ALTERATION
Construction involving changes in the materials used, partitioning,

Administration & Enforcement

Secretary of the DPWH

Duties:
1. Formulation of policies, plans, standards and guidelines (code-
compliant)
2. Memorandum circulars for implementation of Code
3. Exercise of appellate jurisdiction over decisions of OBO
4. Evaluation and approval of amendments to referral codes
5. Setting/imposing fees that the OBO may collect
6. Appointment of Building Officials in all cities and municipalities

Qualifications:
1. Filipino citizen, good moral character
2. Architect or civil engineer
3. Member of duly accredited organization of their profession for at
least 5 years
4. At least 5 years of diversified and professional experience in
building design and construction
5. Has attending a seminar workshop on PD 1096 conducted by the
DPWH

Duties:
1. Tasked with enforcement of the Building Code in their
jurisdictions, with guidance from the Secretary
2. Has overall control over works pertinent to buildings & structures
3. Undertakes annual inspection of buildings
4. Issuance, non-issuance, suspension, revocation of building &
occupancy permits
5. Work stoppage orders
6. Declaration of a building as dangerous
7. Imposition of fines and penalties

The DPWH Secretary prescribes the rates of fees, guidelines on fees

The Building Official collects the fees


• Maximum of 20% will be retained by the OBO for expenses of
their office
• Remainder will be remitted to LGU

A dwelling intended for the use by one family…

Maximum amount that secretary may impose is Php10,000
• Light violations: Php5,000
• Less grave violations: Php8,000
• Grave violations: Php10,000

In addition to the fine, the violator must correct/remove his violations


at his own expense.

Any person, firm or corporation who shall violate any of the
provisions of the Building Code shall upon convictions, be punished
by a fine of not more than Php20,000 or by imprisonments not more
than 2 years or both

A written authorization from the Building Official to proceed with
work (construction, demolitions, alteration, renovation, etc.) issued to
an applicant only once the plans, specifications, and other pertinent
documents are found to be satisfactory and substantially conforming
with the Building Code

Article 1723 of the New Civil Code states:

The engineer or architect who drew up the plans and specifications


for a building is liable for damages if within 15 years from the
completion of the structure, the same should collapse by reason of a
defect in those plans and specifications, or due to the defects in the
ground

Article 1723 of the New Civil Code states:

The contractor is likewise responsible for the damages if the edifice


falls, within the same period, on account of defects in the
construction or the use of materials of inferior quality furnished by
him, or due to any violation of the terms of the contract

If the engineer or architect supervises the construction, he shall be


solidarily liable with the contractor

Article 1723 of the New Civil Code states:

Acceptance of the building, after completion, does not imply waiver


of any of the cause of action by reason of any defect mentions in
preceding paragraphs.

The action must be brought within 10 years following the collapse of


the building (Prescription Clause)
