BAR PART 1 CRIMINAL LAW PRE-CLASS ACTIVITIES

At about 12:30pm on the 10th February, 2023, Mr. Kola was about to park his car
in front of the only super market store in Bwari Area Council, Abuja when he
spotted two men later identified as Jegede and Kehinde staring menacingly at
him. While in the super market store, he saw the two men looking into his car
through the glass. He later saw Jegede opened and searched the car for like 30
minutes and later saw him with his car stereo. He also noticed Kehinde struggling
with his car battery but before reaching out to his car, he saw him with the car
battery who together with his partner dashed away with the items. Mr Kehinde
who did not give up the struggle met his wife Agnes of a Christian marriage and
narrated the incident with Mr Jegede to her who then kept her husband’s battery
pending further instruction. Whereas Mr. Jegede quickly handed over the car
stereo to Mrs. Agnes who further delivered same to Mr. Razaq who in turn
dropped same in Mrs. Jegede’s room and fled away. Consequently, Mr. Razaq
continued to play along till the end of the game wherein he grabbed a cell phone
from Miss Titilayo after using force to subdue her resistance. At last, Jegede who
was holding a stone and Kehinde again stopped a cyclist rider with the mindset to
take away the bike, having successfully gotten the bike rider terrified, took away
the bike. To mark the success of their operation, Mr. Kehinde who had a statutory
marriage with Mrs Agnes, married one Miss Sofia under Islamic rites.

The above is the excerpts of the report of the Police after investigation, as a new
lawyer in the Public Prosecution Department of the Ministry of Justice briefed to
handle the case;
a. Identify the offence or offences that can be alleged against Mr. Jegede
alone.
b. Identify the offence or offences that can be alleged against Mr. Kehinde
alone.
c. Comment on the appropriate offence you could allege against Mr. Razaq
for snatching the cell phone.
d. What offence could you allege against Mrs. Jegede for harbouring the car
stereo in her room without knowledge?
e. Comment on the possibility of charging Mr. Kehinde over his subsequent
marriage and why?
f. Would your answer be different in (e) above should the subsequent
marriage be under the Act?
g. Comment on the appropriate charge to be made against Jegede, Agnes and
Razaq for the chain of activities till the car stereo is kept in Mrs. Jegede’s
room.
h. Comment on the offence likely committed by Mr Jegede and Kehinde when
they took the bike.
