General terms and conditions
1. Durchführung des St udiums
1.1. St udieng ang sbezeichnung und Abschluss
Die IU Internationale Hochschule (im Folgenden: IU) verpflichtet sich zur
Durchführung des auf Seite 1 des Studienvertrages genannten
„myStudies“-Studienprogramm nach der jeweils gültigen Studien- und
Prüfungsordnung. Für Teilnehmende, und damit auch für die Zeiträume,
in denen der Teilnehmende noch keinen offiziellen Studierendenstatus
hat, gelten die jeweils gültigen Studien- und Prüfungsordnungen des
zugrunde liegenden Quellstudiengangs. Der Vertrag kommt durch
Annahmebestätigung der IU mittels Bestätigungsschreiben zustande,
spätestens aber an dem Tag, an dem der:die Teilnehmende Zugang zu
den Lehrmaterialien erhält.
Mit erfolgreichem Abschluss des myStudies-Studienprogramms erwirbt
der:die Studierende abhängig von dem gewählten Studienprogramm
den akademischen Titel nach der jeweils gültigen Studien- und
Prüfungsordnung. Der Inhalt der angebotenen Lehrveranstaltungen
(inklusive Präsenzseminare) sowie der jeweils dafür vorgesehene
Zeitraum ergeben sich aus dem Modulhandbuch mit Curriculum,
welches dem Studierenden in geeigneter Form zur Verfügung gestellt
wird.
Die IU weist darauf hin, dass es bei neu-eingeführten Studiengängen zu
einer Einschränkung bezüglich der Verfügbarkeit von Studieninhalten
höherer Fachsemester kommen kann, ebenfalls kann bei neu-
eingeführten Studiengängen nicht immer die freie Wählbarkeit der
Reihenfolge der Studieninhalte garantiert werden. Dessen ungeachtet
gewährleistet die IU, dass die Inhalte des betreffenden Studiengangs
innerhalb der zugrundeliegenden Regelstudienzeit absolviert werden
können.
1.2. Änderung von St udienplänen
Die IU ist zu organisatorischen und inhaltlichen Änderungen des
Studienganges berechtigt. Dieses Recht umfasst die Anpassung des
Studienplans sowie die Umverteilung von Modulen des Fernstudiums
bzw. den Präsenzveranstaltungen, sofern das Ziel des Studiums dadurch
nicht gefährdet wird.
1.3. Zulassung zum St udium
Die Einschreibung sowie die Zulassung zum Studium erfolgen nach den
Vorgaben der jeweils geltenden Allgemeinen Einschreibungs- und
Zulassungsordnung (AZE) und den jeweils geltenden Regelungen der IU.
Bewerbende, die ihr Studium virtuell beginnen (Hybrid), starten mit dem
Status eines:einer Teilnehmenden und werden erst dann zu
eingeschriebenen Studierenden, wenn sie bis zu 50 Prozent der für den
Abschluss des gewählten Studiengangs erforderlichen Leistungspunkte
(Credits) erfolgreich erbracht sowie alle Zulassungsvoraussetzungen
erfüllt und alle erforderlichen Unterlagen gemäß der Allgemeinen
Einschreibungs- und Zulassungsordnung (AZE) in der erforderlichen
Form eingereicht haben. Mit dem Status eines:einer Teilnehmenden
können formal keine ECTS-Punkte erworben werden, bis der
Studierendenstatus erreicht ist. Sobald der Studierendenstatus erreicht
ist, werden alle Prüfungsleistungen, die zuvor im Teilnehmendenstatus
erbracht wurden, in vollem Umfang als Teil des Studiums anerkannt und
die ECTS-Punkte für diese Leistungen entsprechend erworben.
