ዒIቭዘጵያ ዒሕ኉ፃ A኷ጅ ETHIOPIAN BUILDING PROCLAMATION

ዒሕ዇ቝ ገ኉ኄቭኇ ዙህ኉ኄቭ E኉ዛረዴዱጉ ጤማዞ WHEREAS, it has been found necessary to
ረዶ ዒሕ኉ፃ ዶ኉ቛቫ ወ዗ም ዒሕ኉ፃ ዶ኉ቛቫ determine the minimum national standard for the
ማሻሻያኇ ዒAዱልዶጪቭ ጤኹጉ኉ ቘቨመጤኜቨ construction or modification of buildings or alteration
ቘሀዱሪቩ ቘAጄቃ ላ዗ ቨ ፃሚ ዒሚጣ኉ ዇ቅቨኛኹ኉ of their use in order to ensure public health and safety;

ቘIቭዘጵያ ዝራላ኶ ዛሞኡራሲያ኶ WHEREAS, sub-article (3) of Article 51 of the

NOW, THEREFORE, in accordance with Article
55 (1) of the Constitution of the Federal Democratic

Republic of Ethiopia it is hereby proclaimed as

This Proclamation may be cited as the “Ethiopian

2. Definitions
In this Proclamation, unless the context otherwise
2. ቭርጓሜ
requires:
ዒቃጥ Aዱቛቝ ዒቨጤዒ ቭርዲም ዒሚያሰጄኹ ኟል
ጣኄ ቘስቨቀር ቘዄህ A኷ጅ ኹስጉ 1/ “Ministry” means the Ministry of Works and
Urban Development;
1/ “ሚኆስቬር” ማጤቭ ዒሥራኇ ኜቨማ
ልማቭ ሚኆስቬር ኄኹ 2/ “building” means a permanent or temporary
construction used for the purpose of dwelling,
2/ “ሕ኉ፃ” ማጤቭ ጤመኊሪያ ጤቚሮ ጤ ቝሪኟ office, factory or for any other purpose;
ወ዗ም ጤማኇተኹም ሌላ Aዱልዶጪቭ
ዒሚኹል ቋሚ ወ዗ም ዳ዆ያ኶ ዶ኉ቛቫ ኄኹ 3/ “building officer” means a person appointed by
an urban administration or designated organ to
3/ “ዒሕ኉ፃ ሹም” ማጤቭ ዗ህ኉኉ A኷ጅ enforce this Proclamation;
E኉ዛ ያስ ጽም ቘኜቨማ Aስቨዜዙር
ወ዗ም ቘቨ ሰዒመ Aኟል ዒቨሾመ ሰኹ 4/ “a registered professional” means a person who
ኄኹ is issued with a certificate as a design or
construction professional or a juridical person
4/ “ዒቨመዂዱቘ ቛጤሙያ” ማጤቭ ሥልጇ኉ ቛጤኹ which is issued with a certificate as a design or
Aኟል ቨመ዇ዶ቞ ቘዛዅ዗኉ ወ዗ም ቘኢ኉ስቭራ construction consultant by the relevant body;
ኡሽ኉ ዒቛጤሙያኄቭ ዒምሥኡር ወረቀቭ ዒቨሰ
ጄኹ ሰኹ ወ዗ም ቘዛዅ዗኉ ወ዗ም ቘኢ኉ስቭ
ራኡሽ኉ ዒAማኟሪኄቭ ዒም዇ዱቛ ምሥኡር ወረ 5/ “a registered contractor” means a juridical
ቀቭ ዒቨሰጄኹ ዞርጅቭ ኄኹ person who is registered and issued with a work
permit by the relevant authority as a contractor;
5/ “ዒቨመዂዱቘ ዒሥራ ቨቋራ጑” ማጤቭ
ሥል ጇ኉ ቛጤኹ Aኟል ቨመ዇ዶ቞ ዒሥራ
ቨቋራ ጑ኄቭ ዒም዇ዱቛ ዒምስኡር ወረቀቭ 6/ “category ‘A’ building” means a one story
building with a span of 7 meters or less
ዒቨሰ ጄኹ ዞርጅቭ ኄኹ
between two reinforced concrete, steel or other
structural frames or any dwelling house not
6/ “ምዞቝ ‘ሀ’ ሕ኉ፃ” ማጤቭ ቘሁጤቭ ዒኢ኉ኡሪቭ
exceeding two stories;
ወ዗ም ዒቝረቭ ወ዗ም ሌጪት ስቭራኡተራል
ኹቅሮት መኟኜል ያጤኹ ርቀቭ 7 ሜቭር
ወ዗ም ኜዄያ ቘቫት ዒጣኄ ቛጤA኉ዞ ቅ
ሕ኉ፃ ወ዗ም ማኇተኹም ኜሁጤቭ ቅ ቘቫት
7/ “category ‘B’ building” means a building with
ዒጣኄ ዒዶል መኊሪያ ቜቭ ኄኹ a span of more than 7 meters between two
reinforced concrete, steel or other structural
7/ “ምዞቝ ‘ለ’ ሕ኉ፃ” ማጤቭ ቘሁጤቭ ዒኢ኉ኡሪቭ
frames or of two or more stories not covered in
ወ዗ም ዒቝረቭ ወ዗ም ሌጪት ስቭራኡተራል
category ‘C’ or a real estate development of
ኹቅሮት መኟኜል ያጤኹ ርቀቭ ኜ7 ሜቭር category ‘A’;
ቘላ዗ ዒጣኄ ወ዗ም ቛጤሁጤቭ ቅኇ ኜሁጤቭ
ቅ ቘላ዗ ዒጣኄኇ ቘምዞቝ ‘ሐ’ ዒማ዗ሸ ኉ 8/ “category ‘C’ building” means any public or
ሕ኉ፃ ወ዗ም ቘምዞቝ ‘ሀ’ ዒቨመዙቘ institutional building, factory or workshop
E኉ዙሪል ስቬቭ ያጤ ዒቜቮት ልማቭ ኄኹ building or any building with a height of more
than 12 meters;
8/ “ምዞቝ ‘ሐ’ ሕ኉ፃ” ማጤቭ ዒሕ዇ቝ መዱልዱያ
ወ዗ም ቨቋም ኄኡ ሕ኉ፃ ዒ ቝሪኟ ወ዗ም
ዒወርኡሾ ሕ኉ፃ ወ዗ም ኜመሬቭ Eስኜ 9/ “construction” means the construction of a new
መጨ ረሻኹ ወጤል ኜ ቫኹ ኜ02 ሜቭር building or the modification of an existing
ቘላ዗ ዒጣኄ ማኇተኹም ሕ኉ፃ ኄኹ building or alteration of its use;

9/ “ዶ኉ቛቫ” ማጤቭ Aዛስ ሕ኉ፃ መዱ኉ቛቭ 10/ “dangerous building” means a building that is
ወ዗ም ኄቛር ሕ኉ፃ኉ ማሻሻል ወ዗ም structurally unsafe or constitutes a special
fire hazard or health risk;

