1. For the Chief, BFP to approve the herein attached Memorandum Circular
re: Guidelines in the Submission and lssuance of lnvestigation Reports (lR) in
the Bureau of Fire Protection (BFP).

BACKGROUND / JUSTIFICATION

2. References:
a. Standard Operating Procedure (SOP) No. 2023-OO1
otherwise known as the SOP on Fire lnvestigation dated 11
October 2023; and
b. Memorandum from the Chief, Legal Service re: Comment on
the BFP Policy on Disclosure of lnvestigative Reports vis-A-
vis Freedom of lnformation Program.

3. ln view of the approval and ongoing implementation of the revised Standard


Operating Procedure on Fire lnvestigation, the guidelines of the processes that
ensue likewise needed to be reviewed to ensure its compliance to existing laws.

4. Relative hereto, the undersigned submits the proposed Memorandum


Circular to establish uniform guidelines in the submission and issuance of
lnvestigation Reports pertaining to fire and explosion incidents and set forth the
responsibility and accountability of the Heads of Offices in its monitoring and
compliance.

IT{VESTIGATION REPORTS (IR) IN THE BUREAU OF FIRE
PROTECTION (BFP)

SECTION I. REFERENCES

A. Standard Operating Procedure (SOP) No. 2023-001 otherwise known as the


SOP on Fire lnvestigation dated 1'1 October 2023i and

B. Memorandum ftom the Chief, Legal Service re: Comment on the BFP Policy
on Disclosure of lnvestigative Reports vis-d-vis Freedom of lnformation
Program.

SECTION II. SCOPE

This Circular covers lnvestigation Reports pertaining to fire and explosion


incidents submitted and issued by BFP lnvestigative Units.

SECTION III. PURPOSE

This Circular aims to

A. Establish uniform guidelines in the submission and issuance of


investigation reports pertaining to fire and explosion incidents; and

B. Set forth the responsibility and accountability of the Heads of Offices in its
monitoring and compliance.

SEGTION IV. DEFINITION OF TERMS

A. Critical lnfrastructures. An asset / system, whether physical / virtual, so


essential to the maintenance of vital societal functions or to the delivery of
essential public services that the incapacity or destruction of such systems
and assets would have a debilitating impact on national defense and security,
national economy, public health or safety, the administration of justice, and
other functions analogous thereto (Sec 3.a RA 1 1479).

B. Judicial Authority. The term refers to a judicial and / or quasi-judicial body,


i.e. Office of the Ombudsman, authorized by law to require the production,
attestation and authentication of documents primarily for use in proceeding/s
filed before the court and / or office.

C. Heads of Offices. The term refers to the Director for lntelligence and
lnvestigation, Regional Directors, District / Provincial Fire Marshals and the
City / Municipal Fire Marshals.

D. lnvestigation Reports. The term refers to the reports specifically provided in


Vll.B.4 of SOP 2023-001 dated 11 October 2023.

E. Summary Report of Findings. A written document that outlines the facts


and specific findings of a given fire case. This is issued to interested parties
in lieu of the Final lnvestigation Report (FlR) for information purposes and in
cases when the requesting party does not meet the specific purpose for the
issuance of the FlR, per se.

SECTION V. SUBMISSION OF INVESTIGATION REPORTS

A. General Provisions

1. As a general rule, the reporting procedure, i.e. Spot lnvestigation Report


(SlR), Progress lnvestigation Report (PlR) and Final lnvestigation Report
(FlR), must be adhered to by the FAls. However, in cases when the
contents of the PIR are almost the same as that which shall be entered
into the FIR and a case may be disposed of within the tirfie prescribed
prior the submission of a PlR, the accomplishment of the PIR may be
dispensed with and the FAI may directly proceed to the accomplishment
and submission of a FlR.

