Letter to me from Mr. Watkins referring to my letter to him received by him on 10 July 2002 regarding gifted and
talented students. Mr Watkins advises me that Ms Endicott is currently conducting an audit of the gifted and
talented provisions available for students at Lilli Pillie public school and l stating that DET is committed to the
provision of appropriate educational opportunities for all children.
Letter from Mr Watkins referring to my letters received by him on 27 & 28 August 2002 with regard to the provision of
education for gifted and talented students and non placement of my son in a Selective High School . Letter
congratulating Katie for qualifying for placement into St George Girls and Danny for placement on the reserve list for
Caringbah. Telling me that my children should feel proud of their achievement, as there is always very strong
competition for selective school placement. Mr Watkins stated that all information was provided to selection
committees and that he understands that we have already requested Appeal forms.
Letter addressed to me. Letter was not received by me. A draft copy was sent to me under FOI at a later date. The
letter is from Robyn McKerihan Director Assessment and School Accountability and in response to a letter to the
Director General Jan McClelland that I wrote. Robyn McKerihan said the Director General has asked her to respond

Letter sent to me by Malcolm Kerr stating that he had received a letter from the Minister for Education
acknowledging representations that he made on my behalf concerning my children and enclosing the letter for my
records saying he will contact me again when he receives further advice from the Minister

requested the Year 7 Selective School application information and after seeing so much misconduct we requested
the OC information
Advising me that the Premier has received a copy of my recent letter concerning entry of my children to selective
schools. Advising that the matters raised primarily concern the administration of the Minister for Education, Mr
Watkins and stating that it is appropriate that I have acquainted the Minister with my concerns and advising that in
the circumstances Mr Car has requested his college to carefully consider my letter.
Letter to me from Mr. Watkins responding to my letter 6 January noting my concerns of perceived discrepancies in
documents and results obtained under FOI saying he asked the SSU for advice. Mr Watkins sets out some
explanations that he was provided by the SSU with regard to some of the discrepancies (that did not address the
issues) and advises me if I want more information to contact Bob Wingrave.

Letter states that they are responding on behalf of the Prime Minister and they thank me for my correspondence of 22 January
regarding my allegations of discrimination against my children by the NSW Department of Education. The letter states that Mr
Howard appreciates the time that I have taken to convey my views and concerns to him however he regrets that due to the
large volume of correspondence he receives he is unable to respond to each personally. It states that Mr Howard has asked
that my correspondence be referred to his Ministers for further consideration and that he has referred my correspondence to
the Minister for Education, the Hon Brendan Nelson MP for attention given that he is responsible for the development of
Policy on public education.

and states that the appeals carefully considered by the appeals penal and panel determined that grounds were
insufficient to warrant further adjustment to scores. Advising that should I require any further information to contact
Mr Bob Wingrave and congratulating my children on their success.

Barry O'Farrell responded to me on 1 April saying that he read my letter with great interest and would be making
representations to the Minister for Education Mr Watkins and he would contact me.

In the letter he acknowledged that in my letter I expressed great concern regarding my children's treatment,
education and placement in to Selective Schools by the DET. He stated he read my letter with great interest and
has made representations to the Minister for Education Mr Watkins. He thanked me for taking the time to write to
him.
In the letter he thanked me for my letter of 4 March 2003 and said the Minister had asked him to reply. He advised
that from the outset that the responsibility for school admission policies is a matter for the relevant educational
authorities, rather than the Commonwealth and therefore the Minister regrets that he is unable to offer any tangible
assistance with the matter. He goes on to say that he must say that while he is not in a position to comment
authoritatively on the matter, the procedures for calculating admission scores appear to be complex, so much so that
in the case of both my children scores were apparently incorrectly calculated by officers of the New South Wales
Selective Schools Unit and then subsequently corrected. He states that this suggests that current procedures may
be overly complex and liable to make the admission process less than ideally transparent. He noted that I had
sought the assistance of Barry O'Farrell and stated that he would be forwarding a copy of his letter to Mr O'Farrell's
office for his information. He then went on to say that on behalf of the Minister, he takes this opportunity to wish my
children all the best in their schooling and trust that they will be given the opportunities the they deserve to develop
their talents to the fullest.
Letter to Mr. Barry O'Farrell MP from Jan McClelland, Director-General of Education and Training, Managing Director
of Tafe NSW received under FOI referring to his representations to the former Minister for Education Mr. Watkins on
our behalf saying she had been asked to respond on Mr. Watkins behalf. Letter said that we had been invited on
several occasions to contact Bob Wingrave for further explanation and that we have not done so. Letter did not
address my sons non placement in a Selective School and only referred to my daughter.
Letter to me referring to my correspondence of 2 May 2003 concering the manner in which my complaint to the
Ombudsman was dealt with. States that matter will be brought to the attention of the Committee Members and the
Chairman will write to me after they have had the opportunity to consider the matters. Advised that the Commitees
for the new Parliament had not yet been established and that it was anticipated they would be announced in the next
week. She advised that the Committee is established under the Ombudsman ACT 1974 and attached a copy of the
relevant statutory provisons. Advised that the role of the Commitee is to examine general policy and procedural
issues relevant to theoperation of the Ombudsman and Police Integrity Commission.

This letter is addressed to me and refers to my concerns in relation to the way the Ombudsman has handled my
complaints and advises that we have been supplied with the Committee's funtions and that the Commitees role is to
examine general policy and procedural issues arising from the Ombudsman fulfillment of his functions and that they
are not there to serve as an appeal mechanism for people who are dissatisfied with the Ombudsmans findings and
advising that consquently the Commitee does not have the power to review the outcomes of complaints already
investigated by the Ombudsman. It states that the matters raised that our matter is outside thier jurisdiction and this
is depsite that the Ombudsman did not ever investigate the matter.
There is a lettter with ref 03/5996 that the Ombudsman provided to me addressed to me that we had never seen or
received under FOI. This letter is not on letterhead, not signed and not dated and says the matter has been
investigated by the DET and the Ombudsman and is closed and directs me to contact Bob Wingrave.

schools has been dealt with and says that as the matters raised primarly concern the Administration of the Deputy

consider my letter
Letter states that she is writing on behalf of Mr John Brogden, NSW Liberal leader who has asked her to respond on
his behalf regarding discriminination within the Education System Advising that she will be forwarding my concerns
to her collegues and to the Hon Dr. Andrew Refshuage for his consideration and advice.
This Letter is addresse to me from Mr Refshauge and was received by me advising that an investigation would take
place and that I would be contacted by Chris Carroll.

