Change of Signatories 4 PREAMBLE We, the members of Entrepreneurship students of Obafemi Awolowo University, having firmly and solemnly resolved: to live in unity and harmony as one indivisible and indissoluble body under God, dedicated to the promotion of Entrepreneurship students solidarity. And, to provide a constitution for the purpose of promoting good governance and welfare of all students of Entrepreneurship Department in Obafemi Awolowo University on the principle of Justice, Fairness and Professional ethics. And for the purpose of consolidating the unity of all Entrepreneurship student across universities, do hereby, enact and give to ourselves the following constitution. ARTICLE I (GENERAL PROVISIONS) S.1 PROCLAMATION OF NAME Entrepreneurship students of Obafemi Awolowo University shall form and belong to one indivisible and indissoluble body called INSTITUTE FOR ENRREPRENEURSHIP AND DEVELOPMENT STUDIES STUDENT ASSOCIATION Hereafter refers to as IFEDSSA and its members shall be referred to as IFEDSSIT(S). S.2 MOTTO The motto OF INSTITUTE FOR ENRREPRENEURSHIP AND DEVELOPMENT STUDIES STUDENT ASSOCIATION shall be “Entrepreneurship, a profession of creativity, innovation and uniqueness”. S.3 EMBLEM Our Emblem shall be a blue 10 sided polygon and OAU LOGO at the center, round with the department name. S.4 SUPREMACY OF THE CONSTITUTION (i) This constitution is supreme and its provision shall be bidding on all members of the association. (ii) The constitution shall be amended or replaced only in accordance with its provision 5 (iii) Any other law that is inconsistent with the provisions of this constitution, shall to the extent of its consistency be regarded as null and void S.5 PRINCIPLES IFEDSSA in pursuit of the aims and objectives stated in section 6 below shall act in accordance with the following principles; (i) Consultation with members and lecturers in the Department (ii) Democracy as expected of every civilized society (iii) Intellectual analysis of issues in other to promote understanding (iv) Eradication of act(s) of indiscipline such as promotion of disorder, physical conjunction and such other acts could be seen as unbecoming of a future Entrepreneur S.6 OBJECTIVES (i) To represent the overall interest of the Entrepreneurship student of Obafemi Awolowo University on all matters (ii) To promote, guide and protect the interest of members of Entrepreneurship student of Obafemi Awolowo University on all matter. (iii) To mobilize members for the purpose of self-development, skill acquisition, intellectual and cultural enhancement. (iv) To contribute our noble Quota to the stability, growth and development of Nation. (v) To organize social gathering for member such as welcome and end session parties (vi) To undertake any activities deemed necessary for the advancement of the association. (vii) To ensure the upliftment of the name of the department in whatever manner the association may deem fit. (viii) To foster unity, promote understanding and ensured sustainable relationship among the members of the association. (ix) To promote welfare of IFEDSSA 6 S.7 MEMBERSHIP (i) All students of Entrepreneurship shall be a registered and financial member of IFEDSSA (ii) Without prejudice to (i) above, all Entrepreneurship students must pay association’s dues. (iii) Honorary member may be conferred by the 2/3 majority of the House on deserving lecturer/Alumnus in Public life that has shown positive interest in the affairs of the association and the department in general. (iv) Without prejudice to (iii) above, the nomination for Honorary membership shall be made by the Executive Council while suggestion can be made by the parliament. The nomination and/or suggestion must pass through the parliament to the congress for approval. S.8 DRESS CODE AND GENERAL DISCIPLINE The Student of INSTITUTE FOR ENRREPRENEURSHIP AND DEVELOPMENT STUDIES STUDENT ASSOCIATION shall: (i) Be in formal dressing from Monday to Wednesday and decent casual dressing on Thursday and Friday. (ii) With respect to (i) above, any dress code contrary to the provision shall stand punishable by not being allowed to stay in class, shall return home immediately to redress and report to the lecturer every day of the week. (iii) Vandalisation of the department’s property of any kind by individual(s) or collective action of the class in case of a cover-up to find the perpetuator of the act, the individual or the class shall be liable for the repair of the damaged property. 7 ARTICLE II (THE LEGISLATIVE) S.9 EHP Subject to the provision of this constitution, the legislative power of the association shall be vested in the Entrepreneurship House of Parliament (EHP), which shall consist of Honorable. The Entrepreneurship House of Parliament (EHP) shall be referred to as “The House” S.10 COMPOSITION OF THE HOUSE (i) The House shall compose of Honorable made up of 18 students from all the constituencies of the department of Entrepreneurship. (ii) The composition of the House shall be as follow: (a) 5 representatives from each constituency; except (b) Part 1 which shall have 3 representatives S.11 FUNCTIONS OF THE HOUSE (i) The House shall have power to make laws and regulations for the peace, order and good running of the association. (ii) The House shall consider and approve budget proposal from the executive council. (iii) The House shall consider the budget proposed by the Executive Council within one month of new academic session (iv) The House shall have power to summon the whole or any member of the executive or committee to appear before it in connection with specific matter(s), provided not less than forty-eight hours notice given to the officer(s) (v) Subject to (iv) above, failure to respond to such summon shall be regarded as CONTEMPT on the House and shall be reported to the relevant authority/committee for appropriate disciplinary actions in the House. (vi) The House shall have power to pass resolution on any matter affecting Entrepreneurship students in Obafemi Awolowo University in so far as such resolution do not conflict with this constitution. (vii) Such resolution shall be forwarded to the President for implementation and shall within a time frame stipulated by House implement such resolution(s). 