PREFACE
INTRODUCTION
This manual represents the personnel policies and administrative, operational and disciplinary

procedures which are enshrined, in part in the:-

Fire Brigade Act 1988,

Fire Brigade (Amendment) Act, 1992

Fire Brigade (No. 2) Regulations, 1993

Government’s Staff Orders

The Manual is the complete reference point on the Terms and Conditions of employment for all

categories of uniformed staff within the Jamaica Fire Brigade. Similarly, the Fire Brigade Board may

alter its policies, practices and procedures from time to time and these will be reflected by revising the

appropriate Sections. All references to “members”, “fire officers”, “subordinate officers”, “he”, “him” or

“his” throughout the Manual apply to both male and female.

The Manual’s content is for use within the Jamaica Fire Brigade only.
MISSION STATEMENT

To minimize loss of life, injury to persons and damage to property in Jamaica from fires

and other disasters/accidents, by application of the most advanced knowledge available, appropriate

technology and highest ideals of professionalism and by the total commitment

of highly trained and disciplined work-force, acting in close collaboration with businesses, householders

and local communities.


FUNCTIONS OF THE BRIGADE

It shall be the duty of the Brigade to protect life and property in the case of fire or other disaster and

without prejudice to the generality of the foregoing, such duty shall include:-

a) extinguishing fires;

b) protecting life and property endangered by fire and other disasters;

c) obtaining information with regard to potential risks from fire or other disaster;

d) inspecting specified building to ensure that reasonable steps are taken for the prevention

of fire and for protection against the dangers of fire and other disaster;

e) making arrangements for ensuring that reasonable steps are taken to prevent or mitigate

loss or injury arising from fire or other disaster.

The Ministry may, by order, require the Fire Brigade to undertake other functions for the purpose of

prevention or mitigation risk to dangers to life and property.

CHAPTER I
PRELIMINARY

1. CITATION This manual may be cited as the Jamaica Fire


Brigade (Terms and Conditions of Employment) Manual 1994.

2. INTREPRETATION
1) In this Manual:-
“ACT” means the Fire Brigade Act 1988;

“BRIGADE” means the Jamaica Fire Brigade established by Section of the Fie
Brigade Act 1988;

“SERVICE” means service in the Jamaica Fire Brigade;

“BOARD” means the Fire Brigade Board established under section 5 (a) (1) of
the Fire Brigade Act.

“CHAIRMAN” means the Chairman of the Board;

“FUNCTIONS
OF THE BOARD” “includes power and duty”

“COMMISSIONER” means the Commissioner of the Jamaica Fire Brigade;

“MEDICAL OFFICER” means the registered medical practitioner in each parish engaged
with the Brigade to perform medical services;

“DIRECTOR OF
ADMINISTRATION” means the Director of Administration of the Brigade;

“DIRECTOR OF
FINANCE” means the Director of Finance of the Brigade;

“DIRECTOR OF
PERSONNEL” means the Director of Personnel of the Brigade;

“MEMBERS” means member of the Brigade;

“APPROPRIATE In relation to a member accused of a disciplinary


SUPERIOR offence which is to be dealt with summarily, AUTHORITY”
means:-
a) such officer in charge of an Area or Division as the
Commissioner may designate as respects an accused
member other than one specified in paragraph (b);

b) the Board, as respect the Commissioner, or


other officers above the rank of Assistant
Commissioner.

“TRIBUNAL” means an authority empowered by section 39 of the Fire Brigade


(No. 2) Regulations 1993, to hold a disciplinary inquiry.
“OFFICER” means any member of the Brigade above the rank of Sergeant and
“Fire Officer” has the same meaning;

“COMMANDANT” means Senior Fire Officer in command of the Fire Brigade Training
School;

“SUBORBINATE means any member of the Brigade in the post of


OFFICER” Sergeant, Corporal or Lance Corporal;

“FIREFIGHTER” means any member of the below the post of


Lance Corporal and “Firefighter” has the same meaning;

“RECRUIT” means any person who has been selected to undergo an Introduction
course at a Fire Brigade Training School;

“OFFICERS IN CHARGE” means the Fire Officer or Subordinate Officer for


the time being in charge of a Fire Station or at
the scene of a fire or other disaster;

“PROMOTION ADVISORY means the Promotion Advisory Committee of


COMMITTEE” the Brigade established by the Board;

“PROMOTIONS” means the appointment of a member to a


officer carrying a higher remuneration from the
one he held prior to that appointment;

“EXAMINATION AND
PROMOTIONS means “the Examination and Promotions
COMMITTEE” Committee” establish by the Brigade;

“ASSIGNMENT” means the movement of a member by the


Commissioner from one Administrative or
Operational Section in the Brigade temporarily
and with no change of office;

“TEMPORARY means the appointment of a person to a


APPOINTMENT” temporary office or the appointment of a person
temporarily to a permanent office;

“ACTING mean the temporary appointment of a member


APPOINTMENT” holding a permanent appointment from one office
to a office higher than that to which he is substantively
appointed whether the office is vacant or not;
“APPOINTMENT” means the placing of a person in an office in
the Brigade;

“DATE OF means the date of appointment specified in the


APPOINTMENT” member’s “Letter of Appointment” or published
in Brigade’s General Order;

“INCREMENTAL DATE” means the anniversary of the date of the


member’s appointment to the post he holds;

“SALARY” means the actual pay of a member which is


one of the steps or points in a salary scale;

“ALLOWANCES” means an additional sum in addition to salary


which is attached to a post to take account of
considerations such as travelling, housing,
meal etc.;

“PERFORMANCE means the Performance Appraisal Report


APPRAISAL REPORT” relating to the period of service of a member
during the immediately preceding twelve (12)
months;

“TRANSFER” means the movement of a member from an office,


“SALARY SCALE” section means the salary attached to a post beginning with a
minimum and advancing by an incremental rate to a maximum;

2) These Rules are applicable to all members, except in-so-far as alternative provision is made for
a member in written law or lawful direction applicable to the office held by such member which
expressly excludes the operation of these Rules.

CHAPTER II

PART I
RECRUITMENT

3. NATIONALITY
Only persons of Jamaican Nationality shall be permanently appointed to the Brigade.
Persons of foreign nationality may, however, in special cased be appointed to the Brigade
but shall only be so appointed where there is no available suitably qualified Jamaican
National.

4. FEMALE MEMBERS
A female member shall not be exempt by reason of her sex or marital status, from any of the
normal requirement s and conditions of her employment, including regular attendance,
working overtime when required, and the liability of transfer.

5. MINIMUM QUALIFICATIONS FOR OFFICE


Subject to this section, a person who:
a) successfully compiles an introduction course at a Fire Brigade training school or a course
of equivalent level so recognized by the Commissioner; and
b) satisfies the requirements set out in Section 12 (a), (b), (c), (d) and (e) of the Fire Brigade
(No. 2) Regulations 1993, (Admission, Probation Service and Termination of
Appointments) is eligible for appointment to the post of Firefighter in the Brigade.
6. ENLISTMENT
Subordinate Officers and Firefighters may be enlisted for a term of five (5) years and may
within three (3) months of expiration of a term apply to be re-enlisted for a further term of one
(1) year in each instance.

7. TERMINATION OF ENLISTMENT
1) Subject to section 166 enlistment under Section 6 may only be terminated prior to
expiration of the term.

a) By three months notice:-


i) from the Subordinate Officer or Firefighter to the Commissioner; through his
immediate superior, of his intention to withdraw from the Brigade; or
ii) to the Subordinate Officer or Firefighter from the Commissioner; or

b) in exceptional circumstances upon application by the member to the


Commissioner.

8. QUALIFICATION FOR CONDITION AS A RECRUIT


1) A candidate for consideration as a recruit shall:-
a) be of good character and if he had served in any branch of the Jamaica Defence
Force, the Jamaica Constabulary Force or in a civil capacity in the Public service
must produce satisfactory proof of his good conduct while in such service;

b) be under the age of twenty eight (28) years provided that the candidate above that
age may be admitted if he have such previous service or specialized skills as in the
opinion of the Board renders his admission desirable;
c) produce satisfactory proof that he possesses such educational or professional
qualifications as may be required by the Board;
d) satisfy the Board that he is sufficiently educated by passing a written examination,
notwithstanding the provisions set out in sub-section (c);
e) complete an application in such form as the Board may from time to time prescribe.
2) A candidate who satisfies the requirements of Section 1 shall:
a) be required to pass an aptitude test prescribed and conducted by the
Personnel/Training Departments of the Brigade.
b) if successful in the aptitude test, be required to attend an interview; and
c) if successful in the aptitude test and interview referred to above, shall be certified
by the Medical Officer to be in be in good health, of sound constitution and fitted
both mentally and physically to perform the duties of his office.

2) A candidate who satisfies the requirements of the Sub-Sections (1) and (2) may be selected
to undergo an introduction course at the Fire Brigade Training School as a recruit.

9. FAILURE TO PASS TRAINING COURSE


Where a person fails to satisfy the requirements of the induction course at the Fire brigade
training school, or is otherwise not considered fir to graduate by the training staff, that person
shall be notified accordingly in writing by the Commissioner on the recommendation of the
Commandant of the Fire Brigade Training School and ceases to be a recruit.

10. QUALIFICATION FOR ELIGIBILITY FOR APPOINTMENT TO POST OF FIREFIGHTER


A recruit who successfully completes an induction course conducted at the Fire Brigade Training
School and graduates accordingly shall be eligible as candidate for appointment to the post of
Firefighter.

11. SERVICE NUMBER AND IDENTIFICATION CARD


1) A person on appointment to the uniformed ranks of the Brigade shall be given a service
number which shall be inserted on that person identification card and which number shall
retained throughout that person’s service irrespective of where in the Brigade the person
is employed from time to time.

2) A service number once issued shall not be re-issued.

3) A person appointed to the uniformed ranks of the Brigade shall be issued with an
Identification Card in which shall be contained the following details pertinent to the holder
of the card:
a) photograph on red background
b) Rank
c) Name
d) Date of Birth
e) Height
f) Signature

4) The authorizing signature of the issuer of the card will also be on the face thereof.

12. MEMBER TO REPORT CHANGE NAME


A member shall report a legal and official change of name, if any, to the Commissioner who shall
in turn advise the Board and all relevant authorities.

13. QUALIFICATIONS FOR PROMOTIONS IN THE SUBORDINATE OFFICERS’ RANK


STRUCTURE
1) A candidate for promotion to the rank of Lance Corporal shall be:
a) a person appointed to the post of Firefighter with two (02) or more years service in
the Brigade who has passed a job-related written and oral examination and a practical
examination conducted for that purpose by the Examination Committee and shall be
certified by the Commissioner to be of good conduct and efficient.
b) a person holding the office of Firefighter with at least ten (10) years experience and
is certified by the Commissioner to be of good character and efficient.
2) A candidate for promotion to the rank of Corporal shall be a person holding the rank of
Lance Corporal with at least three (03) years service in the Brigade who:
a) has passed a job-related written and oral examination and a practical examination
conducted for that purpose by the Examination Committee and shall be certified by the
Commissioner to be of good character and efficient.
3) A candidate for promotion to the rank of Sergeant shall be a good person holding the rank
of Corporal who:
a) has passed a job-related written and oral examination and a practical examination
conducted for that purpose by the Committee and is certified to be of good
character and efficient.

14. QUALIFICATION FOR PROMOTION TO THE RANK OF DISTRICT OFFICER


1) A candidate for promotion to the rank of District Officer shall be selected from among
those person holding the rank of Sergeant with at least eight (8) years service in the
Brigade and who:

a) has passed a job-related written examination conducted by the Examination


Committee; and
b) possesses passes in five (5) subjects in the examination Council (CXC) including
a pass in the subject of English Language at General Proficiency Grade I, II, III, or
Basic I and in the other subjects at the grade of I, II or III or Basic I or II and
passes in two (2) subjects at “A” Level in the General Certificate of Education; or

c) possesses a General Certificate of education with passes at “O” Level in not less
than five (5) subjects with English Language and Mathematics being two (2) of the
five (5) subjects and passes in two (20 subjects at “A” level; or
d) be the holder of a Graduate Diploma of the Institute of Fie engineers, or equivalent
related qualification as assessed by the Personnel Officer after consultation with
the Commissioner; or
e) have been successful at the Overseas Operation Commanders’ and Fire
Prevention Course; or
f) have passed a written examination in English, Mathematics and Management
Studies conducted by the Examination Committee.

15. QUALIFICATIONS FOR PROMOTION TO OTHER OFFICERS RANK

1) A candidate for another post in the fire Officers rank structure shall have the qualifications
prescribed for the rank of District Officer, or such higher qualifications a determined by the
Board.

2) Waiver of qualifying period:-


The qualifying rank and period of service specified in this part in respect of a member
may be waived where the member is in possession of educational qualifications superior
to those prescribed for that rank.

16. EMPLOYMENT OF PENSIONERS AND OTHERS ON CONTRACT

1) A person, including a pensioner, may with the approval of the Board, be employed on
contract for a period not exceeding five (5) years if it is established to the satisfaction
of the Board that the person or pensioner is in possession of essential experience or
technical qualifications not available within the Brigade which makes him particularly
useful to the Brigade.

2) For the purpose of this Section “pensioner” means a person in receipt of a pension.

17. EXAMINATION COMMITTEE

1) An examination Committee convened in writing by the Commissioner shall:-

a) when convened the examination which is to be passed by a member prior to


promotion to a rank in the Brigade; and

b) asses each examination paper submitted.

2) All candidates shall apply in writing to sit an examination referred to in Sub-section (1)
and shall undergo an examination conducted by the Examination Committee.

3) Candidates shall be placed in order of merit by the Examination Committee according to


their performance in that examination.

PART II

PROBATIONARY PERIOD AND SENIORITY


18. PROBATIONARY PERIOD ON APPOINTMEMT AS FIREFIGHTER

1. On appointment to the Brigade, a Firefighter shall:-

a) be on probation for a period of one year from the date of hi appointment;


b) during the period of appointment on probation the services of a firefighter may be
dispensed with at any time if the Board considers that he is not fitted mentally or
physically to perform the duties of his post;
c) that he is not likely to become an efficient and well conducted member; or
d) provided that a member whose services are to be dispensed with shall be entitled to
receive one (1) month’s notice in writing from the Board or one (1) month’s pay in lieu
of notice.
2. At the end of the period of probation, if his service has not been dispensed with, be
deemed to have been duly confirmed as respect his enlistment.