Ombusman has not found any irregularities. Referring to the viewing of my children tests papers and that I have
been offered the opportunity for further meetings. Advising that he has asked the DET to review the current policy
regarding gifted and talented programs in secondary schools and that he hopes this helps to clarify things for him

Minister for education and advises that the matters raised are noted and are presently receiving attention. States
that a further reply will be forwarded as soon as possible. I was forwarded a copy of this letter with a with
compliments slip from Mr Brogden.
Referring to my letter 12 July 2013 to the Office of the Ombudsman and Police Integrity Commission in regarding
the Ombudsmans failure to provide my family procedural fairness and natural justice and advising that under Section
31B (2) of the Ombudsman Act, the Committee is prohibited from a) investigating a matter relating to particular
conduct; b) reconsidering a decision to investigate, not to investigate or to discontinue investigation of a particular
complaint; c) reconsidering the findings, recommendations, determinations or other decisions of the Ombudsman, or
of any other person, in relation to a particular investigation or complaint. The letter states that the Commitee is
therfore unable to comment on any particular detail of my complaints abut the Department of Education and Training
and advised that any further correspondence will be filed and not responded to.
Letter states that she is writing on behalf of Mr Brogden, NSW Liberal Leader and that he has asked her to reply. It
states that Mr Brogden has noted that they have already made representations to the Minister for Education and
Training regarding this issue and thanked me for taking the time to write stating that my comments are noted and

information/documents that I received from the Department under FOI.

My solictor had written to Bob Wingrave in relation to errors in certified true and accurate copies that he sent of my
sons OC test in that there were 61 answers to 60 questions and other anomalies.

Letter to me stating that whilst in Oppposition at state level she is limited in what she can do as the Minister has the
responsibility in a situation such as this.
Letter from my solicitor to SSU referring to their letters to them of 21 October & 14 November to which they have
received no reply and stating that a cursery examination of the ACER extracts, which are certified to be a true and
accurate record of the resuls, reveals that the OC placement test 2000 results for D Challita Student No. 77801
contained the answers to 61 questions, when in fact the test consisted of only 60 questions and that this remarkable
result demonstrates either that the system is flawed, or that it is possible to intervene in or otherwise manipulate
results. Clearly the integrity of the system is in question.
Letter from Bob Wingrave to my solicitors dated 27 November 2003 sent via DX box stating that my sons second
intial had inadvertenly slipped onto the next line and formed part of the answers. My solicitor responded on the 27-
11-03 stating that my son didn't have a second name and therefore could not have a second initial and that excuse
for the purposes of my concerns was useless.
Submission to the Minister content and accuracy endorsed by Chris Carroll and Approved by George Green,
Assistant Director General, Schools and Special programs. Referring to representations made by Mr. Brogden MP
setting out some background information and stating that enquires have now been completed by both the Dept and
an external agency with a recommendation that the Minister signs the attached response if approved.
Letter addressed to Mr Brogden, NSW Liberal leader from Mr Refshuage. This letter was drafted by the
persons we alledged were responsible and is filled with misrepresentations and lies. This letter is the letter
that has been referred to constantly as the basis of closing the matter. The letter states that extensive
enquiries have been completed by the DET and that the Ombudsman had investigated the matter which is a
lie. On the basis of this letter my name was placed on a black list and the matter was closed and
correspondence from me was to be filed away. I received a copy of this letter from Mr Brogden's office after
I chased them in relation to my families complaints. Mr Brogden's office fowarded this letter to me by fax
dated 11 March 2004.
This RML was never received it was noted in FOI documents. A document under FOI shows that on the 12
February 2004 there was a request EMD/04/005240 to file this letter without response. File Corporate document.

Letter states that following their representations to the Minister for Education and Training relating to my
conerns about placement of my childern in selective schoos that she has received the enclosed response
from the Minister and that she is forwarding me the response for my information. Letter dated 19
December 2003 stating matter closed. She states that she trusts it assists to clafify some matters for me.
Letter refers to my most recent letter to the Premier Mr Bob Carr conerning placement of my childern in
selective schoos and states that he has been advised that on 19 December 2003 the Minister for Eduction
and training responded to similar representations to Mr Brogden advising that the matter had been
investigated and as a result the Premier cannot be of further assistance with regard to this matter.
Referring to a fax they received stating that a clerical assistance had acknowledged the fax on Bob
Wingraves behalf that I sent on 27 November 2003 The letter states that after 14 RML's, 3 FOI's an
Ombudsman's investigation and an Administrative Decisions hearing that I have been deemed a vexatious
correspondent by the Minister and that letters to me are to be filed away and asks how to proceed.
Letter refers to my letter to the Prime Minister John Howard that was forwarded to the Hon Brendan
Nelson MP stating the minister has asked her to reply. The letter states that the Australian Government
doe not have a direct operational role in relation to school management or selection of students for
selective schools as these are a matter for State and Territory governments and for this reason the
Minister is unable to intervene or make comment on the rights and wrong of the handling of individual
cases. It states from your letter that I believe that the NSW Education authorities have not followed due
process and suggests I contact the Ombudsman.
Stating that the Australian Government does not have the jurisdiction to deal with my families matter;
and that it is the responsibility of the NSW GOV. Advising that they have therefore forwarded my
correspondence to the Office of the Premier of NSW, The Hon R J Carr for attention.

Letter from Carmel Tebbutt to me referring to my letter dated 8 February 2005 concerning my children and the DET.
Stating that she has been advised that the matters raised in my letter have been the subject of numerous
Ministerial responses and an Ombudsmans investigation (lie). She mentions that the FOI matters I now raise now
involve my younger daughter's OC placement test and that officers are currently dealing with this request. She
comments on my daughters appeal and stes that it was considered by two independant senior officers (lie) and that
the appeal was carefully cosidered and the decision of the panel was unanimous. She states that extensive
enquirie have now been undertaken and as result the department consideres the matter closed. All future
correspondence will be filed unless it relates to matters not previously raised.