8 (viii) The House shall summon the President if he refuses to implement resolution at the expiration of the stipulated time to explain the reason(s) for his refusal to implement such resolution(s); if such resolution is again passed by 2/3 majority of members of the House, it shall became binding on him for implementation. (ix) The House may review any action or programme proposed by the executive council or any committee of the association or any member thereof. (x) The election of the electoral commission for transitional programmes shall be subjective to the approval of the house. (xi) Shall approve all external functions and ratify the delegate as nominated by the executive council. (xii) The House shall have power to regulate its proceeding including procedures for summoning and recess of the House. (xiii) Every members of the House must always report and ask his constituency members in general their demands and needs at least twice in a semester. (xiv) The House shall do other thing(s) that shall guarantee the meaningful attainment of the aims and objective set out in the preamble and section of this constitution. S.12 OFFICERS OF THE HOUSE (i) All officers shall be elected by the members of the House themselves. (ii) The speaker – Open to part 3 students at all time of election and who must have been in the House for at least a term. (iii) Deputy Speaker: Open to part 2 students at the time of election and who must be in the House for at least a term already. (iv) The Clerk: Open to part 1 & 2 student at the time of election. (v) The Chief Whip: Open to part 2 and 3 student as at the time of election. S.13 DUTIES AND POWER OF OFFICERS (i) THE SPEAKER (a) Speaker shall summon (via the clerk) and preside over all sittings of the House. (b) Shall at the sitting of The House interpret the constitution with good faith 9 (c) Shall declare vacant the seat of member who absent himself for more than two consecutive sittings without the speaker’s prior permission subject to the approval of the House. (d) The speaker shall at the request signed by the 2/3 majority of the House mandate the President to call a special Congress within a stipulated time. (e) Shall cast a vote whenever there is a tie. (f) Shall swear in any officer after dissolution of the electoral commission. (g) Shall have the power to pronounce the end of parliamentary year by dissolving the House (ii) THE DEPUTY SPEAKER (a) Shall assist the speaker from time to time in the discharge of his duties and perform all duties of the speaker in the speaker absence. (b) Shall be responsible for conducting in-House elections. (c) Shall be elected by members of the house among themselves (d) Shall perform any other duties as required by the House iii. CLERK (a) Shall be responsible for taking proper minutes during the sittings of the House (b) Shall prepare in advance the agenda for all the sitting of the House and publicize them as appropriate. (c) Shall publicize all resolution of the house within 48 hours of such resolution with the consent of the speaker. (d) Shall keep proper financial records of the House (e) Shall keep register at every sitting of the House (f) Shall receive correspondence on behalf of the parliament (g) Shall perform any other duties related to his office. (iv) CHIEF WHIP (a) Shall maintain discipline and decorum in the House on the advices of the speaker. (b) Shall in consultation with the speaker send out any member or observer who in his opinion has misconduct himself through disregard to the rules of the House. 10 (c) Shall on order of the Speaker send out and call in any member of galleria who has misconduct him/herself through disregard to the rules of the House. (d) Shall be the chairman of the Ethics and Disciplinary committee. S.14 QUORUM (i) 2/3 majority members including at least 2 officers shall form the quorum at an ordinary sittings of the House (ii) At least 5 members including the speaker shall form the quorum at an emergence sitting of the House. S.15 PLENARY SITTINGS (i) The House shall convene to transact business at least once in every month in the semester with exception to examination periods. (ii) It shall meet at least three times in a semester S.16 EMERGENCY PLENARY (i) A special or emergency sitting of the House shall be convened on the order of 7 members (ii) Subject to the provision of (i) above, a notice supporter by not less than 5 members of the House shall be laid before the speaker. S.17 CONSTITUTIONAL (PROGRESS) REPORT (i) Honorable shall report back to their respective constituencies of the decisions and resolutions reached on the floor of the House and ask for their demands and needs to be addressed at the floor of the house through their consistency leader at least twice in a semester. (ii) Honorable shall ask for their demand and needs which should be address in a semester. S.18 PARLIAMENTARY DRESS CODE (i) The dress code shall be Formal. All Honorable shall be required to observe this code. 11 (ii) Without prejudice to (i) above, formal dress code includes a shirt and trouser with a tie or native attire with a cap and female Honorable dressed in a shirt/blouse skirt and shoes to match. S.19 PASSAGE OF BILLS (i) A bill shall not become a law unless it has been duly passed by 2/3 majority of Honorable and shall be presented to the President for assert. (ii) Where a bill is presented to the President for assent, he shall within three days thereof sign the bill or withholds his assent. (iii) Where the President withholds his assent, the House shall forward the bill to the congress for approved by 2/3 majority of congressional members. (iv) A bill can be sponsored by any organs of the Association and be presented to the floor by a member of the parliament. S.20 HOUSE COMMITTEES (i) BUDGET AND FINANCE (a) Monitoring and ensuring the proper implementation of the budget (b) Shall firstly seat on proposed budget (c) Shall give advice on expenditure (d) Any other functions as may be required by the House (ii) EDUCATION AND LIBRARY (a) Shall monitor and assist the Academic and Editorial Committee in carrying out their duties efficiently. (b) Shall monitor the library activities of the association (c) Shall discharge any other function as may be required by the House. (iii) ETHICS AND DISCIPLINARY COMMITTEE (a) The Committee shall composed of six (6) members of the association which shall be headed by chief whip. (b) Shall effect disciplinary actions on any member or among the executive as directed by the House. 