19. ELIGIBILITY FOR INCREMENTS – POST OF FIREFIGHTER

Every person admitted on appointment to the Brigade as a firefighter shall be paid initially the
minimum of the scale attached to the post, and , subject to Section 49, Sub-Section

For the salary to be increased by annual increments at the rates approved until he reaches the
maximum of the scale or is promoted to the next senior post.

20. PROBATION PERIOD OF MEMBER ON PROMOTION

1) Except as otherwise provided in this part, a member who is promoted shall be required to
serve on probation for 6 months in the rank to which he is promoted, and such period of
probation shall be stated in his letter of appointment to the new rank.

2) Subject to Sub-section (3), where immediately preceeding his promotion a member has
served in an acting appointment in the post to which he is promoted, the period of
promotion shall be abated by the extent of the aggregate of service in such acting
appointment unless the Commissioner directs otherwise.

3) In calculating the aggregate of service in the acting appointment for the purpose of Sub-
section (2), only continuous service three (3) months or more shall count.

4) Where a member is promoted to a rank in which he has acted satisfactorily for the period
of probation prescribed in Section 18 (1) or Section 21 (1), the period of acting service
shall be offset against the period of probation.

21. EXTENSION OF PROBATION PERIOD

1) Notwithstanding the period of probation prescribed in Section 18 (1) and 21 (1), where a
member is appointed on probation and does not perform his duties satisfactorily during
the probationary period the Commissioner may extend the period of probation to be
served:-

a) by a further six (6) months in the case of a Firefighter on first appointment; or


b) by a further six (6) months in the case of a member promoted to a post, and shall
advise the Board accordingly.

2) Before the Commissioner extends the period of probation of a member the commissioner
shall inform the member accordingly and of his reasons and he shall invite the member to
submit any representation he may wish to make on such recommendation in accordance
with section 24,sub-section (5).

3) If the Commissioner is not satisfied that the performance of a member on probation has
been satisfactory for the purpose of appointment, the Commissioner shall so inform the
Board who may extend the period of probation or recommend the termination of that
appointment.
22. PRINCIPLES TO BE OBSERVED DURING PROBATIONARY PERIOD

1) The following principles shall be observed for the treatment of a member during the
member’s period of probation;

a) the member on probation shall be given every opportunity to learn his work and be
tested as to his suitability for it;

b) the member on probation shall be accorded all possible


facilities for acquiring experience in his duties;

c) the member on probation shall be subject to supervision;

d) so far as the exigencies of the brigade permit, the member on


probation shall be assigned to duty only where such observation is
possible.

2) Where at any time during his period of probation in a rank, the member exhibits
tendencies in the performance of his office which indicate he is unlikely to be fit for
confirmation in the rank these tendencies shall immediately be drawn to his attention in
writing by the Commissioner and the member shall be given such assistance as may be
possible to enable him to correct those tendencies.

23. PROBATION REPORTS

1) In the cases of a ember serving a one (1) year period of probation, the Commissioner
shall submit to the Board two (2) reports:-

a) a first report after the member has completed six (6) months service; and

b) a final report one (1) month before the period of probation expires.

2) In the case of a member serving a period of probation of six (6) months, two (2) reports
shall be submitted;-

a) a first report three (3) months before the probation expires; and

b) a final report one (1) month before the period of probation expires.

3) In submitting the final report under this section, the Commissioner, shall recommend
that :-
c) the member be confirmed in the appointment;
d) the period of probation be extended;
e) the services of the member be terminated in that rank; or
f) the member revert to his former rank.
4) The first report under this Section shall be seen by the member on probation. He must
also be made to see the second report.

5) Any adverse comments in a report on the member shall be in specific terms and the
member shall be notified in writing in duplicate as early as possible, in order that he has
sufficient time in which to make an effort to correct any shortcomings before his period of
probation expires.

6) The member shall retain the original notification of the adverse report or comments
referred to in sub-section (5) and shall sign the duplicate and return it o the Commissioner
for the record.

7) The member may present a report to the Commissioner commenting on the adverse
report referred to in sub-section (5) and may send a copy of such report to the Board
through the Commissioner.

8) The report of the member made under Sub-section (7) shall be forwarded to the Board by
the Commissioner.

24. RECORD TO BE KEPT OF EVERY MEMBER

The Commissioner shall keep a record of every member who has been appointed to a post in
the Brigade.

25. SENIORITY LIST

1) The Commissioner shall keep an up-to-date seniority list of all members in the Brigade
showing, in respects of each member, the date promoted to his present rank and the date
of his first appointment to the Brigade.

2) The seniority of a member shall be determined by the date of his promotion to the
particular rank in which he is serving.

3) The seniority of members promoted to the same rank from the same date shall be
determined by their seniority in their former ranks.

4) Where more than one member is promoted to the same rank with effect from the same
date, the relative, seniority of such members shall be determined by date of their first
appointment to the Brigade.

26. SENIORITY DATE ON RE-APPOINTMENT

The seniority of a member who voluntarily resigns form the brigade and is subsequently re-
appointed shall be reckoned from the date of his re-appointment.

27. BOARD TO DETERMINE SENIORITY


In any case not covered by section 26, sub-sections (1), (2) and (3) the Board after taking into
account the comments of the Commissioner shall determine the seniority of the member.

28. BOARD TO BE PROVIDED WITH SENIORITY LIST

The Commissioner shall provide a copy of an up-to-date seniority list to the Board in January
each year.

PART III

REMUNERATION AND ADVANCES

29. APPOINTMENT OF BRIGADE MEMBERS AND EMPLOYEES AND AGENTS OF THE BOARD

1) The Board may appoint and employ at such remunerations and on such terms and conditions
as it may determine:

a) a Commissioner, such other members of the Brigade; and

b) such other employees and agents, as may be necessary for the purpose of the Brigade

Provided that:

a) no salary in excess of the prescribed rate shall be assigned to any post without the prio
approval of the Minister;
b) no appointment shall be made without the prior approval of the Minister
c) to any post which a salary in excess of the prescribed rate is assigned.

2) In sub-section (1), “prescribed rate” means a rate of $50,000 per annum or


such higher rate as the Minister may, by order, prescribe.

3) The Governor General may, subject to such conditions as he may impose,


approve of the appointment of any public officer in the service of Jamaica to
any post with the Brigade or the Board as the case may require, and any
public officer so appointed shall, in relation to pensions, gratuity or other allowances, and to
other rights as a public officer, be treated as continuing
in the service of the Government.

30. SALARY

1) The salaries attached to all posts in the Brigade shall be as determined


by the Board and as may be approved by the Board from time to time,
subject to the provisions of section 30, sub-section (2).

2) It shall be normal for a member appointed on a permanent basis to be


paid initially the minimum salary of the scale and for the salary to be
increased by annual increments at the rates approved until he reaches
the maximum salary of the scale. In special circumstances, however, appointments may be a
a salary higher than the minimum by the Board.

31. INCREMENTAL DATE

1) Except as otherwise provided a member’s incremental date shall be the anniversary of the
date of his appointment to the post which he holds.

2) Payment of increment:-
All normal increments accruing to the salaries of members will be paid,
as a matter of courses, when due, save in any case where the Board on
the recommendation of the Commissioner, considers that the increments
should not be paid to a member for reasons prescribed in these rules.

3) When the Board considers that the member’s increment should not be paid,
the Board shall direct the Director of Finance as early as possible and in
any event not later than four weeks before the date on which the increment
falls due.

4) When an increment referred to in this Section is withheld but subsequently


granted it will become effective from the latter date only, and the member
must serve one year from that date before proceeding to the next incremental
step.

32. SENIORITY ALLOWANCE

1) A member who holds a post to which an annual scalar salary is attached, and who
has served at the maximum salary of the scale for three (3) years will be granted a
seniority allowance at a rate equivalent to the highest incremental rate of his salary
scale, provided the Commissioner is able to certify that he is of good character
and efficient.

2) The grant of any Seniority Allowance will only be made if there is no increase in the
number of increments attached to the particular scale.

3) All members who have been granted a Seniority Allowance will be considered for the
grant of a further increment if, in the absence of promotion opportunity he serves three
more years in the same post, provided the Commissioner is able to certify to the
Board that the member’s service is satisfactory in all respects.

4) Seniority Allowance are personal to the members who have earned them and shall be
taken into in the calculation of retiring benefits.

33. DATE OF PAYMENT OF SALARY

1) Subject to sub-sections (2) and (3), salary shall be paid on the 25th
day of each month.

2) When the 25th day of any month falls on a Friday, Saturday or


Sunday, payment of salary shall be made on the preceding
Thursday.

3) The Board may vary the date of payment of salary to a date earlier
than that referred to in sub-section (1) or (2) whenever it appears
expedient to do so.

ADVANCE LEAVE PAY

4) A member who is proceeding on Vacation leave may receive his


salary at his request before the day referred to in sub-section (1), (2) or (3) for the whole
month in which he proceeds on leave where the period of leave extends beyond the end
of the particular month.

34. ADVANCE OF SALARY IN CASE OF EMERGENCY ABROAD

1) An advance not exceeding one (1) month’s salary may be paid to a member through a
Jamaican Mission in cases of emergency, while the member is abroad; each case being
dealt with on its merit.

2) An advance granted under this section, together with interest, shall be repayable in
twelve (12) monthly installments or in such longer periods as the Board may determine,
with the first installment falling due at the end of the month following that in which the
member resumes duty.

35. THE BOARD MAY AUTHORISE ADVANCES FOR OTHER PURPOSES

1) The Board may authorize an advance of salary for other purposes not specified in these
sections.

2) For the purpose of the sub-section (1), documented proof of the need, to the satisfaction
of the Board shall be furnished by the member and the remittance shall be made out not
to the member but to a personal guarantee.

3) Interest shall be payable by the member on any advance made under this section and at
such rate as the Board may from time to time determine.

4) An advance granted under this section shall be recovered by deductions from the
member’s salary in not more than twenty-four (24) monthly installments as shall be fixed
by the Board.

5) In determining the number of monthly installment, the indebtedness of the member shall
be taken into account.

36. DEDUCTIONS FROM SALARY

1) Except as allowed for at sub-section (3), no money shall be deducted from a member’s
salary without prior notice in writing to him of not less than one (1) month.

2) A member may authorize the director of fiancé to make monthly deductions from his on
his behalf, of dues, liabilities or contributions payable to:-
a) the appropriate recognized trade Unions or Fire Officers Association to which he
belongs;

b) an Insurance Company in respect of Life Insurance Premiums, Pensions or Annuities;

c) a credit Union or other Financial Institutions approved by the Director of fiancé for
receipt of such payments;

d) a spouse or parent of his child according to a court order.

3) The Commission may:-

a) deduct from the salary of a member the amount of penalty imposed as a result of
disciplinary action under the Fire Brigade Disciplinary Regulations;

d) deduct from the salary in accordance with Government Financial Regulations and
may make such other deductions as approved by the Board towards reduction of,
or payment of outstanding debts due to the Government.

37. ADJUSTMENT OF SALARY ON PROMOTION

1) a) The following shall apply when a member is promoted in


the ordinary course to a post carrying salary on an incremental scale:-

b) If immediately prior to his promotion the salary of the


member was less than the minimum of that of the new post, he shall, subject to
sub-section (2) (a), receive the minimum.

2) a) If his salary (Fixed Salary) was not less than the


minimum of that of the new post or his salary was in a scale which touches or
overlaps the salary of the new post, unless his benefits under sub-section (1) (b)
will be greater, an amount equivalent to the value of an increment of the new scale
shall immediately be added to his salary.

b) The member shall receive this consolidated sum in money as set out at sub-
section (2) (a),above, until by length of service at his new incremental rate he has
earned such an amount of increment as will bring him to the next higher
incremental step in his new scale: but if he was qualifying for increment in his
former post, the date of increment in his new scale shall subject to sub-section (3)
of this section, be advanced proportionately, even though it may mean the
immediate grant of one increment and the advancement of the normal date for
further increment.

3) If his former post was one to which no duty or other similar non-pensionable
allowance was attached, and he is promoted to a post carrying such allowance, he
shall serve for a full incremental period in the new post before becoming eligible
for an increment.

38. SALARY PAYABLE ON PROMOTION


1) Notwithstanding the provisions of sub-sections (38) (1) (b) and(2) (a), every member on
promotion shall receive an immediate increase of emoluments which is not less than the
value of a increment of the higher post.

2) If the salary scale of an individual office is altered, the salary of the holder shall be
determine in accordance with the provisions of this section as if the holder of the post had
been promoted, but in the case of a revision of salaries which affects the entire Brigade
or a class or category of Brigade members the salaries of the members affected will be
determined on the basis on sub-section (4).

3) The term ‘salary’ in this Section shall include any personal or other allowances which is
payable in money and which ranks as a pensionable emolument.

4) Subject to the provision of sub-section (2),if the scale of salary of a member’s post is
altered, the member shall enter his new scale at an incremental point which corresponds
with the point he had reached in his old scale subject to the following conditions:-

a) Apart from the cases mentioned at paragraphs (b),(c), (d) and (e), the member
will proceed to the next step in the new scale on the date on which he would have
become eligible for the next increment in his old scale, but his incremental dates
shall remain unchanged.

b) Where it is necessary that two or more salary points in any old scale convert to one
point in a new scale, members receiving the lower salaries in the old scale, will, on
conversions of the new scale not become eligible for the next increment until
they have served a full incremental period of one year from date of effect. In all
such cases therefore the date of effect will be the new incremental date.

c) If in a conversions by corresponding points the maximum of the old scale falls


below the maximum of the new scale, a member who, on the date of effect had
completed one year at the maximum of the old scale will be eligible to receive one
additional increment in the new scale.

d) A member in the circumstances set out at ( c) above who had completed two or
more years on the maximum of the old scales will be eligible (subject to the
maximum of the new scale) to two (2) increments but no more: Provided that in all
such cases the Commissioner is able to certify that the member has earned such
increments by the standard of h is work and conduct since he reached the
maximum of the old scale. The new incremental date in all such cases will be the
date of effect.

e) If a member of a fixed salary converts to a scale of salary his incremental date will
be the date of effect or the actual date or appointment to a fixed salary, if
subsequent to the date of effect. Such a member will be eligible to receive the
incremental concession in Section 39 and Sub-section (4) paragraphs (c)and (d).