Der Studierendenstatus ist eine Voraussetzung, um auf den Campus der
IU kommen zu können. Bewerbende, die ein virtuelles Studium beginnen
und alle Zulassungsvoraussetzungen erfüllen sowie alle erforderlichen
Unterlagen gemäß der geltenden Allgemeinen Einschreibungs- und
Zulassungsordnung (AZE) und der "Ordnung für Prüfungen zum Zugang
zu Bachelor- und Masterstudiengängen (OZBM)" in der erforderlichen
Form eingereicht haben, können den Studierendenstatus unmittelbar
erhalten, d.h. bevor sie 50 Prozent der Credits im Teilnehmendenstatus
absolviert haben, falls sie sich entscheiden, vor Erreichen der 50 Prozent
an den Campus zu wechseln.
Zur Erlangung des Studierendenvisums können darüber hinaus
länderspezifisch weitere Anforderungen von den ausstellenden
Behörden gelten.
Sich Bewerbende, die von virtuell zum Campus wechseln wollen, aber
nicht alle Zulassungsvoraussetzungen erfüllen sowie nicht alle
erforderlichen Unterlagen gemäß der geltenden Allgemeinen
Einschreibungs- und Zulassungsordnung (AZE) und der "Ordnung für
Prüfungen zum Zugang zu Bachelor- und Masterstudiengängen (OZBM)"
in der erforderlichen Form eingereicht haben, können nicht an den
Campus nach Deutschland kommen, da sie unter Umständen keinen
Anspruch auf ein Visum haben.
Die Regelungen dieses Unterrichtsvertrags gelten ebenfalls für
Teilnehmende, auch wenn die Bezeichnung „Studierende:r“ verwandt
wird.
Für Semester, die an einem Campus in Deutschland in Präsenz
absolviert werden, gilt grundsätzlich die Pflicht sich in der gesetzlichen
deutschen Krankenversicherung zu versichern, vor diesem Hintergrund
muss der Nachweis einer solchen Krankenversicherung oder einer
Befreiung von dieser Pflicht erbracht werden.
1.4. Präsenzseminare
Die entsprechenden Termine der Präsenzseminare finden i.d.R. nach
dem auf Seite 1 gewählten Modell und Standort statt und werden im
Campus Management System veröffentlicht. Die IU behält sich sowohl
hinsichtlich des Standorts als auch hinsichtlich der Durchführungsform
der Präsenztermine, Termine, Orte und deren Intervalle Änderungen vor.
Dieses Recht umfasst ebenfalls die Verlagerung der Präsenztermine in
den virtuellen Raum. Eine entsprechende Mitteilung seitens der
Hochschule erfolgt spätestens zwei Wochen vor dem geplanten
Präsenztermin. Mit einer solche Änderung verbundene Kosten
beispielsweise jedoch nicht ausschließlich aufgrund von
Stornogebühren etc. werden nicht durch die Hochschule ersetzt.
Studierende, die mit einem Visum zum Zweck des Lernens an der IU in
Deutschland einreisen, sind verpflichtet, an Präsenzveranstaltungen der
IU, die für den jeweiligen Studiengang vorgeschrieben werden,
teilzunehmen. Die IU führt zur Überprüfung der verpflichtenden
Teilnahme Anwesenheitslisten, die die Studierenden bei jeder
Präsenzveranstaltung unterschreiben müssen.
2. Vert rag slaufzeit
2.1. Vert rag sdauer
Der Vertrag hat die auf Seite 2 des Studienvertrages festgelegte Laufzeit.
Der Vertrag beginnt mit Erhalt des Bestätigungsschreibens durch die IU,
spätestens jedoch mit Erhalt der Zugangsdaten zum Campus
Management System und endet nach der auf Seite 2 des
Studienvertrages festgelegten Vertragslaufzeit, ohne dass es einer
Kündigung bedarf.
Voraussetzung für die Erfüllung der Hochschulzugangsberechtigung an
der IU ist, dass die/der Studierende die Zulassungsvoraussetzungen
gem. des für den Sitz der Hochschule geltenden Hochschulgesetzes in
seiner jeweils gültigen Fassung sowie der Studien- und
Prüfungsordnung der IU erfüllt.