12 (c) Shall see to all cases of all sorts of misconduct and misappropriation and thereafter propose effective punishment for the offender(s) subject to the parliament. ARTICLE III (THE EXECUTIVE) S.21 EXECUTIVE POWER (i) The executive power of the Association is hereby vested in the executive council, and subject to the provisions of this constitution, such power may be exercised by members of the executive council either directly or through offices subordinate to them. (ii) The Executive powers of the Association shall extend to the maintenance of this constitution and all matters except with the respect to which the PAHP has powers to make rules and regulations. S.22 COMPOSITION OF THE EXECUTIVE CONCIL (i) The President (ii) The Vice President (iii) General Secretary (iv) Assistant General Secretary (v) Financial Secretary (vi) Treasurer (vii) Public Relation Officer (viii) Sport Director (ix) Social Director (x) Welfare Director (xi) Librarian (xii) Public Liaison Officer (xiii) Ex-Officio. 13 S.23 FUNCTIONS AND DUTIES OF THE EXECUTIVE OFFICERS (i) PRESIDENT (a) President shall be the first member of the association and head to both the executives and association. (b) Shall represent or delegate to executive member(s) the authority to represent the association in any official engagement within and/or outside the university (c) He shall attend the first meeting of the House of Parliament (d) Shall present the association budget to the House of Parliament (e) Shall summon all executive meetings and Congresses in consultation with the General Secretary preside over such meetings (f) Shall present the annual report of the executive stewardship in writing and circulate to all members of the association at least two weeks to the expiration of his tenure (g) He shall be responsible for the co-ordination of activities of the other members of the Executive council. (h) He shall have power to refer disputes and matter(s) burdening on indiscipline of any member of the executive council to EHP. (i) He shall be one of the signatories to the Association’s bank account (j) He shall maintain decorum during executive meetings and congresses in accordance with the Standing Orders (k) He shall not vote at any meeting except when there is a tie. (l) He shall preside over executive and congressional meetings (m) He shall discharge any other duties that are reasonably incidental to his office. (ii) VICE PRESIDENT (a) Shall corporate and assist the President in the execution of his duties (b) Shall act for the President in his absence or if he is incapacitated, suspended or impeached (c) Shall be responsible for the welfare of the quest of the association. (d) Shall be the chairperson of the Academic Committee. 14 (e) Shall coordinate under the supervision of the executive the orientation program for fresh students (f) Shall be responsible for the recommendation of registration of student’s societies, clubs and organizations within the association to the appropriate university organs (g) Shall discharge all such duties that are reasonably incidental to his office. (iii) THE GENERAL SECRETARY (a) Shall conduct and deal with all official correspondence of the association (b) Shall summon meetings of the executive and congress on the order of the President (c) Shall keep minutes and records of such meetings in (b) above (d) Shall give notice of all general and executive meetings at least 24 hours prior to the meetings except on emergencies. (e) Shall see to the registration and renewal of the registration of the association with the student affairs office. (f) Shall in consultation and with the approval of the executive council compile a comprehensive report of the activities of the executive for that session and present same to the EHP at its last meeting during the session upon receipt of notice from EHP not less than 72 hours before the sitting. (g) Shall discharge all such duties that are reasonably incidental to his office. (iv) THE FINANCIAL SECRETARY (a) Shall co-ordinate the collection of annual dues, donations and all monies on behalf of the association. (b) Shall in collaboration with the executive, prepare and submit annual budget to the EHP for approval provided that such budget proposal is sent to the EHP at least 48 hours before it is table for discussion at the EHP. (c) Shall ensure that all receipt issued are serially numbered for proper auditing. (d) Shall keep detailed account of income and expenditure of the Association and make account books of the association available to the House of Parliament at least once in a semester as requested by the EHP 15 (e) Shall submit (d) above to the Audit Committees as at when demanded. (f) Shall be a member of all committee in order to give them financial advice. (g) Shall hand over all the financial books and all monies received on behalf of the Association to the treasurer within 24 hours of such collection (h) Shall be one of the signatories to all financial matters of the association. (i) Shall keep receipt showing expenditure and issue receipt for the income of the association. (j) Shall perform any other duties that are reasonably incidental to his offence. (v) TREASURER (a) Shall be the custodian of the Association’s money (b) Shall accept all money from the financial secretary and deposit such in the Association’s bank account not later than 2 working days after such collections are made. (c) Shall make payment on behalf of the Association as