0/ “Aስዳ ሕ኉ፃ” ማጤቭ ዶ኉ቛቫኹ Aስቨማማኑ


ያልጣኄ ወ዗ም ቘኜ ቨኛ ዙረዬ ጤEሳቭ Aዙዴ 11/ “designated organ” means an organ appointed by the
ዒቨዴጤጄ ወ዗ም ጤገኇ ጄ኉ቅ ዒጣኄ ሕ኉ፃ concerned Regional State to enforce this

ኄኹ Proclamation in areas outside of urban centers to
which this Proclamation is applicable;
01/ “ዒቨሰዒመ Aኟል” ማጤቭ ዗ህ A኷ጅ ኜኜ
12/ “document” means any plan, report, estimate
ቨማ ኡልል ኹጎ ቨ ጻሚ ቘሚጣ኉ቘቭ
or any other technical presentation required
ዳ዆ A኷ዪ኉ E኉ዛያስ ጽም ቘኡልጥ or prepared in connection with the design and
ዒሚሰዒም Aኟል ኄኹ construction of a building;
02/ “ሰኄዞ” ማጤቭ ኜሕ኉ፃ ዛዅ዗኉ኇ ዶ኉ቛቫ ዴር 13/ “private dwelling building” means a house
ቘቨያያዂ ዒሚያስ ልዶ ወ዗ም ዒቨዂዴዩ containing one or more habitable rooms with
ላ኉ ሪ ርቭ ዒ኷ዴ ዶምቭ ወ዗ም ማ኉ኛ sanitary and cooking facilities for the use of a
ኹም ዒቬኡኆኡ ዲዜ዗኉ ዒሚያስረዜ ሰኄዞ single family and may include any garage
ኄኹ and other domestic outbuildings within its
site;
03/ “ዒዶል መኊሪያ ሕ኉ፃ” ማጤቭ ጤA኉ዞ ቜቨሰቝ
መኊሪያኄቭ ዒሚያዱጤዶጥ A኉ዞ ወ዗ም
ኜA኉ዞ ቘላ዗ ኡ ጪትኇ ዒመ ዜዬኇ ዒማቝሰያ 14/ “person” means any natural or juridical

person;
ቅጉር ዶቚ ኹስጉ ዒሚዱኑ ዒመኞኇ

15/ “plan” means any drawing or model showing

04/ “ሰኹ” ማጤቭ ዒቨ ጉሮ ሰኹ ወ዗ም structural, sanitary, electrical, mechanical,
ቘሕዶ ዒሰኹኄቭ መቝቭ ዒቨሰጄኹ Aኟል fire protection and other drawings;
ኄኹ

05/ “ ላ኉” ማጤቭ ዒA኉ዞ኉ ሕ኉ፃ መጄ኉ ዓ዗ኄ 16/ “Regional State” means any regional state
ቭኇ ስ ቭ E኉ዛሁም ሕ኉ፃኹ ዒሚሠራቘቭ኉ established in accordance with Article 47 of
ቁሳቁስኇ ዒAዱኄቛቝ ዂዝ኉ ዒሚያሳ዗ ኉ዞ the Constitution of the Federal Democratic
ወ዗ም ሞዝል ሲጣ኉ ዒAርኡቬኡተር ዒስቭ Republic of Ethiopia and includes the Addis
ራኡተር ዒሳኆቨሪ ዒኤሌኡቭሪኟል ዒሜኟ Ababa and Dire Dawa city administrations;
ኆኟል ዒEሳቭ መኜላኜልኇ ዒሌጪት
ሥራኺት኉ ኉ዞ ጦያኟቭቭ ዗ትላል 17/ “stop order” means any order given by a
building officer or by a building inspector to
06/ “ኡልል” ማጤቭ ቘሕዱ መ኉ዶሥቩ discontinue activities on a building
A኉ቀጽ #7 መሠረቭ ዒቨቋቋመ ኡልል construction site;
ሲጣ኉ ዒA ዛስ Aቘቛ ኜቨማ Eኇ
ዒዞሬዜ኷ ኜቨማ Aስቨዜዙሮት኉ 18/ “story” means that part of a building which is
዗ጨምራል situated between the top of any floor and the
top of the floor next above it, or if there is no
07/ “ዒማስቆሚያ ቭEዅ዇” ማጤቭ ቘA኉ዞ ዒሕ floor above it that portion between such floor
኉ፃ ዶ኉ቛቫ ቞ቫ ዒሚኟጡዞ ሥራ E኉ዛቋ and the ceiling;
ረጉ ወ዗ም E኉ዛቆም ቘሕ኉ፃ ሹም
19/ “urban administration” means an organ to
ወ዗ም ቘሕ኉ፃ ቨቆጇጇሪ ዒሚሰጉ ቭEዅ዇
which powers and duties of administering an
ኄኹ urban center have been given by law or
delegated by the concerned government
08/ “ ቅ” ማጤቭ ቘሁጤቭ ወጤጪት መኟኜል body;
ወ዗ም ኜላ዗ ሌላ ወጤል ኜሌጤ ቘወጤጥኇ 20/ “urban center” means any locality having a
ቘኰርኆስ መጠል ያጤኹ ዒሕ኉ፃ ኡ ል municipal administration or a population size
ኄኹ of 2,000or more inhabitants, or which at least
50% of its labour force has, primarily,
09/ “ዒኜቨማ Aስቨዜዙር” ማጤቭ ቘሕዶ engaged in non –agricultural activities.

Aኟል ኹኡ ልኇ ዒኜቨማ Aስቨዜዙር


ሥልጇ኉ኇ ቨዶ ቛር ዒቨሰጄኹ Aኟል 3. Scope of Application
ኄኹ
1/ This Proclamation shall apply to:
!/ “ኜቨማ” ማጤቭ ማዂዴዬ ቜቭ ዒቨቋቋመ
ቘቭ ወ዗ም 2ሺ ወ዗ም ኜዄያ ቘላ዗ ዒሕ
a) urban centers that have 10,000 or more
዇ቝ ቁጉር ያጤኹኇ ኜዄህ ኹስጉ ቚያ኉ስ
dwellers;
$ ቘመቮ ዒሚጣኄኹ ዒሰኹ ኃ዗ል
ኜዶቝርኇ ኹ጑ ቘጣኄ ሥራ ዒቨሰማራ b) other urban centers that have less than

ጣኊ ዒሚዱኑ ቘቭ Aኟቛቚ ኄኹ፡፡ 10,000 dwellers and to which this
Proclamation shall be applicable in
3. ዒቨ ጻሚኄቭ ወሰ኉ accordance with the decision made by the
Regional State concerned;
1/ ዗ህ A኷ጅ ቘሚኜቨጥቭ ላ዗ ቨ ፃሚ
዗ጣኇል c) public buildings, or buildings which could
be used for industrial or commercial scale
ሀ/ 0ሺ Eኇ ኜዄያ ቘላ዗ ኄ኷ሪኺት ቛጫ agricultural occupancy or real-estate out
ተኹ ኜቨሞት side of urban centers.

