MEMORANDUM OF UNDERSTANDING

KNOW ALL MEN BY THESE PRESENTS:

This Agreement was made and entered into by and between:

The BALINGASAG MUNICIPAL POLICE STATION, an agency of the national


government created and existing by virtue of and pursuant to RA 6975 as amended by RA
8551 with address at Poblacion 6, Balingasag Misamis Oriental, represented by
PMAJ ARNOLD T GAABUCAYAN, Officer in-Charge, and herein referred to as the
“FIRST PARTY”.

The MISAMIS ORIENTAL INSTITUTE OF SCIENCE & TECHNOLOGY


(MOIST) , an educational institution duly organized and existing under the Department of
Education (DepEd) with an office address at Sitio Eva, Barangay Samay, Balingasag,
Misamis Oriental represented by MR REYNALDO P VALMORES, School President
herein referred to as “SECOND PARTY”,

That both parties in this MOU are further referred to as the PARTIES.

-Witnesseth-

WHEREAS, Article 15, Section 3 (2) of the 1987 Philippine Constitution further
mandates the State to defend the right of children to assistance, including proper care and
nutrition, and special protection from all forms of neglect, abuse, cruelty, exploitation, and
other conditions prejudicial to their development;

WHEREAS, criminality where children are victims, is everybody’s concern that


needs to be addressed in partnership with all government sectors concerned;

WHEREAS, in 2020, CHR 10 reported its findings that the NPA committed a Grave
Child Rights Violations in Misamis Oriental province where nine of twelve NPA who
surrendered to the 58IB, PA in November 2020 were recruited minors from the towns of
Claveria and Lagonglong. Inhumane treatment, abuses and exploitation are violations of
children’s rights regardless they were recruited voluntary or by forced;

WHEREAS, the National Task Force to End Local Communist Armed Conflict
(NTF-ELCAC) urged school authorities to prevent recruitment among students from schools
as it become the breeding ground of child warriors and cadres of CPP-NPA-NDF;

WHEREAS, the PNP is mandated to enforce the law, prevent and control crimes,
maintain pace and order, and ensure public safety and internal security with the active
support of the community/stakeholders towards the attainment of a safer place to live, work
and do business;

WHEREAS, the PNP recognizes the vital partnership of the different government
agencies, business sector, non-government organizations (NGOs), people’s organizations,
sectoral organizations in ensuring public order, safety, and security of the community and in
the government’s campaign against criminality, insurgency, terrorism, illegal rugs and
corruption, as well as on disaster response;

WHEREAS, the PNP recognizes the vital role of the youth in nation-building and
shall promote and protection their physical, moral, spiritual, intellectual, and social well-
being, as it includes patriotism and nationalism, while encouraging their involvement in
public and civic affairs;

WHEREAS, in partnership with KINANAO PAMALIHI ELEMENTARY


SCHOOL which give greater emphasis on the development of foundational skills such as
literacy, numeracy, and socio-emotional skills by integrating peace competencies-
highlighting the promotion of non-violent actions and the development of the conflict-
resolution skills to its learners; and

NOW THEREFORE, for and in consideration of the foregoing premises and


pursuant to the respective agencies Child Protection Police, the parties hereby agree to
support the revival and reimplementation of Department Order No 1, Series of 2006, Creation
and Composition of the Student Crime Prevention Committee (SCPC) in all public and
private high schools, senior high school, colleges and universities in region.

I. Creation and Composition of the Student Crime Prevention Committee


(SCPC)

The parties hereby agree to encourage and facilitate the creation of the above-
mentioned Committee under the Supreme Student Council in the school which shall be
composed of the following:

1. Chairperson – the President of Supreme Students Council in concurrent


capacity;
2. Vice -Chairperson – the Vice President of Supreme Students Council in
concurrent capacity;
3. Members – the class presidents or the vice -presidents, in the absence of the
former, as case maybe, of the high school and senior high school level and
of all courses, for college level as members of the committee;
4. The Secretary of the Supreme Student Council shall serve as such in
Committee in a concurrent capacity.

II. Duties and Responsibilities of the Committee

The Committee shall have the following duties and responsibilities

1. Formulate crime prevention, counter-terrorism and anti-illegal drugs


programs for the implementation of the committee;
2. Coordinate with President of the Parent-Teachers Community Association
(PTCA), if any, the Scholl Principal or Dean, as the case maybe, in the
maintenance of peace and order within the school premises;

3. Recommend to the school/college the conduct of seminars or trainings on
crime prevention, counter terrorism awareness and drug prevention and
control in coordination with Balingasag Municipal Police Station;
4. Conduct intensive information drive on crime prevention, particularly on
drug abuse, alcoholism, illegal gambling, fraternity quarrels, hazing and
other undesirable activities through conduct of Kabataan Kontra Droga at
Terorismo (KKDAT) and Community Anti-terrorism Awareness (CATA)
program of the PNP; and
5. Report illegal activities of the students and/or recommend the imposition
of appropriate sanction by the school authorities

III.The Board of Advisers

There shall be a Board of advisers who shall provide consultancy and advisory
on matter affecting operations and activities of the committee compose of the
following;
1. School head – as Chairman
2. Chief of Police - as Vice-Chairman
3. Adviser of the Supreme Student Council
4. Punong Barangay (where the school is situated)
5. SK Chairman (where the school is situated)
6. President of the PTCA or PTA
7. Representative of the interfaith sector to be designated by the
school head

IV. Responsibilities of the PARTIES

A. Balingasag MPS, through MCAD, as project proponent shall:

1. Coordinate with the school officials concerned for the organization


of the Student Criem Prevention Committee (SCPC)
2. Conduct lectures or seminar-workshops on crime prevention and
criminal justice, counter-terrorism awareness, drug awareness and
community involvement to be held in school campus in
coordination with school officials concerned;
3. Provide resource speakers/lectures on the abovementioned topics
or any available competent lecturers as may be recommended by
Balingasag MPS; and
4. Coordinate, supervise and monitor the implementation of crime
prevention projects of SCPC jointly with the parties through the
Office of the Student Service.

B. The MOIST shall

1. Issue and order directing the organization of SCPCs in school and


providing full support to the crime prevention and anti-terrorism
campaign of the government;
2. Coordinate, supervise and monitor the implementation of the crime
prevention and anti-terrorism projects of SCPCs jointly with
Balingasag MPS.

V. Monitoring Mechanism

The Balingasag MPS through MCAD, shall monitor the SCPDs in


coordination with school officials.

VI. TERMS
This MOU shall be valid until or unless revoke on reasonable ground by
the PARTIES upon prior notice.

VII. GRIEVANCE

The PARTIES may settle any dispute in any alternative dispute resolution
deemed proper and practical.

PARTIES may not be held jointly liable in any acts or omission done outside
of the scope or objective of this MOU.

IN WITNESS WHEREOF, the parties have hereunto affixed their signatures this