approved by the executive and obtained receipt for such payment. (d) Shall keep the Association’s bank passbook(s) / cheque book (e) Shall keep the impress account of N1000 at a time subject to proper accountability. (f) Shall be one of the signatories in all financial matters of the Association. (g) Shall assist the financial secretary in preparation of the Association budget and other financial statement. (h) Shall perform any other duties that are reasonably incidental to his office. (v) PUBLIC RELATION OFFICER (a) Shall be responsible for the publicity of all Association’s activities within and outside the university. (b) Shall make available to the Librarian all publicity work for record purposes. (c) Shall liaise between the members and recognized professional bodies especially in matters relating to the student’s registration. (d) Shall be the chairman of Editorial Committee/board 16 (e) Shall recommend to the executive council, members who he deemed fit to be in the Editorial Board subject to the approval of the EHP. (f) Ensure that the notice of congressional meeting is out at least 3 days to the date of the meeting or congress (g) Make release with a view at correcting any erroneous impression held by any person or group of persons against any member of the association for purpose of shaping good image of the association. (h) Shall perform any other duties that one reasonably incidental to his office. (vii) SOCIAL DIRECTOR (a) Shall be the chairman of Social Committee (b) Shall be responsible for all social activities of the association. (c) Shall promote the association’s culture and social heritage. (d) Shall arrange and coordinate all excursions and tour undertake by the association. (e) Shall perform any other duties that are reasonably incidental to his office. (viii) SPORT DIRECTOR (a) Shall be the chairman of Sport Committee (b) Shall responsible for all sport activities of the association. (c) Shall liaise with other departments to promote the development of sport organized by different department (d) Shall cater for all indoor games of the association and shall organize open and outdoor competition at least once in every semester (e) Shall perform any other duties that are reasonably incidental to his office. (ix) WELFARE DIRECTOR (a) Shall see to all academic welfare of members such as counselling, advice on CGPA, organizing tutorial etc. (b) Shall work in close relationship with the Vice President and Librarian to carry out all academic affairs of the association. (c) Shall keep all the Association Properties (Asset) (d) Shall see to the well-being of the members of the Association. 17 (e) Shall assist in the catering for the welfare of Associations guest (f) Shall perform any other duties that are reasonably incidental to his office. (x) ASSISTANT GENERAL SECRETARY (a) Shall assist the General Secretary in the discharge of his duties (b) Shall take up the duties of the General Secretary in his absence. (c) Shall keep records of attendance of executive and congressional meetings (d) Shall discharge all such duties that are reasonable incidental to his office. (xi) LIBRARIAN (a) Shall be the chief custodian of the Association’s library and be responsible for the upkeep of the library assets. (b) Shall keep record of usage and movements of the library’s textbooks, Journals, periodicals etc. (c) Shall recommend for the update and improvement of the library’s condition and textbooks from time to time to the executive council (d) Shall perform any other duties that are reasonably incidental to his office. (xii) PUBLIC LIAISON OFFICER (a) Shall be an assistant to the Public Relation Officer (b) Shall be an assistant to the Librarian (c) Shall liaise between the students of part 1 and executives on the matters relating to the department. (d) Shall perform any other duties that are reasonably incidental to his office. (xiii) EX-OFFICIO (a) There shall be two ex-officio members to be appointed from past elected officers of the association, who are no longer holding any elective office. (b) The appointment shall be based on nomination by the executive subject to the approval of the House. (c) They shall both be members of the executive and parliament of past administration (d) They shall function in advisory capacity for the executive and perform other duties as designated by the executive council. 18 (e) They shall also deliberate and vote in executive meetings. S. 24 COLLECTIVE RESPONSIBILITY (i) Members of the Executive council shall be collectively responsible for the official decisions and activities of the council and shall be answerable to the EHP and the Congress. (ii) Nothing in this constitution shall prevent any officer from being liable for his individual culpable act(s) or omission(s) in the performance of his duties for which he is elected, as may be determined by the EHP. ARTICLE IV (STANDING COMMITTEES) S. 25 STANDING COMMITTEE The following are the standing committee of the Association. (i) Social Committee (ii) Academic Committee (iii) Sport Committee (iv) Fund Raising Committee (v) Audit Committee (vi) Editorial Committee S.26 FUNCTIONS AND COMPOSITIONS OF THE STANDING COMMITTEE (i) SOCIAL COMMITTEE (a) Shall be 12 members committee from all levels (b) The social director shall be its chairman (c) The committee secretary shall be elected by its members (d) The Vice President shall be its member (e) The welfare director shall be its member (f) The public liaison officers shall be its member (g) Two members from each class specifically Mr. and Miss IFEDSSA from part 1 (h) Shall be responsible for organizing the association’s week, welcome ceremony for fresh students and all social activities of the association. 