2 Hire Charges

2.1 The monthly hire charges for each machines will be fixed as mentioned for a minimum
billable period of 240 hours (Minimum Billing Hours on Shift basis as per Ledger Entry)
of 26 working days in a calendar month.
2.2 The Hirer will pay extra charges on shift basis as per ledger entry and Not On Engine
SMU if used beyond minimum billable period of 240 hours per month.
2.3 Hirer have to deposit 2 months advance payment before machine mobilization.

3 Taxes & Duties

3.1 GST at 18 % will be paid extra on monthly invoice value and will be payable by the Hirer
extra at actuals.
3.2 Any other taxes, duties or levies as applicable will be borne by the Hirer extra at actuals.
3.3 The Hirer will issue TDS Certificate at the end of each quarter and immediately on closure
of the agreement.
3.4 Hirer will furnish GST Number

4. Transportation

4.1The cost of transportation of Equipment from GMMCO, Raipur yard shall be borne
by the Hirer and back will be borne by hirer if contract would run less than 06 Months.

4.2 The transit insurance will be GMMCO’s responsibility. The E-waybill will be in hirer’s
account.

5. Delivery & Commissioning

5.1 GMMCO will dispatch the machine on receipt of the duly signed agreement.
5.2 GMMCO will provide the well maintained equipment.

6 Operators

6.1 GMMCO will provide One skilled Operator for Single shift operation (08 hours per shift
for each operator) in a day for operation of the Equipment at the site. If Extra operator
is required, then Hirer will have to pay Rs 20,000.

6.2 Fooding & lodging will be in hirer’s account or will have to give Rs 5000 for each person
as fooding expense.

6.3 Hirer should have to avail the Travel facilities for operator conveyance.

7 Fuel
High Speed Diesel with Ad blue required for the operation of the equipment shall be
provided by the Hirer at the site at his costs.
8 Maintenance & Repairs

8.1 The routine maintenance and repairs of the equipment will be carried out by GMMCO
personnel by providing the necessary parts or lubricating oil as may be required.
8.2 The Hirer shall give recess to the equipment for carrying out routine maintenance
without delay.

8.3 GMMCO will arrange for the necessary spare parts as may be required for carrying
out the repairs and maintenance subject to proper operation of the equipment.
8.4 The Hirer agrees to provide unskilled labor as and when required for maintenance of
the Equipment at their own costs.
8.5 Any repairs on account of use of contaminated fuel or misuse / abuse of the equipment
will be borne by the Hirer. The decision of GMMCO on whether the repairs are on
account of fuel contamination or misuse / abuse will be final and binding on the Hirer.

8.6 The transportation for repair should be availed by Hirer.

9 Invoicing

9.1 The hire charges is payable from the date of commissioning of the equipment at the
hirer’s site/works or three days from the date of delivery of the machine at site whichever is
earlier. The billing cycle will be on Calendar month basis.

9.2 Final billable hours will be done on shift Basis as per Ledger entry and not on Engine
SMU.

9.3 In case the deployment is for partial month then invoicing will be done on
Pro-rata basis of minimum shift hours or actual worked days whichever is
Higher.

9.4 Both the parties will sign the Log sheets on daily basis certifying the working hours

of the equipment and break down hours if any. The mutually agreed breakdown

hours for deductions will be reduced from the final billable hours.

9.5 The Hirer shall be entitled to make deductions in Log Sheet on number of hours utilized
for Machine Breakdown beyond one hour at a stretch. However, Hirer will cooperate to
do make up for the break down hours by working extra hours.

9.6 The log sheet shall be reconciled and signed by both parties on fortnightly basis and shall
be binding on both parties.
9.7 The Hirer and GMMCO will nominate their respective authorized representative
to sign the Log Sheet which shall be binding on both the parties.
9.8 If the total number of hours utilized during a month exceeds minimum billable
Hours then no deduction towards breakdown shall be made.
9.9 GMMCO will raise invoices for utilization of the Equipment for each calendar
Month and submit the same to the Hirer based on Log sheets.

10 Payment Terms

10.1 The hire charges shall be paid by the Hirer within 10 days from the date of invoice by
way of Account Payee Cheques in favor of GMMCO LIMITED
10.2 The Hirer shall be liable to pay interest @ 14% p.a for any delay in payment of hire
charges beyond the stipulated period.

11. Other Terms

11.1 Hirer will use the equipment only for the purpose it is hired and shall not misuse or
abuse the equipment or use the Equipment for any unlawful or illegal purposes.

11.2 Hirer will have to give 30 days advance notice or one month hire charges in lieu of the
notice before de hiring of the Equipment.

11.3 Gmmco will de-hire machine in case of payment default.

11.4 Hirer will ensure the safe custody of the equipment by providing necessary security,
parking bay, etc. and will be liable for any loss or damage or destruction to the
machine at prevailing prices, taxes freight etc. Both the parties will enter into an Agreement
for Hire on acceptance of the offer by the Hirer.

11.5 Hirer would terminate the agreement by giving 30 Days advance notice. Machine
will not run if advance is not available and customer will have to pay idle charges.

12. Arbitration: Any dispute arising out of the contract will be decided by a Sole Arbitrator
nominated by us. The venue of Arbitration shall be at Chennai.

13: Delivery time: After confirm Work order/Agreement: Min…Days (As

mentioned Above clause No. 1) after Agreement, commercial terms clearance and
Advance Credit.