Für sich Bewerbende, die am Virtuellen Campus, d.h. online beginnen
oder kein Visum benötigten, um auf den Campus in Deutschland zu
kommen, und die Dokumente zum Nachweis der
Hochschulzugangsberechtigung und die Dokumente für die Zulassung
zum gewählten Studiengang nach der jeweils gültigen allgemeinen
Zulassungs- und Einschreibungsordnung (AZE) nicht in der
erforderlichen Form vor dem Vertragsbeginn nachweisen kann, wird
vorläufig kostenpflichtig Zugriff auf die Studieninhalte gewährt. Die auf
Seite 1 festgelegte Vertragslaufzeit wird durch die nachträgliche Vorlage
der Dokumente nicht verändert. In diesem Fall ist die/der Studierende
verpflichtet, die Dokumente der IU innerhalb von sechs Monaten nach
dem in 2.1. festgelegten Vertragsstart in der erforderlichen Form
nachzureichen. Erfolgt dies nicht fristgemäß, endet der Studienvertrag
mit Ablauf des sechsten Monats, ohne dass es einer Kündigung bedarf.
Kann der:die Studierende bis zu dem auf Seite 2 des Studienvertrags
angegebenen Anfangsdatum kein gültiges Visum und keine gültige
Aufenthaltsgenehmigung nachweisen oder gibt es andere Gründe, die
den Studienbeginn verschieben, wird der:die Studierende von der IU mit
dem Zulassungsschreiben informiert, wenn der verschobene
Anfangszeitpunkt festgelegt wird. Der im Zulassungsschreiben
angegebene Studienbeginn ist für den/die Studierende/n verbindlich,
solange er:sie sich nicht vor dem Studienbeginn an die IU wendet, um
den Studienbeginn weiter zu verschieben.
2.2. Vert rag sverläng erung weg en fehlender Leist ung snachweise
Erwirbt der:die Studierende nicht alle erforderlichen
Leistungsnachweise innerhalb der auf Seite 2 vereinbarten
Vertragsdauer, kann er:sie in Textform eine kostenpflichtige
Verlängerung des Vertrages beantragen. Für den Zeitraum der
kostenpflichtigen Vertragsverlängerung sind für die Weiterbenutzung
der Einrichtung, Geräte und Angebote der IU Studiengebühren zu
entrichten. Einzelheiten werden in einer gesondert abzuschließenden
Vereinbarung zur Vertragsverlängerung geregelt.
Für den Verlängerungszeitraum gelten die zum Zeitpunkt des
Studienbeginns gültigen online oder On-Campus Gebühren und
Ermäßigungen die im Bestätigungsschreiben festgelegt wurden.
2.3. Ordent liche Kündig ung des Vert rag es
Bis zum Ablauf der ersten fünf Monate kann der Vertrag mit einer Frist
von einem Monat zum Ablauf eines vollen Monats bezogen auf den
Vertragsbeginn gekündigt werden.
Nach Ablauf der ersten fünf Monate kann der Vertrag jederzeit mit einer
Frist von drei Monaten zum Ablauf eines vollen Monats bezogen auf den
Vertragsbeginn gekündigt werden.
Die Kündigung hat in Textform (z.B. per Kündigungsantrag in Campus
Management System oder per E-Mail) zu erfolgen.
2.4. Außerordent liche Kündig ung des Vert rag es
Das Recht zur außerordentlichen Kündigung dieses Vertrages aus
wichtigem Grund bleibt unberührt. Wichtige, zur außerordentlichen
Kündigung berechtigende Gründe auf Seiten des Studierenden liegen
insbesondere bei lebensbedrohlichen Krankheiten sowie bei Tod des

Studierenden vor. Der Studiengangwechsel, ein Umzug, nicht
bestandene Prüfungen, finanzielle oder familiäre Gründe rechtfertigen
grundsätzlich keine außerordentliche Kündigung.