2/ This Proclamation may not apply to any


ጤ/ ዒኄ኷ሪኺታተኹ ቁጉር ኜ0ሺ ቘቫት
building:
ቘጣኄኇ ቨ ፃሚ E኉ዛጣ኉ቛተኹ ቘሚ
መጤኜቨኹ ኡልል ቘሚወሰኅ ሌጪት a) completed on or before the effective date
ኜቨሞት of this Proclamation;

ሐ/ ኜኜቨማ ኹ጑ ቘሚዱኍ ህ዇ቝ b) which is under construction with a


ዒሚዱ ጤዱልቛተኹ ሕ኉ፃኺት building permit issued before the effective
ዒI኉ዚስቭሪ ወ዗ም ዒዂመኇ኶ Eርሻ date of this Proclamation;
ቨቋሞትኇ ዒሪልስቬቭ ሕ኉ፃኺት፡፡
c) exempted by the decision of the Council
2/ ዗ህ A኷ጅ ቘሚኜቨጥቭ ላ዗ ቨ ፃሚ of Ministers for reasons related with
A዗ጣ኉ም national security and other purposes.

ሀ/ A኷ዪ ቘ ኇቘቭ ቀ኉ ወ዗ም ኜዄያ 3/ Notwithstanding the provisions of sub-article


ቘ ቭ ቘቨጄኇቀቀ ሕ኉ፃ 2(b) of this Article, the urban administration or
the designated organ may apply this
ጤ/ A኷ዪ ኜ ኇቘቭ ቀ኉ ቘ ቭ ቘቨሰጄ Proclamation to:
ዒሕ኉ፃ ዶ኉ቛቫ ቃዞ ቘመኟጡዞ
ላ዗ ቘሚዱኑ ቘማኇተኹም ሕ኉ፃ a) a building under construction with a build-
ing permit issued before the effective date
ሐ/ ኜሀዱር ዙህ኉ኄቭ ዴር ቘቨያያዂ Eኇ of the Proclamation if such construction is
ቘሌጪት ምኡ኉ያቮት A኷ዪ ቨ ፃሚ not completed within three years of the
E኉ዜ዗ጣ኉ቘቭ ቘሚኆስቭሮት ምኡር effective date of the Proclamation;
ቜቭ ቘሚወሰ኉ ሕ኉ፃ፡፡
b) in order to ensure the compliance of a

building for which alteration of service is

sought to render;
ሀ/ ዗ህ A኷ጅ ኜመጽኇቩ ቘ ቭ ቘወጇ
ዒሕ኉ፃ ዶ኉ቛቫ ቃዞ መሠረቭ c) a building to which a renovation is
ቘመ ኟጡዞ ላ዗ ዒሚዱኑ ጣኊ required.

ሰቘኹ Aዱልዶጪቭ A኉ፃር ዙረዬኹ኉
ዒጄቘቀ መጣኅ኉ ጤማረዴዱጉ 4. Submission of Application and Plans

1/ Any person intending to carry out construction


ሐ/ ዒEዞሳቭ ቃዞ ጉያቄ ቘሚቀርቝጤቭ
ህ኉ፃ ላ዗
shall submit an application to the urban
ዒኜቨማኹ Aስቨዜዙር ወ዗ም ዒቨሰዒመኹ
administration or designated organ.
Aኟል ዗ህ A኷ጅ ቨ ጻሚ E኉ዛጣ኉ቘቭ
ማዞረዶ ዗ትላል፡፡
4 6)&7 2/ The application to carry out construction shall
be made on an application form prepared by the
urban administration or designated organ and
ኡ ል ሁጤቭ
shall consist of a design and report according to
Aስቨዜዙር
the category of building in question.
4. ማመልኜታኇ ላ኉ ስጤማቅረቝ 3/ The application shall be accompanied with a
reference to main roads and names of
1/ ዒዶ኉ቛቫ ሥራ ጤማኟጡዞ ዒሚ ልዶ prominent places.
ማ኉ኛ ኹም ሰኹ ጤኜቨማኹ Aስቨዜዙር
ወ዗ም ጤቨሰዒመኹ Aኟል ማመልኜታ
ማቅረቝ ዗ኊርቘቫል፡፡
4/ The applicant shall submit proof of possession
2/ ሕ኉ፃ኉ ጤመዱ኉ቛቭ ዒሚቀርቝ ማመልኜታ rights to the land or property on which the
ዒኜቨማኹ Aስቨዜዙር ወ዗ም ዒቨሰዒመኹ construction will take place.

ምዞቝ A዗ኄቭ ዛዅ዗኉ኇ ሪ ርቭ ዒያዂ 5/ The documents to be submitted shall be
sufficiently complete to determine compliance

with this Proclamation and other laws.
3/ ኜማመልኜታኹ ዴር ቘA኷ሳኑ ቛጥ ስ ራ
ኺት ዒሚዱኍ ኷ኇ መ኉ዱዟት኉ኇ ዒቫወቁ 5. Planning Consent
቞ቫኺት኉ ስም ዒሚዱል መረዬኺት
መቅ ረቝ ዗ኊርቛተ኷ል፡፡
1/ Any person intending to carry out construction
4/ Aመልኟቱ ሕ኉ፃ ቘሚዱኄቛቘቭ ቞ቫ shall secure a planning consent prior to
ወ዗ም ቘ኉ቝረቩ ላ዗ ዒ዗ወቫ መቝቭ submitting application for construction permit.

2/ After having received an application for a
planning consent a building officer shall grant a

written declaration for compliance or non-

compliance with the urban planning of the

1/ A building officer shall check submitted plan

ላኅ኉ ጦያ ዞቀኹ ዗ትላል፡፡ accompanying plan, as stamped and signed in
accordance with sub-article (3) of this Article,
shall be returned to the applicant and the other

4/ ኜ ዙቀኹ ላ኉ ዴር Aቝረኹ ዒቀረ቙ቭ form and approved plans shall be permanently
ዒማ መልኜታ ቅ ት ቘቅ ት ኹስጉ ጤዄሁ displayed at the building site. All original
ቨቝጪ ቘቨዂዴዩኹ ኡ ቭ ቞ቫ ላ዗ approved application forms and plan shall be
“ ዞቋል” ዒሚል ምልኡቭ ቨዙርጐቛተኹ kept in good condition and presented at any
ዒም዇ዱቛ ቁጉ ርኇ ዒ ዙቀቘቭ ቀ኉ time, before and during construction, upon the
዗ሠ ርቛተ኷ል፡፡ Aስቨ ያዒቭ ኟጤ ጤዄሁ request of the urban administration or
ቘቨዂዴዩኹ ኡ ቭ ቞ቫ ላ዗ ሰ ሮ ቘሕ኉ፃ designated organ or the building officer or an
authorized inspector.