39. EFFECTIVE DATE OF PROMOTION


A member who is promoted in the ordinary course in the service shall be eligible to receive
salary in the scale of his new post as from the date specified in his letter of appointment even if
he on leave of absence at the date in question. His appointment to a newly created post,
however, will take effect only from the date on which he enters upon his new duties.

40. ACTING ALLOWANCE

1) A member duly appointed to act in a post higher than his substantive post for a
continuous period exceeding twenty-eight (28) days shall be granted in addition to his
own substantive salary an acting allowance from the date on which he assumes the
duties of the higher post, up to the date preceeding that on which he resumes his normal
or other duties, calculated on the following basis:-

a) if the salary of the higher post is incremental, at a rate equal to the difference
between the members own substantive salary and the minimum salary of the
higher office;

b) where the salary of the lower post touches or overlaps the salary scale of the
higher post and the actual salary drawn by the member in respect to his
substantive post, is less than the minimum of the higher office he should be paid
at a rate equivalent to the amount of one (1) increment in the higher scale,
whichever is the greater;

c) If the actual salary drawn by the member in respect of his own substantive post is
equal to or greater than the minimum of the higher office at a rate equivalent to the
amount of one (1) increment in the higher scale.

2) Notwithstanding the provisions of sub-paragraph (a) and (b), every member on being
appointed to act shall receive an acting allowance which is not less than the value of one
increment of the higher office.

3) When a member discharges the duties of any other office in addition to his own, for a
continuous period exceeding twenty-eight (28) days the following rule shall apply:-

a) if the two posts are distinct and separate posts in the Brigade but stand to one
another in immediate relation of superiority or subordination, the member shall
not be eligible for an acting allowance, unless the post in which event he shall
receive an acting allowance calculated as if his case fell under paragraph (a) of
this Section.

4) When a duty allowance is attached to any post, a member appointed to a t in that


post shall, draw the duty allowance while so acting in addition to any acting allowance
as provided in this regulations subject to Section 75.

41. SUBSTANTIVE SALARY

1) For the purpose of this Section:

a) A member’s own substantive salary comprises the whole of that member’s


receipts from the Fire Brigade Funds by virtue of his substantive post, but does not
include duty allowance, house allowance or allowances for out-of-pocket
expenses;

b) “The salary of a post’ means the salary attached to the post exclusive of
allowances of any kind;

c) “Higher office than his own” means a post the fixed salary of which exceeds the
members owns substantive salary or a post, the minimum or maximum salary of
which is greater than the member’s own substantive salary;

e) “Distinct and separate posts” include post which are of similar designating in the
Brigade.

2) An acting allowance will be payable in respect of periods during which the member while
holding the acting appointment, is absent on periods of departmental leave or leave on
medical grounds not exceeding twenty-eight 928 days at any one time.

42. ENTERTAINMENT ALLOWANCE


1) The Board on the recommendation of the Commissioner may authorize the refund of any
expenditure made by an Officer in respect of the entertainment of private individuals or
such other persons approved by the Board.

Such expenditure should be regarded as covering:-


a) all entertainment in the home;
b) all entertainment of persons not visitors to the Island;
c) entertainment of visitors to the Island at small luncheon, cocktail or dinner party.

43. PAYMENT OF WASHING ALLOWANCE DURING LEAVE

A member who is granted vacation leave in excess of thirty-five (35) days shall not be eligible for
the payment of washing allowance. The allowance may, however, be paid during leave which
does not exceed thirty-five (35) days as well as during the first twenty-eight (28) days of leave on
the ground of illness and any period of departmental leave. In cases however of leave prior to
retirement or separation from the Brigade the allowance will not be payable during such leave.

44. SALARY ON RETURN TO DUTIES IN SUBSTANTIVE POST

A member after terminating any period of acting appointment and on reverting to his substantive
post, shall be paid the salary in his substantive post which he would have received had he not
been given an acting appointment.

45. PERFORMANCE APPRAISAL REPORTS

1) The Commissioner shall each year prepare and submit to the Board a performance
appraisal report relating to the period of service of a member during the immediately
preceeding twelve (12) months on:-

a) the 1st day of November, in respect of officers; and


b) the 1st day of December in respect of subordinates officers.
2) In order to assist the Commissioner in performing his functions under this Section, the
Fire Officer incharge of each fire area or branch as the case may be, shall in each year
furnish to the Commissioner, performance evaluation reports in respect of the twelve (12)
months immediately preceeding the 1st day of October of such year, upon all members
serving in the fire area or branch under his command.

3) In the preparation of a performance appraisal report, the Commissioner or fire Officer in


charge of ach fire area or branch shall be guided by his own deliberate judgement and
shall in such report:-
a) make an unbiased assessment of the standard of the member’s performance of his
duty in the preceeding twelve (12) months; and

b) identify the training and developmental needs of the member within the service
together with the future prospects of the member in the service.

4) a performance appraisal report shall be in such form as may from time to time be
determined by the Board and shall be made in respect of every member.

46. MEMBER TO BE INFORMED OF PROGRESS OR OTHERWISE


1) In order that a member may be aware of the satisfaction or otherwise of his performance
of his duty during the course of the twelve (12) months period of service reported on the
Commissioner or Fire Officer in charge of a fire area or branch:-

a) shall discuss at any time such performance with the member recommending
methods by which such performance may be improved or the potential of the
member may be developed; and

b) shall, as and when shortcomings in the performance of the members are noticed,
discuss such shortcomings with t e member and recommend appropriate remedial
acting to improve the level of that performance.

2) Where after discussions under sub-section (1) (b), there is no improvement in the
members performance, the Commissioner shall cause the member to be informed in
writing of such shortcomings and the recommended remedial acting referred to in sub-
Section (1) (b).

3) Where any adverse markings are included in the performance appraisal report, the
Commissioner shall notify the member in writing.

4) The member may within seven (7) days of the notice in writing referred to in sub-section
(3) make representation in writing to the Board through the Commissioner on such
markings.

5) A representation in writing made in accordance with sub-section (4) shall be included in


the performance appraisal report by the Commissioner together with his comments, if
any.

6) Representations made under sub-section (4) and comments made under sub-section (5)
shall form part of the final performance appraisal report.
7) A member shall be provided with a copy of the final performance appraisal report:-

a) at his request if it contains no adverse comments, or

b) if it contains an adverse comment, at the time a copy is forwarded to the Board


under sub-section (1).

8) Nothing in this Section precludes a member from making a further representation to the
Board directly on comments made in a performance appraisal report within seven (7)
days of receipt of a final performance appraisal report provided to him in accordance with
sub-section (7).

47. PAYMENT OR OTHERWISE OF INCREMENTS

1) The Commissioner may defer the payment of an increment payable to a member for a
period not exceeding six (6) months.

2) Where the Commissioner after considering any representation by a member made under
section 48, sub-section (5) is of the view on the basis of the performance appraisal report
and representations of the member, that payment of an increment to the member is not
justified, the Commissioner shall notify the member in writing, together with reasons, of
his decision to defer the payment of the increment and of the period of that deferral.

3) Where the Commissioner defers payment of an increment to a member under sub-section


(2) for a specified period, the Commissioner shall, not less than thirty (30) days before the
expiration of the specified period, obtain a report on that member form the senior
commanding officer.

4) Where the Commissioner after taking into account the report referred to in sub-section
(3) is of the view that the payment of the increment is justified, the Commissioner shall
grant the payment of the increment from a date determined by him.

5) Where the report referred to in sub-section (3) does not justify the payment of the
increment, the Commissioner shall refer the matter to eh Board for its ruling.

6) Where the Commissioner defers the payment of an increment to a member under this
section, that deferral shall not affect the member’s incremental date.

PART IV
SECONDMENT TO OFFICE IN THE BRIGADE
48. SECONDMENT TO THE BRIGADE

1) A person on secondment to an office in the Brigade shall draw the full pay applicable in
respect of the post to which he is seconded and shall be eligible for increments, if any,
normally payable to a person in that post.
2) A person on secondment into the Brigade, as provided for under section 30, sub-section
(3), shall be eligible for the leave applicable to the post to which he is seconded and while
on such leave, he shall receive the pay of that post.

PART V

PENSIONS, GRATUITIES RETIRNG ALLOWANCES AND DEATH


BENEFITS
49. CLAIMS FOR PENSION

1) Pensions, gratuities, retiring allowances and death benefits for members of the Brigade
and employees and agents of the Board, shall be in accordance with the relevant
provisions of the applicable regulations made by the Board with the approval of the
Minister.

2) All claims to pension, gratuities, and other retiring allowances shall be made on the
appropriate form and shall be submitted by the director of Personnel to the Board through
the Commissioner, as soon s the question of a member retirement has been settled. The
form shall be accompanied by the necessary supporting document and shall be certified
by the Commissioner to the effect that all the particulars contained therein are correct.
The supporting documents consist of the following:-

a) certified copy of Birth Certificate;

b) period of Service Form completed and signed by the Commissioner;

c) Pension Particulars Form completed and signed by the Commissioner;

d) Statutory Declaration where there are discrepancies in the Birth Certificate.

50. RETIREMENT ON THE GROUNDS OF ILL-HEALTH

1) In cases of retirement on grounds of ill-health a medical report from a medical Board


appointed by the Fire brigade Board comprising not less than three registered medical
practitioners should be submitted in the prescribed form. The report to the Fire brigade
Board should state clearly that the member is incapable by reason of an infirmity of mind
or body of discharging the duties of his office efficiently and that such infirmity is likely to
be permanent.
2) In case of application for death gratuities the Death Certificate as well as the Birth
Certificate of the deceased should be submitted.

51. COMPUTATION OF PENSIONS

1) The computation and authorization of pensions, gratuities and retiring allowances of


persons whose retirement from the brigade is known to be impending shall be treated as
urgent matters of high priority.

2) The Director of Finance shall keep separate records with respect to each member in the
Brigade showing at the various posts held by each member and pay drawn by him while
in the service.

3) The Director of Finance shall be responsible for the computation of pensions, gratuities
and retiring allowance and shall submit same to the Board through the Commissioner for
authorization before the date on which the member’s retirement from the Brigade is due
to take effect.

4) The Director of Finance shall ensure that the particulars of service and pay of all
members whose retirement is known to be imminent are furnished accurately to the
Board through the Commissioner not less than three (3) months before the date on which
the member is due to retire.

52. INSURANCE SCHEMES FOR THE PROVISION OF MEDICAL, HEALTH AND OTHER
BENEFITS FOR MEMBERS

Subject to the provisions of section (8) (b) of the Jamaica Fire Brigade (Amendment) Act,
1992 the Board may, with the approval of the Minister, enter into arrangements respecting
Insurance Schemes for the provision of life, health, maternity, dismemberment and accidental
death benefits for members of the Brigade, and employees and agents of the Board, during
the period of their service with the Brigade.

CHAPTER III
TERMINATION OF SERVICE

53. 1) RESIGNATION FROM THE BRIGADE

Subject to the provisions of Regulations 13 (2) and 45 (c ) of Fire Brigade (No. 2)


Regulation 1993 and may rule made by the Board in respect of termination of service, a
member who wishes to resign from the Brigade shall give to the Commissioner notice in
writing of his intention to resign at least (3) months before the date on which he wishes to
relinquish his appointment.

2) where a notice of resignation is received under sub-section (1) above, the Commissioner
shall immediately forward that notice to the Board.
3) The Board may waive the requirement of notice in whole or in part if the Board thinks fit.

4) Notwithstanding any regulation in respect of the non-forfeiture of leave, a member who


fails without reasonable cause to comply with sub-section (1) risks forfeiture of all leave
and the benefits and privileges accruing to him in respect.

5) A member is not entitled to withdraw his notice of resignation before such resignation
becomes effective but the Commissioner may permit the withdrawal if tendered in writing
at any time before the effective date and shall inform the Board accordingly.

54.

TERMINATION OF SERVICE OTHER THAN REMOVAL FROM OFFICE

1) The services of a member may cease:-

a) where the member holds a permanent appointment, and such appointment has
been terminated by the Board:

i) on abandonment of office;
ii) on resignation;
iii) on attaining the age of retirement specified in Section 57;

b) where the member holds a temporary appointment and such appointment has been
terminated by the Board under Fire Brigade (No. 2) Regulation, 1993 or any rule made
by the Board:-

i) on the expiry of the specified period of enlistment;

ii) where any post itself is of a temporary nature and is no longer necessary;

iii) on termination by three (3) month’s notice given by either party.

2) For the purpose of sub-section (1) (a) (i)

a) “Abandonment of Office” occurs where a member


absents himself from duty for more than three (3) consecutive days without
satisfactory explanation;

b) a member who abandons his office as set out in sub-section (2) (a) shall be
held automatically to have vacated his position and shall be liable to summary
discharge by the Board.

c) a member so dismissed under the provisions of sub-section (2) (b) above all
shall be served with a notification in writing of his dismissal and where such a
member cannot be located, service of notification shall be deemed to be
effected by sending such notification by prepaid registered post to his last
known address;

d) Where abandonment of office occurs, the Commissioner shall advise the Board
accordingly in writing.

55. RETIREMENT AGE

1) A member of the Brigade:

a) shall retire on attaining the age of sixty (60) years;

b) may retire voluntarily at any time after attaining the age of fifty-five (55) years;

c) may apply to the Board, through the Commissioner, seeking permission to retire at
any time after attaining the age of fifty (50) years.

2) A member who applies under sub-section (1) (c ) may retire without


prejudice to his benefits.

3) The Personnel Officer shall inform the Commissioner of all members in the Brigade who are
within one (1) year of attaining the relevant compulsory retirement age.

4) Where the exigency of the service so require, a member of the Brigade may be called upon
to retire before attaining the age of sixty (60) years.

CHAPTER IV
ALLOWANCES

56. ALLOWANCES

Members of the brigade shall be paid such allowances at such rates as may be agreed by the
board from time to time.

57. HOUSING ALLOWANCE

1) A member who marries shall advise the board through the Commissioner according, in
writing, in addition to providing a copy of the marriage certificate within three (3) months
of the marriage and any such member in the rank of fire fighter shall receive housing
allowance of the next highest rank.