19 (ii) ACADEMIC COMMITTEE (a) Shall be a 7 members committee from all levels (b) The Vice President shall be its chairperson (c) The committee secretary shall be elected by its members (d) The welfare Director shall be its member (e) The Public liaison officer shall be its member (f) A member from all constituencies (g) Shall see to the academic wellbeing of every member of the association (h) In pursuance of (g) above, shall engage in the dissemination of past question papers, organization of effective tutorials and any other means it deems fit (i) Shall in collaboration with the executive council, organize seminar, symposium workshop relating to overall academic development of members. (j) Without prejudice to the provisions of this section, members many request for the assistance of any member what they (members) deem fit to be competent enough. (iii) SPORT COMMITTEE (a) Shall be a 6 members committee from all levels (b) The sport Director shall be its chairman (c) The committee secretary shall be elected by its member (d) The public Liaison officer shall be its member (e) Shall have a member from each constituency (f) Shall see to the welfare of the sport men and women in the association (iv) FUND RAISING COMMITTEE (a) The Financial Secretary shall be its chairman (b) The President shall be its member (c) The Treasurer shall also be its member (d) The Committee shall be appointed at the discretion of the chairman of the chairman subject to the approval of the House. (e) Shall be in charge of raising fund (f) All monies raised shall be paid directly to the association bank account. 20 (v) AUDIT COMMITTEE (a) Shall be a 9 (nine) member committee and its composition shall be of 3 members from each class (part 4, 3 and 2) with the exclusion of part 1 (b) The class Governor in conjunction with his Assistant shall at the request of the President appoint persons of unquestionable integrity; not being a member of EHP or Executive. (c) Its formation shall be at most 7 weeks in second semester. (d) Its chairman shall be from part 3 or part 4 student (e) Shall make available its report at the last congress of the association (f) Without prejudice to (b) above, this appointment shall be subjected to the approval of the House. (g) Shall have a lecturer as its external body. (vi) EDITORIAL COMMITTEE (a) Shall be a 10 member committee from all levels (b) The PRO shall be its chairman (c) The committee shall elect any other post(s) deemed necessary by it e.g the Editor, The Deputy Editor, Secretary etc. (d) Shall be responsible for the regular education and information publications and that of official Journal of the Association (e) Shall organize political debates for aspirants in conjunction with the Electoral Commission. ARTICLE V (ELECTORAL ACT) S.27 ELECTORAL COMMISSION There shall be an Electoral commission responsible for the conduct of IFEDSSA election. S.28 COMPOSITION OF ELECTORAL COMMISSION The Electoral commission shall consist of seven electoral officers, two from each parts with exception to part one which shall have one member. 21 S.29 FUNCTIONS OF ELECTORAL COMMISSION (i) It shall be responsible for the conduct of elections into the Executive Council and House of Parliament as well as EHP Principal Officers’ election. (ii) It shall screen members intending to contest for electoral position (iii) It shall educate electorates and candidates vying for elective post on the details of electoral procedures. S. 30 ELECTION OF ELECTORAL COMMISSION (i) The Executive Council shall under the supervision of the House of Parliament conduct the election of Electoral Officers from each class (ii) With respect to sub section (i) above, the method of voting shall be by raising of hands (iii) The members of the Electoral Commission shall within themselves elect the chairman and secretary provided that the chairman comes from part 4 and the secretary from part 3. (iv) The Election of the members of Electoral Commission shall be held at least a week before the last congress. S.31 DURATION OF THE ELECTORAL COMMISSION (i) The Electoral Commission shall be officially constituted the day ban of election’s campaign is lifted. (ii) It shall stands dissolved immediately after the swearing in of members of both the Legislative and Executive Council. S.32 ACCOUNTABILITY (i) The Electoral Committee shall submit detailed electoral activities including how money were spent to the speaker immediately after being dissolved. (ii) Such electoral activities submitted shall be included into the agenda of the first meeting of the House for scrutiny. S.33 ELECTORAL GUIDELINES (i) Voting shall only be allowed upon the production of an OAU student identity card, or any other means of identification as a Entrepreneurship student. 22 (ii) There shall be no solicitations of votes at the election venue or anywhere else in the day of the elections. (iii) Intimidation of voters by a candidate or his agents shall be prohibited (iv) Elections shall be by secret ballot (v) No candidate shall engage in any form of campaigns before the ban on election campaign is lifted. (vi) Whoever is found in breach of any of the above electoral guidelines and regulation shall be disqualified by the Electoral Commission. (vii) Reasonable price of forms into elective offices are to be fixed at the discretion of Electoral Commission. (viii) A candidate who has not paid his dues stands disqualified. (ix) Any candidate found guilty of examination malpractices or any criminal offence shall stand disqualified from contesting in an election. S. 34 ELIGIBILITY (i) Every financial member of Entrepreneurship shall be eligible to be voted for provided that as at the time of election, candidates contesting for the post of: (a) President, General Secretary, Vice President and Financial Secretary comes from part 3; (b) Treasurer and Assistance General Secretary comes from part 2; (c) Public Relations Officer, Social Director, Sport Director and Welfare Director comes from part 2 or 3. (d) Librarian comes from part 1 or 2. (e) Public Liaison Officer comes from part 1. (ii) Subject to subsection (i) above, candidate(s) vying for executive office(s) and House of Parliament shall at least fulfil 50% congressional attendance except for part one students who are partaking in by election. (iii) Without prejudice to any other part of the constitution, only financial members shall be allow to vote (vi) A dismissed or removed officer of the Association shall not be eligible to contest any association election for a period of 2 academic sessions. 