ዒሕቝ ገኄቭኇ ዙህኄቭ Eዛረዴዱጉ ጤማዞ WHEREAS, it has been found necessary to

1. Aር ርEስ
This Proclamation may be cited as the “Ethiopian

2. Definitions
In this Proclamation, unless the context otherwise
2. ቭርጓሜ
requires:
ዒቃጥ Aዱቛቝ ዒቨጤዒ ቭርዲም ዒሚያሰጄኹ ኟል
ጣኄ ቘስቨቀር ቘዄህ Aጅ ኹስጉ 1/ “Ministry” means the Ministry of Works and
Urban Development;
1/ “ሚኆስቬር” ማጤቭ ዒሥራኇ ኜቨማ
ልማቭ ሚኆስቬር ኄኹ 2/ “building” means a permanent or temporary
construction used for the purpose of dwelling,
2/ “ሕፃ” ማጤቭ ጤመኊሪያ ጤቚሮ ጤ ቝሪኟ office, factory or for any other purpose;
ወም ጤማኇተኹም ሌላ Aዱልዶጪቭ
ዒሚኹል ቋሚ ወም ዳያ ዶቛቫ ኄኹ 3/ “building officer” means a person appointed by
an urban administration or designated organ to

construction professional or a juridical person
4/ “ዒቨመዂዱቘ ቛጤሙያ” ማጤቭ ሥልጇ ቛጤኹ which is issued with a certificate as a design or
Aኟል ቨመዶ ቘዛዅ ወም ቘኢስቭራ construction consultant by the relevant body;
ኡሽ ዒቛጤሙያኄቭ ዒምሥኡር ወረቀቭ ዒቨሰ
ጄኹ ሰኹ ወም ቘዛዅ ወም ቘኢስቭ
ራኡሽ ዒAማኟሪኄቭ ዒምዱቛ ምሥኡር ወረ 5/ “a registered contractor” means a juridical
ቀቭ ዒቨሰጄኹ ዞርጅቭ ኄኹ person who is registered and issued with a work
permit by the relevant authority as a contractor;
5/ “ዒቨመዂዱቘ ዒሥራ ቨቋራ” ማጤቭ
ሥል ጇ ቛጤኹ Aኟል ቨመዶ ዒሥራ
ቨቋራ ኄቭ ዒምዱቛ ዒምስኡር ወረቀቭ 6/ “category ‘A’ building” means a one story
building with a span of 7 meters or less
ዒቨሰ ጄኹ ዞርጅቭ ኄኹ
between two reinforced concrete, steel or other
structural frames or any dwelling house not

exceeding two stories;

ወም ኜዄያ ቘቫት ዒጣኄ ቛጤAዞ ቅ
ሕፃ ወም ማኇተኹም ኜሁጤቭ ቅ ቘቫት
7/ “category ‘B’ building” means a building with
ዒጣኄ ዒዶል መኊሪያ ቜቭ ኄኹ a span of more than 7 meters between two
reinforced concrete, steel or other structural
7/ “ምዞቝ ‘ለ’ ሕፃ” ማጤቭ ቘሁጤቭ ዒኢኡሪቭ
frames or of two or more stories not covered in
ወም ዒቝረቭ ወም ሌጪት ስቭራኡተራል
category ‘C’ or a real estate development of
ኹቅሮት መኟኜል ያጤኹ ርቀቭ ኜ7 ሜቭር category ‘A’;
ቘላ ዒጣኄ ወም ቛጤሁጤቭ ቅኇ ኜሁጤቭ
ቅ ቘላ ዒጣኄኇ ቘምዞቝ ‘ሐ’ ዒማሸ 8/ “category ‘C’ building” means any public or
ሕፃ ወም ቘምዞቝ ‘ሀ’ ዒቨመዙቘ institutional building, factory or workshop
Eዙሪል ስቬቭ ያጤ ዒቜቮት ልማቭ ኄኹ building or any building with a height of more
than 12 meters;
8/ “ምዞቝ ‘ሐ’ ሕፃ” ማጤቭ ዒሕቝ መዱልዱያ
ወም ቨቋም ኄኡ ሕፃ ዒ ቝሪኟ ወም
ዒወርኡሾ ሕፃ ወም ኜመሬቭ Eስኜ 9/ “construction” means the construction of a new