Letter to me from Chief of Staff stating he is writing on behalf of the NSW Liberal leader Peter Debnam and thanking
me for my letter regarding my allegations against the DET. Advises that Mr Debnam appreciates that I have taken
the time to write to him and has asked him to forward my correspondence to Brad Hazzard MP, the Shadow Minister
for Education for his consideration and action where appropriate.
Letter to me from Brad Hazzard referring to my leter dated 14 July 2006 that I sent to the Opposition leader Peter
Denhman advising that Peter Denham has forwarded the letter to him for his response. Brad Hazzard states that
he notes that I wrote to him on 14 September 2005 and that he made representations on my behalf to the Minister
Carmell Tebbutt and that he sent me a copy of the Ministers response daed 8 December 2005. He states that in
that letter he highlighted that the Minister said she would not respond to further correspondence from me and that at
that time he stated that as Shadow Minister he did not have the power to further investigate my claims. He noted
that I had once again approached the Ombudsman and wished me all the best in my endeavours to receive an
acceptable outcome.
Malcolm Kerr sent me a copy of the letter attached to a with compliment slip from Nicole Humphry stating that the
matters raised have been noted and are currently receiving attention.
Letter from Virginia Judge addressed to Malcolm Kerr setting out some excuses and saying that the matters have
not been taken lightly and that the Ombudsman conducted preliminary investigations into the issues and determined
there was no case for further investigation.
Letter to me refering to my representations and advising that he had received the enclosed response and stated that
the matter has been the subject of a review by the DET and the NSW Ombudsman and the ADT. His letter states
tht as a member of the Commitee of the Office of the Police Integrity Commission he concurs with the advice given
to me that the Commitee does not have the power to review the outcome of complaints already investigated by the
Ombudsman. His letter ends with in view of the long history of this issue, he advises he is unable to assist me any
further. His letter enclosed a letter from Virginia Judge, Parliamentary Secretary addressed to him
The letter thanks me for my letter of 9 January 2008 and advised that the concerns that I raise are very complex and
regrets that he is unable to offer any assistance in this matter. He states that the Commonwealth Ombudsman
may be able to offer some assistance.
The letter states that the premier Mr Morris Iemma has received my correspondence regarding the DET,
the Ombudsman and the Joint Parliamentary Committee on the Office of the Ombudsman and Police
Integrity Commission. The letter advises that the Ombudsman is an independant office created by statue
and is responsible directly to parliament and accordingly the Government cannot, and should not,
attempt to, direct the Ombudsman in the exercise of the Ombudsmans functions. It states that the
Ombudsman is overseen by the Joint Parliamentary Commitee which monitors and reviews the exercise
of the Ombudsmans functions. The letter notes that we have already raised our concerns regarding the
Ombudsmans office with the Office of the Ombudsman and Police integrity commission. It ends stating
that the matters raised concern the administration of the Minister for Education, the Hon John Della
Bosca and that he has arraged to forward a copy of my corresolndence and his reply to my letter to the
Ministers office and that in the circumstances, the Department can be of no further assistance to me

regarding my allegations of a conspiracy to cover up by both agencies. It states that it appears that I am
not satisfied with the investigations into my complaints by the DET and Ombudsman. It goes on to say
that the Commonwealth Ombudsman investigates complaints about the administrative actions of
Australian Government agencies and that as the NSW Department of Education and the NSW
Ombudsman are State Government agencies that they cannot take up my complaint. It states that they
appreciate that I will remain dissatisfied with the decision but trusts that the above explains the reasons
for the conclusions.

Letter to me from Mr. Watkins referring to my letter to him received by him on 10 July 2002 regarding gifted and
talented students. Mr Watkins advises me that Ms Endicott is currently conducting an audit of the gifted and
talented provisions available for students at Lilli Pillie public school and l stating that DET is committed to the
provision of appropriate educational opportunities for all children.

education for gifted and talented students and non placement of my son in a Selective High School . Letter
congratulating Katie for qualifying for placement into St George Girls and Danny for placement on the reserve list for

December 2002 and saying has referred matter to DET for advice. Mr Watkins refers to the appeals for my children
and states that the appeals carefully considered by the appeals penal and panel determined that grounds were
insufficient to warrant further adjustment to scores. Advising that should I require any further information to contact
Mr Bob Wingrave and congratulating my children on their success.
Letter to me from Mr. Watkins responding to my letter 6 January noting my concerns of perceived discrepancies in
documents and results obtained under FOI saying he asked the SSU for advice. Mr Watkins sets out some
explanations that he was provided by the SSU with regard to some of the discrepancies and advises me if I want

In the letter he acknowledged that in my letter I expressed great concern regarding my children's treatment,
education and placement in to Selective Schools by the DET. He stated he read my letter with great interest and
has made representations to the Minister for Education Mr Watkins. He thanked me for taking the time to write to
him.
In the letter he thanked me for my letter of 4 March 2003 and said the Minister had asked him to reply. He advised
that from the outset that the responsibility for school admission policies is a matter for the relevant educational
authorities, rather than the Commonwealth and therefore the Minister regrets that he is unable to offer any tangible
assistance with the matter. He goes on to say that he must say that while he is not in a position to comment
authoritatively on the matter, the procedures for calculating admission scores appear to be complex, so much so that
in the case of both my children scores were apparently incorrectly calculated by officers of the New South Wales
Selective Schools Unit and then subsequently corrected. He states that this suggests that current procedures may
be overly complex and liable to make the admission process less than ideally transparent. He noted that I had
sought the assistance of Barry O'Farrell and stated that he would be forwarding a copy of his letter to Mr O'Farrell's
office for his information. He then went on to say that on behalf of the Minister, he takes this opportunity to wish my
children all the best in their schooling and trust that they will be given the opportunities the they deserve to develop
their talents to the fullest.
Letter to Mr. Barry O'Farrell MP from Jan McClelland, Director-General of Education and Training, Managing Director
of Tafe NSW received under FOI referring to his representations to the former Minister for Education Mr. Watkins on
our behalf saying she had been asked to respond on Mr. Watkins behalf. Letter said that we had been invited on
several occasions to contact Bob Wingrave for further explanation and that we have not done so. Letter did not
address my sons non placement in a Selective School and only referred to my daughter.
Letter to me referring to my correspondence of 2 May 2003 concering the manner in which my complaint to the
Ombudsman was dealt with. States that matter will be brought to the attention of the Committee Members and the
Chairman will write to me after they have had the opportunity to consider the matters. Advised that the Commitees
for the new Parliament had not yet been established and that it was anticipated they would be announced in the next
week. She advised that the Committee is established under the Ombudsman ACT 1974 and attached a copy of the