Wenn nach Vertragsschluss die Zulassung für den Studiengang erlischt,
widerrufen oder zurückgenommen wird, kann der Studierende ohne
Einhaltung einer Kündigungsfrist innerhalb von zwei Wochen kündigen.
Auf Seiten der IU können wichtige, zur außerordentlichen Kündigung
berechtigende Gründe insbesondere bestehen bei nicht fristgemäß
bezahlten und ausstehenden Studiengebühren, Verstößen gegen die
Prüfungsordnung der IU, bei kriminellen Handlungen des Studierenden
zulasten der IU, wenn der Teilnehmer nicht alle
Zulassungsvoraussetzungen für den gewählten Studiengang erfüllt und
diese nicht in der erforderlichen Form gemäß der Allgemeinen
Zulassungs- und Immatrikulationsordnung (AZE) nachweisen kann oder
falls absehbar ist, dass eine notwendige (Re)Akkreditierung oder
Zulassung eines Studienprogramms nicht erteilt wird.
2.5. Folg en eines Nicht erreichen der Mindest t eilnehmerzahlen am
g ewählt en Hochschulst andort
Die IU behält sich das Recht vor, einzelne Module des gewählten
Studienprogramms, durch Erklärung in Textform spätestens bis vier
Wochen vor dem Programmstart, in einer virtuellen Variante
(Präsenzveranstaltungen in einem virtuellen Raum) anzubieten, falls bis
zu diesem Zeitpunkt die Mindestteilnehmerzahl von neun (9) für einen
auf dem Deckblatt gewählte Studiengang bei dem jeweiligen
Hochschulstandort nicht erreicht wird.
Des weiteren behält sich die IU vor, von dem Studienvertrag durch
Erklärung in Textform spätestens bis vier Wochen vor dem
Programmstart zurückzutreten, falls bis zu diesem Zeitpunkt die
Mindestteilnehmerzahl von neun (9) für den auf dem Deckblatt
gewählten Studiengang bei dem jeweiligen Hochschulstandort nicht
erreicht wird. Bereits geleistete Vorauszahlungen werden in diesem Falle
vollumfänglich erstattet.
2.6. Beurlaubung
In Fällen von Krankheit oder bei Vorliegen von anderen nachgewiesenen
persönlichen Verhinderungsgründen kann der Studierende eine
Beurlaubung für einen Zeitraum von sechs Monaten beantragen. Die
Beurlaubung kann grundsätzlich frühestens zum Start des zweiten
Semesters, d.h. sechs Monate nach Studienstart erfolgen. Die
beidseitigen Rechte und Pflichten des Vertrages ruhen in diesem Falle
für den Zeitraum der Beurlaubung. Die Verpflichtung zur Zahlung der
gesamten Studiengebühren nach Ziff. 3.1. bleibt auch bei der
Beurlaubung des Studierenden bestehen. Wird dem Studierenden eine
Beurlaubung für einen Zeitraum von sechs Monaten gewährt, sind die
auf Seite 1 dieses Vertrages festgelegten monatlichen Raten über die auf
Seite 1 vereinbarte Vertragsdauer hinaus zu zahlen bis die
Gesamtsumme der nach Seite 1 zu zahlenden Monatsraten vollständig
beglichen ist.
Die Beantragung einer Beurlaubung für einen Zeitraum von sechs
Monaten hat spätestens zwei Wochen vor dem gewünschten Beginn zum
Beginn eines Quartals bezogen auf den Vertragsbeginn in Textform zu
erfolgen. Der Studienvertrag kann während dem Zeitraum einer
gewährten Beurlaubung nicht gekündigt werden. Durch Beantragung
einer Beurlaubung wird das „Merkblatt zum Urlaubssemester“ und/oder
das „Merkblatt zum Urlaubssemester wegen Mutterschutz und/oder
Elternzeit“ Bestandteil des Studienvertrages. Bei Wiederaufnahme des
Studiums nach einer Beurlaubung besteht keine Garantie, dass die im
Curriculum vorgesehen Module zum Zeitpunkt der Wiederaufnahme zur
Verfügung stehen. Es kann daher erforderlich sein, dass das Studium
mindestens zeitweise als reines Onlinestudium fortgeführt werden
muss.