ቘላ ዒጣኄ ማኇተኹም ሕፃ ኄኹ building or alteration of its use;
9/ “ዶቛቫ” ማጤቭ Aዛስ ሕፃ መዱቛቭ 10/ “dangerous building” means a building that is
ወም ኄቛር ሕፃ ማሻሻል ወም structurally unsafe or constitutes a special
fire hazard or health risk;

05/ “ ላ” ማጤቭ ዒAዞ ሕፃ መጄ ዓኄ 16/ “Regional State” means any regional state
ቭኇ ስ ቭ Eዛሁም ሕፃኹ ዒሚሠራቘቭ established in accordance with Article 47 of
ቁሳቁስኇ ዒAዱኄቛቝ ዂዝ ዒሚያሳ ዞ the Constitution of the Federal Democratic
ወም ሞዝል ሲጣ ዒAርኡቬኡተር ዒስቭ Republic of Ethiopia and includes the Addis
ራኡተር ዒሳኆቨሪ ዒኤሌኡቭሪኟል ዒሜኟ Ababa and Dire Dawa city administrations;
ኆኟል ዒEሳቭ መኜላኜልኇ ዒሌጪት
ሥራኺት ዞ ጦያኟቭቭ ትላል 17/ “stop order” means any order given by a
building officer or by a building inspector to
06/ “ኡልል” ማጤቭ ቘሕዱ መዶሥቩ discontinue activities on a building

ዒዞሬዜ ኜቨማ Aስቨዜዙሮት 18/ “story” means that part of a building which is
ጨምራል situated between the top of any floor and the
top of the floor next above it, or if there is no
07/ “ዒማስቆሚያ ቭEዅ” ማጤቭ ቘAዞ ዒሕ floor above it that portion between such floor
ፃ ዶቛቫ ቫ ዒሚኟጡዞ ሥራ Eዛቋ and the ceiling;

19/ “urban administration” means an organ to

which powers and duties of administering an
ኄኹ urban center have been given by law or
delegated by the concerned government
08/ “ ቅ” ማጤቭ ቘሁጤቭ ወጤጪት መኟኜል body;
ወም ኜላ ሌላ ወጤል ኜሌጤ ቘወጤጥኇ 20/ “urban center” means any locality having a
ቘኰርኆስ መጠል ያጤኹ ዒሕፃ ኡ ል municipal administration or a population size
ኄኹ of 2,000or more inhabitants, or which at least
50% of its labour force has, primarily,
09/ “ዒኜቨማ Aስቨዜዙር” ማጤቭ ቘሕዶ engaged in non –agricultural activities.

05. ስጤ ማስቫወቂያ
1/ An urban administration or a designated organ
1/ ቘምዞቝ ‘ጤ’ ወም ‘ሐ’ ሥር ዒሚወዞቅ shall issue special identification badges to
ህፃ ጤመዱቛቭ ዒ ዙቀ ላ ያጤኹ ሰኹ building officers and inspection staff working
ዶቛቫኹ ዒሚኟጡዞቘቭ ዳ ዒሚያሳ under their supervision.
ማስቫወቂያ ጤሚመጤኜቨኹ ዒህፃ ሹም
ማቅረቝ ኊርቘቫል፡፡
2/ Inspectors carrying an urban administration’s or
a designated organ’s badge identifying them
2/ ቘዄህ Aቀጽ Uስ Aቀጽ /1/ መሠረቭ shall be permitted access to any building
ቘቀረቘ ማስቫወቂያ ላ ህፃ ሹም ዒሚሰ completed or under construction at any working
ጄኹ ኹሳኈ ዒዳ ዱዙቝ ህ Aጅ ጤማ hours.