are not there to serve as an appeal mechanism for people who are dissatisfied with the Ombudsmans findings and
advising that consquently the Commitee does not have the power to review the outcomes of complaints already

the Ombudsmans failure to provide my family procedural fairness and natural justice and advising that under Section
31B (2) of the Ombudsman Act, the Committee is prohibited from a) investigating a matter relating to particular
conduct; b) reconsidering a decision to investigate, not to investigate or to discontinue investigation of a particular
complaint; c) reconsidering the findings, recommendations, determinations or other decisions of the Ombudsman, or

My solictor had written to Bob Wingrave in relation to errors in certified true and accurate copies that he sent of my
sons OC test in that there were 61 answers to 60 questions and other anomalies.

Letter to me stating that whilst in Oppposition at state level she is limited in what she can do as the Minister has the
responsibility in a situation such as this.
Letter from my solicitor to SSU referring to their letters to them of 21 October & 14 November to which they have
received no reply and stating that a cursery examination of the ACER extracts, which are certified to be a true and
accurate record of the resuls, reveals that the OC placement test 2000 results for D Challita Student No. 77801
contained the answers to 61 questions, when in fact the test consisted of only 60 questions and that this remarkable
result demonstrates either that the system is flawed, or that it is possible to intervene in or otherwise manipulate
results. Clearly the integrity of the system is in question.
Letter from Bob Wingrave to my solicitors dated 27 November 2003 sent via DX box stating that my sons second
intial had inadvertenly slipped onto the next line and formed part of the answers. My solicitor responded on the 27-
11-03 stating that my son didn't have a second name and therefore could not have a second initial and that excuse
for the purposes of my concerns was useless.
Submission to the Minister content and accuracy endorsed by Chris Carroll and Approved by George Green,
Assistant Director General, Schools and Special programs. Referring to representations made by Mr. Brogden MP
setting out some background information and stating that enquires have now been completed by both the Dept and
an external agency with a recommendation that the Minister signs the attached response if approved.
Letter addressed to Mr Brogden, NSW Liberal leader from Mr Refshuage. This letter was drafted by the
persons we alledged were responsible and is filled with misrepresentations and lies. This letter is the letter
that has been referred to constantly as the basis of closing the matter. The letter states that extensive
enquiries have been completed by the DET and that the Ombudsman had investigated the matter which is a
lie. On the basis of this letter my name was placed on a black list and the matter was closed and
correspondence from me was to be filed away. I received a copy of this letter from Mr Brogden's office after
I chased them in relation to my families complaints. Mr Brogden's office fowarded this letter to me by fax
dated 11 March 2004.
This RML was never received it was noted in FOI documents. A document under FOI shows that on the 12
February 2004 there was a request EMD/04/005240 to file this letter without response. File Corporate document.

Letter states that following their representations to the Minister for Education and Training relating to my
conerns about placement of my childern in selective schoos that she has received the enclosed response
from the Minister and that she is forwarding me the response for my information. Letter dated 19

Referring to a fax they received stating that a clerical assistance had acknowledged the fax on Bob
Wingraves behalf that I sent on 27 November 2003 The letter states that after 14 RML's, 3 FOI's an
Ombudsman's investigation and an Administrative Decisions hearing that I have been deemed a vexatious
correspondent by the Minister and that letters to me are to be filed away and asks how to proceed.
Letter refers to my letter to the Prime Minister John Howard that was forwarded to the Hon Brendan
Nelson MP stating the minister has asked her to reply. The letter states that the Australian Government
doe not have a direct operational role in relation to school management or selection of students for
selective schools as these are a matter for State and Territory governments and for this reason the
Minister is unable to intervene or make comment on the rights and wrong of the handling of individual
cases. It states from your letter that I believe that the NSW Education authorities have not followed due
process and suggests I contact the Ombudsman.
Stating that the Australian Government does not have the jurisdiction to deal with my families matter;
and that it is the responsibility of the NSW GOV. Advising that they have therefore forwarded my

The letter thanks me for my letter of 9 January 2008 and advised that the concerns that I raise are very complex and
regrets that he is unable to offer any assistance in this matter. He states that the Commonwealth Ombudsman
may be able to offer some assistance.
The letter states that the premier Mr Morris Iemma has received my correspondence regarding the DET,
the Ombudsman and the Joint Parliamentary Committee on the Office of the Ombudsman and Police
Integrity Commission. The letter advises that the Ombudsman is an independant office created by statue
and is responsible directly to parliament and accordingly the Government cannot, and should not,
attempt to, direct the Ombudsman in the exercise of the Ombudsmans functions. It states that the
Ombudsman is overseen by the Joint Parliamentary Commitee which monitors and reviews the exercise
of the Ombudsmans functions. The letter notes that we have already raised our concerns regarding the
Ombudsmans office with the Office of the Ombudsman and Police integrity commission. It ends stating

regarding my allegations of a conspiracy to cover up by both agencies. It states that it appears that I am

that the Commonwealth Ombudsman investigates complaints about the administrative actions of
Australian Government agencies and that as the NSW Department of Education and the NSW

Letter addressed to me. Letter was not received by me. A draft copy was sent to me under FOI at a later date. The
letter is from Robyn McKerihan Director Assessment and School Accountability and in response to a letter to the
Director General Jan McClelland that I wrote. Robyn McKerihan said the Director General has asked her to respond
to my letter and received by her on 26 November 2002 saying convinced everything was done properly and no
further action will be taken in this matter.
Letter from Malcolm Kerr MP to me stating that the Minister for Education and Training The Hon John Watkins has
requested he acknowledge receipt of my correspondence and stating the matters raised by me have been noted and
are currently receiving attention.
Letter to me from Mr. Watkins responding to my letter 6 January noting my concerns of perceived discrepancies in
documents and results obtained under FOI saying he asked the SSU for advice. Mr Watkins sets out some
explanations that he was provided by the SSU with regard to some of the discrepancies and advises me if I want
more information to contact Bob Wingrave.