5/ ላ኉ ኜ ዙቀ ቘኋላ ቘዄህ A኉ቀጽ ኉Uስ 7. Plan Review Period


A኉ ቀጽ /3/ መሠረቭ ማህቨምኇ ርማ
ያረ ቘቭ ዒማመልኜታ ቅ ኇ ቘAቛሪኄቭ A building officer shall review documents
ዒቨያያ ዂኹ ላ኉ A኉ዞ ቅጅ ጤAመልኟቱ submitted and approve or reject within the time
዗መጤስ ጤቫል ሌላኹ ቘኜቨማኹ limit. The time limit shall be determined by
Aስቨዜዙር ወ዗ም ቘቨሰዒመኹ Aኟል Regulation to be issued for the implementation of
ዂ኉ዞ ዗ቀመጇል፡፡ this Proclamation.

6/ ርማኇ ማህቨም ያጤቘቭ ዒ ዙቀ ላ኉ኇ

9. Construction Permit
ዒቨጇሰኹ኉ ዒህዲ኉ ዞ኉ዴድ ቘA጑ሩ
መዶጤ ዗ኊርቘቫል፡፡ Aስ ላዳ ጣኊ A plan which has been approved in accordance with
ኜቨዱኌ ቨጨማሪ ማቝራሪያኺት ቘቨጤዒ Article 6 of this Proclamation shall constitute a
ወረቅቭ ቘመፃ ማያያ዇ ዗ትላል፡፡ construction permit.

3/ ቘሕ኉ፃ ሹሙ ኹዞቅ ዒቨዙረዱ


10. Validity Period of Plans
ማመልኜታኇ ላ኉ “ኹዞቅ ቨዙርጓል”
ዒሚል ምልኡቭኇ ቀ኉ E኉ዛሁም ዒሕ኉ፃ 1/ The validity of approved plans shall expire after
ሹሙ ርማ ዗ሠ ርቘቫል፡፡ six months from the date of issuance where
construction work has not been started.
4/ ዒቀረቘኹ ላ኉ ኹዞቅ ሲዙረዶ ዒሕ኉ፃ
ሹሙ ርማ Eኇ ማህቨም ያረ ቘቭ
ማመልኜታ A኉ዞ ቅጅ Eኇ ዒ ላኅ ሁጤቭ 2/ The validity of approved plans with which
ቅያኺት ጤAመልኟቱ ዒሚመጤስ ሲጣ኉ construction work has been started within six
ዒህ኉ፃ ሹሙ ርማ Eኇ ማህቨም ያረ ቘቭ months from the date of issuance shall expire
ዒማመልኜታ ቅ A኉ዞ ቅያ ቘኜቨማኹ after five years from the date of issuance, if the
Aስቨዜዙር ወ዗ም ቘቨሰዒመኹ Aኟል construction work has not been completed.
ዂ኉ዞ ዗ቀመጇል፡፡
3/ Upon expiry of the validity period as set out in

11. Building Officers
1/ ዒዶ኉ቛቫ ሥራኹ ኟልቨዩመረ A኉ዞ
ዒ ዙቀ ላ኉ ዒሚ ኇቘቭ ዳ዆ ዒሚያቘቃኹ 1/ Every urban administration or designated organ
ላኅ ኜ ዙቀቘቭ ቀ኉ ዩምሮ ስዞስቭ ወር shall appoint a building officer, with the
ኟቘቃ ቘኋላ ዗ጣኇል፡፡ required educational and professional
qualifications to enforce, on its behalf, the
provisions of this Proclamation and other laws.

ዒሚያቘቃኹ ላኅ ኜ ዙቀቘቭ ቀ኉ ዩምሮ for approval of plans and issue approved plans
Aምስቭ ዓመቭ ኟቘቃ ቘኋላ ዗ጣኇል፡፡ after ascertaining full compliance with this
Proclamation and other laws.
3/ ቘዄህ A኉ቀ ኉Uስ A኉ቀ /1/ ወ዗ም /2/
ቘቨዱጤ ኹ መሠረቭ ላ኉ ኉ቮ ዒሚቆ዗
3/ A building officer shall inspect all buildings
ቘቭ ዳ዆ ሲያቘቃ ዳ዆ኹ E኉ዛራዂም ቘዄህ under the territorial jurisdiction of the urban
A኷ጅ መሠረቭ ላኅ኉ E኉ዙዱኇ ዒማ ዙቅ administration or designated organ to ascertain
ጉያቄ መቅረቝ ዗ኊርቘቫል፡፡ conformity with this Proclamation and other
laws.

1/ Eያ኉ዜ኉ዚ ዒኜቨማ Aስቨዜዙር ወ዗ም ዒቨ 4/ A building officer may be assisted by staff of


ሰዒመኹ Aኟል Aስቨዜዙሩ኉ ወ዗ም Aኟጥ኉ the urban administration or designated organ in
ቘመወኜል ዒዄህ኉ A኷ጅኇ ዒሌጪት኉ the discharge of his duties; provided, however,
ሕጐት ዞ኉ዴድኺት ጤማስ ም that he shall be responsible for the ruling on
ዒሚያስትል Aስ ላዳኹ ዒቭምህርቭኇ applications for approval of plans and
inspection reports.

5/ A building officer is empowered to order
inspection of exempted buildings erected before

ኹስጉ ያጥ ሕ኉ፃኺት ኜዄህ A኷ጅኇ error; provided, however, that he must have
ኜሌጪት ሕጐት ዴር ዒሚሰማሙ adequate justification for ordering such
መጣኇተኹ኉ ጤማረዴዱጉ ቁጉጉር rectification work.

7/ Without prejudice to his criminal liability, the

body shall make good the damage incurred by

connection with review of plans for which he is

13. Appeals

02. ኹኡልኇ 1/ Each urban administration or designated organ


shall establish a board of appeal which shall

ቘቨያያዂ ራሱ ቘሙጥም ጣኄ ቘኜ ል enable them to decide cases in accordance with

2/ The board of appeal shall have the power to
hear, and decide on, decisions taken by building

1/ A Building officer may order a building
3/ ዒኜቨማኹ Aስቨዜዙር ወ዗ም ዒቨሰዒመኹ constructed without approved plans to be
Aኟል ዒ ዙቁቭ኉ ወ዗ም ኹዞቅ ዒቨዙረ demolished, if the plans utilized to construct
ዲቭ኉ ሰኄዟት ቘህ኉ፃ ሹሙ ስም ዗ሰጇል፡፡ such building does not comply with the
provisions of this Proclamation or other laws.
4/ ላኊት኉ ጤመዱምዱም ዒሚሰጄኹ ኹኡልኇ
2/ In the event that the owner of a building who
ዒቁጉጉር ቨዶቛራቭ኉ም Eስኜማኜኇወ኉ has been ordered by a building officer to
ዞረስ ጦሰ ዗ትላል፡፡ demolish or remove his building fails to comply
with the order, the urban administration or
03. ስጤ ዗ዶቛኑ designated organ may demolish or remove the
building and claim the incurred expenses from

approved plans, and may suspend all works on

06. ስጤ ቨቆጇጇሪኺት

1/ ዒኜቨማ Aስቨዜዙር ወ዗ም ዒቨሰዒመ Aኟል 5/ Where the owner of a building fails to execute
an order issued to him in accordance with sub-

article (4) of this Article, the urban

ቘቫት ወርዟ ቘመዱኌቭ ዒቨሰራ ሥራ኉ 1/ When plans or other documents are required to
ላጤመቀቘል E኉ዙቘቂ ምኡ኉ያቭ ጣኊ be submitted for review, a plan review fee shall
ጦቆጄር ዗ትላል፡፡ be paid. Such fee shall be determined by
Regulation to be issued for the implementation
of this Proclamation.