1/ ዒኜቨማ Aስቨዜዙር ወም ዒቨሰዒመ Aኟል 5/ Where the owner of a building fails to execute
an order issued to him in accordance with sub-
ጤህፃ ሹምኇ ቘEሱ ቁጉጉር ሥር ጤሚሰሩ
article (4) of this Article, the urban
ቨቆጇጇሪኺት ቘልቝስ ላ ዒሚጄጤጄል
administration or the designated organ may
ማኄቫተኹ ዒሚዱል ዒመቫወቂያ ወረ cause the work to be rectified, removed or
ቅቭ Eዛኊራተኹ ያዙርዴል፡፡ demolished at the expense of the owner.
1/ ቘምዞቝ ‘ሐ’ ሥር ዒሚመዙቝ Aዛስ 3/ A plan review fee shall be paid at the time of
ዒቨዱኄቛ ህፃ ቘዄህ Aጅ መሠረቭ submitting an application for approval of plans.
መስ ርቩ ማሟላቩ ቘ ቨሻ
ኟልቨረዴዱጄኇ ዒመጄቀ ሚያ ቃዞ
ኟልቨሰጄ ቘስቨቀር ህፃኹ ጉቅም ላ 4/ When rejected plans are re-submitted for

charged, The rate of such fee shall be
determined by Regulation to be issued for the

20. Plan Approval Fees
09. ዒ ላ መዱምዱሚያ ኡ ያ 1/ For inspection visits a fee per visit shall be paid
in accordance with the category of buildings.
1/ ላኇ ሌጪት ሰኄዟት ቀርቘኹ Eዛመ The fees shall be determined by Regulation to

4/ ኹዞቅ ዒጣኅ ላኊት Eዙዱኇ ጤማ ዙቅ 2/ A request for refund under sub-article (1) of this
ቘሚቀርቘቭ ዳ ዒ ላ መዱምዱሚያ Article shall be bared unless submitted within
ኡ ያ ቘዞዴሚ ኜ ላል፡፡ ዒኡ ያኹ six months from the date of payment.

23. Fines
!. ስጤ ላ ማ ዙቂያ ኡ ያ
1/ An urban administration or a designated organ
1/ ዒህፃ ሹም ዒህፃ ዶቛቫ ማስ ያ may impose administrative fines on persons
ወም ማሻሻያ ሥራ ላ ጤማ ዙቅ who violate the provisions of this Proclamation.
ኡ ያ ያስኜ ላል፡፡ ዒኡ ያኹ መጄ ህ The fine shall be determined by Regulation to
Aጅ ጤማስ ም ቘሚወጇኹ ዙቝ be issued for the implementation of this
ወሰኇል፡፡ Proclamation.
2/ ቨዙዴዴሚ ወጤጪት ወም Aሀዟት 2/ The payment of fines may not relief the offender
ቘሚመጤኜቭ ዒ ላ ማስ ዙቂያ ኡ ያ from complying with the requirements of this
ዒሚጄዒቀኹ ዒወጤጥ Aጄቃላ ስ ቭ Proclamation and of additional legal measures
to be taken by the urban administration or the

24. Temporary Constructions
1/ ጤቁጉጉር ሲቛል ጤሚዙረዶ ዲቝኑቭ ዒህፃኹ
Where an application is made to erect a building

which the applicant has declared to be a

ማኛኹም ህፃ ጤሚዱኑቘቭ ምዞቝ ዒሚያስ
ልዲ ዛዅኊት ጦዂዴዪጤቭ ዱቛል::
"1. ቘዶቛቫ ወቅቭ መዙረዶ ስጤሚዱቛተኹ ጉቃ 2/ Where any work connected with the erection
ቄኺት or demolition of any building may, in the
opinion of the urban administration or
ዒዄህ Aጅ Aቀጽ " ዙዴድኺት designated organ, have any detrimental effect
Eዙቨጄቘቁ ጣኄኹ on the strength, standard, safety, quality or
position of its property or any property
1/ ማኛኹም ዶቛቫ ቘዶቛቫኹ Aኟቛቚ falling under its authority, it may require the
ዒሚ ቀሳቀሱ ሰኺት ዒዶቛቫኹ owner of such building to make such deposit
or give such security, as it may require to

cover the costs of the repair of any damage

which may be caused by such work.