Letter to Mr. Barry O'Farrell MP from Jan McClelland, Director-General of Education and Training, Managing Director
of Tafe NSW received under FOI referring to his representations to the former Minister for Education Mr. Watkins on
our behalf saying she had been asked to respond on Mr. Watkins behalf. Letter said that we had been invited on
several occasions to contact Bob Wingrave for further explanation and that we have not done so. Letter did not
address my sons non placement in a Selective School and only referred to my daughter.
Letter received by me from Janet Collins, Executive Officer, Office of the Deputy Premier on Deputy Premier
letterhead referring to my letter to the Minister for Education dated 8 May 2003 and stating that the matters raised
have been noted and are presently receiving attention
There is a letter that the Ombudsman provided to me with reference 03/5996 that we had never seen or received.
This letter is not on letterhead, not signed and not dated and says the matter has been investigated by the DET a nd
the Ombudsman and directs me to contact Bob Wingrave.
Letter to me from Mr Refshauge referring to my letter of 22 April 2003 and advising that he has been advised that
matters have been responded to with detail explanations given and that he cannot help me with previous matters but
that since I had not previously brought to his attention the issue with my son's profile score that he would refer my
complaint to Chris Carroll

Letter to me from Mr Refshauge advising that an investigation would take place and that I would be contacted by
Chris Carroll.
Letter From Mr Refshauge to Mr Brogden stating that I have accessed all documents under FOI and that the
Ombusman has not found any irregularities. Referring to the viewing of my children tests papers and that I have
been offered the opportunity for further meetings. Advising that he has asked the DET to review the current policy
regarding gifted and talented programs in secondary schools and that he hopes this helps to clarify things for him
Submission to the Minister content and accuracy endorsed by Chris Carroll and Approved by George Green,
Assistant Director General, Schools and Special programs. Referring to representations made by Mr. Brogden MP
setting out some background information and stating that enquires have now been completed by both the Dept and
an external agency with a recommendation that the Minister signs the attached response if approved.
Letter addressed to Mr Brogden, NSW Liberal leader from Mr Refshuage. This letter was drafted by the persons we
alledged were responsible and is filled with misrepresentations and lies. This letter is the letter that has been
referred to constantly as the basis of closing the matter. The letter states that extensive enquiries have been
completed by the DET and that the Ombudsman had investigated the matter which is a lie. On the basis of this
letter my name was placed on a black list and the matter was closed and correspondence from me was to be filed
away. I received a copy of this letter from Mr Brogden's office after I chased them in relation to my families
complaints. Mr Brogden's office fowarded this letter to me by fax dated 11 March 2004.
This RML was never received it was noted in FOI documents. A document under FOI shows that on the 12
February 2004 there was a request EMD/04/005240 to file this letter without response. File Corporate document.

BODY
Ms Challita, who rang you earlier this year to complain about the Departments treatment of her children, is challenging the
FOI’s Units decision not to provide her with the test papers she requested. We are being asked to produce for the
Administrative Decisions Tribunal hearing, test papers relating to the 2000 for 2001 and the 2001 for 2002 Opportunity Class
Placement Tests as well as the 2002 for 2003 Selective High Schools test.
They understand that the answer sheets are no longer available.Could you have the relevant reference copies already ready
for us but don’t send them until we find out where and when they’re required.
Bob correction to my earlier email this is the one formal mention of Mrs Challita I can find in my correspondence in which I
mentioned (to Magda at least) that Mrs Challita had rung me.
John has discovered some earlier advice he has received from our Unit. He phoned for advice. I said that he should slow the
process down and not answer the last email until I get some advice from above. He has agreed to do this. Would you be able
to get back to me as soon as possible preferably week or early next week, with some direction as to how he should answer the
email. We at this Unit will also give some consideration. He did suggest that he answer by referring her to us.