2) Only one (1) housing allowance shall be paid and that to a member in receipt of the
higher allowance where a member is married to another member but housing allowance,
it shall be paid to the member elected jointly by both (in writing) to receive the allowance.
3) A member claiming or receiving a housing allowance shall be responsible for ensuring
that sub-section (2) is complied with .

4) Except in special circumstances, a claim for a housing allowance appropriate to a married


member if submitted later than three (3) months of the date of marriage shall be met, but
shall be met from the date of receipt of the claim.

5) Where a member who would have been in receipt of a housing allowance, becomes
windowed, divorce or legally separated, that member shall report the fact to the
commissioner within one (1) month of that fact occurring.

6) A member referred in to sub-section (5) shall be paid the housing allowance applicable to
a married member up to the end of the month in which he becomes windowed, divorce or
legal separated and thereafter shall be paid the housing allowance applicable to an
unmarried member, unless there are children of the marriage or legally adopted children
who are dependent on the member in this case the member may continue to receive
housing allowance applicable to a married member.

58. TEMPORARY SEPARATION ALLOWANCE

1) A member may be paid a temporary separation allowance being


an amount fixed from time to time by the board where the member is separated from his
family and is maintaining two (2) separated establishments, one (1) for his family.

2) For the purpose of payment of temporary separation allowance a


member shall be considered to be “separated” if, as a result of promotion, transfer or
assignment, he is compelled to take up residence in another locality for the purpose of
the performance of his duty without being able to take with him the family for which he
is responsible, with the that he is required to maintain two (2) establishments
because :-

a) suitable accommodation cannot be immediately found in the new locality;

b) it would be unreasonable to expect the member to remove his family from his
present residence to the new locality;

c) he could not reasonably be expected to travel daily from his present residence to
the new locality.

3) For the purpose of payment of temporary separation allowance referred to in sub-section


(1) “family” shall be taken to mean a member’s spouses and children, and his mother
father, brothers or sisters who are living with, and are dependent on, him.

4) PAYMENT OF TRAVELLING ALLOWANCE


While on separation for one visit per month to family.

59. CONDITIONS ATTACHED TO TEMPORARY SEPARATION ALLOWANCE

1) The payment of the temporary separation allowance referred to in Section 60 shall be


subject to the following conditions:-

a) the allowance shall not exceed the maximum rate approved from time to time by
the Board;

b) in the case of a promotion or transfer which is known to be permanent, it shall


normally be paid for a period not exceeding three (3) months;

c) in the case of an assignment or a promotion or transfer which is known to be or is


expected to be temporary, it shall normally be paid for a period not exceeding six
(6) months;

d) Notwithstanding (b) (c ) above extensions of the period of payment shall be made


on the authority of the Board to whom an application shall be made through the
Commissioner with full supporting reasons for the grant of extension of time.
Extension will not exceed an additional two months in the case of (b) or an
additional three months in the case of (c).

2) a temporary separation allowance shall not be paid to a member where the period of
separation is less than one (1) month.

3) A member shall not receive both a temporary separation allowance and subsistence
allowance for the same period.

60. CLAIM FOR TEMPORARY SEPARATION ALLOWANCE

1) A claim for temporary allowance referred to in Section 60 shall be submitted to the


Commissioner through the Director of Personnel on the determined form.

2) A claim for temporary separation allowance referred to in Section 60 shall not be


entertained if not made within three (3) months after the period to which the claim relates.

3) A claim for temporary separation allowance shall be made on the


prescribed form.

61. TRAVEL ALLOWANCE

A member who is required to travel abroad on official business shall receive a per diem
allowance which shall be issued to cover:

a) the costs of transport as approved by the Board to and from the place of business;
or be provided with Airline ticket in lieu of payment.

b) the cost of appropriate hotel accommodation and meals as approved by the Board;
c) the cost of transport within the country (including reasonable taxi hire);

d) the cost of official telecommunication charges;

e) a subsistence allowance as referred to in section 67 (3) and

f) such other expenses which may be incurred in connection with the transaction of
the business as approved by the Board.

62. QUALIFICATION FOR TRAVEL AND ACCOMMODATION

1) A member who is required to travel outside Jamaica on official business, unless otherwise
permitted by the Board, shall travel by the National Airline.

2) The Board shall issue appropriate instruction which will determine the type or class of
accommodation to be available to a member while abroad.

63. WARM CLOTHING ALLOWANCE

1) A member who is required to travel abroad to cold or temperature climate countries on


official business shall be paid an allowance to be known as a “Warm Clothing Allowance
at such rates as the Board may from time to time determine.

2) A member who has received an allowance referred to in sub-section (1) shall not be
eligible for a further allowance within a period of two (2) years from the date of receipt of
that allowance.

64. SUBMISSION OF CLAIMS

A member shall submit to the Commissioner claims in respect of expenses incurred when
traveling an official business on the appropriate form determined by the Commissioner.

65. SUBSISTENCE ALLOWANCE

1) A member traveling on the Brigade’s business shall be paid a subsistence allowance at


the appropriate rate defined by the Board, provided that the member:-

a) travels more than twenty (20) miles from his place of work and;
b) is absent for more than six (6) hours from his place of work.

2) In lieu of subsistence, the board shall pay for reasonable expenses incurred when
supported by bona fide receipts.

66. TRAVEL INSURANCE WHILE ON OFFICIAL BUSINESS ABROAD


1) The Board shall cause a member to be insured against death or personal injury during
the period that he member is traveling abroad on official business.

2) The period referred to in sub-section (1) means the period from date of departure from
Jamaica up to and including the date of return to Jamaica of the travel of that member.

67. QUALIFICATION ALLOWANCE

An allowance to be known as a qualification allowance shall be paid at a rate to be approved by


the Board to a member who is the holder of :-

a) membership of the Institution of Fire Engineers;

b) the Graduate Diploma of the Institution of Fire Engineers;

c) the preliminary Certificate of the Institution of Fire Engineers;

68. QUALIFYING EXAMINATION ALLOWANCE

1) Where a Subordinate Officer or firefighter has passed the qualifying examination for the
post next senior to the post presently occupied by him and is not promoted to the post
within two (2) years of the date of his passing the qualifying examination, he shall
be paid an allowance known as a qualifying examination allowance.

2) The amount of qualifying examination allowance payable to a member shall be equal to


the amount of the first increment in the salary scale of the post next senior to the
substantive post of the member.

3) Payment of the qualifying examination allowance shall cease with effect from the date of
promotion of the member concerned.

4) If on the date of his retirement a Subordinate Officer or Firefighter is in receipt of a


qualifying examination allowance and has been receiving this allowance for not less than
three (3) years the allowance shall be regarded as part of his salary for the purpose of
computing his pension.

69. NATIONAL HONOURS AND AWARDS TO MEMBERS OF THE BRIGADE

Members of the Brigade shall be eligible for the grant of National Honours and Awards in
accordance with the National Honours and Awards (Medal of Honour) (Fire Brigade)
Regulations 1970.

70. UNIFORMS

1) Fire Officers, Subordinates Officers and Firefighters shall wear such uniforms as may
from time to time be approved by the Board, on the recommendation of the
Commissioner.
2) Subject to this Section a person on first appointment to the Brigade as a firefighter
shall, in the case of a male member, receive as his initial issue the uniforms,
accessories, equipment or accoutrements mentioned in the Uniform schedule at
Section 178, sub-sections (2) (a) (b) and (c ); and in the case of a female member
the uniforms, accessories, equipment or accoutrements mentioned at section 178,
sub-sections (3) (a) and (b).

3) On first appointment as a Fie Officer a male member shall receive,


as his initial issue of officers uniforms, the uniforms, the accessories, equipment or
accoutrement mentioned in the Uniform Schedule at Section 178, sub-section (4) (a) (b)
and (c ) and; in the case of a female member the uniforms, accessories, equipment or
accoutrements mentioned at section 178, sub-section (5) (a) and (b).

4) Fire Officers, subordinates Officers and Firefighters shall after the initial issue of
uniforms receive items of uniforms, accessories, equipment, or accoutrements on a
replacement basis, provided that the Commissioner is satisfied that any particular
item of uniform, accessories, equipment or accoutrement is in need of replacement
– fair wear and tear expected.

5) All items of uniforms, accessories equipment or accoutrements shall be marked by


the Fire Brigade Store-keeper with the members service number and the date of issue
of the item, prior to any such item being issued to the member.

6) Specialized clothing, equipment or accoutrement issued to a member for the


execution of his duties in the Brigade shall not become the property of such member
but shall be used by such member in the performance of his duties and shall be
delivered up by him on leaving the Brigade.

7) Subject to sub-section (8) replacement of lost, damaged, faulty, or ill-fitting clothing thereto
issued to a member and repairs thereto (other than minor repairs which the member can
satisfactorily do himself) shall be made and done at the expense of the Board.

8) Where loss or damage to the clothing described in sub-section (7) is caused by the
member’s default, the costs or replacement or repairs shall be payable by the member and
deductible from his pay or other wise recoverable from him as a debt due to the Board.

9) Any faulty, damaged or badly deteriorated item or uniforms, accessories, equipment or


accoutrement which the Commissioner has approved for replacement, shall be returned to
the Brigade Stores prior to the issue of its replacement.

71. UNAUTHORISED BADGES AND EMBLEMS

No badges, emblems or decoration other than those officially approved by the Board or the
Jamaica National Honours and Awards Committee shall be worn with the uniform unless
approved by the Board.

72. PROFICIENCY ALLOWANCE


1) A proficiency allowance at such rate as approved by the Board may be payable to a
member performing duties in respect of an occupation specified by the Commissioner.

2) Subject to sub-section (3) an allowance referred to in sub-section (1) shall only be paid to a
member actually performing such duties.

3) Where the member is being paid a proficiency allowance, the allowance shall
continue to be paid to the member if he proceeds on a period of ordinary sick leave or
casual absence from work not exceeding twenty-eight (28) consecutive working days.`

73. DUTY ALLOWANCE (OFFICERS)

An allowance to be known as a “Duty Allowance” shall be paid at a rate approved by the Board to
a each Fire Officer in the Brigade to compensate the officer for work done on Public Holidays, for
hours worked in excess of forty (40) hour work week and the need for him to be available for duty
at all times.

74. MEAL ALLOWANCE

A meal allowance shall be paid to a member who qualifies for this allowance under the terms and
conditions stipulated by the Board from time to time.

75. MILEAGE AND UPKEEP

1) Members of the Brigade who are required to use their private vehicle on the Brigade’s
business shall be eligible for a motor vehicle upkeep payment in accordance with the
prevailing rates. The payment is granted to cover expenses actually incurred during
the performance of duties. The member receiving these payments should not derive
financial benefits or loss as a result of traveling while performing his duty.

2) In order to be eligible for reimbursement of mileage and upkeep, the following conditions
must be satisfied:-

a) the vehicle is registered in the member’s name;

b) the insurance coverage provides for the use of the vehicle on the Brigade business;

c) the vehicle is available when required for use by the member on the Brigade’s
business;

d) the member is not assigned a fire Brigade owned vehicle.

3) Claims shall be submitted on a monthly basis.

4) A member is entitled to upkeep during periods of absence such as vacation leave shall not
exceed:-

a) a total of three (3) months in any one calendar year;

b) three (3) months on any one occasion of leave.


CHAPTER V
PART I
HOURS OF WORK

76. WORK WEEK


1) Subject to Sub Section (3) and (4) members of the Brigade shall work an average of forty
(40) hours per week.

2) Every member shall as far as exigencies of the service permit be granted twenty four (24)
hours off duty after completion of each tour of duty of an average of eight (8) hours.

3) The Commissioner may require the attendance of off duty staff on such days for such hours
as he considers necessary in the exigencies of the Service.

4) Notwithstanding the previous Sub Section (1) and (2), the off duty period of twenty four (24)
hours granted to a member after completing each duty tour of an average of eight(8) hours,
may be cancelled by the Commissioner if he considers it necessary in the exigencies of the
Service.

77. COMPENSATION FOR HOURS WORKED ON A PUBLIC HOLIDAY


Where a public holiday falls within a Subordinate Officer’s and Firefighter’s schedule work week
and he works on such a public holiday, he shall be paid for that day double time his basic hourly
rate.

78. COMPENSATION FOR EXCESS HOURS WORKED


1) Where a Subordinate Officer or Firefighter works excess of the hours prescribed in
Section 78 Sub Section (1), he shall be granted overtime pay for the exact hour worked
which shall be calculated at a rate of time and one half his basic hourly rates. However, if
the excess hours worked on a public holiday, the payment shall be calculated at double
time his basic hourly rates for each hour worked.
2) For the purpose of Section 78, Subsection (3), time spent in traveling to and from the
location at which Officers, Subordinate Officers and Firefighters is required to report for
duty, shall be included in the calculation of the time the member was required for duty.

3) Where a member is called out for duty by the Commissioner in the exigencies of the
Service he shall be paid those expenses actually incurred by him in the use of public
transportation to the location at which the member is required for duty, or where there is
no public transportation available at that time, the cost of one seat for one return journey
by taxi.

79. ATTENDANCE
1) Members of the Brigade shall report to duty at the Watch Room of the fire station to which he
is assigned and the time of his arrival at and the departure from that station shall be recorded
in the Watch Room attendant on duty in the station diary or in any object or device designed
to record the time of arrival and departure at the place of work as identified by the
Commissioner for that purpose.

2) The Station Diary, or other or device referred to in Sub Section (1), shall be examined daily
by the Duty Officer/Sub-Officer of that Fire Station.

3) For the purpose of this Section “Duty Officer” means a member with the responsibility of
checking the Station Diary and includes the senior member in charge of the operational duty-
watch at that Fire Station.

PART II
RECORDS OF PERSONNEL

80. PERSONNEL RECORD

1) There shall be one personnel record for each member which


shall be kept by the Director of Personnel.

