ORDINANCE NO. 10

SEGREGATION AND ANTI LITTERING ORDINANCE OF

BARANGAY 08 ZONE 02

BE IT ORDAINED BY THE SANGGUNIANG BARANGAY 08 ZONE 02 OF

PASAY CITY IN SESSION DULY ASSEMBLED THE HEREIN SEGREGATION
AND ANTI - LITTERING ORDINANCE OF 2012.

Section I
Title
This Ordinance shall be known as the waste segregation and anti - littering ordinance of
Barangay 08 Zone 02. This ordinance prohibits the throwing of non - biodegradable plastic,
garbage and other waste materials in esteros, streets and other public places

Section II
Prohibited Acts

No person shall:
1. Throw or dispose non - biodegradable plastic, including single use thin film plastic,
garbage
and other waste materials in esteros, streets and other public places;

2. Throw or use as trash or garbage bags non - biodegradable plastic or cellophane in

disposing
other waste materials in trash cans or garbage bins;

3. Throw or dispose unsegregated garbage or trash in any garbage bin or trash can

Section III
Regulated Acts

1. Segregate all their trash and waste materials according to the following
a. Plastic
b. Styrofoam
c. Paper
d. Glass
e. Cans
f. Non - Biodegradable waste
g. Biodegradable waste

2. Provide separate trash bin for all the above - mentioned wastes in their respective areas
including School, Homes, Condominiums, Commercial and Industrial buildings and other
places within the Barangay.

Section IV
Penalty

VIOLATIONS OF THE ABOVE SHALL INCUR THE FOLLOWING PENALTIES

1. The Barangay shall refuse issuance of clearance and other persons, personal and juridical,
found littering and not segregating their waste materials;

2. Any violation of the provision of this Ordinance shall be punished by a fine of not less
than
One Thousand pesos ( P1,000.00 ) but not exceeding One Thousand five hundred Pesos
( P 1,500.00 ) at the
discretion of the court.

3. Payment of a fine is herein provided shall not relieve the offender from the payment of
the
delinquent tax, fee or charge under this code. If the violation is committed by any juridical
entity, the President, the General Manager or any person entrusted with the administration
thereof at the time of the commission of the violation shall be held responsible or liable
thereof.

Section V
Compromise Settlement Fee

The Punong Barangay is hereby authorized to enter into an extrajudicial Or out of court
settlement of any offense Involving violations of any provisions Of this Ordinance Subject,
however, to the following conditions, via;

1. That the offense does not Involve fraud;

2. That the offender shall pay a compromise settlement fee not less than One
Thousand Pesos( P 1,000.00 ) but more than One Thousand Pesos ( P 1,500.00 )
as may agreed upon by the both parties;
3. That the payment of the compromise settlement fee above mentioned shall not
relieve the offender from the payment of the corresponded tax, fee or charge due
from his as provided under this code, if he is liable therefore;
4. That an Official Receipt shall be issued to the offender and the amount collected
shall be utilized for the environment and solid waste management concerns of
the Barangay;
5. That the Barangay shall issue the corresponding clearance to the person or entity
that violated this Ordinance after payment of the corresponding compromise
settlement fee.
 Section VI
Seperability Clause

1. If for any reason, any provision, section or part of this Ordinance is declared not
valid by a court of competent jurisdictio or suspended or revoked by
Sangguniang Barangay, such judgement shall not affect or;

2. Impair their remaining sections or parts thereof which shall remain or continue to
be in full force and effect.

Section VII
Effectivity

This Ordinance shall take effect immediately upon the approval of the Sangguniang
Barangay
members and upon the review and approval of Sangguniang Panglunsod.
