APPLICATION OF AGRICULTURAL FREE PATENT

Documentary Requirements (to be secured by applicant)

1. Duly accomplished Application Form (SPA, in case the application is filed by a representative)
2. Application Fee of Php150.00
3. Documentary Stamp Tax
4. Certified True Copy of Tax Declaration in the name of the applicant
 If TD is in the name of the predecessor-in-interest, present any of the following:
i. Deed of Sale
ii. Extra Judicial Settlement of Estate
iii. Waiver of Rights
iv. Deed of Donation or other form of muniments of ownership
5. Certification of the status of the land from LRA
 In case where the subject land is covered by a Cadastral Subdivision Plan (CSD), LRA
Certificate is waived provided that the applicant indicates in the application that no
petition for judicial titling has been filed.

Documentary Requirements (to be secured by CENRO)

1. Copy of approved survey plan / cadastral map


2. Technical descritopm / V-37
3. A&D Certification

Procedures:

1. Preliminary Assessment by Regulation and Permitting Section (RPS) of the CENRO prior to
endorsing to the records officer.
2. Acceptance of the Application
 Upon submission of complete documentary requirements, the application is forwarded
to the Records Officer. Applicant will get an SMS acknowledgement receipt.
3. Posting of Notice
 The CENRO shall post notices for 15 days in the municipal building and barangay hall
where the land applied for is located.
4. Inspection / Investigation
 Land investigator shall prepare the investigation report within 3 days and geo-tagged
photographs shall be part of such report.
5. Preparation of Judicial Form and other Forms
 CENRO shall prepare JF including V-37, Certified lot data computation and the Order of
Award. All these forms part of the carpeta.
6. Endorsement of the Application to PENRO / RED / Secretary
7. Review, evaluation, and approval/disapproval of application
 In case the application is disapproved, an Order shall be issued and shall be furnished to
the applicant.
8. Issuance of the Free Patent
9. Transmittal to the Registry of Deeds