2) The personnel record referred to in Sub Section (1) shall


contain: -

a) a description of the member;


b) a recent photograph of the member taken full face without that of a size
of ( 2 ½” x 2”);

c) the member’s place and date of birth;

d) Birth Certificate registration number;

e) particulars of marriage (if any);

f) religion;

g) next of kin;

h) beneficiary(s)

i) a record of service (if any) in the Jamaica Defence Force, Jamaica


Constabulary Force or in a civil capacity in the public service;

j) a record of service in any municipal or parish council Fire Brigade prior to


enlistment in the Jamaica Fire Brigade, including particulars of all promotions,
assignments, transfers, removals, injuries received, commendations, awards,
punishments other than cautions, and the date, reason and manner of his
ceasing to be a member of that service;

k) a record of results of examinations at which the member was a candidate;

l) copies of the Divisional Inset Sheet referred to in Section 83;

3) A member shall be informed in writing on any adverse reports or of any


commendations which are made on the personal record referred to in
Sub-Section (1).

81. DIVISIONAL INSET SHEET

1) A Divisional Inset Sheet with the comments of the officer in charge of the division,
or section shall be kept in respect of each member in a division or section.

2) Where a member is transferred from a division or section, the member’s


Divisional Inset Sheet shall be sent directly to the Commissioner and a new Inset
Sheet opened at his new division or section.

82. MEMBERS TO SEE PERSONAL RECORD

A member shall within fourteen (14) days of his request to the Commissioner in writing,
be shown his personal record and Divisional Inset Sheet referred to in Section 83 Sub
Section (1).
83. DESTRUCTION OF PERSONAL RECORD

The personal records of a member who leaves the Brigade shall be kept for such
time as the Commissioner, after consultation with the officer in charge of the Government
Archives thinks fit.

84. CERTIFICATE OF SERVICE

A member who leaves the service shall be given a certificate showing his rank and setting
out the period of his service and the reason for and other circumstances of his leaving the
Brigade and the Commissioner may append thereto any recommendations which he
considers appropriate.

CHAPTER VI

LEAVE AND RELATED BENEFITS

85. MEMBERS OF THE BRIGADE ARE ENTITLED TO LEAVE AS OF RIGHT

Members of the Brigade shall be entitled to leave as set out in these Sections. However,
the grant of leave other than sick leave or maternity leave shall be subject to the
exigencies of the service.

86. AUTHORITY FOR GRANT OF LEAVE

1). Authority for the grant of leave to individual members shall be vested in the Board.
General authority shall, however, be given to the Commissioner, who may grant
leave subject to the limitations set out in these Regulations without reference to
the Board.

2). The Commissioner shall seek approval of the Board for the grant of any leave to
himself.

3). The Commissioner shall determine whether the exigencies of the service are
such as to enable a member to proceed on leave at any given time.

87. CANCELLATION OF LEAVE

1). The Commissioner may if the exigencies of the Service so require: -

a) cancel any leave already granted;

b) recall to duty any member who has proceed on leave at any time before the
expiration of such leave.
88. PERIOD REGARDED AS LEAVE

Leave other than Departmental Leave will normally count from the working day after a
member has handed over his duties until the working day preceding that on which he
resumes duty (both dates inclusive).

89. EXTENSION OF LEAVE

1) A member on leave of absence seeking an extension of such leave must, in the


absence of exceptional circumstances, apply in sufficient time to allow of a reply
being received before the expiration of the original period of leave granted.

2) A member who has been granted leave under these Sections may be required in
the interest of the service to remain on leave after the expiration of the original
period of leave.

90. LEAVE ON GROUNDS OF URGENT PRIVATE AFFAIRS

Members applying for leave on the grounds of urgent private affairs must satisfy the
Commissioner that the indulgence is indispensable. This may be done confidentially if
necessary.

91. FORM OF LEAVE PARTICULARS

1) Applications for leave which need to be referred to the Board shall be


accompanied by leave particulars in the prescribed form.

2) A member shall apply in writing for permission to take annual vacation leave not
later than ninety (90) days before the date he anticipates proceeding on such
leave.

3) A member on applying for annual vacation leave shall indicated in his application
whether the leave is to be spent in or out of Jamaica and the address at which he
can be contacted at any time during the leave.

4) A member who has applied for leave within the time specified in Section 93 (2)
shall be advised of the outcome of his application no later than forty five (45)
days prior to the date of the commencement of the annual vacation leave
requested in the application.

92. ILLNESS WHILE ON LEAVE ABROAD

A member who falls ill and requires medical attention while on leave of absence abroad,
and remains ill must report the fact to the agents of the Government of Jamaica in the
country in which he is spending his leave, and he shall, if required, send at his own
expense periodical reports from his medical attendant so long as he remains under
medical care.
93. LEAVE PRIOR TO RETIREMENT

Notwithstanding anything to the contrary in these Sections, a member who is being retired
from the Brigade may be granted, immediate prior to the effective date of his retirement
on pension, the Vacation Leave on full salary to which he is entitled together with: -

a) the additional full pay leave earned in accordance with Section 102;

b) recalled leave in accordance with Regulation 89 Sub Section (2), provided


however, that in no case shall a member be granted a total period of more than
twelve (12) months leave prior to his retirement.

94. LEAVE PRIOR TO RESIGNATION

A member who resigns voluntarily from the Brigade (in circumstances other than
retirement on pension or termination of contract) shall be paid a sum equivalent to the
remuneration which he would have received had he been granted all the Vacation Leave
to which he is entitled. Notwithstanding the provision or Section 101 Sub Section (1),
such a member must have served continuously for not less than three (3) months to be
eligible for the grant of leave on a proportionate basis in order to qualify for any
remuneration.

95. LEAVE TO BE GRANTED PRIOR TO DISMISSAL

Subject to Regulation 18 Sub Section (1) (b) and (c) and Section 14 (b) of Fire Brigade
(No. 2) Regulation 1993, a member who is being dismissed from the Brigade shall be
paid a sum equal to the remuneration which he would have received had he been
granted all the Vacation Leave to which he was entitled immediately prior to his dismal.

96. RETIREMENT WHILE ON LEAVE

If a member retire during his leave of absence without having originally giving notice
of his desire to do so, the date at which payment of his salary is to cease will be
determined according to the circumstances of the case.

97. PAYMENT IN RESPECT OF LEAVE ENTITLEMENT ON DEATH OF


MEMBER

In the event of the death of a member a sum equivalent to the emoluments he


would have received for the number of days Vacation Leave at his credit shall be
paid to his legal representative.

98. CALCULATION OF ANNUAL VACATION LEAVE

1) Subject to Sub Section (2), Saturdays, Sundays and public holidays shall not be
counted in the calculation of annual Vacation Leave.
2) Where public holidays, Saturdays and Sundays falls within a period that a member
is on annual Vacation Leave, such leave shall be extended by the number of
holidays, Saturdays and Sundays falling within that period.

3) A member shall not be allowed to earn Vacation Leave during periods of sick leave
exceeding fourteen (14) days respectively.

98. ELIGIBILITY FOR ANNUAL VACATION LEAVE

1) Every member of the Brigade, subject to the exigencies of the service shall be
eligible for the grant of annual Vacation Leave in accordance with Sub Section (2)
after the completion of one (1) year continuous service, and thereafter annual
Vacation Leave shall be pro-rated according to the subsequent period of
continuous service.

2) Every member shall be eligible to Vacation Leave based on length of service as


follows: -

LEVEL OF 1 – 10 YEARS OVER 10 YEARS POST/RANK


CONTINUOUS CONTINOUS SERVICE

a) Fire Officer 28 working days 35 working days

b) Subordinate
Officer 21 working days 28 working days

c) Firefighter 17 working days 21 working days

3) In computing length of service for the purpose of Sub Section (2) “Services” shall
include service in the public service.

4) Annual Vacation Leave may be accumulated to a maximum of: -

a) seventy (70) working days in the case of a member eligible to thirty-five (35)
days;

b) fifty six (56) working days in the case of a member eligible to twenty one
(21) days;

c) forty two (42) working days in the case of a member eligible to twenty one
(21) days; and

d) thirty four (34) working days in the case of a member eligible to seventeen
(17)) days.

99. ACCUMULATION OF VACATION LEAVE BEYOND THE MAXIMUM


1) If a member who has accumulated the maximum Vacation Leave should
apply in writing for the Vacation Leave to which he is entitled or some
portion thereof, but he is not granted such leave owing to the exigencies of
the service, such member shall be entitled to additional full pay leave
beyond the maximum accumulatable. In such cases however, the amount
of additional leave which may be so accumulated shall be limited to leave in
respect of service for a further period of two (2) year, subject to the approval
of the Commissioner.

2) A member who accumulated Vacation Leave shall not have the right of
guarantee that when the maximum leave is accumulated, such leave will be
granted as from the date it is requested. Accumulation of leave beyond the
maximum will only be allowed in the circumstances described in Sub
Section (1).

100. A MEMBER SHALL NOT EARN ANNUAL VACATION LEAVE WHILE ON SUCH
LEAVE

101. DEFFERAL OF ANNUAL VACATION LEAVE

1) The Commissioner may, owing to the exigencies of the


service require a member to defer the taking of annual
Vacation Leave.

2) A member who, owing to the exigencies of the service, is required to defer


his annual Vacation Leave by the Commissioner shall, in the year following
that in respect of which his leave was deferred, be granted such deferred
Vacation Leave approved for that year.

102. NON-FORFEITURE OF ANNUAL VACATION LEAVE

Annual Vacation Leave once earned shall not be forfeited.

103. NOTIFICATION OF RETURN FROM LEAVE ABROAD

A member who has been abroad on Vacation Leave shall report his return to the
Commissioner immediately on his arrival in Jamaica whether or not he continues to be on
leave.

104. DEPARTMENTAL LEAVE

1) Members of the Brigade shall be eligible to departmental leave on full salary at the
rates set out at Sub Section (2) to enable them to attend to private affairs and in the
circumstances referred to in Section 118 Sub Section (3).

a) Firefighters - seven (7) days in each

calendar year.

b) Subordinate Officer - ten (10) days in each

calendar year.
c) Fire Officer - fourteen (14) days in

each calendar year.

2) Departmental leave will not normally be granted to run consecutively with


Vacation Leave or visa versa except when such leave is granted on medical
grounds of for urgent private affairs.

105. MEMBERS MAY BE DIRECTED TO TAKE VACATION LEAVE

The Board or the Commissioner may direct a member to take Vacation Leave at
any time.

106. SPECIAL LEAVE

a) To enable members who are selected by the proper authorities to represent


Jamaica or the West Indies in international sporting, educational or cultural events;

b) To enable members who belong to Boy Scouts, Boys Brigade and similar
organizations and are selected by the proper authorities, attend gatherings of a
world-wide or international character connected with such organizations. Special
leave will however not be granted in respect of attendance at local training camps.

107. BEREAVEMENT LEAVE

1) The Commissioner may grant to a member up to five (5) days leave of


absence for the member to make arrangements for, and attend the funeral
of his spouse, parent, child or sibling.

2) The Commissioner may grant the leave in Sub Section (1) as bereavement
leave where the officer submits documentary evidence of the death referred
to in Sub Section (1), within seven (7) days of such leave being taken.

108. SCHOLARSHIP AND STUDY LEAVE

1) When a member with the approval of the Board, undertake any course of
study in the interest of the Brigade, he will be required to utilize for this
purpose, all Vacation Leave, accumulated Vacation Leave and recalled
leave, to which he is entitled and he may be granted by the Board such
additional full pay study leave up to maximum of six (6) months to enable
him to complete the course.

2) Should the combined period of vacation, accumulated vacation, recalled


and full-pay study leave referred to in Sub Section (1), prove insufficient to
enable the member to complete the course of study, he may be granted a
further period of half-pay study leave not exceeding a maximum of twenty-
four (24) months.

3) On completion of the course the Board may grant a member a period of full
pay leave to be utilized for the propose of recreation, not exceeding half the
period of Vacation Leave, accumulated Vacation Leave and recalled leave
which he devoted to the period of the course, subject to the condition that
such recreation is utilized not later than the first occasion on which the
member is granted Vacation leave following completion of this course of
study.

4) Members selected for training at the expense of the Board may be required
to enter into an agreement undertaking to resume, or take up employment in
the Brigade on the completion of these studies for a period of up to five (5)
years at the discretion of the Board.

5) The agreement referred to in Sub Section (4) may require the member
selected to pay to the Board on default such sum as may be prescribed
therein or such lesser amount as may be determined by the Board, provided
that there shall be a sliding-scale on which such sum is repayable with
credits awarded for periods of service given.

6) In exceptional circumstances, a member of the Brigade who fails to obtain


study leave under Sub Section (1) of this regulation may be granted, by the
Board leave of absence without salary, in addition to the Vacation Leave,
accumulated Vacation Leave and recalled leave to which he is entitled for
the period of undertaking a course of study, although the particular course
of study may not be immediately in the interest of the Brigade.

7) Where a member is selected for a period of in-service (centralized) or in-


house (departmental) training, and is not required to execute a loan
agreement, that member shall be regarded as being on duty for the duration
of the course and shall continue to enjoy the benefit of any allowance
including acting allowance he was receiving immediately prior to the
commencement of the course.

8) Sub Section (7) is, however, subject to the condition that payment of such
allowance would have continued if the member had not embarked on the
course and will not be payable beyond any date that these allowance would
normally have ceased.

109. ATTENDING COURT WHILE ON LEAVE

A member who is required to attend a court or an administrative tribunal while on


leave as a result of his official duty, shall have his leave preserved or extended by
a period equal to the number of days he attends the court or administrative
tribunal.

110. DUTY LEAVE AND SPECIAL LEAVE

1) Subject to the exigencies of the service, a member selected as a member of


an official Fire Brigade Team, as approved by the Commissioner, engaging
in a sporting, educational or cultural event, may be granted duty leave with
full pay by the Board.

2) Subject to the exigencies of the service, a member selected to participate in


a sporting, educational or cultural event approved by the Board may, for this
purpose, be granted special leave with full pay by the Board after
consultation with the Commissioner.

3) A member selected to represent Jamaica as a member of a national team


engaging in a sporting, educational or cultural event may in order to enable
him to complete his engagement and subject too the exigencies of the
service, be granted special leave with full pay by the Board after
consultation with the Commissioner.

4) Leave granted under this section shall not affect a member’s entitlement to
annual Vacation Leave.

111. SPECIAL DUTY LEAVE

1) Subject to the exigencies of the service, special duty leave with full pay up
to fourteen (14) days per annum by be granted by the Board to a member
attending a conference in or outside Jamaica as a delegate of an
appropriate registered Fire Officers Association or Trade Union.

2) Leave granted under Sub Section (1) shall not affect a member’s
entitlement to annual Vacation Leave.