2.7. Nicht best ehen not wendig er Prüfung en
In dem Fall, dass der Studierende die für den erfolgreichen Abschluss
des Studiengangs notwendige Prüfung endgültig nicht besteht, endet
der Unterrichtsvertrag, ohne dass es einer Kündigung bedarf mit
endgültigem Nichtbestehen. In diesem Fall erfolgt die Exmatrikulation
des Studierenden, wenn zu diesem Zeitpunkt der offizielle
Studierendenstatus erreicht war.
3. St udieng ebühren
3.1. St udieng ebühren für das Prog ramm
Die Gesamtkosten für das gewählte Studienprogramm sind im
Bestätigungsschreiben und auf der Seite 2 des Studienvertrages
angegeben.
3.2 St udieng ebühren für das Hybridst udium
Die Gesamtkosten für das Hybridstudium werden auf der Grundlage des
voraussichtlichen Wechseldatums zum Campus berechnet. Während der
virtuellen Studienzeit gelten die Studiengebühren für das virtuelle
Studium an der IU und während der Zeit auf dem Campus gelten die
Studiengebühren auf dem Campus der IU. Die endgültigen Kosten
werden je nachdem Zeitpunkt des Wechsels auf den Campus ermittelt,
was bedeutet, dass die auf Seite 2 des Studienvertrags angegebene
Kostenschätzung auf den dort genannten Zeiträumen im virtuellen
Studium und die Lehre am Campus basiert und von den endgültigen
Kosten abweichen kann.
Hybrid-Studierende, die nicht von einem anderen IU-Produkt zu Hybrid
gewechselt haben oder bereits eine Campus-Einschreibegebühr bezahlt
haben, müssen eine Hybrid-Einschreibegebühr in Höhe von 500 Euro
entrichten, bevor sie an einen Campus-Standort der IU in Deutschland
studieren können. Die Hybrid-Campus-Einschreibegebühr wird
zusammen mit der Zahlung der ersten Campus-Rate der monatlichen
Studiengebühr fällig. Eine Rückerstattung der Hybrid-Campus
Einschreibegebühr ist ausgeschlossen.
Alle Rechnungen für Studiengebühren werden mit einer Zahlungsfrist
von 30 Tagen ausgestellt.
3.3 Zusät zliche Campus-Reg ist rierung sg ebühr
Die/der Studierende ist verpflichtet, eine Campus-Registrierungsgebühr
von insgesamt €1500 zu entrichten, wenn sie/er mindestens ein Quartal
an einem Campus der IU vor Ort in Deutschland präsent ist. Die Gebühr
muss für ein Studium nur einmal bezahlt werden, unabhängig davon,
wie viel Zeit auf dem Campus in Deutschland durchgeführt werden. Die
Campus -Registrierungsgebühr ist jeweils im Voraus für das erste
Quartal, das an einem Campus in Deutschland besucht werden soll, bis
spätestens einen Monat vor dem Beginn des jeweiligen Quartals zu
bezahlen.
Von der Zahlung der Campus-Registrierungsgebühr sind Studierende
ausgenommen, die zu Zeitpunkt der Bewerbung für das Studium die
Staatsangehörigkeit oder einen gültigen Reisepass eines EU-
Mitgliedsstaates besitzen oder über ein gültiges Visum verfügen und
somit rechtlich zum Aufenthalt in Deutschland und zum Studium an
einem deutschen Campus der IU berechtigt sind.
Darüber hinaus müssen Studierende, die das Pathway-Programm
absolviert und bereits die Campus-Registrierungsgebühr bezahlt haben,
keine erneute Campus-Registrierungsgebühr für das "myStudies"-
Programm entrichten. Ebenso sind Studierende, die die Hybrid-
Registrierungsgebühr entrichten müssen, von der Campus-
Registrierungsgebühr befreit.