23 (vii) The candidates for the post of President, Vice President & General Secretary and other posts shall have the CGPA of not less than 3.0, 2.5 and 2.0 respectively as at the time of contesting for such elections (viii) Without prejudice to (vii) above, part 1 and D.E students are exempted from such requirements; whereas GPA will be used instead. (ix) Serving member(s) aspiring for ant post shall resign such appointment at least 2 weeks before election. (x) No person shall be qualified for election if; (a) He has been indicted for embezzlement of the association’s fund (b) He has been found guilty of dishonesty or fraud ARTICLE VI (AUXILIARY PROVISIONS FOR ELECTORAL COMMISSION) S.35 EHP ELECTION EHP election shall hold at least two days and not later than five days before the election of the executive council. S.36 EXECUTIVE COUNCIL ELECTION The Election of Executive council shall hold two weeks after the liftment of electoral ban. S.37 SWEARING IN CEREMONY (i) The swearing in ceremony shall be organized by the Electoral Committee not later than one week after the election of the Executive Council (ii) The Head of Department (HOD) or his representative shall swear in the President and the Speaker who shall in turn swear in members of the Executive Council and Entrepreneurship House of Parliament respectively. S.38 TENURE OF OFFICE Without Prejudices to any part of the constitution tenure of all office holders shall be one academic session. 24 S.39 ELECTORAL PETITION COMMISSION (i) There shall be 7 members commission, 2 from each class with the exception of part one which shall be one. (ii) It shall be officially constituted at the last congress (iii) The president shall in conjunction with the speaker appoint members of the commission (iv) The Committee shall hear and decide: (a) All cases on election malpractices and irregularities (b) Any question as to whether not any person has been arbitrarily dismissed. (c) Any question as to whether or not an electoral officer has been arbitrarily dismissed (v) The decision of the committee shall be by simple majority voting at the meeting (vi) The committee shall publish its findings on the notice board within 2 days subject to the advice of the staff adviser. S.40 CERTIFICATE OF MERIT The Certificate of Merit shall be issued to certified officer(s) of the department authorized by the Head of Department, President of the Association and the Speaker of the House. ARTICLE VII (AUXILIARY PROVISIONS FOR ELECTED OFFICERS) S.41 VACANCY An office shall be declared vacant if: (i) The office holders resigns his appointment (ii) The office holder is impeached or removed S.42 RESIGNATION (i) Any executive members/honorable who wishes to be relieved of his duties shall tender a letter of resignation giving at least 3 weeks’ notice to the Executive Council or Entrepreneurship House of Parliament. 25 (ii) The Executive Council /EHP shall before deciding on the resignation refer such purported resignation to an investigative committee which shall be set up by the Executive Council/Entrepreneurship House of Parliament for the purpose for appropriate recommendation. S.43 SUSPENSION AND REMOVAL (i) Any Executive officer of the Association shall be removed from office if a mention for removal is supposed by 2/3 inability of house of parliament member present and voting provided a quorum is formed. (ii) If a notice in writing signed by not less than 50 members of the association is given to the speaker of the Entrepreneurship House of parliament that the conduct of an officer be investigated so as to ascertain whether he is guilty of misconduct in the performance of the function of his officer. This shall be debated in the House with 2/3 majority vote for resolution. (iii) An officer may also be removed on the basis of the finding the investigating committee. (iv) An officer stands suspended during the investigation process of his office. S.44 REINSTATEMENT OF OFFICERS PREVIOUSLY SUSPENDED (i) Where the committee reports that allegation has not been proved, no further proceedings shall be taken in respect of the matter and the officer(s) shall be reinstated to office. (ii) Subject to Section 43(iii) above, where the report is supported by less than 2/3 majority of House of parliament member present voting of House of Parliament member present voting the report shall be considered not adopted and the holder of the office shall be reinstated to his office. S.45 POWER TO RECALL A member of the House may be recalled if a petition in that regards, signed by at least 2/3 of members of his constituency, alleging their less of confidence in him and presented to the speaker of the House. 26 ARTICLE VIII (SPEFICIC PROVISIONS) S.46 CONSTITUTIONAL MATTERS (i) Notwithstanding any provision to the contrary a member shall pronounce “Constitutional Matter” which must be heard forthwith. (ii) Constitutional matters shall be raised only when a process/speech or acts of any member or the entire House/congress is deemed inconsistent with a citable section of this constitution or standing order. (iii) In line with sub section (i) above, the cited section of the constitution must be immediately read aloud to the hearing of house/congress. (iv) Subject to section 46(i) above, any constitutional matter previously raised shall not be entertained after such matter has been resolved by the House/congress. S.47 POINT OF ORDER (i) A point of order when raised, must be heard at all times except during the act of voting and shall deal with the conduct of the meeting. (ii) It shall concern matters as: (a) Indecorum (b) Intention to refer to standing order and/or clause of the constitution. (c) Violation of standing orders (d) Introduction of a matter not relevant to the question under consideration. S.48 STANDING ORDER (i) A member shall stand when speaking and shall address the Speaker/President and the House/Congress. If 2 or more members arise at a time, the