6) HISTORY OF PROPERTY :-
On the perusal of the said property card extracts, i.e 7/12 and Mutations of the
S. No/ 318, it seems that the said S. No. 318 admeasuring 08H-77R was owned by
Kevalchand Bora transferred by way of Gift the land bearing S. No. 318 to her son Mr.
Prakash Kevalchand Bora and her four grandsons viz. Mr. Vinay Prakash Bora, Mr.
Vishal Prakash Bora and Mr. Vinit Prakash Bora. The said Gift Deed , dated
13/12/2007 has been registered in the office of Sub-Registrar Shirur at Sr. No.
5437/2007. The effect of the said gift was given to the record of rights and thus the
names of the said owners were mutated in the said 7/12 Extracts vide Mutation Entry
No. 12308.
Thereafter the said owners Mr.Prakash Kevalchand Bora, Mr. Vinay Prakash
Bora, Mr. Vishal Prakash Bora and Mr. Vinit Prakash Bora entered into a Partition
Deed on 9/06/2011,whereby they partitioned the land bearing S. NO. 318 and other
lands jointly belonging to them by metes and bounds. The said Partition Deed, dated

09/06/2011 has been registered in the office of Sub-Registrar Shirur at Sr. No.
2586/2011. By virtue of the said partition the land bearing S.No. 318 has been
allotted to the exclusive shares of Mr. Prakash Kevalchand Bora, Mr. Vinay Prakash
Bora. The effect of the said partition has been given to the record of rights and thus
the names of the said owners were mutated in the said 7/12 Extract vide Mutation
Also it appears from Mutation Entry No. 19004 that the said owners Mr.
Prakash Kevalchand Bora, Mr. Vinay Prakash Bora made application for Sub-division
of the said S. No. 318 owned the land bearing S. NO. 318 has been Sub-divided into 5
hissas viz. (i) S.No. 318 admeasuring 01 Hectare 56 Ares recorded in the name of
Mr. Prakash Kevalchand Bora, (ii) S.NO. 318/2 admeasuring 01 Hectare 04 ares
recorded in the joint names of Mr. Prakash Kevalchand Bora, Mr. Vinay Prakash
Bora, (iii) S.NO. 318/3 admeasuring 02 Hectare 13 Ares recorded in the name of Mr.
Vinay Prakash Bora, (iv) S. NO. 318/4 admeasuring 02 Hectare 30 Ares recorded in
the name of Mr. Prakash Kevalchand Bora and (v) S.No. 318/5 admeasuring 01
Meanwhile Mr. Prakash Kevalchand Bora, Mr. Vinay Prakash Bora entered into
Mr. Santosh Motilal Bhansali and Mr. Rahul Rasikalal Nahar for jointly developing
the lands bearing Survey Nos. 318,318/2,318/3,318/4, and 318/5. The said Joint
Venture Agreement has been registered in the office of Sub –Registrar, Shirur at Sr.
No. 3296/2011 on the same day. In pursuant to the joint Venture Agreement the
parties also entered into a Supplementary Agreement dated 16/04/2014 which has
been registered in the office of Sub-Registrar Shirur at Sr. No. 2324/2014. Mr.
Prakash Kevelchand Bora and Mr. Vinay Prakash Bora also executed two Power of
authorizing them to do all acts, deeds and things as mentioned there in. The said

Power of Attorneys, dated 27/07/2011 and 01/10/2013 have been registered in the
Further it seems that the said owners of Land, Mr. Prakash Kevalchand Bora
and Mr. Vinay Prakash Bora obtained N.A. permission for non-agricultural use of the
land bearing S. No. 318, 318/3, 318/4, and 318/5 vide his order Nos. (i)

Mr. Rahul Rasikalal Nahar. The said Revocation/ Cancellation of Power of Arrorneys,
dated 30/06/2018 have been duly registered in the office of Sub-Registered Shirur Sr.
Further it seems that the Ramling Land Developers LLP. through Partners, 1)
Sunil Popatlal Nahar and 5) Prakash Kevalchand Bora was formed and the

decided to prepare a layout of the same comprising of area demarked for plots, internal
roads, amenity space and open space and thereby applied to the Municpal Council,
Shirur for Sanction of the said Lay-Out and thus the said Lay-out was initially
sanctioned vide its Letter No. 1151/2018 dated 12/06/2018 and further the Revised

