Hi Rollin,
As the petition is turned into first your office, and then the Registrar of
Voters office, this implies that both offices have the opportunity to
disqualify the petition based on content, format, etc.
I am not asking for legal advice, nor am J asking you to interpret
anything. I am only asking you to do what you would do (assumingly)
when I turn the petitions in signed.
Tam asking you to approve the petition, or disapprove it based on
missing information and to tell me what the missing information is. The
RoV does disqualify petitions for such reasons (spelling, syntax, specific
wording, etc, but will also preview petitions for errors before the
gathering signatures.
Otherwise, it would be very difficult to exercise one's First Amendment
right to redress their government for grievances, in a very short period of
time. i.e. There would be no time to repeat the process if you
disqualified the petition for any of the aforementioned reasons. That
seems rather abusive.
Is it the position of your office, that the only way I can find out that if the
petition is acceptable to you is to gather signatures in my 30 day window
and hope that you do not disqualify it for a missing comma, or margin
errors, or spelling errors, or any host of other reasons?Or,
If it is the position of your office that you will not in any way, shape, or
form, have any power to disqualify our petition on the basis of anything
other than voter signatures, please make that fact very clear for me.

I realize you stated previously that you have no overview of the actual

Hi Rollin,
As the petition is turned into first your office, and then the Registrar of
Voters office, this implies that both offices have the opportunity to
disqualify the petition based on content, format, etc.
I am not asking for legal advice, nor am I asking you to interpret
anything. I am only asking you to do what you would do (assumingly)
when I turn the petitions in signed.
1am asking you to approve the petition, or disapprove it based on
missing information and to tell me what the missing information is. The
RoV does disqualify petitions for such reasons (spelling, syntax, specific
wording, etc, but will also preview petitions for errors before the
gathering signatures.
Otherwise, it would be very difficult to exercise one's First Amendment
right to redress their government for grievances, in a very short period of
time. i.e. There would be no time to repeat the process if you
3disqualified the petition for any of the aforementioned reasons. That
seems rather abusive.
Is it the position of your office, that the only way I can find out that if
the petition is acceptable to you is tu yather signatures in my 30 day
window and hope that you do not disqualify it for a missing comma, or
margin errors, or spelling errors, or any host of other reasons?
Or,
If it is the position of your office that you will not in any way, shape, or
form, have any power to disqualify our petition on the basis of anything
other than voter signatures, please make that fact very clear for me.

stipulated in Ed Code 5091(f), which also references Elections Code 100-104. The number of signatures
required is determined by the Registrar of Voters (ROV), and they may also have a format sample for
collecting signatures. The number of signatures will depend upon whether the member vacating the seat
was elected at large or by trustee area, and | don't have that information- ROV might, or Desert Sands
USD would. While the final petition will be turned into this office, the petition process is really an