ኊርቘቫል 3/ Where construction materials or residues
thereof are accumulated around a

4/ Any owner or persons carrying out work in

ቘማያሰዴ ሁኈቫ መጄቘቅ Aጤቘቭ 5/ No owner or person shall commence or
continue the erection or demolition of any

ዒማኛኹም ቝረቭ ወም Aዱልዶጪቭ are availed for all personnel employed for or
ዙህኄቭ Aዙዴ ላ ጦጉል ዒሚትል መጣኅ in connection with such work, at the site or,
ሲዱመቭ ዒዶ ቛቫ ቫኹ ቛጤቜቭ with the permission of the urban
ቘቅዞሚያ ዒመኜላኜያ ዂዝኺትኇ administration or designated organ, at some
ዒጉቃቄ Eርምዬኺት ጤኜቨ ማኹ other place. The construction activity shall
Aስቨዜዙር ወም ጤቨሰዒመኹ Aኟል be interrupted till such facilities are provided.
ቘማቅረቝ ዒ ሁ ቃዞ ማዶኌቭ Aጤቘቭ
6/ The urban administration or designated organ
5/ ማኛኹም Aዛስ ዒሚዱኄቛ ህፃ መሠረቭ may device mechanisms to administer the
ኄቭ ቘኄቛር መሠረቮት ዒAዱልዶጪቭ safety requirement during construction.

33. Architecture
"2. ቘዶቛቫ ቫ ላ ስጤሚኜኇወኅ ሥራኺት 1/ Any room or space shall have dimensions that
shall ensure that such room or space is fit for
the purpose for which it is intended.
1/ ማኛኹም ህፃ ሲዱኄቛ ወም ሲ ርስ
ቘሕ ቝ ላ Aዙዴ ወም ኜ ቨኛ
2/ The floor area of any dwelling unit may not
መዲላላቭ ጦያስኜቭል ዒሚትል ኜጣኄ be less than that necessary to provide one
ዒዶቛቫ ቫኹ ቛጤቜቭ ሥራኹ habitable room and a separate room

Aስቨዙዙር ወም ቘቨሰዒመኹ Aኟል 3/ Any habitable room in any dwelling building
ጦጄዒቅ ትላል፡፡ or dwelling unit, or any bedroom in any
building used for residential or institutional
2/ Aዞ ህፃ ኜመዱቛቭ ወም ኜማ ረስ occupancy shall, in addition to the provision

4/ Any building, which is more than 20 meters

above the ground floor, shall be provided

with a lift or other similar service.

ዲዜቭ መጄዱኛ ዒሚኹል ማስያዣ ወም 5/ Lifts shall be made to provide service without

PART FOUR
WATER SUPPLY AND SANITATION
2/ ዒማኛኹም ዶቛቫ ዒኹጠ Aቅርቭ ዂዝ 2/ The owner of any site shall provide suitable

within the site.