Die Zahlung der Campus-Registrierungsgebühren hat grundsätzlich
unbar auf das Konto der IU zu erfolgen. Bei Barzahlung behält sich die
IU die Erhebung einer Bearbeitungsgebühr vor.
Der Fortbestand des Interesses der IU an diesem Vertrag ist an die
Rechtzeitigkeit der Zahlung gebunden. Wenn die /der Studierende mit
der Zahlung der Campus-Registrierungsgebühren in Verzug ist, so ist die
IU zur außerordentlichen Kündigung des Vertrages berechtigt.
3.4. Zahlung sweise und Zahlung sfrist
Die Studiengebühren sind monatlich zu zahlen und werden jeweils
nachträglich zum Ende des Monats fällig. Bei einem vorliegendem SEPA-
Lastschriftmandat erfolgt die Abbuchung der Studiengebühren jeweils
nachträglich zum Ende des Monats. Im Übrigen sind die Studierenden
verpflichtet, die Studiengebühren jeweils nachträglich zum Ende des
Monats an die IU zu überweisen. Die Zahlung von Studiengebühren
erfolgt erstmals nach Ablauf der Widerrufsfrist. Die Graduierungsgebühr
ist zum Termin der Abschlussprüfung durch den Studierenden selbst zu
überweisen. Die Graduierungsgebühr wird mit der Anmeldung zur
Abschlussprüfung fällig und ist innerhalb von 14 Tagen zu bezahlen.
Will der Studierende seine Abschlussprüfung vor dem Ende der in Ziff.
2.1. festgelegten Vertragslaufzeit ablegen, müssen die noch bis zum
regulären Ende des Studiums ausstehenden Studiengebühren
vollständig vor dem Termin der Abschlussprüfung beglichen werden.
Änderungen bezüglich der Höhe der Studiengebühren können sich aus
dem zum Zeitpunkt der Anmeldung geltenden Rabattaktionen ergeben.
Für den Fall, dass Studierende sich dazu entschieden haben, die
Studiengebühren für einen gewissen Zeitraum oder vollständig im
Voraus zu bezahlen, kann die Zahlungsweise und die Zahlungsfrist der
Studiengebühren abweichen.
3.5. Anerkennung von Vorleist ung en und Qualifikat ionen
Mit der Erlangung des Studierendenstatus können Vorkenntnisse und
Qualifikationen im Rahmen der Studien- und Prüfungsordnung auf
Antrag anerkannt werden. Eine Anerkennung von Vorkenntnissen und
Qualifikationen hat zur Folge, dass anerkannte Module von dem:der
Studierenden nicht erneut belegt werden müssen. Alle anderen
Parameter des Vertrages bleiben unverändert. Über die Anerkennung
von Vorkenntnissen und Qualifikationen im Rahmen der Studien- und
Prüfungsordnung wird der:die Studierende durch einen
Anerkennungsbescheid informiert.
3.6 Gebührenerst at t ung
Kündigt der:die Bewerbende den Studienvertrag durch ordentliche
Kündigung vor dem auf Seite 2 des Studienvertrages festgelegten
Studienstart, erstattet die IU dem:der Bewerber:in die bereits im Voraus
an die IU gezahlten Studiengebühren vollständig. Eine Erstattung der
bereits gezahlten Campus-Registrierungsgebühren erfolgt in diesem Fall
nicht.
Kündigt der:die Bewerbende den Studienvertrag vor dem auf Seite 2
festgelegten Studienstart außerordentlich gem. Ziffer 2.4 dieses
Studienvertrages, erstattet die IU dem Bewerber alle bereits im Voraus
an die IU gezahlten Studien- und Campusgebühren, abzüglich einer
Bearbeitungsgebühr in Höhe von EUR 500,00. Erfolgt die
außerordentliche Kündigung seitens des:der Studiereden gem. Ziffer 2.4

nach Studienbeginn, werden im durch die IU anteilig die bereits im
Voraus für das Studium gezahlten Gebühren erstattet. Eine Erstattung
der bereits gezahlten Campus-Registrierungsgebühren erfolgt in diesem
Fall nicht.