Unit would like advice as after 14 RML's, 3 FOI's, an Ombudsman investigation and an Administrative Decisions Tribunal
hearing, Mrs Challita has been classified as a vexatoius correspondent and has been advised that further letters to the Ministry
will be filed without resonse. Does this also come under that heading or do we respond? If so how?
Mrs challita rang. Soon after there was a fire alarm. We undertook to contact each other later.
Left a message for Mrs Challita to call me.
Spoke to Mrs Challita - agreed to call her tomorrow after 10.00 am.
Spoke to Mrs Challita - she is concerned that documents have been purposely hidden and asked me to keep an open mind to
this. She also said that the department, Dr Bendall had not finalised the agreements reached in a previous ADT matter.
Discussed with Anthony Bendall. His recollection was that Mrs Challita was to attend the Selective Schools unit to exame the
test papers, then meet with Bob Wingrave to satisfy herself that nothing had been improperly withheld. Bob would then explain
the 'discrepancies' to her. Anthony understood that this had occurred. He is aware that there was an argument commenced by
Mrs Challita as he understands it at the time of her visit. He will go to the previous FOI file to clarify if there were written "terms
of settlement". I will talk to Louise about identiying the Departmental sign attendees to the Year 8 appeal by Danny Challita.
Discussed with Anthony. The 'Agreed Settement' seems to be embodied in the letter from John McDonald dated 18 August
2003. Mrs Challita seems to have responded to item 2 in these terms by letter dated 22 August 2003.
Spoke to Dave Wasson. He is essentially relying on Magda Pollack for advice. Agreed that I would send the letter with a
comment that I was exploring the Chris Carrol investigation and would get back to her about that. Agrees I would call Dave on
Monday.
Spoke to Magda Pollak. She advised that Bob Wingrave is probably the appropriate person to arrange the meeting.
Spoke to Bob Wingrave. His recollection was that there was no investigation as such. My suggestion was that it may have
been overtaken by the resolution of the ADT proceedings. I said I would discuss that with Anthony.
Spoke with Anthony Bendall, his recollection was that the ADT resolution was in settlement of 'everything'. He is happy to
attend a veiwing with Bob Wingrave and Mrs Challita if required.
Left a message for Bob Wingrave to call me. Apparently the line of reporting is through Carol Carrigan.
Spoke to Mrs Challita - has now received the response from St George Girls. Said I would talk to Sydney Boys and would look
at the advice that informed the Ministerial letter.
Spoke to Bob Wingrave. The person between Bob Wingrave and Carol Carrigan is Dave Wasson, Director of Education
Measurement, who is located at Banksown. I offered to physically assist in preparing the correspondence. Karen Endicott had
a file - Bob will chase that up. He will come in next Tuesday @ 2.30 pm.
Left a message for hte Principal of Sydney boys (Kim Jagger) to contact me.
Magda Pollack rang. Said will prepare a response but does not have the material I sent to Bob Wingrave in April. I undertook
to resend this.
She raised child protection concerns for the Challita’s children. Apparently they were crying at the meeting that was held. I
said we should discuss this further and if there was a risk of harm, Docs should be notified.
Rang for Magda Pollack - has apprently finished the resonse but is away sick. A hard copy is on its way to me.
Rang David Wasson - he is also away sick but may be in later. I left a message for him to call me. His assistant, Melba Clark
will e-mail the response to me.
Gentlepeople. Thank you for your good work in relation to the matter of Mrs Challita. I've prepared a draft letter (attached)
which contains the material Magda has prepared in response to Mrs Challita's letter of 22 August 2003. I have made some
minor amendments to this material and would be grateful if you could read it through to make sure I haven't mucked anything
up.
I have taken the liberty of presuming that you do not want to investigate a complaint about essentially the same issues but
there still seems to be two outstanding points.
One is Mrs Challita's desire to again look at the test papers. I have decided to ignore that for the moment unless you counsel
me otherwise.
The second one is something of a surprise. On 4 August 2003 the Minister wrote to Mrs Chalilta advising that he in turn had
'advised Mr Chris Carroll. R/Director of Student Assessment and School accountability, that your formal complaint should be
dealt with in accordance with the Depts 'Responding to Suggestions, Complaints and Allegations procedures and that 'Mr
Carroll will proceed to set the process in place and will contact you in due course to advise you of progres. Mrs Challita says
that she has never been contacted by Chris Carroll. Can you tell me what the position is with this and what transpired between
then and the Minister's letter of 19 December 2003.
Spoke to Magda Pollack she sent some suggested changes to Dave Wasson. Discussed her comments in detail. She is not
aware of the Chris Carroll investigation. In her view there should be no revisiting of the test exam paper issue. I said I would fi
these thins and talk to Dave Wasson.
Spoke to Chris Carroll. He said the complaint was investigated this was at the time that she came in to review the exam
papers. Dave Wasson and/or Bob Wingrave would be aware of what transpired.
In the matter of John Murn's letter to Mrs Challita - the second last paragraph has dropped the U off Unit and now reads 'nit'.
I have not brought my original document home with me so I can't compare John's version with mine but I don't recognise the
relevance of his response to the last heading. "Re documents from Caringbah;. If it can wait until Monday, I'll look at it at work
If not, I'll log in tomorrow from Melbourne and get somene in the office to send me the original.

I am not sure ignoring this woman is the way to go. I pointed out in my document that we have complied with the ruling that we
were to give her an opportunity to go through the test papers and unless we state that she’ll just keep demanding another
session.