Speaker/President shall determine to whom precedence shall be given. (ii) If the Speaker has occasion to rise to assert his authority, any member of the council standing shall immediately resume his seat. (iii) Debates must be limited to the immediate pending questions. The Speaker/President shall rule out of order anyone who fails to adhere to the subject under discussion 27 (iv) A member shall not speak more than on the same motion or amendment. The mover of an original motion shall reply to the debate, on the motion and in the reply shall limit himself to answering statement or argument made in the course of the debate. (v) The Speaker may call to order any member of the House for disregarding the authority of the Speaker for abusing the rules of the House. If after such certain, such a member persist in misconducting himself, the Speaker may: (a) Disqualify the member from voting on a specific issue or (b) Order the member to take leave of the house for a specific period of time (vi) All members of the EHP shall remain standing when speaker enters the House and shall all sit down when he has taken his seat. S.49 RECOGNITION (i) A person shall stand to address the House/Congress only what the Speaker/President recognizes his raised hand. (ii) Bearing the above, all members shall remain seated and calm. S.50 MODE OF ADDRESS (i) A member shall stand before addressing the House/Congress except the Speaker/President who may sit down for the same. (ii) Such a member shall then proceed with his address by saying “Speaker of the House” or “President”, Deputy Speaker, Clerk of the House, Chief Whip and my fellow Honorable etc. (Mention his name and his constituency) and then proceeds to the address proper. S.51 DECORUM (i) No foul language (abusive, insulting, vulgar etc.) shall be used on any member during the course of a Sitting/Congress. (ii) Such foul language(s) which has been inadvertently used shall be caused to be withdrawn immediately with unreserved apology to the affected person(s). 28 S.52 MOTION (i) Original Motion: (a) All motions duly signed shall be submitted in writing to the Clerk of the House of the Association not later than 3 days before a sitting. (b) All motions shall appear on the order paper of the meeting on the day they are to be discussed. (c) A motion that has been moved and second shall not lapse unless the mover is absent from the meeting at the time the motion is being tabled for debate. (d) Any motion raised in which a part of this constitution is to be altered if passed must be supported by two third (2/3) majority, provided quorum is formed. (ii) Motion without Notice: (a) Motion withdrawing a motion (b) Motion to adjoin the meeting (c) Motion that the question be now put (d) Motion to adjoin meeting to specific date (e) Motion to introduce any new business deemed important (f) Motion to reverse the decision of the Speaker/President or Chairman other than an point of order (g) Motion to limit or extent time of debate (h) Motion to alter the agenda of business (i) Motion to postpone consideration of a motion to a define time (j) Motion to refer matter to committee (k) Motion to suspend standing order or a clause of the constitution. S.53 VOTING Unless the House decides otherwise where voting shall be by secret ballot, voting shall normally be by showing of hands and every Honorable / Congress men is entitled to one vote at a time. 29 S.54 ORDER OF PROCEEDINGS Declaration (i) The presiding officer shall declare the sitting open when the quorum has been specifically satisfied. Adoption and Amendment of the Agenda (ii) The agenda shall be open to amendment with the consent of a simple majority of members at a sitting/congress after which it shall be adopted following no further amendment. Any amendment shall take the form of re-arrangement of items etc. and shall affect fundamental issues only. (a) Opening Prayer (b) School Anthem (c) Minutes of last sitting (d) Correction, amendment and adoption of last minutes (e) Endorsement of adoption of last minutes by the Speaker/President and Clerk/General Secretary. (f) Matters not separately stated on the agenda (g) Main business on the agenda (h) Any other business (AOB) (i) Adjournment (j) Closing Prayer S. 55 MEMBER(S) OF THE GALLERY Members of the gallery shall be admitted to sittings under such rules as the House may take from time to time for that purpose. S.56 SUSPENSION OF PROVISIONS (i) A section of this constitution may be suspended by at least 2/3 majority of the House of Parliament members or congress provided that quorum is formed (ii) Upon the suspension of such section, a working order shall be adopted by at least 2/3 majority of the House of Parliament members or congress. (iii) Such a working order shall remain binding for a period of not more than 6 weeks during which it shall be considered for amendment. 30 ARTICLE IX MISCELLANOUS PROVISIONS S.57 AMENDMENT (i) This constitution may be amended by the Entrepreneurship House of Parliament upon resolution to do so, passed by at least 2/3 majority of members of the congress. (ii) Any proposed amendment of the constitution shall be sent in writing by the President to the Clerk of the House at least a week before the said sitting of the House and to furnish every member of the House with a noticed of the Amendment at least 24 hours before the sitting. (iii) A resolution for amendment of the constitution may also be made upon a bill being brought before the House and subsequently passed by 2/3 majority of the House of Parliament present and voting provided they form quorum at such sitting. (iv) The resolution of the constitutional review committee shall than be brought back to the House for approval (v) After the approval of the House of such amendment, it shall there for be presented to the Congress. (vi) The Congress may decide to adopt the proposed amendment by a simple majority vote which after it shall come into full effect. (vii) In respect of the above sub-sections, amendment shall be to: (a) Leave out words (b) Leave out words and insert or add other words (c) Insert or add other words S.58 CONSTITUTIONAL REVIEW COMMITTEE (i) Subject to section (57) of this constitute an adhoc committee which shall be constituted for the purpose of constitutional amendment. (ii) The constitutional Review Committee shall comprises of 11 members (iii) The Eleven (11) members committee shall comprise of 3 members from each class with the exception of part 1 which shall have only 2 members. 