Kündigt die IU den Studienvertrag gegenüber dem:der Studierenden
außerordentlich gem. Ziffer 2.4 werden dem Studierenden anteilig die
im Voraus bezahlten Studiengebühren zurückerstattet. Die bereits
gezahlten Campusgebühren werden dem:der Studierenden in diesem
Fall weder anteilig noch vollständig erstattet.
4. Pflicht en des St udierenden
4.1. Zahlung der St udieng ebühren
Falls die Studiengebühren nicht zum Fälligkeitszeitpunkt bezahlt sind, ist
die IU berechtigt, eventuell anfallende Gebühren dem Studierenden in
Rechnung zu stellen. Unabhängig davon ist die IU zur außerordentlichen
Kündigung des Vertrages berechtigt, wenn der Studierende mit der
Zahlung der Studiengebühren in Verzug ist. Entscheidet sich der
Studierende vor Beginn des Studiums für eine Vorauszahlung, so
besteht nur Anspruch auf die Gewährung eines Vorauszahlungsrabattes,
wenn der Zahlungsbetrag bis zum Ablauf des Widerrufsrechts auf dem
Konto der IU eingegangen ist.
4.2. Prüfung en
Muss der Studierende aufgrund eines Täuschungsversuches oder
Plagiats eine Prüfungsleistung wiederholen, fallen zusätzliche Gebühren
in Höhe von EUR 300 je zu wiederholender Prüfungsleistung an.
Innerhalb von 24 Monaten nach Belegung des entsprechenden Kurses
muss der Studierende die entsprechende, im Modulhandbuch
festgelegte Prüfungsleistung, zumindest jedoch den ersten
Prüfungsversuch, erbringen. Erbringt der Studierende diese
Prüfungsleistung oder den ersten Prüfungsversuch nicht innerhalb von
24 Monaten nach Belegung des Kurses, so verfallen alle bis dahin
erbrachten Lernkontrollen mit der Folge, dass diese innerhalb von 12
Monaten neu zu erbringen sind und der Kurs kostenpflichtig neu zu
belegen ist.
4.3. Erbring ung von St udienleist ung en mit t els Online-Tools
Die Erbringung von Studienleistungen in bestimmten Modulen bzw.
Kursen kann teilweise nur durch die Nutzung von Online-Tools erfolgen,
die eine Datenverarbeitung auch außerhalb der EU erfordern. Die
Einzelheiten zur Datenverarbeitung sind in gesonderten
Informationsblättern erläutert.
4.4. Überprüfung mit t els Plag iat ssoftware
Der Studierende ist verpflichtet, eine elektronische Fassung seiner
Prüfungsarbeiten in elektronisch kopier- und lesbarem Format (z.B. DOC,
DOCX, PDF, RTF) frei von allen personenbezogenen Daten (ohne
Deckblatt, persönliche Erklärungen, Widmungen, Unterschrift etc.) zur
Ermöglichung einer Überprüfung seiner Prüfungsarbeit mittels einer
Plagiatssoftware durch die IU zur Verfügung zu stellen. Der Studierende
räumt der IU und eigens hierzu von ihr beauftragten Dritten das Recht
ein, die Prüfungsarbeit für diesen Zweck zu nutzen.
4.5. Wahrung des Urheberrecht s
Sämtliche Studieninhalte- und Medien sind urheberrechtlich geschützt.
Jede Nutzung in anderen als den vertraglich zugelassenen Fällen ist
nicht erlaubt und bedarf der vorherigen schriftlichen Genehmigung des
Rechteinhabers. Dies gilt insbesondere für das öffentliche
Zugänglichmachen via Internet, die Vervielfältigung und Weitergabe an
Dritte. Zulässig ist das Speichern und Ausdrucken der Studieninhalte-
und Medien für persönliche Zwecke.