112. LEAVE – INDUSTRIAL RELATIONS MATTERS

1) A member of the Brigade who is a member of a registered Fire Officers


Association or registered Trade Union and who is selected by the
Association or Trade Union to attend a local or overseas course in Trade
Unionism approved by the Board may be granted leave of absence with full
pay by the Commissioner for the full period of the course (depending on the
financial assistance received by the member from other sources during that
period).

2) A member of the Brigade who is a member of a registered Fire Officers


Association or registered Trade Union and who is authorized to do business
for that association or trade union, shall be allowed time off to do so
provided that the work of the Brigade is not unduly affected.

3) An application for leave or time off provided above shall, as far as


practicable, be made well in advance of the commencement of such leave
or time off.

113. MEDICAL ATTENDANCE

1) Subject to Sub Section (2), a member shall not be absent from duty on
account of injury or illness except with the authority of a medical officer.

2) When on account of some unavoidable cause the authority of a medical


officer cannot be given, the certificate of another medical practitioner may
be accepted.
3) The Board shall provide free medical treatment by a medical officer for
every member who is incapacitated from duty by injury or illness not caused
by his own default and shall supply to such member such medicines and
drugs as a medical officer may consider necessary: -

a) provided that if a medical officer certifies that a member required


specialist treatment, whether locally or overseas, such treatment
shall be provided without cost to the member, if his incapacity was
due to an injury received without his default in the course of his duty;

b) in all other circumstances, the provision of specialist treatment shall


be at the discretion of the Board.

114. DENTAL AND OPTICAL TREATMENT

1) The Board shall provide free dental and optical treatment including the
provision of dentures and spectacles when necessary for every member in
respect of whom a medical officer has certified that such treatment is
necessary for the member’s health and continued efficiency in the Brigade
and that the necessary does not arise from the neglect of default of the
member.

2) Subject to Sub Section (1) the provision of dentures and or spectacles for
members of the Brigade, shall be by such providers designated by the
Board, and the cost of dentures or spectacles shall not exceed the
prescribed limits determined by the Board from time to time.

115. LEAVE ON THE GROUNDS OF ILL-HEALTH

1) A member absent from duty with the authority of a medical officer on


account of injury or illness, is entitled to receive full pay for a period not
exceeding an aggregate of fourteen (14) days in any calendar year or such
further period as the Board may, in any particular circumstances determine.

2) If the absence of a member pursuant to Sub Section (1) is continuous, the


Board may grant half pay for a further period not exceeding four (4) weeks if
the member is entitled to free medical attention under Section 116 Sub
Section (3).

3) If the member has already exhausted his sick leave on the ground of ill
health he will be required to utilize departmental leave for the required
period if it be available.

4) If the amount of sick and departmental leave at credit is insufficient to cover


the amount of sick leave required the member ill utilize vacation leave not
exceeding 50% of such leave for which he was entitled on the date of
commencement of the sick leave.

5) Should the illness of the member necessitate his continuous absence


beyond his normal full pay leave entitlement on the basis of Sub Section (3)
and (4) of this Section the Board may grant special sick leave subject to the
provisions of Sub Section (1).

6) If a member required an extension of leave which will make his continuous


absence on account of illness more than sixty (60) days, or if the original
period of leave required is more than sixty (60), the Commissioner shall
forward all medical certificates received to a medical board unless the
Commissioner is satisfied that a medical board is unnecessary.

7) If the illness of the member exceeds one hundred and eighty (180) days, the
question of his fitness for further service shall be taken up with the Medical
officer.

8) When asking that a Medical Board be convened to examine a member the


Commissioner shall inform the Medical Board which of the following reasons
has prompted the request for the Medical Board: -

a) the question of the fitness of the member for further service;

b) his disability;

c) leave on medical grounds.

117. INJURY SUSTAINED DURING PERFORMANCE OF DUTY

1) If absence of a member is caused by injury sustained in the performance of


his duties and he is on leave with full pay, he shall be seen by a Medical
Board before the expiration of twelve (12) months of such leave.

2) A member shall, while on sick leave, unless confined to bed by order of the
medical officer, visit the medical officer when so directed by him.

118. MEDICAL CERTIFICATES GRANTING SICK LEAVE

1) Where medical certificates are submitted in support of application for leave


on the grounds of illness, members are required to ensure that the
certificate (whether issued in Jamaica or elsewhere) contain the following: -

a) date of issue;

b) date of onset or malady;

c) a statement as to whether or not the member is unable to perform his


duties because of the nature of his illness;

d) if the member is unable to perform his duties, an opinion as to the


likely duration of his incapacity.

119. MEDICAL BOARD


1) A member may be required by the Commissioner to undergo a medical
examination by a Medical Board at any time.

2) A member who is required to undergo a medical examination under this


Section shall submit himself to be examined by the Medical Board at such
time and place as directed.

3) Where a member is referred to a Medical Board under this Section, the


Medical Board shall be provided with records relating to that member’s
health by the Board or the Commissioner, as the case may be.

4) A Medical Board after examining a member referred to it under this


Section and record relating that member’s health that are provided, may
recommend a course of treatment in its report to the Board or the
Commissioner as the case may be and shall advise: -

a) that sick leave or extension of sick leave be granted to the member;

b) that the member is fit for continued performance of his duties without
need for sick leave or extension of sick leave; or

c) that the member is unfit for further service.

5) When it is considered necessary for a member to be examined with a view


to ascertaining whether or not he should be retired on grounds of ill-health,
the Commissioner shall recommend accordingly to the Fire Brigade Board,
and shall where possible, make available the medical records of the
member to the Fire Brigade Board, which may direct the member to attend a
Medical Board.

6) In case of a question of fitness for further service, reasons should be given


and any special circumstances explained. Any unusual traits or peculiar
behaviour on the part of the member while on duty should be stated.

7) In the case of disability its nature, when and how incurred, and all relevant
circumstances should be stated. Medical certificates, if any, from private
practitioners, or otherwise, shall be attached; in case of mental disorder a
report shall be furnished by the Commissioner indicating the amount of sick
leave taken by the member and the effect of his illness on his efficiency.

8) Where member is notified by the Board that he is unfit for further service he
shall be granted such annual leave and accumulated leave for which he is
eligible commencing from the date on which he is notified of his lack of
fitness for further service.

9) Where a deterioration in the work of the member is the reason, or one of the
reasons, for requesting that the member undergo a medical examination.
the Commissioner shall make a recommendation to that effect to the Fire
Brigade Board which may direct that the member attend a Medical Board.
10) The Medical Board after examining a member referred to in Sub Section (9)
shall report its recommendations to the Fire Brigade Board and shall provide
a copy of its report to the Commissioner.

11) Where a Medical Board advises that a member is fit for the continued
performance of his duties, neither the Fire Brigade Board or the
Commissioner, as the case may be, shall grant an extension of sick leave to
that member.

120. INJURY SUSTAINED ON DUTY

Where a member is injured in the execution of his official duty and such injury is of
a nature which is likely to lead to a claim for a special award under the Fire Brigade
Pensions Scheme of any other claim against the Fire Brigade Board, a
Departmental Board shall be appointed without delay by the Commissioner to
enquire fully into the circumstances and report whether in its opinion the injury was
sustained in the actual discharge of the members duty and through no fault of his
and was specifically attributed to the nature of his duty. The Departmental Board’s
report shall be submitted to the Fire Brigade Board.

121. ACCESS OF MEDICAL BOARD TO MEDICAL HISTORY RECORD

The Medical Board shall have access to the Medical History Record referred to in
Section 124 when examining a member.

122. MEDICAL HISTORY RECORD FOR EACH MEMBER

The Commissioner shall cause to be kept a Medical History Record in respect of


each member indicating every illness or injury sustained by such member during
his period in the service, together with such account of treatment received, and
other comments and recommendations made by the medical officer or medical
practitioner concerned with the case as well as a record of all sick leave granted.

123. SICK LEAVE ABROAD

A member who desires to leave Jamaica during a period of sick leave shall obtain
the prior approval of the Commissioner.

124. ABSENCE THROUGH ILLNESS TO BE REPORTED

Where a member is unable to perform the duties of his office as a result of illness
he shall cause an immediate report to be made to the Commissioner.

125. MATERNITY LEAVE

Subject to the Maternity Leave Act (Act 44 of 1978) and these Sections: -

1) A female officer of the Brigade or a female employee of the Board who


requires leave for maternity purposes may be granted leave by the Board,
provided that she has completed twelve (12) months service at the date of
application: -
i) special maternity leave on full salary for a period not exceeding fifty-
six (56) days on the presentation of an appropriate medical
certificate;

ii) all the vacation leave to which she may be entitled;

iii) leave without pay for an additional period not exceeding ninety (90)
days.

2) Notwithstanding the provisions of Sub Section (1), the Board may in any
particular case authorize the grant of leave without pay for maternity
purpose in excess of ninety (90) days on the recommendation of the
Commissioner.

3) If the member of employee requests more leave in excess of the additional


ninety (90) days referred to in Sub Section (1) a medical certificate is once
again required.

4) Sick leave may be granted to run consecutively with leave granted for
maternity purposes in accordance with the provisions of Sub Section (1) on
the production of satisfactory medical evidence that the illness does not
result directly or indirectly or specifically from pregnancy.

5) In accordance with the provisions of the Maternity Leave Act referred to in


these Sections, the member or employee will not be granted such leave in
respect of three (3) or more pregnancies.

126. PROCEDURE WHEN APPLYING FOR MATERNITY LEAVE

Subject to the provisions of Section 127, the female member or female employee
shall: -

a) inform the Commissioner in writing that the maternity leave is required not
less than two (2) weeks before the expected weeks of confinement;

b) on verification the Director of Personnel shall recommend the leave to the


Commissioner for approval; and

c) if the leave is approved, the Director of Personnel shall formally advise the
member, or employee and the Director of Finance of the grant of leave and
record the details of the maternity leave and pay granted on the medical
history record.

CHAPTER VII
127. SERVICE ESTABLISMENTS AND CONTENTS TO BE KEPT IN GOOD
CONDITION
1) All items of Fire Brigade furniture or equipment in fire stations,
establishments, or office of the fire service, shall be maintained in good
order and condition, the responsibility for which shall rest with the senior
officer in charge of such fire station, establishment or office.

2) When any item of furniture or equipment requires repairs or need to be


replaced in respect of any fire station, establishment or officer of the service,
the senior officer in charge of such station, establishment or office, shall
inform the Commissioner in writing, so that repairs or replacement may be
affected.

3) If a building owned, leased or rented by the Brigade is expected to become


vacant for any period, the officer in charge of such building shall inform the
Commissioner in writing.

128. DESCRIPTION OF UNIFORMS

Subject to Section 72, the description of all items of uniform and the other orders of
dress to be worn by members of the Brigade shall be determined by the Board and
shall be published in Fire Brigade General Orders referred to in Section 172, for
the information of fire service members.

129. ISSUE OF STORES

Subject to Government Financial Regulations relating to stores, miscellaneous


stores shall be issued to divisions, stations, section, branches or offices, at such
intervals as the Commissioner may direct.

129. REQUISTIONS

1) The supply of stores, uniforms and equipment shall occur only on a


requisition made to the officer in charge of stores.

2) A delivery and receipt voucher signed by the member making the issue shall
be sent with such supplies.

3) On receipt, such voucher shall be signed by the member receiving the


stores, uniform and or equipment as the case may be and returned to the
member in charge of stores.

130. STORES LEDGERS

1) Store Ledgers shall be kept by the member in charge of stores in which


shall be entered all stores received, issued and returned to stores.

2) Receipt for all articles returned to stores shall be given by the member in
charge of stores.
CHAPTER VII
CONDUCT

131. GENERAL CONDUCT

A member shall conduct himself at all times in such manner that does not bring
discredit to the reputation of the Fire Service.

132. DUTIES OF A MEMBER

A member shall carry out all lawful orders of a member senior in office and shall at
all times punctually and promptly perform all appointed duties and attend to all
matters within the scope of his office.

133. DUTIES OF A FIRE OFFICER

1) A fire officer of the Brigade shall be responsible for the state of his
command and for the conduct, and efficiency of all under his command.

2) A fire officer shall, where applicable, be responsible for his area, division,
station, section or branch.

3) In the absence of the fire officer referred to in Sub Sections (1) and (2), the
authority and responsibility of that officer shall devolve upon the next in
seniority unless the Commissioner otherwise specifically directs.

4) In the discharge of his duties, a member of the Brigade shall be courteous


and polite both to members of the service and to members of the public.

134. SALUTING

1) Members above the rank of Sergeant shall salute their seniors in rank.

2) Members below the rank of District Officer shall salute all officers of that
rank and above.

3) All officers to whom such compliments are paid shall acknowledge them in
an appropriate manner.

4) All members of the Brigade shall pay compliments to such designated


person, on such occasions and in such manner as the Commissioner may
direct.

135. ABSENCE TO BE REPORTED


1) A member shall not be absent from duty without leave or reasonable
excuse.

2) Where a member is unable to perform the duties of his office, whether from
illness or some other cause, he shall cause an immediate report to the
officer in charge of the station, section, branch or office to which he is
assigned.

3) A member when leaving the country shall inform the Commissioner in


writing accordingly or, in cases of emergency, a senior Officer, who shall
report forthwith in writing to the Commissioner.

136. ADDRESS WHILE ON LEAVE

A member proceeding on leave, where such leave is to be spent away from his
normal place of residence in the island or overseas, shall report his new address
and any change to the Commissioner.

137. ACTIVITIES OUTSIDE THE SERVICE

1) A member: -

a) shall not at anytime engage in any activity which would in anyway


tend to impair his usefulness as a member, nor may he engage in
any occupation which might in anyway conflict with the interests of
the Brigade or be inconsistent with his position as a member; or

b) shall not engage, whether or not on any leave, in any trade or any
professional, commercial, agricultural or industrial undertaking, or
undertake private work for remuneration without the prior approval in
writing of the Commissioner.

2) A member who is desirous of engaging in an activity, occupation,


undertaking or work referred to in Sub Section (1) (b), shall apply in writing
to the Commissioner.

