date should
I considered.
7. Is there any new amendments for persons in
urban areas of KURUBA community for OBC. If
So in which year. I mean , Persons in urban areas
of KURUBA community are eligible to apply for
OBC certiMcate or not . If not eligible , from which
year they are not eligible.
8. What is wealth limit for OBC non creamey layer
in terms of rupees and properties.
I request , please kindly clarify me, these doubts.

My father is an exservicemen and he got
recruited in central psu at the age of 41 as group
c oZcer. He got promoted to group b at the age
of 49.
His annual income from central psu is 6.2 lakhs.
His annual pension is 2.6 lakhs.
So cumulatively 8.8 lakhs.

I have a query
My father used to work in PSU Insurance and got
job under Class III i.e. clerical level.
He got promoted to Class I after age of 40.
Now he is retired.
Moreover our income is below 8 Lakhs P.A. and it
consists of pension only.

A/Class I OZcer after the age of 40 years, the
children are entitled to get the reservation.”

Hi Ankur,
First of all, you have not mentioned the
profession of your father. If he is in service
(Govt./PSUs/Private sector), then his salary
income will be ignored for determining your
Creamy Layer status and income from other
sources will only be taken into account. This
income should not exceed ₹8 Lakhs
consecutively for three years. Suppose you apply
for a job in the year 2020, then “consecutive three
years” means-
Financial Year 2016-17, 2017-18 & 2018-19. If
income from other sources falls below ₹ 8 Lakhs
in any one or two of these Years, then it makes
you entitled for Non-Creamy Layer OBC
certiMcate. Since, Creamy Layer status is liable to
change, hence the validity of the certiMcate is
normally treated as being one year. Therefore, it
is advisable to obtain fresh certiMcate just before
applying for a competitive exam. which is spread
over a year.

I am an obc from punjab belonging to the lohar
caste and my father was a bank clerk in bank of
india. According to the notiMcation issued by the
gov india i should be coming under the non
creamy layer, but the authorities at tehsil sri
hargobindpur in district gurdaspur are adamant
that the cumulative income of whole family
should be less than Rs.600000/-. I tried
reasoning with them but they outright rejected
my claim and said that i belong to the creamy
layer.
What option do i have to claim my right in this
case?

Hi Navneet Singh,
Your problem relates to lack of awareness on the
part of lower level bureaucracy. Even the N.C.B.C.
have recognised this . Clearias has put all the
relevant clariMcatory circulars on this
website.You can show these to the dealing
oZcials.It would be better if you directly
approach at least the S.D.M. of your Sub-
division.If he is not convinced, then you must
approach the D.C. of your district.
Since, your father has been/is in service as bank
clerk, therefore his income from salaries is to be
excluded from the purview of creamy-layer. Only
household income from other sources,e.g. bank
interest,house-rent received, income from trading
in shares etc. is to be counted. And, this income
from other sources should not exceed ₹8 lakh
p.a. for consecutive 3 years. I assume that your
mother is home-maker.
If you meet the above mentioned criteria, you
should deMnitely get your Non-Creamy Layer OBC
certiMcate.

lakh..if only parent’s income has to take it is less
than 8 lakhs..I went to patwari for the
certiMcate..He refused to give me certiMcate
saying that It doesn’t matter whether income is
from salary or any other source.. everything
counts..He also said that Gross family income is
counted before giving certiMcate and not only
parent’s income…do i belong to non creamy

10-1978(dob-13-04-1956).he was promoted to
oZcer on 02-02-1987 and he again got
promotion on 31-03-1995 and last promotion
was on 01-04-2007 as scale-3 oZcer.he retired

My son is going to attend JEE main exam in
February 2021 and we belong to OBC.
My husband was working as Director in a private
company with more than 25 lacs per annum
salary. He retired from service on 30/09/2020.
Now his monthly income from pension from
October 2020 is 5000 only.
You have mentioned as income from salary will
not be included for calculation of creamy layer.
His income from other sources are less than 8
lacs only.
I would like to know whether my son is eligible for
OBC NCL category for applying the JEE main
exam.

the income criteria.
One way the interpretation is that Salary and
agriculture income is not counted and not be
within the 8 lakhs income ceiling for NCL.If a
group C or promoter Group A,B oZcers aged 50
yeras and getting above 8 lakhs s gross salary
incl Basic Salary,+ HRA,DA,TA,is his Son get NCL.
Which part of the salary be counted as income?
Is it Basic salary only or all emoluments together
be taken go calc Annual Income.
Please gI’ve clariMcation on this by quoting the
rule position to get the NCL from Authorities.Your
reply /advice will
be helpful to many OBC s to get the NCL
CertiMcates by showing the GOI orders to the
Thahsildar.

Hi sir,
My mother got recruited in delhi Police in 1989 as
a constable and after her 31 years of service she
has attained the post of sub inspector. Her
current salary is 60k per month. My father joined
indian army as sepoy and retired as Naik in 2003,
after which he joined as driver in Tata motors
earning 25-30k per month from then till now. So
he has his pension as well which is around 24k
per month.
I’m a resident of Delhi and residing in delhi since
1990. I belong to Jaat community, as I am
residing before 1993 am I eligible for falling
under the OBC category, and also i would like to
know that if UPSC considers OBC of NCT Delhi
non creamy layer in their eligible OBC candidates.
It would be really helpful if I could borrow your

My parents are central govt servants. Father has
retired. I am preparing for various govt exams.
Since recruitment comes from time to time, they
stress on getting obc certiMcate for that year
based on income of three previous Mnancial
years but as we know, the non creamy criteria for
govt servants is NOT decided on the basis of
salary, rather their cadre/group. So, how can I
keep updating my OBC everytime for claiming
reservations in jobs? Please clarify. I am very
confused. Any advice would be highly
appreciated.
