CREATING THE DEVOLUTION TRANSITION COMMITTEE OF THE BARANGAY


LUMBAAN-BICBICA, PINILI, ILOCOS NORTE

WHEREAS, the implementation of the Supreme Court Ruling on the Mandanas-Garcia petitions
gave the Local Government Units additional financial resources from their just
share of national taxes in accordance with Section 6, Article X of the 1987
Philippine Constitution;

WHEREAS, the substantial increase in the shares of Local Government Units from the
national taxes makes them more capable of providing the basic services and
facilities called for under Section 17 of the Local Government Code of 1991
that will impact on the lives of our constituents;

WHEREAS, with the substantial increase in financial resources, there is the need of
aligning the LGU structure, capabilities and other mechanisms to ensure the
optimal use of resources for a better service delivery to the constituents;

WHEREAS, to ensure the funding of basic services and facilities devolved, Section 5 of
Executive Order No. 138 mandates the national government and Local
Government Units to prepare their respective Devolution Transition Plans (DTPs)
which conform to the guidelines of the Department of Budget and Management and
the Department of the Interior and Local Government;
WHEREAS, pursuant to Section 15 of the Implementing Rules and Regulations (IRR) of
Executive Order No. 138, s. 2021 re: Full Devolution of Certain Functions of
the Executive Branch to Local Governments, Creation of a Committee on
Devolution, and for other Purposes, all Local Chief Executives shall organize
their LGU Devolution Transition Committee (DTC).

NOW, THEREFORE, I, FE M. TIRO, Punong Barangay of Lumbaan-Bicbica, Pinili, Ilocos


Norte by virtue of the powers vested in my by law, do hereby order the following:

SECTION 1. Creation of the Barangay Devolution Transition Committee. The Barangay Devolution
Transition Committee is hereby organized with the following composition:

SECTION 2. Duties and Functions of the Local Devolution Transition Committee. The Local
Devolution Transition Committee shall perform the following functions:

1) Prepare the LGU’s Devolution Transition Plan in consideration of the following;


a) Coordinate with concerned NGAs of their respective devolved services to LGUs
based from their respective approved Agency Devolution Transition Plans;
b) Adopt strategies for the LGU’s capacity development and an organizational
effectiveness as part of the devolution efforts;
c) Consult with concerned NGAs and other resource institutions for technical assistance
in the preparation of the DTP;
d) Create Technical Working Groups for the different areas of concerns in the
formulation of the LGU Devolution Transition Plan.
2) Indorse to the sanggunian for the approval of the LGU Devolution Transition Plan;
3) Submit to concerned NGAs the approved LGU Devolution Transition Plan;
4) Monitor the implementation of the approved LGU Devolution Transition Plan and make
necessary adjustments with the approval of the sanggunian and furnish copies of the
amended plan to the concerned NGAs;
5) Develop a strong communications plan and pursue strategies to effectively inform the
public, as well as other stakeholders, of the LGU Devolution Transition Plan;
6) In coordination with concerned NGAs, adopt mechanisms to ensure continuous delivery
of public services during the transition period to full devolution;
7) In order to effectively carry out the functions, create sub-committees; and
8) Perform such other functions as maybe required by higher authorities.

SECTION 3. Role of Non-Government Organizations (NGOs), Civil Society Organizations


(CSOs), and People’s Organizations (POs). In accordance with Sections 34 and 35 of the Local
Government Code of 1991 and Article 62 of its Implementing Rules and Regulations, the LGUs
shall recognize the roles of NGOs, CSOs/POs in enhancing transparency, accountability, and
good governance, and as active partners in pursuit of local autonomy, particularly, but not
limited to, the following:

a) Providing feedback on programs, activities, and projects of the government;


b) Pushing for various advocacies and initiatives;
c) Formulating plans, policies, and issuances; and
d) Implementing capacity development programs and other activities.

SECTION 4. Funding. An amount necessary to carry out the functions, subject to availability
thereof, and existing budgeting, accounting, and auditing laws, rules and regulations shall be
utilized for such purpose.

SECTION 5. Separability Clause. Should any part or provision of this order be held
unconstitutional or invalid, the other parts or provisions not affected thereby shall continue to be
in full force and effect.

SECTION 6. Effectivity. This Executive Order shall take effect immediately.