This must have been something decided above Unit level as I have no recollection of seeing it. Chris or someone higher than
that may have received an official form or may have been responding to Mrs Challita’s frequent use of the term ‘formerly’ b
which she always seems to mean ‘formally’ and decided to set the wheels in motion. I may not have been made aware of this
development as I was probably one of the people Mrs Challita blames.
It should be noted however, that there have already been numerous internal investigations and an external Ombudsman’s
investigation.
States: As discussed with you the Department has not, until now,properly fulfilled the terms of the third item of the agreed
resolution of your ADT proceedings from 2003, accordingly it is only fair that this be done and I again apologise for the delay
and the oversight in not dealing with this aspect. The Departments response is set out below.
Your letter dated 11 June contains an FOI application this part of your correspondence has been referrred to the Depts FOI &
Privacy Unit.
Your correspondence also includes a complaint which you seek to have dealt with under the Departments "Responding to
Suggestions, Complaints and Allegations policy. As the matters you complain about appear to essentially be those that have
been dealt with previously, no action will be taken on this point in accordance with the advice in the Ministers letter. (This was a
new allegation in relation to my younger daughter).
You also mention an investigation by Mr Chris Carroll which was referred to in a letter from the Minister for Ed to you dated 4
August 2003. At that time Chris Carroll was relieving Director of Student Assessment and school accountability. My
preliminary enquiries indicate that it was intended that the terms of resolutaton at the ADT was intended to cover all outstanding
issues including the complaint to be investigated by Chris Carroll. I will write to you once this issue is further clarified.
There is also an undertaking in item 3 that a meeting be held between yourself and the dept personnel to explain how the
relevant processes work. This meeting can be arranged by contacting Bob Wingrave. It is requested that I do not bring my
childrne to this meeting and that I could bring whatever other support person that I wish. Mr Wingrave has also indicated that
you are welcome to discuss with him the issue of a further opportunity to review copies of your children's test papers.
Spoke to Dave Wasson he has no additional knowledge of the Chris Caroll investigation. Said Bob Wingrave is the person who
would have any relevant files etc. I undertook to forward a copy of my letter to Mrs Challita to Bob, Dave and Magda. I said I
would discuss the Chris Caroll investigation with Bob.
Gentlepeople. The final version of my letter to Mrs Challita (sent last Friday) is attached. The only thing outstanding at this
stage from my perspective is the Chris Carroll 'investigation'. My feeling after talking to Chris, Bob, Anthony Bendall etc is that
the resolution of the ADT proceedings was assumed to wrap up all the outstanding issues. It would be great if there was some
record like a file note etc. Bob, do you have any relevant papers? Copy of letter Challita5.doc attached.
Spoke at lengthh to Mrs Challita. She sais that the Chris Carroll investigation was completely separate to the ADT
proceedings. Said that there has never been an investigation about the corruption that she is alleging. Says the investigation
was not discussed in the context of winding up the ADT proceedings and wants to know what is happened with it.
Mrs Challita rang to advise that I was sending my letters to her old address. Her correct address is now .. She then asked for
the file reference number for her matter. I asked which matter. She became very angry aggressive and kept insisting there
was only one matter 'her complaint'. At one stage she said the file my letters were on. When I started to give her the details of
this file, she shouted "no not he FOI file" She said she was going to see a Solicitor tomorrow and terminiated the conversation.
Further to our meeting today, I wish to confirm that whilst I am happy for Amanda to be assessed in the same manner as every
other student applying for Opportunity Class, I object to my daughters application being handled or dealt with by Magda Pollack
or Bob Wingrave of the Selective Schools unit or any other person previously involved in these issues; as set out in our
Responding to Suggestions/Complaints form that I formally lodged.
I confirm my advice to you that I have made formal allegations and continue to make formal allegations that Magda Pollack and
Bob Wingrave have breached their duty of care on an alarming and excessive amount of occasions, have shown bias and have
tampered with my eldest children’s scores/documents etc on a systemic and continual basis. I also confirm that I believe that
my complaint in relation to the allegations is being sabotaged and covered up by the Department.
Given that my allegations have never been investigated or properly and fairly addressed, and given that I sincerely believe and
have evidence that shows that my family is being victimized, I would request that Amanda’s application for Opportunity Class
not be sent to the Selective Schools Unit for processing and instead be sent directly to Dave Wasson the Director of
Educational Measurement Directorate for his personal attention.
NOTE: I had been told that Dave Wasson was independant and impartial so I agreed for him to deal with Amanda's matter but
documents later received under FOI showed he was the person between Bob Wingrave and Carol Carrigan in charge of the
covering up of my eldest two childrens complaints.
Welcome friend !Welcome friend !I do have a file, which you are welcome to have a copy of/whatever. Ms Challita is a regular
customer of the FOI and Privacy Unit and they have some additional files. Likewise the SSU has a large number of material in
relation to her repeated complaints.
She has been told by the Minister that ‘no further correspondence will be entered into ‘because of the vexatious nature of her
communications. There is another ministerial reply not long before that however, which indicated that Chris Carroll would
investigate her complaints and get back to her. It appears this did not happen. She brought proceedings in the Administrative
Decisions Tribunal concerning one of her FOI requests and it seems likely the discussions around that drew attention away
from the promised investigation. The ADT proceedings were eventually resolved on terms of settlement which I have also been
following through on.I have also been following through on.
I became involved by doing the internal review on another of Mrs Challita’s FOI requests and have been trying to tie up loose
ends and assist her.
She did go to the Ombudsman at some stage and they declined to go further with her complaint. The other issue to bear in
mind is that some members of staff have reportedly felt concerns about risk of harm to Ms Challita’s children arising from her
behavior and their involvement in the complaints etc. How would you like to proceed?
Email states that he has received complaints from me regarding Katie's Ella test and selective high school applications for my
son and that since bias, misconduct, victimisation, conspiracy, corruption fraud and a few other related terms are expressed
that he needs to assess the complaint. Asks for any information to help with the assessment.
Spoke to Chris Ballentine. He is waiting to hear back from Selective Schools Unit. It is likely that the audit will not investigate
further He will coy me into his reply.
Bob Wingrave is away ill. Left a message for Dave Wasson to call me on Monday.
Ask for Bob Wingrave to give him a call when he gets back as he is away ill. States that there only seems to be one issue left
from his piece of it and that is the Chris Carroll investigation and that he can't address it with what he has and that there is
another letter from me requesting the investigation. States that his inclination is, subject to talking to him and Dave Wasson, is
to send an acknowledgment to me saying he has referred the matter to Bob or Dave (whoever) to reply and that it would be a
matter for them for what they say but that they might just want to indicate that all of my complaints have been dealt with and
that they do not intend to take further action. Ends with Anyway we can talk it through when you get back.
Spoke to Bob Wingrave. Magda thinks it is a good idea to do a file revew for the operative period and write to Mrs Challita
advising that the matter is considered to be finalised. I said that I would send a confirming email to Bob, Magda and Dave
Wasson.
Bob. I refer to our discussions yesterday and confirm that from my perspective and I now there are many others the only issue
remaining outstanding is the"Chris Carroll investigation" referred to in the letter to Mrs Challita from the Minister dated 4 August
2003. States that as you know I flagged this with Mrs Challita in his letter of 2 July which stated that "My preliminary enquiries
indicate that it was intended that the terms of resolution of the ADT proceedings cover all outstanding issues betwen you and

Letter to me from Upaporn Blunden re FOI states: Mr Robert Wingrave, Manager of the Selective High School and Opportunity
Class Placement Unit has provided documents which are related to requests as mentioned in points (i), (ii),(iv) and (v). I have
made a determination to provide these documents in full.
I have also been advised that documents provided to you include Magda Pollack's emails. These documents were Ms Pollack's
correspondence while she was working as Records Management Officer at the Educational Measurement Directorate.
I refer to your client’s recent applications for Selective School placement for her daughter Amanda Challita. I presume you act
in this matter as your client has informed my client that she has instructed Solicitors.
Your client has lodged with the applications a “Suggestion or Complaint form’ which refers to allegations made against the
Selective High school and Opportunity Class Placement Unit, including Magda Pollack, dealing with or processing Amanda
Challita’s selective School applications. She requests the applications be dealt with by the Gifted and Talented Directorate
(actually a unit) of the Department.
Please not that the Department will deal with your clients complaint in accordance with its states policies. The complaint has
been referred to the Corruption Prevention and Investigation unit of the Departments Audit Directorate and any further
communications regarding the complaint should be directed to Chris Ballentine on 9561 8410.
However, I am instructed that the Department is unable to acquiesce your client’s request that her daughter’s application be
dealt with by the Gifted and Talented Unit. The unit does not have the requisite skills, personnel or resources to deal with such
applications. It would create an increased risk of error to have the application dealt with by persons not experienced in these
matters. Therefore Amanda’s application will be dealt with by the Selective High School and Opportunity Class Placement Unit
in the normal way.

submission but I have a concern about the draft letter for Gillians Signature. If we are not happy at all with Mrs Challita’s

Yes that is our standard procedure provided there is evidence and Mrs Challita knows this.