2. the nature and significant impact of fire incidents involving critical


infrastructures and explosion - related fire incidents, especially if it
involves casualties, necessitate urgent reporting for information and
immediate action of concerned BFP Offices. Reporting of such cases with
potential security implications has an added requirement of urgency.
Hence, the SIR must be submitted as soon as initial details are
established irrespective of the period provided.

3. Spot and / or Progress lnvestigation Reports may be utilized in filing fire -
related criminal cases, specifically in inquest proceedings wherein the
suspecUs has / have been arrested by virtue of a valid warrantless arrest-

4. lRs must be accomplished in accordance to the |SO-approved standard


forms which are made readily available for download at the BFP website.
The forms are subject to revision based on the requirements of lSO.

5. Conections in the submitted lRs must be made promptly upon existence


of a ground for correction / amendment of report. ln such cases, the
reason / justification for the conection / amendment must be specifically
included in the narrative of the corrected IR. The previously submitted lR
must be attached for reference purposes.

6. Revision of lR from FIR-MDFI to SIR may be permitted provided that the


aforementioned provision must be complied with but in no case shall a
SIR be converted to FIR-MDFI, especially if the former has already been
submitted. ln such case, the submission of PIR and / or FIR is necessary.

7. The inclusion of Minimal Damage Fire lncident (MDFI) does not impose
changes on the existing classification of fire and does not, in any
circumstance, defer the computation of damages based on that
prescribed under the BFP Operational Procedures Manual. lt shall not be
construed as an altemative to dispense with the prescribed conduct of
investigation, particularly on fire incidents not falling under the category of
MDFls. lnitial investigation must still be conducted to sufflciently establish
that the fire incident falls under MDFI, othenrise the conduct of
investigation shall proceed as that prescribed by the regular procedures.

8. ln any case that a particular lR can not be accomplished within the


reglementary period due to circumstances beyond the control of the FAl,
a written request for extension in the conduct of investigation and
subsequent submission of the requisite lR may be submitted to the
Regional Director, for requests from Municipal / City / Provincial /
District Ofrices and the BFP National Headquarters, for requests from
Regional llB, for consideration of the Regional Director and the Chief,
BFP. The reason / justification behind must be specified in the written
request.

9. All FlRs and the substantiating documents of a case folder shall, at the
very least, be classified as "Confidential" considering its overall contents
which include, among others, personal and / or company information and
excerpts of the statements of witnesses. Heightened document
classification may be imposed as necessary.

B. Reporting Procedures

The following lRs shall be submitted to the respective Regional Offices, copy
furnished the OFAID - BFP National Headquarters for immediate information
and recording purposes, within the prescribed period:

1 Spot lnvestigation Report (SlR) - Accomplished and submifted within


24 hours from the occurrence of the fire incident

2. Progress lnvestigation Report (PlR) - Accomplished and submitted


within 7 to 15 days.

3. Final lnvestigation Report (FlR) - Accomplished and submitted within


30 to 45 DAYS, from the date of issuance of a Letter/Mission Order. No
UNDETERMINED cause should be reflected in any FlR.

ln circumstances that a case cannot be completed for reasons


independent of the will of the FAl, a FIR must stitt be accomplished
stating therein the details of the investigation and the most probable
conclusion based on the presenting facts and circumstances. Such case
shall be closed based on the merits and specifically considered to be
subject to REOPENING in circumstances that relevant evidence and / or
a witness shall surface in the future.

4. Fire lnvestigation Report - Minimal Damage Fire lncident (FlR -


MDFI)i - Accomplished in case of fire which resulted to negligible
damage to property or structure and have no recorded casualty [injured
or fatalityl. Typically, these cases involve only a small portion or single
section of any structure or building and are usually declared Fire Out
Upon Arrival (FOUA) by the firefighting unit.