2/ Plan review fees shall be charged on the basis
ዒጉራቭ ምርመራ ምስኡር ወረቀቭ of total gross floor area of one unit of each type

08. ዒህ኉ፃ መጄቀሚያ ቃዞ

1/ ቘምዞቝ ‘ሐ’ ሥር ዒሚመዙቝ Aዛስ 3/ A plan review fee shall be paid at the time of

1/ A building officer shall charge fees for the

22. Refund of Fees

1/ A building officer may, upon a request in writing
3/ ዒ ላ኉ መዱምዱሚያ ኡ ያ ዒሚኜ ጤኹ by the applicant, authorize the refund of fees
ላ኉ ጤማ ዙቅ ማመልኜታ ቘሚቀርቝቘቭ where services applied for are not rendered.

4/ ኹዞቅ ዒጣኅ ላኊት E኉ዙዱኇ ጤማ ዙቅ 2/ A request for refund under sub-article (1) of this
ቘሚቀር቙ቘቭ ዳ዆ ዒ ላ኉ መዱምዱሚያ Article shall be bared unless submitted within

23. Fines

1/ An urban administration or a designated organ
1/ ዒህ኉ፃ ሹም ዒህ኉ፃ ዶ኉ቛቫ ማስ ያ may impose administrative fines on persons
ወ዗ም ማሻሻያ ሥራ ላ኉ ጤማ ዙቅ who violate the provisions of this Proclamation.
ኡ ያ ያስኜ ላል፡፡ ዒኡ ያኹ መጄ኉ ዗ህ኉ The fine shall be determined by Regulation to

3/ All precautionary measures which should be

4/ A building officer shall grant permission to

ቘዄህ A኷ጅ ዒቨመጤኜቩቭ኉ ኜመ ም
ወ዗ም ቘኜቨማኹ Aስቨዜዙር ወ዗ም 5/ No person shall, at any time, during the course
ቘቨሰዒመኹ Aኟል ኜሚወሰዚ ቨጨማሪ of or after demolition of a building leave it in
Eርምዬኺት ኄፃ Aያዙርዱኹም፡፡ a condition dangerous to the public or any
adjoining property.
!4. ዳ዆ያ኶ ዶ኉ቛቫኺት
6/ Notwithstanding the provisions of sub-article
Aመልኟቱ ቘዳ዆ያ኶ ዶ኉ቛቫኄቭ ያሳወቀኹ኉ (1) of this Article, prior written consent from
ዶ኉ቛቫ ጤማኟጡዞ ማመልኜታ ያቀረቘ E኉ዙጣኄ the appropriate government organ shall be
required before repairing or extending
ዒኜቨማኹ Aስቨዜዙር ወ዗ም ዒቨሰዒመኹ Aኟል
buildings of historical value.
ዶ኉ቛቫኹ኉ ቘዄህ A኷ጅኇ ቘሌጪት ህጐት
መሠረቭ E኉ዛያኜኇኹ኉ ዳ዆ያ኶ ቃዞ
ጦሰጄኹ ዗ትላል፡፡ 26. Employment of Registered Professionals

!5. ዒAዱልዶጪቭ ጤኹጉ ስጤማዞረዶ 1/ A person intending to erect a building shall


ስጤማስ ቭ Eዞሳቭ ወ዗ም ጉዱኇ employ a qualified registered professional for
ስጤማዞረዶ Eኇ ስጤማ ረስ each type of design required for the category
of the building and retain their services for
the purpose of supervising the erection
1/ ዒህ኉ፃ ሹም ኜዄህ A኷ጅ ዴር thereof. The details shall be determined by
Eስኜቨጇጇመ ዞረስ ዒህ኉ፃ Aዱልዶጪቭ Regulation to be issued for the
ጤኹጉ ዒማዞረዶ ዒማስ ቭ Eዞሳቭ implementation of this Proclamation. The
technical work of the building design shall be

coordinated by the architect.
ቃዞ ዗ሰጇል፡፡
2/ Upon completion of building works, a

registered professionals referred to under
sub-article (1) of this Article, shall be

ዒሚ ወሰዚ ጉ኉ቃቄኺት ሁጥ ጦወሰዚ 27. Employment of Registered Contractors
዗ዱቛል፡፡
1/ A person intending to erect a building shall

኉ቝረቮት኉ ዙህ኉ኄቭ ጤAዙዴ ቘሚያዴልጉ out category “A” and “B” buildings shall
ሁኈቫ መቨኹ ዒጤቘቭም፡፡ produce a guarantee for any damage resulting
from any defective work due or negligence.
6/ ዒዄህ A኉ቀ ኉Uስ A኉ቀጽ /1/ ዞ኉ዴድ The form and the amount of the guarantee to
ቚኊርም ዒቫሪኟ኶ ቅርስኄቭ ኷ዴ ያላተኹ be produced for each category of building
ህ኉ፃኺት኉ ኜመጄዱ኉ ወ዗ም ኜማስ ቭ shall be determined by Regulation to be
ቘ ቭ ኜሚመጤኜቨኹ Aኟል ዒጽሁ issued for the implementation of this
ስምምኄቭ መዱኌቭ ዗ኊርቘቫል፡፡ Proclamation.

!6 ዒቨመዂዱ቙ ቛጤሙያኺት኉ ስጤመቅጄር


28. Responsibility of Contractors and Registered
Professionals
1/ ጤማ኉ኛኹም ህ኉ፃ ህ኉ፃኹ ጤሚዱኑቘቭ
ምዞቝ ዒሚጄዒቁ ዒዛዅ዗኉ ዓ዗ኄቮት 1/ Without prejudice to his criminal liability,
ጤዒሥ ራኹ ቘሚመጉኅ ዒቨመዂዱ቙ any registered professional, contractor or sub
ቛጤሙያኺት መሰራቭ ዗ኊርቛተ኷ል፡፡ contractor shall be liable for any damage he
዇ር዇ሩ ዗ህ኉ A኷ጅ ጤማስ ም causes to his employer in accordance with the
ቘሚወጇኹ ዙ኉ቝ ዗ወሰ ኇል፡፡ ዒህ኉ፃኹ provisions of the Civil Code due to his
ዶ኉ቛቫ Eስኞጄኇቀቅ ዞረ ስም defective design or construction work.