As alternative evidence we request an individual IQ test and standardized tests of reading and mathematics. She does not
need the second IQ test. I have mentioned in the letter she lacks a recent school report. I have discovered with this client that
the shorter the communication, the less material we provide for her to hold us up with more requests or complaints.
I am happy to make any changes you advise but I know this won’t end the matter and the more information we provide at this
juncture, the more evidence Mrs Challita will obtain to support what I really believe is an attempt to circumvent the procedures
which apply to everyone else.
Let me know what you think. I’d like to get this on its way ASAP.

I feel we have to give her a reason why we can’t comply with her request for test exemption. If she submits what we feel is a
doctor just writing out a medical certificate inappropriately there are avenues to complain such as the Health Care Complaints
Commission and the NSW Medical Board. In relation to home schooling that is under the Board Of Studies jurisdiction and it
requires a specific process. It would be appropriate to contact the Board of Studies to see if Mrs Challita has actually applied to
home school Amanda and aif not to get a Home School liaison officer of the Department to pay her a visit.
I certainly understand that with Mrs Challita she attempts to circumvent appropriate channels however we still need to tell her
why we will not comply with her request. As long as she has been told that the “old” IQ test can not be used I am happy with
that and that she has been made aware that no recent report has been provided and this will also cause problems with the
application.

issue from the principal of Baulkham Hills Hs (selective). I have rung another selective school (Girraween) and can surmise
that the original defamatory email has been distributed to principals of all selective high schools. Mrs Challita has also
distributed it to at least Angela Chessman from the G & T Unit in Curriculum K-12.
I have asked Magda to begin a Briefing regarding this.

Chris. Mrs Challita has applied on behalf of her daughter, Amanda, for Year 7 entry to Caringbah High School and St George
High School. This year I have removed myself from all involvement in the importing of scores from ACER, the processing of
those scores and any selection commitees relevant to Mrs Challita’s application. The scoe calculation was effected by a
process developed entirely outside my Unit by the Systems, Data Analysis and Regional Support Unit. Regrettably, Amanda
has a score of 168.44 which makes it unlikely that she will be selected. On past experience Mrs Challita will be reluctant to
believe the outcome was derived fairly.
As discussed could you arrange for a member of your team to attend both meetings (I was misinformed when I told you they
were both on the same day) to observe the placement process and to see that the meetings proceed according to the criteria.

Good morning, Magda. Firstly, thanks for inviting me in to view the process last Friday – I found it quite interesting. Secondly,
I would appreciate looking at any documents you have that detail the procedures/processes that need to be taken into account
by the Selection Committee particularly when factors beyond the result of the selective Schools examination need to be taken
into account.
The reason for my request stems from a review of Amanda Challita’s application. Had Amanda not sat he examination through
some misadventure then based on what I understand the procedures to be the committee would have been able to use the
results of her IQ. Given how high her IQ was shown to be she would have easily made it into a selective HS. At the end of the
day I need to see documentary evidence that shows that the committee had no choice but to accept the results Amanda
achieved in the selective school examination and is not able to consider Amanda’s IQ results
The enclosed documents are the Selective Schools tests 2006 materials for Student No 902091 comprising
reading/Mathematics test booklet number 08069, General Ability/Writing test booklet number 08069, answer sheet number

the panels this year to hear the depositions of the parents of 10 students whose writing task responses bore varying degrees of
similarity to each other.

We have today received an appeal from Mrs Challita, on behalf of her daughter Amanda. The cover page of the appeals notes
that the parent strongly objects to this application being processed by the Selective
Schools Unit or any person having been previously involved in this matter.
I have voluntarily excluded myself from any part of the process of Mrs Challita’s application so far. It seems appropriate for this
special panel to hear the appeal from Mrs Challita as well as the writing task matters as the Director Delegate is of a higher
rank than I and has not been involved with previous applications.
As you were kind enough to provide an observer from your Directorate to monitor the selection commitees Amanda applied for,
I was wondering whehte ryou could also provide an observer to monitor this particular appeals panel. It will meet on the
Selective High School and Opportunity Class unit premises from 8 to 11 am on 4 August 2006
Michael. Max will be chairing the appeals panel on Friday and has requested that I seek advice from you concerning Mrs
Challita’ s appeal. It is customary for an analysis to be provided to the panel. This analysis is normally generated by a
member of the SHS&CO placement unit and contains.
1. As summary of the parents claims
2. A summary of the schools’ claim
3. A list of supporting documents
4. A discussion of the main issues as perceived by the unit
5. Options that may be taken within the guidelines by panels
6. A recommendation for the panels consideration.
Magda. In my view, given that the Unit is the department’s expert in this area it is appropriate for the Unit to provide its advise
in relation to this matter. The panel will need to be made aware that Mrs Challita has concerns about the Unit and will need to
be mindful of that when considering the Units advice. I am not sure how the panel could perform its function without the input
from the Unit.

Gillian this is good news. You may be aware that Mrs Challita sent a lengthy complaint to the Office of the Ombudsman
concerning our ‘systematic bias, victimization, vilification, discrimination, bullying, misconduct, neglect, manipulation of
documents and test results, corruption and fraud and a conspiracy to cover up. After two lengthy teleconferences with Michael
Conaty (Ombudsmans office) I have been provided with a verbal indication that the Ombudsman will decline Mrs Challita’s
appeal in strenuous terms.
She can still appeal the Ombudsman’s decision, but this is a huge step forward for us.
States: The Ombudsman has decided not to investigate us in response to Mrs Challita's complaints.
The Challita appeals panel has met over two sessions and has decided not to place Amanda. Outcome letter to be signed by
Gillian in October with the rest of the outcomes (Sub required)
Max draft briefing regarding the Challita appeal is attached. Magda and Dave have accusations made against them and
therefore they do not appear as part of the sign off.
Do you think we should send the panel report in full or make reference to the deliberations and decisions in the letter to be sent
by the GM??