For purposes of clarity and guidance, MDFIs include those that fall under
the following categories, to wit:

a. Stove, Kitchen or Chimney Fires, whether in residential


dwelling or commercial restaurant, and wherein only the
cooking equipment caught fire;

b. lndustrial Exhaust Pipe Fires wherein only the pipe structure


was slightly or partially damaged, without affecting any
portion of the industrial building;

c. Electrical Post, Service Line and Transformer Fires which did


not result to structural / building fire or any damage to other
property;

d. DC Battery and/or Battery Charger Fires, which did not result
to structural fire or any property damage;

e. Building Generator Fires wherein the source of ignition was


from the generator itself and did not affect any portion of the
building where the said generator is installed. Fire damage
should be of minimal impact to the overall operative
condition/functional ability of the equipment;

f. Household Appliance Fires that did not result to structural fire


or any consequential property damage;

g. Rubbish and Grass Fires that did not result to structural fire
or any property damage;

h. Garbage Dump or Sanitary Landfill Fires that did not result to


structural fire or any property damage;

i. Any other fire incident which failed to reach free-burning


phase / propagate, wherein the resultant damage is very
minimal and has no significant value.

On the contrary, MDFIs do not include fire cases that fall under the
following categories, to wit:

a. Fire incidents categorized as MDFI and have resulted to


negligible damage but committed under suspicious
circu mstances;

b. Fire incidents categorized under MDFI but were committed


with malicious intent, intentionally / criminally
perpetrated and/or with negligent act;

c. Fire incidents wherein a property owner or any aggrieved


pafi complained about the incident regardless of the value
and degree of damage and / or the property involved is
subject to insurance claims;

d. Fire incidents categorized as MDFI and have resulted to


negligible damage but caused injury or death to any
person;

e. Fire incidents categorized as MDFI and have resulted to


negligible damage but the extinguishment method
employed resulted to severe property destructlon, i.e.
excessive water damage.

The aforementioned fire incldents wanant complete Fire Cause
Determination and Analysis [full investigation], including responsibility i
liability identifi cation.

ln any case that the fire incident is identified to be under MDFI, Fire
Arson lnvestigators shall be guided by the following investigative
actions, to wit:

a. The BFP Fire Arson lnvestigative Team / Municipal or City


Fire Arson lnvestigation Units must accomplish the Fire
lnvestigation Report - Minimal Damage Fire lncidents
(FlR - MDFI) of the incident for case recording and fire
statistics purposes;

b. Check for any similar incidenVs within the same location or


address. Study the incident frequency;

c. No need for scene cordoning and preservation;

d. The fire victim/s shall only be required to submit an Affidavit


of Loss for purposes of establishing ownership and extent of
damage to the involved property. This shall be attached to
the FIR-MDFI along with the photographs of the fire scene;

e. No need for submission of Spot lnvestigation Report,


Progress lnvestigation Report and Final lnvestigation Report.
However, FAls must ensure that the report submitted
contains all the information as required in the FIR-MDFI Form
and such must be submitted within 48 hours from the
occurrence of the fire incident;

f. Remind or educate the concemed person [fire victim /


occupant / property ownerl about fire safety;

g. The investigating team must ensure that there is no


complaint of any sort before leaving the scene;

h. Terminate the investigation.

SECTION V]. ISSUANCE OF INVESTIGATION REPORTS

A. General Guidelines

1. The Regional Director, after due determination of the merits of the


request, has the exclusive authority to approve the issuance of lRs and
Summary Report of Findings of a fire incident within his I her arce 6t
jurisdiction. Requests for specific details in the lRs shall be acted upon by
the respective Head of Office, with due consideration of the requesting
party and the purpose of the request.

2. fhe Chief, BFP has the exclusive authority to approve the issuance of
lRs and Summary Report of Findings of fire incidents investigated by the
BFP NHQ lnvestigative Team.

3. The issuance of lRs is limited to the report itself. All attachments and
substantiating documents shall remain with the BFP Station / Office
which conducted investigation, subject to presentation, authentication
and attestation once summoned by competent judicial authority / Office of
the City or Provincial Prosecutor. ln addition to the aforementioned,
particular attention must be given to the provisions of the Freedom of
lnformation in relation to documents which are not subject for release to
the general public.