መጣ ኊርቘቫል፡፡
Any building, excluding dwelling house, in which
refuse is generated, shall be provided with an

"9. ቨቀቛኄቭ ዒሌላተኹ ሳሾት መቆጇጄር FIRE PROTECTION AND FIRE FIGHTING
INSTALLATION
1/ ማኛኹም ሰኹ ኜመ ዜዬ Aዱልዶጪቭ መስጏ
ኺት ዒሚወጇ ሳሽ ቆሻሻ ወዙማኛኹም 44. General Requirement
ዒዷር ማስወዱዬ ወም ቘሌላ መልኝ ወዙ
ቨዱኄቛ ዒኹጠ መስመር ወ ም ዷዜኇ Any public building shall be designed and
ወም ሌላ ስ ራ መልቀቅ ወም Eዛጤቀቅ constructed in accordance with acceptable fire

resistant and, if fire occurs, it minimizes accident
to its users and its surroundings.
ቘኹጠ Aማኟኑኄቭ ቆሻሻ ዒማስወዱዬ ዶቛቫ 46. Supply of Water for Fire Protection
ቘሌጤቘቭ ቫ ሌጪት ቆሻሻ ማስወዱዬ ዂዝኺት
ጉቅም ላ Eዛኹጥ ዒኜቨማኹ Aስቨዜዙር Water may not be taken from a supply system for
ወም ዒቨሰዒመኹ Aኟል ጦ ቅዞ ትላል use by any fire fighting installation, unless:

ቨቋራ ጤዄሁ ዶቛቫኹ ጦኹል 3/ supervise compliance with the implementation
ኜሚዱቛኹ ያኄሰ ዒጉኟሬ ወም ዒጉራቭ of this Proclamation by Regional States and
ዙረዬ ያጤኹ ዒዶ ቛቫ Eቃ Eዛያቀርቝ urban centers .
ወም Aዱልዶጪቭ ላ Eዛኹል ቃዞ
ወም ስምምኄቭ ቘመስጄቭ ወም 4/ provide, in coordination with other relevant organs
of the Federal Government, capacity building and
ሐ/ ሙያኹ ዒሚጄቀኹ ሥኄ ምዶቛር ቘመ technical support to Regional States and urban
ጇስ ቘዶቛቫ ሙያ ዂር ቨቀቛኄቭ centers so that they will be able to implement this
ዒማ ኊረኹ ወም ኜዙረዬ ቘቫት ዒጣኄ Proclamation.

ስምምኄቩ ቘመስጄቭ ዒሕ ቝ ዙህኄቭ
ጤAዙዴ ዒሚያዴልጉ ዶቛቫ Aዱልዶጪቭ With respect to the implementation of this
ላ Eዛኹል ያዙረዱ Eዙጣኄ Proclamation Regional States shall have the following
ኜAምስቭ ዓመቭ Eስኜ Aሥራ Aምስቭ ዓመቭ powers and duties to:
ቘሚዙርስ Eሥራቭ ወም ኜቝር ሠላሳ ሺ
Eስኜ ቝር ጠምሳ ሺ ቘሚዙርስ ዒዱዂቝ ቅጇቭ 1/ without prejudice that the rules could be
ቀጇል፡፡ rebutted on grounds of professional or
scientific justifications, issue design and
2/ ቘዄህ Aቀጽ Uስ Aቀጽ /1/ ዒቨመጤ construction rules and standards applicable in
ኜቨኹ ጉ ቭ ዒቨ መኹ ቘተልቨኑኄቭ their own urban centers based on local
ዒጣኄ Eዙጣኄ ቅጇቩ ኜAዞ ዓመቭ Eስኜ circumstances and without contradicting the
Aምስቭ ዓመቭ ጦዙርስ ቘሚትል provisions of this Proclamation;

ዴጇ ቫቭሞ ኜወጇቘቭ ቀ ዩምሮ ዒ ኇ ጣኇል” stated as “ This Proclamation shall come into force upon
the date of its publication in the Federal Negarit Gazeta”
ዒሚጤኹ “ህ Aጅ ቘ ዝራል ኄዴሪቭ ዴጇ ቫቭሞ
shall be read as “This Proclamation shall come into force
ኜወጇቘቭ ቀ ዩምሮ Aዞ ዓመቭ ኟቘቃ ቘኋላ after one year from the date of its publication in the
ቨ ፃሚ ጣኇል፡፡” ቘሚል ኄቘቝ፡፡ Federal Negrit Gazeta.”