ኃላ ኄቭ Without prejudice to the provisions of Article 30
of this Proclamation:
1/ ማ኉ኛኹም ዒቨመዂዱቘ ቛጤሙያ ወ዗ም ዒሥራ
ቨቋራ጑ ቘ኷ኇ ወ዗ም ቘ኉Uስ ሥራ ቨቋራ጑
ኄቭ ወ዗ም ኜ ል ኹጤቫ ቘመኹሰዞ 1/ any building shall be designed and constructed
ያኜኇወኄኹ ዒህ኉ፃ ዛዅ዗኉ ወ዗ም ዒዶ኉ቛቫ in such a way that it shall not impair the

ዛዅ዗኉ መዙረዶ Aጤቘቭ፡፡ 1/ In cases where danger or serious inconvenience
to the public may ensue from the erection or
demolition of a building on any site, the
3/ ማ኉ኛኹም ህ኉ፃ ዒሰኺት኉ ዒሌጪት
urban administration or designated organ
ዶ኉ቛቫ ኺት኉ኇ ኉ቝረቮት኉ ዙህ኉ኄቭ
may require that the owner of the site, before
ቘማያሰዴ መ኉ ዱዞ ዛዅ዗኉ መዙረዶኇ such work is commenced, shall do all the
መዱ኉ቛቭ Aጤቘቭ፡፡ necessary preventive works.

"1. ቘዶ኉ቛቫ ወቅቭ መዙረዶ ስጤሚዱቛተኹ ጉ኉ቃ 2/ Where any work connected with the erection
ቄኺት or demolition of any building may, in the
opinion of the urban administration or
ዒዄህ A኷ጅ A኉ቀጽ " ዙ኉ዴድኺት designated organ, have any detrimental effect
E኉ዙቨጄቘቁ ጣኄኹ on the strength, standard, safety, quality or
position of its property or any property
1/ ማ኉ኛኹም ዶ኉ቛቫ ቘዶ኉ቛቫኹ Aኟቛቚ falling under its authority, it may require the
ዒሚ ኉ቀሳቀሱ ሰኺት኉ ዒዶ኉ቛቫኹ owner of such building to make such deposit
or give such security, as it may require to

cover the costs of the repair of any damage

thereof are accumulated around a

ዒAዱልዶጪቩ኉ ዙህ኉ኄቭ ጤመጄቘቅ ቘቂ in the notice.
ጉ኉ቃቄ ማዞረዶ Aጤቘቭ
4/ Any owner or persons carrying out work in

any building, may erect, at the site of such

ቘማያሰዴ ሁኈቫ መጄቘቅ Aጤቘቭ 5/ No owner or person shall commence or
continue the erection or demolition of any

ዒማ኉ኛኹ኉ም ኉ቝረቭ ወ዗ም Aዱልዶጪቭ are availed for all personnel employed for or
ዙህ኉ኄቭ Aዙዴ ላ዗ ጦጉል ዒሚትል መጣኅ in connection with such work, at the site or,
ሲዱመቭ ዒዶ኉ ቛቫ ቞ቫኹ ቛጤቜቭ with the permission of the urban
ቘቅዞሚያ ዒመኜላኜያ ዂዝኺት኉ኇ administration or designated organ, at some
ዒጉ኉ቃቄ Eርምዬኺት኉ ጤኜቨ ማኹ other place. The construction activity shall
Aስቨዜዙር ወ዗ም ጤቨሰዒመኹ Aኟል be interrupted till such facilities are provided.

6/ The urban administration or designated organ

"2. ቘዶ኉ቛቫ ቞ቫ ላ዗ ስጤሚኜኇወኅ ሥራኺት 1/ Any room or space shall have dimensions that

ቚያ኉ስ A኉ዞ ኡ ቨቭ ጦኊረኹ ዗ዱቛል፡፡ people shall be provided with adequate water
supply. Such water supply shall have

comply with health standards.
5/ Aሳ኉ሰሮት ያጤማቋረጉ Aዱልዶጪቭ E኉ዛ
ሰጅ መዙረዶ ዗ኊርቛተ኷ል፡፡ 3/ Water supply systems to any building shall be
accessible for inspection and testing.

38. Sewerage
1/ ማ኉ኛኹም ህ኉ፃኇ ዒህ኉ፃኹ ኡ ል ወ዗ም
Aኟል ቨቀቛ዗ኄቭ ቛጤኹ ዒህ኉ፃ ዛዅ዗኉
ዙ኉ቝ መሠረቭ ጉ኉ኟሬ኉ ቨዙላዞጪ 1/ Where in respect of any building a suitable
መቨኜ ል኉ ጤጉዱኇ ሥራ Aዱልዶጪቭ means of sewage disposal is available, the
Aመቲኄቭ኉ E኉ዛሁም ዂጤቄቫ኶ owner of such building shall provide a
Aስቨማማኑኄቭ኉ ጦያረ ዴዶጉ ዒሚትል sewerage installation.
ጣኊ ዛዅ዗኉ መዙረዶ Aጤ ቘቭ፡፡ E኉ዛህ
2/ Where any person has not any suitable sewage
ያጤኹ ዶ኉ቛቫ ቘAዱልዶጪቭ ዂመኅ
disposal in his vicinity he shall use any other
ኜቨመዙቘጤቭ ሸኡም ቘላ዗ Eስኟል ቨጏኄ
acceptable means to discharge his waste
ዞረስ ዒስቭራኡተር ትዶር ጦቫ዗ቘቭ water.

39. Control of Objectionable Discharge
2/ ማ኉ኛኹም ዶ኉ቛቫ ዒሌጪት ዶ኉ቛቫኺት኉
ወ዗ም ኉ቝረቮት኉ ዙህ኉ኄቭ ቘማያሰዴ 1/ No person may cause or permit sewage
መ኉ዱዞ ዛዅ዗኉ መዙረዶኇ መዱ኉ቛቭ discharged from any sanitary fixture to enter

river, stream, street or any other site.

41. Non-Water Borne Means of Sanitary Disposal
ዲዜቭ ላጤቛተኹ ሰኺት ዒሚመት መዜረሻ
መዂዴዩቭ Aጤቘቭ፡፡ Where water-bone sewage disposal is not
available, other means of sewage disposal shall be
2/ ዒመ ዜዬ ቜቭ ጦሠራቘቭ ቘሚዱቛ ቘማኇተ permitted by the urban administration or
ኹም ህ኉ፃ ኹስጉ ዒAኟል ዲዜቭ ላጤቛተኹ designated organ; provided however, that in the
ሰኺት ዒሚመቱኇ ጦዙርሱቛተኹ ዒሚትጥ case of chemical or pail closets an acceptable
ቘቂ መጄ኉ ያላተኹ መ ዜዬ ቜቮት መኊር means shall be available for the removal and
Aጤቛተኹ፡፡ disposal of sewage from such closets.