4. The issuance of Specific Details in the lRs for the purposes hereunder
enumerated shall be made in consideration of the provisions of the BFP
Media Relations Policy, the Memorandum re: Protocol on the Release of
lnformation on Fire Cases Under lnvestigation dated 11 October 20192,
and the Freedom of lnformation.

5. All requests for lRs, Summary Report of Findings and specific details in
the lRs shall be processed provided that the following are complied with:

a. Written request addressed to issuing authority;


b. lR or details in the lR requested must be specified. (Only the details
specifically permitted to be released pursuant to the provisions of this
MC, the Media Relations Policy and the Freedom of lnformation, shall
be provided); AND
c. Purpose of request must be specified.

6. The BFP's policy on non-disclosure of lRs is in accordance to the


inventory of exception mentioned in Memorandum Circular No. 89, series
of 2021 , specifically under the following ltems:

a. ltem No. 3, as the disclosure may interfere with enforcement


proceedings, deprive a person of the right to a fair trial or an impartial
adjudication, disclose the identity of a
confidential source or
unjustifiably disclose investigative techniques and procedures.

b. ltem No. 4 of the issuance on matters pertaining to the data privacy of


the persons involved in the conducted investigation especially if it
involves sensitive personal information. This is in relation to the
protection granted under the Data Privacy Act;

c. ltem No. 6 (b), on premature disclosure of information, especially if the


investigation involves a suspected arsonist. Premature disclosure
would likely frustrate the implementation of an official action of the
BFP, in coordination with other law enforcement agencies, against the
suspect; and

proceedings as confidential under its existing memorandum circulars
and standard operating procedure.l

SECTION VII. GENERAL RESPONSIBILIT]ES

A. The Fire Arson lnvestigation Division, under the Directorate for lntelligence
and lnvestigation, BFP National Headquarters, shall be the office primarily
responsibie to monitor the implementation of this Circular.

B. The Heads of Offices shall be responsible to monitor and supervise the


implementation of the Circular within their areas of jurisdiction.

C. The Chiefs of lnvestigative Branches, Sections and Units shall be the


persons primarily responsible in ensuring strict adherence of the respective
investigative offices to the provisions of this Circular.

D. The Legal Service in each BFP Office shall render assistance to BFP Offices
in the form of legal opinions / guidance on matters relating to the issuance of
lRs, such as the propriety of its issuance as well as the extent of disclosure of
details.

SECTION VIII. ADMIN]STRATIVE SANCTION

The following Officers or personnel shall be held administratively liable based


on the following guidelines:

A. The Fire Arson lnvestigator (FAl) for failure to strictly comply with the entry
requirements in the Nationwide Online Registry of Fire lncidents within twenty
- four hours from the occurence of the fire incident and the submission of a
PDF copy of the lRs within the prescribed periods of submission.

B. The Chiefs of lnvestigative Branches, Sections and Units for failure to


supervise the FAI in making the entry in the Online Registry of Fire lncidents
and in submitting the PDF copy of the SIR within the period provided.

C. The heads of office for three (3) consecutive non-entry in the Online Registry
of Fire lncidents and / or non-submission of lRs within the prescribed period.

D. The Regional Director for three (3) counts of non-entry in the Online Registry
of Fire lncidents and / or non-submission of lRs within the prescribed period
of the lnvestigative Sections / Units within his / her area of jurisdiction.

SECTION ]X. MODIFICATION CLAUSE

All BFP issuances inconsistent herewith are deemed repealed / amended


accordingly.

SECTION X. EFFECTIVITY

This Circular shall take effect fifteen (15) days from filing a copy thereof at the
University of the Philippines Law Center in consonance with Sections 3 and 4,
Chapter 2, Book Vll of Executive Order No. 292, otherwise known as 'The Revised
Administrative Code of 1987".
