MINUTES OF THE OPEN MASS MEETING OF THE SANGGUNIANG BARANGAY OF WAWA ILAYA
HELD ON FEBRUARY 3, 2024, 3:00PM AT R. VENTURANZA CENTRAL SCHOOL.

WHEREAS, Section 16 of RA 7610 otherwise known as the Local Government Code of 1991 states that
“Every local government unit shall exercise the powers expressly granted, those necessarily
implied therefrom, as well as powers necessary, appropriate, or incidental for its efficient and
effective governance, and those which are essential to the promotion of the general welfare,
within their respective territorial, jurisdictions, local government units shall ensure and support,
among others, promote health and safety, maintain peace and order, and preserve the comfort
and convinience of their inhabitants”;
WHEREAS, loud playing of stereo/sound system, continous blowing of horns, the use of specialized or
modified mufflers and other noise originating from motor vehicles, machines, equipments and
other sources of noise is beleived to be harmful to health not to mention that every citizen
notwithstanding, deserves a quiet and peaceful night for a much needed rest;
WHEREAS, there is a need to enact an ordinance that will contain a general prohibition against irritant noise,
the same shall set specific guidelines for the level of noise allowable at certain times of the day;
NOW THEREFORE, on motion of Kagawad Jose Antonio P. Pilapil, duly seconded by Kagawad Mateo M.
Maneja, BE IT ORDAINED BY THE SANGGUNIANG BARANGAY OF WAWA ILAYA,
LEMERY, BATANGAS ON ITS OPEN MASS MEETING ASSEMBLED.
“AN ORDINANCE REGULATING THE EMISSION OF LOUD NOISE AND UNLAWFUL NOISE AND ITS
SOURCES PROVIDING PENALTY THEREFOR”
Section I. TITLE. - This Ordinance shall be known as “Anti Noise Pollution Ordinance of Barangay Wawa
Ilaya”
Section 2. DECLARATION OF POLICY - It is hereby declared to protect and promote the right of every
constituents of Barangay Wawa Ilaya to a quiet and peaceful environment.
Section 3. DEFINITIONS - When used in this Ordinance, the following term shall
a. NOISE POLLUTIONS - unwanted human created sound that disrupts the environment. The
dominant form of which are derived from transportation, motor vehicles, sound system,
equipment, machines and the like. It is also percieved as noise believed to be
harmful to health or welfare.
d. EXECESSIVELY LOUD MUSIC - music or sound considered way above normal listening level.
Section 4. - It shall be unlawful for any motorist or driver o use and play excessively amplified music or blow
car horns out of the normal adequate and trouble sound level for more than three seconds.
Section 5. - It shall likewise be unlawful for any excessive noise coming from business establishments or from
a house, garden yard, especially from 10:00 o’clock in the evening until 8:00 o’clock in the
morning.
Secton 6. - A warning notice must be served by delivering it to a preson present where the noise is emitted
specifying the time and location of which it is was serve and will give at least 30 minutes within
the noise must cease.
Section 7. - Vehicles used for activities considered as essential public services such as police/patrol vehicle,
garbage collection vehicle, and ambulance are hereby exempted from the restrictions of this
ordinance.
Section 8. - Penalty Clause- Any individual, residential or building owner, group of people found violating this
ordinance shall be penalized as follows:
Section 9. - Barangay Officials and Barangay Tanods of Barangay Wawa Ilaya are hereby empowered to
enforce the provisions of this Ordinance.
Section 10. - Separability Clause - If for any reason, any section or provision of this ordinance shall be held
unconstitutional or invalid by any court of competent jurisdiction, such judgement shall not affect
or impair the other provision or parts thereof which shall continue to be in force and in effect.
Section 11. - Repealing Clause - All ordinances, rules and regualtions inconsistent with this ordinance are
hereby repealed and/or modified accordingly.
Section 12. - Effectivity - This ordiance shall take effect immediately upon approval.
