PROPOSED ORDINANCE NO. _____ - 2023

AN ORDINANCE ADOPTING THE CITY DISASTER RISK REDUCTION & MANAGEMENT PLAN OF THE CITY OF
MASBATE FOR FISCAL YEAR 2021-2025, AND PROVIDING FUNDS THEREOF AND FOR OTHER PURPOSES
WHEREAS, Section 16 of Republic Act No. 7160, otherwise known as “The Local Government Code of 1991” provides
that, “every local government unit shall exercise the powers expressly granted, those necessarily implied
therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective governance,
and those which are essential to the promotion of the general welfare”;
WHEREAS, Republic Act No. 10121, otherwise known as the Philippine Disaster Risk Reduction and Management Act
of 2010, provides to strengthen the institutional capacity for disaster risk reduction management including
the local government units (LGUs);
WHEREAS, the National Risk Reduction and Management Council (NDRRMC) sets goals on four (4) thematic areas in
the attainment of the country’s overall DRRM vision (1) Disaster Preparedness; (2) Disaster Response; (3)
Disaster Prevention and Mitigation and (4) Disaster Rehabilitation and Recovery to which the LGUs should
adopt to complement and effective preparation and response from any calamities or disasters that may
strike anytime;
WHEREAS, to further strengthen the capacity of the local government to mitigate and manage any disaster, the City
Government together with the City Disaster Risk Reduction and Management office is mandated by the City
Ordinance No. 161-14, or Disaster Risk Reduction and Management Code of the City of Masbate to
formulate a responsive and strategic Disaster Risk Reduction and Management Plan and Programs which
will served as the blue print for the city’s prevention, mitigation, preparedness, and response protocols in the
event of disaster to minimize destructive effects of disaster within the city;
WHEREAS, pursuant to the same Code, specifically Article III, Section 11 ( c ), the City Disaster Risk Reduction and
Management Plan of the City shall be approved by the City Disaster Risk Reduction and Management
Council and shall be submitted to the City Development Council to ensure its integration in the city
development plans and budgets;
WHEREAS, the 8th City Council deemed it necessary and appropriate to adopt and approve the City Government of
Masbate City Disaster Risk Reduction and Management Plan, hence, this resolution;
NOW THEREFORE BE IT ORDAINED by the Sangguniang Panlungsod of the City of Masbate in session duly assembled,
that:
SECTION 1. Title. This Ordinance shall be known as the “City Disaster Risk Reduction & Management Plan of the City of
Masbate for Fiscal Year 2021-2025”
SECTION 2. City Disaster Risk Reduction and Management Plan. The City Disaster Risk Reduction and Management
Plan for FY 2021 to 2025 of the City Government of Masbate is hereby adopted for effective implementation
thereof, and hereto attached as “Annex A”, and made an integral part of this ordinance.
SECTION 3. Repealing Clause. All previous ordinances, executive orders, rules, and regulations or parts thereof which
are inconsistent with this ordinance are hereby repealed or modified accordingly.
SECTION 4. Separability Clause. If any provision/s of this Ordinance or the application of such provision/s to any person
or circumstances is declared invalid, the remainder of the Ordinance or the application of such provision/s to
other person/s or circumstances shall not be affected by such declaration.
SECTION 5. Effectivity Clause. This Ordinance shall take effect after compliance of the publication requirement as
provided for under Republic Act No. 7160 or the “Local Government Code of 1991”.