3) Whenever the Commissioner is of the opinion that a member’s performance


of his duties is likely to be influence by the fact that he owns shares or
investments in any company, or has a direct interest in any professional,
commercial, agricultural or industrial undertaking, the Commissioner may,
after discussing the matter with the member, request the member to dispose
of such shares, investment or interest within such period as the
Commissioner may specify or he may assign the member to other duties as
to avoid a conflict of interest.

4) The Commissioner prior to giving an approval under this Regulation shall


consult with the Direct of Personnel.
138. MEMBER NOT TO CALL PUBLIC MEETINGS OR PARTICIPATE IN
CERTAIN PUBLIC MEETINGS

1) A member may not call a public meeting to consider any action of the
Government or actively participate in the proceedings of a meeting called for
such purpose or procure signatures to any public petition regarding the
actions of the Government.

2) Except in the performance of his duty, a member shall not participate in


meetings of any party or political organization while on duty or while wearing
official uniform.

139. MEMBER NOT TO PUBLISH INFORMATION

1) A member other than a member acting in his capacity as a representative of


an appropriate recognized association, shall not make public or
communicate to the press or to individuals, or make private copies of
documents, papers or information of which he may have become possessed
in his official capacity, unless his duties require him to do so.

2) Any member who contravene any written law relating to official secrets is
guilty of an act of misconduct notwithstanding that he may be charged with
an offence under written law.

140. MEMBERS NOT TO ALLOW INTERVIEW ON QUESTIONS OF PUBLIC


POLICY

1) A member, other than a member acting in his capacity as a representative


of an appropriate recognized Trade Union or Fire Officer’s Association shall
not allow himself to be interviewed on questions of public policy.

2) A member shall not allow himself to be interviewed on matters affecting the


defence or military resources of Jamaica or of any other country unless his
official duties require him to do so.

141. MEMBER NOT TO PUBLISH COMMENT ON NATIONAL OR LOCAL


MATTERS

1) Subject to Sub Section (2) and (4), a member shall not publish by word or
pictures or other signal, in any medium of communication including
newspapers, journals, wireless, television or computer link up, any
information or expression of opinion on matters of a national or local,
political or administrative nature in a public place so as to be said to be
publicly publishing such information or expression.

2) Sub Section (1) does not apply: -

a) where the member, by publishing such information or expression is


executing or performing the duties of his office; or
b) where the approval in writing of the Board or Commissioner has to be
obtained by the member to the fact and subject of the publication
referred to in Sub Regulation (1).

3) Where the Commissioner is in any doubt as to the propriety of any proposed


publication or broadcast under this Section, he shall refer the matter to the
Board.

4) This Section does not apply to the publishing or broadcasting of material by


a member acting in his capacity as a representative of an appropriate
recognized association.

142. MEMBERS NOT TO EDIT OR MANAGE NEWSPAPER

Except in the case of the official organs of appropriate recognized associations or


professional association, a member shall not, without the permission in writing of
the Commissioner, act as editor of any newspaper or take part directly or indirectly
in the management of a newspaper, or anonymously contribute any statement or
article which may reasonably be regarded as a commentary on the politics of the
country or the administration of the Government.

143. RULES RELATING TO BROADCAST TALKS

Broadcast talks by a member shall be governed by the following rules:-

a) there shall be not payment either to the member or to the Brigade arising
out of the preparation or delivery of a lecture or talk to be broadcast that is
necessary or desirable in order to enable the Brigade to carry out its
recognized duties to the community;

b) lectures or talks which are to be broadcast and are not necessary for the
purpose of the Brigade may be given by members who are experts in a
particular subject, whether or not they have specialized in this subject in
their official capacity;

c) where the subject matter of a broadcast is related to the work or the policy
of the Brigade or if the broadcast is to be announced by his departmental
title, the prior authority of the Commissioner is required with the object of
ensuring: -

i) that there is nothing in the lecture or talk contrary to the interest of


the Brigade; and

ii) that the standing of the speaker is sufficient to justify the delivery by
him of a lecture under the title of his office.

144. INDEBTEDNESS

A member shall not incur indebtedness to the extent that it impairs his efficiency or
has brought, or is likely to bring, the Brigade into disrepute.
145. MEMBER NOT TO SOLICIT INTERVENTION

A member shall not solicit the intervention or influence of members of Parliament,


Ministers, or prominent members of the community to support or advances his
individual claims in the Brigade.

146. GIFTS, REWARDS

Except with the permission of the Commissioner, a member shall not accept: -

a) any gift or reward from any member of the public or from any organisation
for services rendered in the course of the performance of his duty; or

b) any present which is likely to influence him in the performance of his duty.

147. FIRE OFFICERS NOT TO ACCEPT GIFTS FROM ANY SUBORDINATE


MEMBER

1) An officer shall not receive from any subordinate member any


present, gift or reward except with the permission of the
Commissioner.

2) Where the officer who is to be the recipient of any present, gift or reward
referred to in Sub Section (1) is the Commissioner, he shall not receive the
same except with the permission of the Board.

148. EXCEPTIONS

Notwithstanding Section 150 or 151, a member may accept a present offered by: -

a) a representative of a foreign government on the occasion of any official visit


to that country;

b) a community organisation, on a social occasion where the gift


represents the work or achievement of that organisation;

c) a member in the Brigade on the occasion of marriage, retirement, transfer,


or other celebratory occasion to which the Commissioner signifies approval.

149. MEMBER TO ATTEND MEDICAL BOARD

A member shall not fail, or refuse, to attend a Medical Board for examination as
directed by the Board, Commissioner or Director of Personnel, as the case may
be.

150. APPEARANCE AND TURN OUT

1) A member shall be clean and smart in appearance.


2) A member shall be alert on duty, smart in his movement and respectful in
bearing and manners.

3) A member shall keep the hair on the head dressed short and neatly
groomed and have the chin and under-lip shaven.

151. OTHER ACTS OF MISCONDUCT

A member who without reasonable excuse does an act which: -

a) amounts to failure to perform in a proper manner any duty imposed upon


him as a member of the Brigade;

b) contravenes any of these Sections, or any section or sub section of


Regulation 33, of the Fire Brigade (No. 2) Regulation 1993, referred to in
Section 156, or any order published by the Commissioner in Fire Brigade
General Orders;

c) contravenes any written law relating to the Brigade; or is otherwise


prejudicial to the efficient conduct of the Brigade or tends to bring discredit
on the reputation of the Brigade, commits an act of misconduct.

CHAPTER IX
DISCIPLINE
152. DISCIPLINARY OFFENCES

1) Without prejudice to the generality of Section 115 and subject to the


provision of Regulation 33, of the Fire Brigade (No. 2) Regulation 1993, a
member commits a disciplinary offence if as respects the Brigade he is
guilty of: -

a) discreditable conduct, that is to say, if he acts in a disorderly manner


or any manner prejudicial to discipline or likely to bring discredit on
the reputation of the Brigade;

b) insubordinate or oppressive conduct, that is to say, if he:-

i) is insubordinate by work, act or demeanour; or

ii) is guilty of oppressive or tyrannical conduct towards a member

iii) uses obscene, abusive, or insultive language to


any other member; or

iv) willful or negligently makes any false complaint or statement


against any member; or
v) assaults any member; or

vi) withholds any complaint or report against any member;

c) disobedience to orders, that is to say, if he disobeys or without


sufficient cause, omits or neglects to carry out any lawful order,
written or otherwise;

d) neglect of duty, that is to say, if he: -

i) neglects, or without good and sufficient cause omits, promptly


and diligently to attend to or carry out anything which is his
duty;

ii) idles or gossips while on duty; or

iii) leaves his place of duty without due permission or sufficient


cause; or

iv) fails to report any matter which it is his duty to report; or

v) omits to make any necessary entry in any official document or


book; or

vi) neglects, or without good and sufficient cause, omits to carry


out any instruction of the medical officer, or while absent from
duty on account of sickness, is guilty of any act or conduct
calculated to retard his return to duty;

e) falsehood or prevarication, that is to say, if he: -

i) knowingly makes or signs any false statement in any official


document or book; or

ii) willful or negligently makes any false, misleading


or inaccurate statement; or

iii) without good and sufficient cause, destroys


or mutilates any official document or record, or alters or erases
any entry therein;

f) breach of confidence, that is to say, if he: -

i) divulges any matter which it is his duty to


keep secret;

ii) without proper authority communicates to the public media, or


to any unauthorized person, any matter connected with the
Brigade;
iii) without proper authority shows to any person, outside the
Brigade any book or written or printed document the property
of the Brigade;

iv) makes any anonymous communication to the Board or to the


Commissioner;

v) canvases any member of the Board with regard to any matter


concerning the Brigade;

vi) signs or circulate any petition or statement with regard to any


matter concerning the Brigade, except through the proper
channel or correspondence with the Commissioner; or

vii) calls or attends any unauthorized meeting to discuss any


matter concerning the Brigade;

g) corrupt practice, that is to say, if he: -

i) directly or indirectly solicits or receives, any gratuity, present,


subscription or testimonial without the consent of the
Commissioner; or

ii) improperly uses his character and position as a member of the


Brigade for his private advantage;

h) unlawful or unnecessary exercise of authority, that is to say, if he: -

i) without good and sufficient cause makes any


unlawful or unnecessary arrest or breaks into any building;

ii) is uncivil to any member of the public;

i) malingering, that is to say, if he feigns or exaggerate any illness or


injury with a view to evading duty;

j) absence without leave or being late for duty, that is to say if he


without reasonable excuse is absent without leave from, or is late for
parade or any other duty;

k) untidiness, that is to say, if while on duty or while off duty in uniform: -

i) he is improperly dressed or dirty, or untidy in his personal


clothing or accoutrement; or

ii) the hair on his head is not properly groomed; or

iii) his cheek and chin are not clean shaven; provided that any
member who has obtained from a Medical Officer and
delivered to the Commissioner a recommendation in writing
that he be excused from compliance with this provision, may
be so excused.

l) damage to equipment, clothing or other articles supplied, that is to


say, if he: -

i) willfully or by carelessness causes any waste, loss or damage


to any fire engine, equipment, article of clothing,
accoutrements or to any book, document or other property of
the Brigade, operated by him, served out to him, used by him
or entrusted to his care; or

ii) fails to report any loss or damage as aforementioned;

m) drunkenness, that is to say, if he while on or off duty, is


unfit for duty due to consumption of intoxicating liquor;

n) unfit for duty due to the consumption of any drug other than pursuant
to the lawful directions of a registered medical practitioner;

o) drinking on duty or soliciting drink, that is to say, if he:-

i) without the consent of his superior officer drinks or receives


from any other person any intoxicating liquor while he is on
duty; or

ii) demands or endeavours to persuade any other person to give


him or to purchase or obtain for him, any intoxicating liquor
while he is on duty;

p) entering licensed premises while on duty, that is to say, if he enters


while on duty, any premises licensed under the Spirit License Act or
any other premises where liquor is stored or distributed, other than in
the execution of his duty;

q) improper conduct, that is to say, if he: -

i) lends money to any member superior in rank or borrows from


or accepts any present from any member inferior in rank;

ii) connives at, or is knowingly an accessory to any breach of


these Regulations.

2) Any case not provided for by these Regulations shall be reported to


the Board and the Board may issue instructions as to how the case is
to be dealt with and the case shall be dealt with accordingly.

153. INVESTIGATION
1) Subject to the provisions of Fire Brigade (No. 2) Regulations, 1993, and
these Regulations, where it is alleged that a member has committed a
disciplinary offence and after the investigation of the charge it appears that:
-

a) the charge is for an offence that can be dealt with summarily, it shall
be so dealt with by the appropriate authority;

b) the charge is not for an offence which can be dealt with summarily, it
shall be referred to the Tribunal who shall hold an inquiry with respect
thereto;

c) an offence against any enactment or any of these Regulations


appears to have been committed, the matter shall, unless criminal
proceedings have been or are about to be instituted, be referred to
the Director of Public Prosecution for advice as to whether criminal
proceedings out to be instituted;

d) There is insufficient basis for preceding further the charge shall be


dismissed.

2) If the Director of Public Prosecutions advises that criminal proceedings


ought to be so instituted, disciplinary proceedings shall not be initiated
before the determination of the criminal proceedings so instituted.

154. WHERE CRIMINAL PROCEEDINGS HAVE BEEN INSTITUTED AGAINST A


MEMBER
Where criminal proceedings have been instituted against a member, disciplinary
proceedings, upon any grounds arising out of the criminal charge shall not be
taken until after judgment has been given and the time allowed for an appeal from
the judgment has expired, and where a member after conviction has appealed,
disciplinary proceedings shall not be taken until after the withdrawal or
determination of the appeal.

155. SUMMARY PROCEDURE

1) References in these Sections to dealing summarily means the hearing and


determination by an appropriate superior authority in such manner as it
deems fit of a charge against a member after notification of the charge to
such member whether orally, or in writing.

2) Disciplinary offences other than those specified in Sub Section (3) may be
dealt with summarily.

3) The offences to which Sub Section (2) refers are those specified at
paragraph (a), (b) (ii), (b) (v), (e), (f), (g), (h) (ii), (n) and (q) of Regulation
156.
4) If the appropriate superior authority determines that the accused is guilty of
a disciplinary offence it shall so find, and may sentence the accused to one
of the following punishments, that is to say: -

a) a fine of a sum not exceeding three (3) days pay;


b) severe reprimand;

c) reprimand.

5) Upon the conclusion of proceedings, the appropriate authority shall submit


to the Commissioner a report of such proceedings.

156. DISCIPLINARY INQUIRY

1) A disciplinary inquiry shall be heard by a Tribunal consisting of: -

a) the Board, where the relevant charge is against the Commissioner or


other officer not below the rank of Assistant Commissioner; or

b) the Commissioner, in all other cases.

2) Every member in respect of whom a disciplinary inquiry is to be held shall


as soon as possible be informed in writing of the exact charge against him.

3) The written charge shall disclose a disciplinary offence under these


Sections and Fire Brigade (No. 2) Regulations 1993, Regulation 33, and
shall state specific particulars thereof.

4) The written charge which shall be entered on a form approved by the Board
(hereinafter referred to as the Charge Sheet) together with the report or
compliant on which the charge is founded and all reports thereon (whether
confidential or otherwise) or copies thereof, shall be delivered as soon as
practicable to the member charged, who shall initial them to show that he
has seen them.

5) The member charged shall either be allowed to retain for the purpose of his
defence, the reports which are handed to him, or shall be allowed a
reasonable opportunity to make copies of the reports for that purpose.