Dinesh Kantilal Kankariya, 2) Anil Kewalchand Nahar, &3) Sunil Popatlal Nahar lives at
Pune and are unable to be present for registration of documents personally at the office
of the Sub-Registrar and thus they gave the rights to present and executed the

docuements on their behalf as the partner of M/s. Ramling Land Developers LLP to 1)
17/10/2018.
As per the N.A Order issued by the S.D.O, Pune and the Sactioned Lay-Out by
Municipal Council, Shirur, the the revenue records were prepared and the new
property card extracts were prepared by the Order of the Tahasildar, Shirur vide
orders having Total 226 Plots and the same were noted in the 7/12 Extracts, vide
Thus the said Plots were recorded in the name of Ramling Land Developers LLP.
Also it seems that the said owners of Ramling Land Developers LLP. through
Nahar, 4) Sunil Popatlal Nahar and 5) Prakash Kevalchand Bora has taken the Project
Loan of Rs. 7,00,00,000/- (Seven Crore Only) from Tata Capital Housing Finance Ltd
and thereby mortgaged all the NA Plots against the said loan by way of Reg. Mortgage
Deed at the Office of the Sub-Registrar, Shirur vide Doc No. 5265/2019 dated
16/09/2019 and thus there is the charge of said Tata Capital Housing Finance Ltd.
MAHARERA REGISTRATION :-
Thereafter the said Promoters Ramling Land Developers LLP. through Partners,
Sunil Popatlal Nahar and 5) Prakash Kevalchand Bora made an application for the
registration of the said Project under Sec 5 of Maharashtra Real Estate (Regulation and

Development) Act, 2017 and thereby the said Project “Sundar Vihar” is registered vide
Further it seems that the out of the Partners of the Ramling Land Developers
LLP. Sunil Popatlal Nahar gave the resignation and thereby was retired from the
March 2021 and other Partners, 1) Dinesh Kantilal Kankariya, 2) Vinay Prakash
Bora, 3) Anil Kewalchand Nahar, and 4) Prakash Kevalchand Bora were continued
to be Partners of the said Firm, Ramling Land Developers LLP. Also the intimation of
the said changes were given to Govt. of India, Ministry of Corporate Affairs vide Receipt
Further it seems that the said Developer Ramling Land Developers LLP. through
Nahar, 4) Sunil Popatlal Nahar and 5) Prakash Kevalchand Bora repaid the Project
Loan of Rs. 7,00,00,000/- (Seven Crore Only) and thereby the said finance company
Tata Capital Housing Finance Ltd executed the Release Deed at the Office of the Sub-
Registrar, Shirur vide Doc No. 4457/2021 dated 09/08/2021 and thus the charge of
the said loan is released from the said property. Thus the said project is free from any
charge or encumbrances.
Thus the said owner Applicant M/S. RAMLING LAND DEVELOPERS LLP.,
the Lawful Ownership and Marketable title in the said Plot Properties by virtue of Sale
Deed dated 20/06/2018 and Approvals given by SDO, Pune and the same is free
Further, it seems that the said Promoters, out of the said Lay-Out, Type B
Plots, the
for the consideration of Rs. 56,98,800/- to the said Applicant M/s. Seven
Square Properties through its Partners, 1) Mr. Swapnil Kailas Bandal, 2) Mr.
Swapnil Uttam Gopale, 3) Mr. Pravin Kisan Mapari and 4) Achal Pandharinath
Phalke by way of Reg. Sale Deed at the Office of the Sub-Registrar, Shirur vide Doc No.
8269/2023 dated 27/09/2023 and thus the name of the said Applicant was noted to
CONSTRUCTION PERMISSION :-
Further the said owner M/s. Seven Square Properties through its Partners, 1)
Mr. Swapnil Kailas Bandal, 2) Mr. Swapnil Uttam Gopale, 3) Mr. Pravin Kisan
Mapari and 4) Achal Pandharinath Phalke decided to construct the House over the
said land and accordingly they made an application to the Municipal Council, Shirur
and thereby obtained permission from the Municipal Council, Shirur to construct on
the said land by its Commencement Certificate bearing No. Order No.
TITLE :-
through its Partners, 1) Mr. Swapnil Kailas Bandal, 2) Mr. Swapnil Uttam Gopale, 3)
Mr. Pravin Kisan Mapari and 4) Achal Pandharinath Phalke has the ownership right
and title to develop the said property along with the right to Sell the said developed
property to the proposed buyers and the same is free from any charge or
encumbrances.

I have carried out the further search Comprising the SAID PROPERTY for last 30
years, i.e. from 1992-2021, i.e. from 2002 onwards from the computer records of
Sub-Registrar’s office Shirur and for year 1992-2000 at from the Index registers of
registers in the said office were not properly maintained and some of the registers
were in torn condition. I have found the above mentioned documents, which I have
mentioned in the above search report and have tried to ascertain the details of the
said property.
Therefore on the basis of the relevant documents, revenue records and other
documents made available and the information given to me, I am of the opinion that:-
through its Partners, 1) Mr. Swapnil Kailas Bandal, 2) Mr. Swapnil Uttam Gopale,
3) Mr. Pravin Kisan Mapari and 4) Achal Pandharinath Phalke has got the Lawful
Ownership and Marketable title in the said Residential Flat Properties by virtue of
Sale Deed and Approvals given by Municipal Council, Shirur and the same is free
Also all the necessary Sanctions and Approvals are obtained by the said
owners from the concerned authorities and thus has lawful right to construct the
