Dear Sir/ Madam,

Sub: Notice Inviting for E-Auction

This e-auction sale notice is published for intending bidders who intend to participate in e-auction for sale of
scrap/unusable/unserviceable items belonging to Indian Institute of Technology Guwahati. Manual auction shall not
be accepted.

The details of notice are as under:


1. All the materials are offered for sale on “As is where is” basis. The details of the materials kept for e-auction is
available on e-Auction India website i.e. www.eauction.gov.in.
2. The bidder who wants to participate in the e-auction process has to enrol his/her name online through the website
www.eauction.gov.in. The bidder has to upload the scan copy of the duly filled up forms as per Annexure II, III and IV
along with required document and should remit the Auction Fee and EMD amount to the IIT Guwahati for
completing the enrolment procedure.
3. After scrutiny of the documents submitted by the intending bidders and if the documents are found to be in order,
such bidder shall be declared qualified to participate in e-auction process. Only qualified and N.I.C. Registered bidder
can participate in e-auction process.
4. For any additional information regarding e-auction the intending bidder can contact following official.

Terms and Conditions

Technical Terms:
1. Bidder will be considered for evaluation who will deposit e-auction fee, EMD in original within prescribed time limit
in the Stores and Purchase office, IIT Guwahati. Furthermore, all other documents mentioned in Annexure-II
should also be uploaded.
2. Original Document, if asked by the officer in charge, should be produced immediately by the bidder.
3. No bidder shall be exempted from payment of EMD. EMD exemption given by any other Office/Department will
not be accepted. Offer submitted without EMD will not be accepted.
4. Acceptance of e-auction will rest with the authority, who reserves the right to reject any or all e-auction without
assigning any reason. Therefore, the acceptance of e-auction may be intimated to the bidder by a letter. Such
intimation shall be deemed to be an intimation of acceptance of e-auction. The e-auction whose offer is accepted
will have to complete the contract form within stipulated time of being notified to do so and shall abide by all the
rules and regulations and special conditions enumerated or attached herewith.
5. The offer shall remain valid for the period of 75 (Seventy-five) days from the date of issue of Acceptance Letter.
6. Special Terms and Conditions for “LotCode1 (Damaged Batteries)” and “LotCode2 (Empty Printer
Cartridges)”: The intending bidders are required to submit copy of valid Registration Certificate as authorised
dismantler or recycler of E-wastes or Waste Batteries from the concerned CPCB/SPCB/PCC under the provisions
of E-waste Management Rules, 2022 or Batteries Waste Management Rules, 2022 as amended from time to
time. The registration should be valid on the date of publication of auction notice as well as on the date of lifting of
the goods/ materials. Firms or Agencies not registered with CPCB/SPCB/PCC and not authorised for
disposal of e-waste or waste batteries will not be allowed to participate in the auction and their bids will
be rejected without assigning any reasons thereof.
Taxes:
1. Prevailing Goods & services Tax (GST) will be charged extra i.e., 18% or 5% of the total bid value (as applicable).
Successful bidder has to pay the tax to IIT Guwahati within stipulated time.
2. Maximum offered rate is net value of the goods to be sold. Taxes in respect of sales by transfer of property in
goods involved under the provision of GST for the purpose of buying is to be borne by the bidder.
3. Income tax (Tax collected at source and surcharge as per section 206 (c) of the Income tax act) as applicable of
the amount to be submitted in the form of demand draft of the nationalize or schedule bank will be payable by the
auction purchaser and it will be collected by the concerned officer and will be paid to Income Tax Office.
Payment Terms:
1. On the completion of the bid and issue of Acceptance letter, bidder shall deposit to Institute 25% of the amount of
bid value within 7 days from the date of issue of Acceptance Letter through RTGS/NEFT/ECS through a schedule
bank. If successful auction purchaser fails to deposit initial 25% amount within stipulated period, his EMD will be
forfeited and further he will be disqualified for the participation in future e-auctions of IIT Guwahati.
2. The successful bidder must pay the balance amount of 75% of the bid value including 18% of GST within 15 days
(including holidays) from the date of issue of Acceptance Letter through RTGS/NEFT/ECS through a schedule
bank. In case of failure to pay the balance 75% amount within above stipulated period, the payment may be
accepted on the discretion of Authority upto period of two weeks from the due date of payment on payment of
additional late payment penalty @1% per week on total sale value. In case of failure of pay the balance amount
along with penalty also, the 25% amount specified above will stand forfeited on expiry of 30 days from the date of
issue of Acceptance letter and same will be treated as cancelled. However, IIT Guwahati reserves the right not to
accept the payment with or without the late penalty after the expiry of above-mentioned time limits.
3. Applicable Goods and Service Tax (GST) shall be paid to IIT Guwahati, along with the payment of 75% amount
then only Sales Release Order will be issued.
Lifting period:
1. The successful buyer has to lift the materials by employing their own labour and transport at their own cost within
30 days from date of issue of Sales Release Order after making the balance payment of 75% of sale value.
2. If the successful bidder is unable to lift the material within stipulated period, ground rent @1/2% of the accepted
bid per day will be levied and upto 2 weeks maximum, provided written request is received before the expiry of