31 (iv) One honorable from each constituency must be part of the (11) eleven man committee. (v) Intending non-honorable members shall be nominated by the President and subjected to the approval of the Entrepreneurship House of Parliament. S.59 INTERPRETATION (i) Interpretation of any part of this constitution shall be by the Entrepreneurship House of Parliament and area(s) of fundamental conflict shall be resolved by the House through a motion supported by simple majority of members present at voting provided they form a quorum. (ii) In this constitution unless it otherwise expressly stated or implied by the constitution: (a) All masculine pronoun includes feminine (b) Officers of the Association refers to all elected or appointed members in one official capacity or the other. (c) Associations election include all original elections and bye-election (d) The House refer to the Entrepreneurship House of Parliament (PAHP) ARTICLE 10 (CONGRESSIONAL MEETINGS) S. 60 CONGRESS (i) The General Assembly of all members shall thereafter be called Congress (ii) It shall be the supreme decision making body. (iii) Shall take decision on all matters referred to it by executive body or parliament and on all matters it deems fit as capable of uplifting the Association. 32 (iv) The Convening power of any congressional meeting shall be on the prerogative of the President. (v) Without prejudice to (iv) above: (a) The House can by a 2/3 majority resolution mandate the President, telling him the agenda to call a Congress. (b) The Audit Committee can notify the House to invoke (a) above, telling them the need for such exigency. (c) If the President fail to comply after 48 hours of such notice, the speaker, after 2/3 majority resolution of the House shall summon a Congress. S. 61 QUORUM Not less than 30 financial members of the Association with a presiding officer shall form a quorum in any Congress. S. 62 CONGRESSIONAL SITTINGS (i) The Congress shall meet not less than two times in a semester (ii) The first congress of a semester shall hold at most 5 weeks after resumption (iii) The last congress of a semester shall hold at least 3 weeks before the end of lecture week. 33 SCHEDULE I (OATH OF OFFICE) An oath of office shall be administered by the Head of Department. I do solemnly declare to abide by all rules and regulations of the Association as stated in the constitution. I pledge to uphold the name of the Association in its sanctity and sanity, to work for it’ glory, honor, upliftment and development and not to use the office for self- enrichment, rather a service to humanity. So help me God. SCHEDULE II (FINANCIAL INSTRUCTIONS FOR THE EXECUTIVE COUNCIL) S.1 PAYMENT AND PURCHASES (i) All purchases and expenditures shall be within the limit prescribed by the budget as approved by the House. (ii) Official invoices shall support all purchases and expenditure or receipt issued by the payee showing amount and other detail duly signed, the concerned that the goods/services rendered have been received in satisfactory condition. (iii) No re-imbursement/refund shall be made for purchase/expenditures made in excess of the amount stated in the requisition unless the particular vote controlling officer makes a satisfactory explanation. (iv) Where the treasurer made available an amount of money more than the approved sum, he shall be held responsible for such payment by the Audit Committee except where such excess is just and equitable. S.2 FINANCIAL CONTROL Without prejudice to any part of this constitution, the funds of the association should be managed in accordance with the provisions of this article in particular and the constitution in general. S.3 BUDGET (i) Subject to the relevant sections of this constitution, the executive shall at the commencement of each financial year prepare and lay before the House, at least 48 34 hours before its first sitting a budget of its financial activities for examination, deliberation and subsequently approval amongst other things; (a) The payable amounts as member’s subscription (b) The cost of stationeries (c) Incentive for members of the association (ii) In preparing the budget, the financial secretary shall establish appropriate budget centers and sub-centre of income and expenditure for purpose of budget control and accounting. (iii) If the house does not approve the budget 4 weeks after he beginning of a new session, the president may authorize the withdrawal and expenditure of money for the purpose of meeting expenditure necessary to carry on the services of the association for a period not exceeding one month. S.4 BANKER The banker(s) of the association shall be the commercial bank(s) approved by the congress. S.5 AUTHORIZED SIGNATORIES TO THE ASSOCIATION (i) The signatories to the association’s bank account, cheques and other financial documents shall be: (a) The President (b) The Financial Secretary (c) The Treasurer (ii) Subject to (a) above, all the 2 shall have the authority to sign the association’s financial documents. S.6 CHANGE OF SIGNATORIES Signatories to the associations’ bank account shall be subject to the following procedures at the end of term of office of the existing Executive Council at any particular session: 35 (i) The President along with other signatories shall write the association’s banker(s) informing them of the expiration of their term of office and introduce the new signatories immediately thereof. (ii) The association’s passbook and/or cheque books and other documents shall therefore be handed over to the new executives. (iii) They shall therefore be authorized to operate the account to comply with the provisions of the constitution.
