Question 1 [4 marks each x 5 = 20 marks]

Can a Contractor claim for extra payment or an extension of time in each of the following
situations and if so, on what basis? (state the GCC 2015 clauses that support your answer)

a) During an excavation it was discovered that a high- water table exists within the
excavation area and that water must be pumped from the excavation.

b) After concerns were raised by road users due to dust caused by the Contractor’s
trucks the Employer’s Agent’s Representative instructed the Contractor to water the
roads on the site three times a day.

c) The Employer’s Agent’s Representative instructed the Contractor to send additional


cubes to an independent laboratory as well as the specified tests that are being
already done on site. The independent laboratory came back with satisfactory test
results.

d) On site the electricity supply has been disconnected because it was not covered
under the agreement with the supply authority resulting in damages to part of the
works and the Employer’s Agent has instructed the Contractor to do the repairs.

e) The site is occupied by illegal land occupiers prohibiting Contractor from starting
work. It took two weeks to remove the illegal land occupiers from the site.

Question 2 [30 marks]

Identify and write at least 15 powers/authority that the Employer’s Agent has according to
the GCC 2015. Include the relevant clause number that talks to each of your identified
powers.