free lifting period. If no such request is received, the Sale Order shall stand cancelled and the entire amount paid
will be forfeited.
3. If the auction material is not lifted within 45 days from date of issue of Sales Release Order, the auction will be
treated as cancelled and in this case the entire amount paid will be forfeited.
General terms:
1. Bidders will have to make a one-time enrolment on the eAuction India website http://eauction.gov.in
2. For enrolment on the website, bidders have to register their Digital Signature Certificate (DSC).
3. Bidders shall upload scanned copies regarding personal details, technical document along with declaration in
schedule time on specified site http://eauction.gov.in
4. The bidders have to submit the auction document online well in advance before the prescribed time.
5. Any change in auction schedule or auction terms and conditions will be available online on e-auction website. IIT
Guwahati will not be responsible for ignorance of bidder to see updates on website.
6. The bidder should see that the bid document/ bid submitted should be free from virus and if the document could
not be opened during auction opening the bidder enrolment/ bid is liable to be rejected.
7. After evaluation of bidder document, only approved bidder will be allowed to participate in live e-auction process.
8. Bidder should log into the site well in advance for bid submission, so that he submits the bid in time i.e. on or
before the bid submission end time. The bidder shall only be responsible for any delay due to other issues
whatever it may be.
9. The e-auction shall be open for the period as per schedule.
10. Department will not be responsible for any kind of failure of network and hardware from bidder side.
11. If any bid is received during the last 5 minutes before schedule close of auction for any lot, its close time will get
automatically extended by 10 minutes from the time of last bid in order to give the bidder equal chance to revise
their bid.
Bidding will close for a particular source either at the scheduled close time or till there will be period of 10 minutes
in which no bid is recorded for the source, whichever happen late.
12. The auctionable material shall be disposed of on “AS IS WHERE IS” basis, “NO COMPLAINT” basis and the
principle of “caveat emptor” shall be applicable. It is expressly understood that the bidder has fully satisfied
himself regarding the quality, quantity & condition of auction able material before bidding. The disposable
materials are normally kept in the yard in open space and the concerned office will not be responsible for any
damage/ loss of the material.
The number/ quantities or tonnage & nature of material given are only indicative & the material will be sold without
any regard or consideration to these number/ tonnages of material & no warrantee shall be implied. It is
presumed that the bidder is fully aware of lot put to auction and no complaint whatsoever will be entertained after
the bid is made.
13. Auction material lying “as is where is” basis will have to be lifted by bidder at his own cost.
14. The bid shall remain valid for a period of 75 days from the date of issue of Acceptance Letter.
15. Only after Sale Release Order is awarded to a particular bidder the concerned bidder has to lift the auction
purchase material from the site as specified earlier.
16. Any change in auction notice or its cancellation is unquestionable.
17. Conditional auction is not acceptable.
18. Bidder/firm bidding less value than reserve price is not acceptable.
19. Resolution of Dispute:
(a) Any dispute arising out of this sale/disposal contract shall be solved through amicable ways as far as possible.
However, if not resolved and not satisfied by both the parties, arbitration may be opted as per the Indian
Arbitration and Conciliation Act 1996 and any amendment thereof. The dispute shall be referred to the decision of
an Arbitrator, who should be acceptable to both the parties, to be appointed by the Director of the Institute. The
decision of such Arbitrator shall be final and binding on both the parties.
(b) The contract shall be governed by the laws and procedures established by Govt. of India and subject to
exclusive jurisdiction of Competent Court and Forum in Guwahati only.
20. Force Majeure: If the performance of the obligation of either party is rendered commercially impossible by any of
the events hereafter mentioned that party shall be under no obligation to perform the agreement under order after
giving notice of 15 days from the date of such an event in writing to the other party, and the events referred to are
as follows:
I) Any law, statute or ordinance, order action or regulations of the Government of India,

II) Any kind of natural disaster, and
III) Strikes acts of the Public enemy, war, insurrections, riots, lockouts, sabotage.
21. IIT Guwahati reserves the right to demand copy of any other documents/ license/ certificate issued by
Government authority in favour of bidder if required.
22. IIT Guwahati reserves the right of cancelling the auction notice and its procedure at any stage.

on “As is where is” basis to the successful bidder. The items are located at different Departments/ Centres/
Schools/ Sections/ Hostels of the Institute and the bidders or their authorised representatives are advised
to physically inspect the items and satisfy themselves of the quantity, quality and condition before
bidding as per stipulated time in the notice, i.e., from 18.01.2024 upto 30.01.2024, from 11 AM to 4PM on all
office working days (excluding lunch hours). No complaints later on shall be entertained.

(If the successful bidder desires to authorise a representative or an agent for lifting, the bidder shall produce a
suitable power of attorney or authorisation letter for each lot separately, duly attested, by a notary public
authorising his representative or agent to lift the material from the location).