"7 ዒኹጠ Aቅር቞ቭ 42. Storm Water Disposal

1/ ጤሰኺት Aዱልዶጪቭ ዒቫሰቘ ማ኉ኛኹም


1/ The owner of any site shall provide acceptable

means for the control and disposal of

within the site.

መጣ኉ ዗ኊርቘቫል፡፡
Any building, excluding dwelling house, in which
refuse is generated, shall be provided with an

ዒዷር ማስወዱዬ ቞዗ ወ዗ም ቘሌላ መልኝ ወዙ
ቨዱኄቛ ዒኹጠ መስመር ወ኉዇ ም኉጑ ዷዜኇ Any public building shall be designed and

Any approved fire fighting installation may be

connected to the water supply system of the urban
administration or designated organ; provided,

designated organ may, subject to any conditions it

1/ any approved alternative source of supply; or

E኉ዛያኜኇኹ኉ ቃዚ ሲሰጄኹ ቘኜቨማኹ
Aስቨዜዙር ወ዗ም ቘቨሰዒመኹ Aኟል ዒቨጄዒቀ

other purpose which, in the opinion of the
urban administration or designated organ
might give rise to health hazard.

ቘኹጠ Aማኟኑኄቭ ቆሻሻ ዒማስወዱዬ ዶ኉ቛቫ 46. Supply of Water for Fire Protection
ቘሌጤቘቭ ቞ቫ ሌጪት ቆሻሻ ማስወዱዬ ዂዝኺት
ጉቅም ላ዗ E኉ዛኹጥ ዒኜቨማኹ Aስቨዜዙር Water may not be taken from a supply system for
ወ዗ም ዒቨሰዒመኹ Aኟል ጦ ቅዞ ዗ትላል use by any fire fighting installation, unless:
ጣኊም አሚኟል ወ዗ም ዇ዶ ቆሻሻ ማስወዱዬ
ቘሚኊርቘቭ ዳ዆ ቆሻሻኹ኉ ኜEቃኹ ጤማስወዱዞ 1/ the use of such fire protection installation and
ቨቀቛ዗ኄቭ ያጤኹ ዂዝ ጦኊር ዗ዱቛል፡፡ water complies with any conditions
prescribed by the urban administration or
#2. ዒዷር ኹሀ ስጤማስወዱዞ designated organ.

1/ ዒማ኉ኛኹም ዗ወቫ ቞ጤቜቭ ቘማኇተኹም


2/ the permission of the urban administration or
ዒA ር ሥራ ዶ኉ቛቫ ወ዗ም ዞልዙላ
designated organ has been obtained upon

ዒሚያመኄ጑ ማ኉ኛኹም ዶ኉ቛቫ ዒዙረቅ ቆሻሻ
47. Application of the Criminal Code
ማኜማታ ዒሚቀመጉቘቭ ቘቂ ቞ቫ ጦኊረኹ
዗ዱቛል፡፡ 1/ Offences committed by government officials and
other civil servants who are entrusted with the
power of issuing construction work permits for
construction works, or offences committed by
registered professionals, contractors or by building
owners in contravention of the provisions of this
Proclamation shall be punishable in accordance
with the provisions stipulated under this part.

2/ Notwithstanding the provisions of sub article
(1) of this Article, the provisions of the
ኡ ል Aምስቭ General Part of the Criminal Code relating to
Eሳቭ መኜላኜልኇ ዒEሳቭ ማጉ ያ ቨኜላ the commission of a crime and the sentencing
thereof shall be applicable for crimes

48. Improper Granting of Work Permit
ቛጤኹ ዒEሳቭ መኜላኜያ ዛዅ዗኉ መስ ርቭ
መሠረቭ ዒEሳቭ Aዙዴ኉ ጦቋቋምኇ ዒEሳቭ 1/ A building officer, or any other person who is
Aዙዴ ቚኜሰቭ ቘቨጄቃሚኺትኇ ቘAኟቛቚኹ vested with the power of granting permit for
ላ዗ ዒሚዙርሰኹ኉ Aዙዴ ጦቀ኉ስ ቘሚትል construction works intentionally :
መልኡ ዛዅ዗኉ ጦዙረዶኇ ጦዱኄቛ ዗ዱቛ኷ል፡፡

#5. ስጤEሳቭ ማጉ ያ ቨኜላ a) grants construction work permit to a person


who has no legal possession on the land on
which the building is to be constructed; or
ቃዞ ቨዱኑቮ ዒቨቨኜጤ ማ኉ኛኹም ዒEሳቭ
ማጉ ያ ዒኜቨማኹ Aስቨዜዙር ወ዗ም
ዒቨሰዒመኹ Aኟል ኜዂረዴኹ ዒኹጠ መስመር b) grants construction work permit to a person
ኹሀ መጄቀም ዗ትላል፡፡ ጣኊም ዒኜቨማኹ whose documents supporting the application
Aስቨዜዙር ወ዗ም ዒቨሰዒመኹ Aኟል Aስ ላዳ are illegal or falsified; or
ጣኊ ዒቨዱኌኹ኉ ቅዞመ ሁኈቫ ቘማስቅመጉ
E኉ዛህ ያጤኹ ዒEሳቭ ማጉ ያ c) grants an occupancy permit to a person
whose building design or the construction
1/ ኜሌላ Aማራ጑ ዒኹጠ መስመር ወ዗ም thereof is not in compliance with the relevant
plan of the urban center in which such a
building is to be constructed;
is punishable with rigorous imprisonment from
2/ ቘኜቨማኹ Aስቨዜዙር ወ዗ም ቘቨሰዒመኹ five years to ten years and a fine not less than birr
Aኟል Eምኄቭ ቘገኇ ላ዗ ትዶር ten thousand and not exceeding fifty thousand birr.
ጦያስኜቭል ቘሚትል መልኝ ጤሌላ
Aዱልዶጪቭ Eስኟል ኷ጤ ዞረስ ጤመጄጉኄቭ

penalty shall be imprisonment from one year

ቃቀም ኜኜቨማኹ Aስቨዜዙር ወ዗ም ኜቨሰ
ዒመኹ Aኟል መስ ርቭ ዴር ዒሚስማማ
1/ Any building officer or other public servant or any
መጣኅ ኟልቨረዴዱጄ other person under contractual agreement, who is
entrusted with supervising a building under
2/ ጤኜቨማኹ Aስቨዜዙር ወ዗ም ጤቨሰዒመኹ construction in accordance with this Proclamation,
Aኟል ቘቅዞሚያ ማመልኜታ ቀር቞ ቃዞ intentionally refrains from stopping or causing the
ኟልቨሰጄ stoppage of the construction of a building the
illegality of which he knows or should have
ጦኜኇወ኉ A዗ትልም፡፡ known shall be punishable with rigorous
imprisonment from five years up to ten years and
with a fine not less than birr ten thousand and not
exceeding fifty thousand birr.