6) The member charged shall state in writing on the Charge Sheet whether he
admits or denies the charge and may explain in writing any facts or
circumstances forming a part of the charge or he may state that he desires
to offer his explanation to the Tribunal and shall, if he so desires, be
afforded an opportunity of doing so.

7) If the Tribunal is not satisfied with the explanation given by the member who
has denied a charge made under Section 160, the member shall be directed
in writing to appear before the Tribunal at a time and place mentioned in the
direction and shall be afforded an opportunity of hearing the evidence
tendered against him and on cross examine the witness called in support of
the charge and of giving evidence and calling witnesses in his defence.

8) If the member charged refuses or neglects without reasonable cause to


appear at the time and place so appointed pursuant to paragraph (1), the
charge may be heard and decided in his absence.

9) The member charged shall, if he desires the presence when the charge is
heard of any witness to material fact, state in writing the names and
addresses of the witnesses and any such witnesses who are member shall
be directed to attend and any witnesses who are not members shall be
given due notice of the time and place of the hearing.

10) The member charged and the person or authority preferring the charges
may each be represented by another member, an Attorney-At-Law or Trade
Union Representative.

11) A member who a Tribunal finds guilty of a disciplinary offence is liable to: -

a) discharge;

b) suspend from duty for a period not exceeding twenty-eight (28) days
without pay or with half pay only;

c) reduction in rank;

d) severe reprimand; or

12. The decision of the Tribunal shall be written upon the Charge
Sheet and notified forthwith to the member charged who shall write on the
Charge Sheet his acknowledgement of having read the decision.

13. Notice required to be given may be given by such person as the Tribunal
may generally or in any particular case direct.

157. SUSPENSION

1) Where: -

a) any disciplinary inquiry or criminal proceedings have been or are about to


be instituted against a member; or

b) the Board or Commissioner becomes aware of any misconduct on the part


of a member; and

c) the Board or Commissioner in either case referred to in paragraph (a) or (b)


is of the opinion that it is necessary or desirable in the Public Interest that
the member should be forthwith suspended from duty.
2) The order for suspension shall be in writing stating the reasons therefore
and shall be made by the Chairman of the Board or Commissioner and a
copy thereof shall forthwith be delivered to the member concerned.

3) A member so suspended shall from the date of suspension be paid half


pay until the final conclusion of the proceedings relating to the charge
against him and appeal (if any).

4) When as a result of the relevant disciplinary inquiry the member concerned:

a) is ordered to be discharged, he shall not be entitled to any further


payment in respect of the period during which he was suspended;

b) is fined, the pay withheld shall be applied against the fine and the
balance (if any) paid to him;

c) is suspended without pay, he shall forfeit the half pay retained by him
during his suspension pending trail;

d) he is suspended with half pay only, the suspension shall be deemed


to commence on the day on which he was suspended pending trial
and any pay withheld in excess of the period ordered, shall be paid to
him;

e) he is acquitted of the charge, he shall receive so much of his pay as


may have been withheld.

5) A member who has been summoned or arrested on a criminal charge “may” be


forthwith suspended from duty without pay and deprived of all uniforms and other
property of the Brigade in his possession, and if admitted to bail may earn is
livelihood as if he were not a member of the Brigade.

6) A member who has been suspended from duty may not leave Jamaica without the
permission of the Board acting on the Commissioner an address at which he may

be found.

7) All documents required to be served pursuant to these Regulations on a member


who is under suspension from duty, shall be deemed to be properly served if sent by pre-
paid registered mail to the address given by that member in accordance with Sub Section
(6).

8) A member convicted of a criminal charge involving dishonesty, fraud or moral


turpitude or convicted of a criminal charge and sentenced to imprisonment shall
not receive any of his emoluments after the date of such conviction pending the
determination of the Board.

158. REVIEW AND APPEAL


1) An aggrieved member may appeal to the Commissioner from a decision of an
officer designated to conduct summary proceeding pursuant to Section 161 Sub
Section (2).

2) The Commissioner may at the hearing of the appeal: -

a) allow the appeal; or

b) dismiss the appeal with such consequential orders setting aside or


varying the decision as he thinks fit.

3) Appeal proceedings under this Section shall be regarded as a disciplinary inquiry


by a Tribunal consisting of the Commissioner and the provisions of these
regulations shall apply.

159. AGGREVIED MEMBER MAY APPEAL TO THE COMMISSIONER

In these Sections, unless the context otherwise requires – “appropriate superior authority”
in relation to a member accused of a disciplinary offence which is to be dealt with
summarily, means: -

a) such officer in charge of a area or division as the Commissioner may designate as


respects an accused member other than one specified in paragraph (b);

b) the Board, as respects the Commissioner, or any other officer not below the rank
of Assistant Commissioner.

160. ACCUSED MAY REQUEST BOARD TO REVIEW DECISION OF TRIBUNAL

1) Within fourteen (14) days after a Tribunal consisting of the Commissioner has
(initially or on appeal) found an accused member guilty of a disciplinary offence the
accused may in writing request the Board to review the decision.

2) On a review pursuant to Sub Section (1) the Board may: -

a) quash the decision;

b) substitute another decision;

c) confirm the decision,

161. APPEAL FROM DECISION OF BOARD LIES TO THE COURT OF APPEAL

Subject to provisions of the Judicature (Appellate Jurisdiction) Act, an appeal from any
decision of the Board (acting summarily or as a Tribunal) lies to the Court of Appeal.

162. DISCHARGE

In addition to any other provision in this regard a member of the Brigade may be
discharged: -
a) by direction of the Board on the recommendation of the Commissioner that
the member is not longer efficient or on the certificate of a Medical Officer
that he is physically unfit to perform the duties of his office;

b) by the Board at the request of the member;

c) on his giving at least three (3) months notice of his desire to retire if the
Commissioner shall certify that the exigencies of the service allow for such
discharge.

163. REDUCTON IN RANK FOR MISCONDUCT

Any member who has been reduced in rank for misconduct: -

a) once, shall not again be promoted or recommended for promotion before


the expiration of a period of one year after such demotion;

b) more than once, shall not be promoted or recommended for promotion save
in the most exceptional circumstances.

CHAPTER X
DUTIES AND TRAINING

168. DUTIES AND TRAINING

1) The Commissioner shall: -

a) Order such drills with or without appliances as in his opinion may be


necessary for training the members of and maintaining the efficiency of the
Brigade;

b) whenever required by the Brigade and at the end of each financial year,
furnish an inventory of all appliance, equipment and other articles belonging to the
Board and also a report on the working of the Brigade during such financial year.

c) as soon as possible after a fire, report on the form from time to time
approved by the Board particulars as to the cause of the fire, the vehicles,
appliances, number of men and methods employed in putting out the fire or
preventing its spread and whether any and what premises were broken into or
taken possession of and as to the insurance carried on all buildings or other
Property damaged or destroyed;
d) generally enforce these Rules and Terms and Conditions of Employment
pertaining to the Fire Service which may from time to time be in force.

2) Each officer shall: -

a) have immediate charge of all such appliance, accoutrements, tools and


equipment as may be placed under his care by the Commissioner and shall
be responsible to the Commissioner for there good condition;

b) make himself acquainted with all the Fire Engines of the Brigade, and with
all the water supplies and Fire Hydrants within the limits of his operations;

c) when in charge of a Fire Station shall on receiving notification that a Fire


Station shall on receiving notification that a fire has broken out or that any other
disaster has occurred, or is imminent, immediately dispatch such members of the
Brigade and fire appliances with equipment as he may consider necessary to the
scene of the fire or other disaster;

d) perform such inspections of premises as may be directed by the


Commissioner and report to him any contravention or regulations for the
prevention of fire which may come to his notice;

e) visit the night watch-room attendant at fire stations and Firefighters at


places of amusement and other places at such times as the Commissioner
may direct and report to the Commissioner the result of such inspections;

f) perform such clerical duties in connecting with the Brigade, as the


Commissioner may from time to time require;

g) report to the Commissioner upon becoming aware thereof, any defect in any
fire appliance or fire equipment or breach or regulations or neglect of duty or
insubordination on the part of any member;

h) at all times, so conduct himself as to be an example to


the members under him.

3) Each Sergeant shall: -

a) receive the orders and instructions of the Commissioner and as the case
may require, officers, and report to such officers as the Commissioner may
from time to time direct;

b) in the absence of the assigned officers take command of the fire division or
branch to which he is posted and perform the duties laid down for such
officers;

c) be responsible for seeing that all the orders of the Commissioner and as the
case may require, officers are promptly and efficiently carried out and
immediately report any misconduct or infringement or regulations on the
part of any Corporal, Lance Corporal, or Firefighter;
d) be responsible for the conduct of the members under his command and for
the good condition of the fire appliances, equipment, buildings and premises
of the station to which he is posted and shall see that all accoutrement and
equipment of the Corporals, Lance Corporals and Firefighters are properly
cared and in good order.

4) Each Corporal shall: -

a) make himself acquainted with these Sections and with the duties of
Sergeant;

b) in the absence of his immediate senior perform the duties


devolving on such senior;

c) ensure that the Lance Corporal and Firefighters under his command
promptly obey all orders given to them in a smart manner and shall immediately
report any misconduct, delay, infringement of regulations or insubordination.

5) Every Lance Corporal and Firefighter shall: -

a) obey the orders of the Commissioner or as the case may require officers
(whether issued directly or through a Sergeant or Corporal) and shall not
question the prudence of any order but shall obey the same smartly;

b) perform for the Brigade any work for which he may be qualified or for which
the Commissioner may consider necessary for the efficient
performance of the duties of the Brigade and for the keeping of the building
and premises, vehicles, appliance, tools and equipment of the Brigade in
good order and condition;

c) report and injury received by him in the course of his duties within one (1)
hour of the receipt of such injury or within one (1) hour of his return to the
fire station if the injury was received while he was away from the station or
at the first available opportunity thereafter;

d) when acting as duty man, on a call or alarm being received use his best
endeavours to ascertain the locality and nature of the supposed fire or other
disasters, and immediately alarm the station notwithstanding that he
may believe the call to be a false alarm.

169. OFFICERS AT FIRE STATION SHALL INSPECT SUBORDINATE


OFFICERS AND FIREFIGHTERS

The officer on duty at any fire station shall inspect all Subordinate Officers and
Firefighters detailed for duty away from the station and shall make a record or such
inspection in the Occurrence Book kept in the watch-room of the particular station.

170. SUBORDINATE OFFICERS AND FIREFIGHTERS TO ATTEND PARADES

Unless otherwise directed by the Commissioner all Subordinate Officers and Firefighters
other than those on special duty shall attend parades at all fire stations at the times
specified in operational directions or at any other time required by the Commissioner.
171. CORRECTIONS

No erasures shall be made in any official book or document but mistakes shall be crossed
out and initialed and a new entry shall be made correcting the original copy.

172. CIRCULATIONS OF ORDERS

All regulations, rules, conditions of employment, administrative directions, orders and


other official publications affecting members shall be brought to their attention by the
Commissioner.

173. CHANNELS OF COMMUNICATIONS

1) A formal communication, other than that referred to in Section 174 which member
wishes to address to the Commissioner shall be forwarded through the senior
official under whom that member is serving.

2) Any official communication in respect of or relating to the employment of a


member which he wishes to address to the Board shall be forwarded to the
Commissioner through the senior officer under whom that member is serving.

3) The senior officer on receipt of a communication referred to in Sub Section (1) or


(2) shall forward such communication together with his comments, if any, to the
Commissioner.

174. COMPLAINTS

1) A member who wishes to make a complaint may do so to his immediate senior


officer, and where he considers himself wronged by that senior officer, he may
complain to a higher authority who shall transmit the complaint to the
Commissioner and the Board.

2) An officer to whom a complaint is made shall acknowledge receipt of such


complaint in writing and cause enquiries to be made into such complaints, and if
satisfied with the justice of the complaint shall take such steps as may be
necessary for giving full redress, if within his powers, or refers the case to a higher
authority.

175. PAYMENT FROM PUBLIC MONEYS APPROPRIATED FOR THE BRIGADE

The Commissioner or Director of Finance, subject to the Government Financial


Regulations, shall ensure that no payment shall be made out of public funs appropriated
for the Brigade, in respect of any matter requiring the approval of the Board until such
approval has been obtained.

176. INDUSTRIAL ACTION

1) Consistent with the provisions of the Labour Relations and Industrial Dispute Act,
there shall be no lock-outs, strikes, or any other conduct which is in contemplation
or furtherance of an industrial dispute with the intention of preventing or reducing
the services offered by the Brigade.

2) The Jamaica Fire Brigade is an essential service and therefore falls under the
jurisdiction of the Essential Services Act and is accordingly subject to the contents
therein.

3) Salaries and wages of members who participate in industrial action may not be
paid for any day or portion of the day during which they are engaged in industrial
action.

4. It is expected that there will be some members who report for duty and are willing
to work but are precluded from doing so because of circumstances beyond their
control. A distinction should be made between this class of worker and the bona
fide class which has resorted to industrial action and the former class may be paid
if after reference to the Board it is considered that the circumstances justify such
action. In any case where there is doubt whether a member was in the bona fide
class resorting to industrial action an inquiry shall be instituted in order to
determine the category in which his conduct places him.

117. LEGAL PROCEEDINGS

1) A member who desires to initiate legal proceedings on his own behalf


against another member or against a member of the public with respect to
any matter which arises out of, or in the course of the execution of his duty,
shall inform the Commissioner accordingly.

2) Where a member is charged with an offense arising out of, or in the course
of, the execution of his duty, and the Board is satisfied that such member
acted in good faith in the execution of his duty, such member shall be
granted legal representation in the conduct of his defence.

3) When as a result of the act of a member legal proceedings are successfully


brought against the Brigade, or the Board deems it desirable to settle such
proceedings out of court, disciplinary action may, if the circumstances
warrant such action, be instituted against such member.

CHAPTER XI
178. SCHEDULE OF UNIFORMS

1) Subject to the provisions of Section 72 Sub Section (2), (3), (4)and (5), a
person on first appointment to the Brigade as a Firefighter, or a member on
first appointment to an Officer’s Rank in the service, shall be eligible to
receive as his initial issue such items of uniforms, accessories, equipment
or accoutrements mentioned in this Section.