ሥራ ቃዞ኉ ቘሚሰጅ ዒመ኉ዶሥቭ ኃላ ኺት
Eኇ ዗ህ኉ኅ E኉ዛያኜኇኹኅ ጠላ ኄቭ A building officer or any other public servant
ቘቨሰጇተኹ ሌጪት ዒመ኉ዶሥቭ ሠራቨኒት vested with the power of the building officer, or
ቘቨመዂዱ቙ ቛጤሙያኺት ወ዗ም ሥራ who is in charge, at any level, of issuing any
ቨቋራጒት E኉ዛ ሁም ቘዶ኉ቛቫ ቛጤቜቮት document under his authority, with intent to
ዒሚ ሙ ጉ ቮት ቘዄህ ኡ ል ኹስጉ obtain an advantage, directly or indirectly, from
ቘቨመጤኜቨኹ መሠረቭ ዗ወሰኇጥ፡፡ any person interested in a matter brought to his
attention by reason of his responsibility, or to
2/ ዒዄህ A኉ቀጽ ኉Uስ A኉ቀጽ /1/ ዞ኉ዴድ benefit or injure any other party interested in such

ዒወ኉ዩል ህዲ ዒጄቅላላ ኡ ል ዞ኉ዴድኺት for the implementation of this Proclamation, or
ቨ ፃሚኄቭ ዒቨጄቘቀ ኄኹ፡፡ abuses the interested party contrary to law, or
accepted office practices, is punishable with

ሀ/ Aዶቛቝ ቛጤኹ Aኟል ዒቨሰጄ ህዴ኶ ዒመ 1/ Any public servant who is entrusted with the
ሬቭ ዗ወቫ ማረዴዱጏ ጤሌጤኹ ሰኹ filing, keeping, or verifying or delivering of
ቘ቞ቫኹ ላ዗ ጤሚኜኇወ኉ ዶ኉ቛቫ documents related to the possession and use
ዒዶ኉ቛቫ ቃዞ ዒሰጄ E኉ዙጣኄ ወ዗ም of land, as well as documents related to the
construction of buildings thereon, with intent

should not have been performed by the qualified

ቘመወኜል E኉ዛሰራ ኃላ ኄቭ ዒቨሰጄኹ ሌላ who is issued with a work permit by the
ዒመ኉ዶሥቭ ሠራቨኛ ወ዗ም ቘዒዙረዬኹ relevant authority፡
ዒቨጤያዓ መረዬ ኺት኉ ወ዗ም ሰኄዟት኉
ጤመስጄቭ ኃላ ኄቭ ዒቨሰጄኹ ዒመ኉ዶሥቭ a) performs a construction work with a low
ሠራቨኛ ቛጤዲዜ዗኉ ጤመዲዜቭ ወ዗ም quality or below standard material in
ቘቀጉቫም ጣኄ ቘቨዂ኷኷ሪ መ኉ዱዞ ኜቛጤዲዜዓ contravention of the standard set or the
ዒዱ኉ዂቝ ወ዗ም ሌላ ጉቅም ጤማዶኌቭ ቘማሰቝ accepted practice for such type of

is punishable with rigorous imprisonment

ዒቨሰጄኹ ዒመ኉ዶሥቭ ሠራቨኛ ቘዲዜዓ ጉቅም qualified nor authorized to perform such

ወ዗ም ጤራሱ ወ዗ም ጤሌጪት ቨዱቚ ያልጣኄ

ዒሰጄ E኉ዙጣኄ ወ዗ም an occupancy permit is not obtained or
to a service other than to which a permit
ጤ/ ቘቭኡኡል መዶጤጽ ያጤቘቭ኉ ሁኈቫ is obtained from the relevant body, or
ዒሚ ያስዱኌኹ኉ ኹገቭ ጤማስቀረቭ
d) constructs or causes the construction of his
ወሳኑ ኄቭ ያጤኹ኉ ሬ ኄዱር ያስቀረ
building in any other manner which
E኉ዙ ጣኄ endangers public safety;

2/ ዒቨሳሳቨኹ መረዬ ዒቨሰጄኹ መረዬኹ ዒሚ


ያስኜቭጤኹ኉ ዲዜቭ ጤመረዜቭ ዒሙያ Eኹ 3/ Where the crimes specified in sub article (1)
ቀቩ ወ዗ም ዒሥራኹ ኃላ ኄቭ ቘሚ ቅዞ and (2) of this Article are committed
ጤቭ ሠራቨኛ ዒጣኄ E኉ዙጣኄ ቅጇቩ ኜAም negligently, the penalties shall be

Aምስቭ ዓመቭ ጦዙርስ ቘሚትል construction consultant:
Eሥራቭኇ ኜቝር A኉ዞ ሺ Eስኜ ቝር
Aምስቭ ሺ ቘሚዙርስ ዒዱ኉ዂቝ መቀጒ a) prepares the design or other relevant
዗ጣኇል፡፡ documents of a construction without
having due regard to the general safety
$2. ዙረዬኹ ዒማ዗ ቅዞጤቭ ዶ኉ቛቫ ማኜኇወ኉ regulations set forth for such specific
work; or

ወ዗ም ቘ኉Uስ ሥራ ቨቋራ጑ኄቭ Aዶቛቝኄቭ supplier to procure or use a cheaper or,
ቛጤኹ Aኟል ዒቨሰጄኹ ዒሙያ ዙረዬ unwarranted quality or different material
ዒማ዗ ቅዞጤቭ኉ ማ኉ኛ ኹ኉ም ዒዶ኉ቛቫ ሥራ which is not acceptable by normal
Aኜኇኹኊ ዒቨዱኌ E኉ዙጣኄ ወ዗ም ማ኉ኛኹም standards for the specific work, or
Aዶቛቝ ኟጤኹ Aኟል ዒቨሰጄ ዒሙያ ቃዞ relieves him of using a specific material
ሳ዗ኊረኹ ቘቛጤሙያ ጦሰራ ዒሚዱቛኹ኉ ዶ኉ቛቫ essential thereto; or
ሠርቮ ዒቨዱኌ E኉ዙጣኄ ኜAምስቭ ዓመቭ Eስኜ
Aሥር ዓመቭ ቘሚዙርስ ኅ Eሥራቭ Eኇ ኜቝር c) approves a construction work capable of
Aምስቭ ሺህ Eስኜ ቝር Aሥር ሺህ ዗ቀጇል፡፡
endangering public safely or the life,
$3. ዙረዬኹ኉ ያልጄቘቀ ዶ኉ቛቫ ስጤማኜኇወ኉ health or person of others or the safety of

ዒኄቘሩ ስህቨቮት኉ ሳያርም ወ዗ም advantage or with intent to cause damage in
E኉ዛቫረሙ ሳያዙርዶ ያኜኇወኄኹ any manner destroys, endangers falsifies,
ዶ኉ቛቫ Aዙዴ ያስኜቨጤ E኉ዙጣኄ deletes, or falsifies by modifying, deleting, or

under this part of the law shall be suspended for a

the Ministry shall have the following powers and duties

of the Federal Government, capacity building and