4.6. Weit ere Pflicht en
Der Studierende erkennt die jeweils gültige Allgemeine
Prüfungsordnung sowie die Studien- und Prüfungsordnung für den auf
Seite 1 des Studienvertrages benannten Studiengang der IU, die
Nutzungsordnung der IU für die Bibliothek und die Richtlinien für
Online- Klausuren und die Richtlinien für Online– Präsentationen als für
sich verbindlich an.
5. Virt ueller Campus und dig it ales Lehrmat erial
Zentrale Lernprozesse im Studium sowie die Studienorganisation
werden online über das Campus Management System der IU
abgewickelt. Die Bereitstellung der notwendigen technischen Geräte ist
in den Studiengebühren nicht enthalten. Der/die Studierende ist
verpflichtet, sich selbständig darüber zu informieren, ob ihm/ihr die von
der IU eingesetzten Online-Tools und sonstige Technik, die für die
Durchführung des Studienvertrages notwendig sind, in seinem/ihrem
Land zur Verfügung stehen. Eine Übersicht über die notwendigen
Online-Tools und die erforderliche technische Studienausstattung (Soft-
und Hardware) können hier (https://www.iu.org/start-studying/)
eingesehen werden. Der/die Studierende ist selbst dafür verantwortlich,
dass die technische Ausstattung (Hard- und Software) seiner/ihrer Wahl
mit den Anforderungen der IU kompatibel ist. Der virtuelle Campus der
IU ist passwortgeschützt. Die Zugangsdaten werden dem Studierenden
zu Beginn des Studiums mitgeteilt und er sichert zu, diese Daten nicht
an Dritte weiterzugeben und unberechtigten Dritten keinen Zugriff auf
den virtuellen Campus oder auf die Lernmaterialien des Studiengangs
zu ermöglichen.
6. Zusat zhinweis zum Aufent halt st it el und VISUM für Nicht-EU
St aat sbürg er
Dem:der Studierenden ist bekannt, dass ein Visum und eine
Aufenthaltsgenehmigung erforderlich sind, um an einem Campus der IU
in Deutschland für die Dauer des Studiums studieren zu können, wenn
sie keine Bürger:in eines EU Mitgliedsstaates sind. Beides muss bei der
Einreise vorliegen und der IU gegenüber der Nachweis erbracht werden,
dass der:die Studierende zum Aufenthalt und zur Aufnahme des
Studiums in Deutschland berechtigt ist. Auf die rechtlichen Formalitäten
für ausländische Studierende wurde der:die Studierende hingewiesen.
Dem:der Studierenden ist bewusst, dass er für die Einhaltung dieser
Formalitäten und die Vorlage der entsprechenden Unterlagen selbst
verantwortlich ist. Dies gilt ebenfalls für eine etwaig benötigte
Verlängerung seines:ihres Studierendenvisums.
Falls er:sie kein gültiges Visum und/oder keine gültige
Aufenthaltsgenehmigung nachweisen kann, ist die IU zum Rücktritt vom
Studienvertrag berechtigt. Der:die Bewerbende kann dann nicht
eingeschrieben werden und folglich nicht am Campus teilnehmen. Der
Student kann dann sein Studium online weiterführen.
Falls der:die Studierende sich für ein Studium an einem Campus der IU
in Deutschland angemeldet hat und das Visum seitens der zuständigen
Behörde abgelehnt wird, kann der:die Studierende vom Vertrag
zurücktreten, sofern es sich um das erste Fachsemester des
zugrundeliegenden Studiums handelt. Bei einem Versagen der
Erneuerung/Verlängerung des Aufenthaltstitels in einem späteren
Fachsemester besteht kein Rücktritts- bzw. Sonderkündigungsrecht
bezogen auf den Studienvertrag. Das Studium kann in diesem Fall als
reines Online-Studium fortgesetzt werden.
Voraussetzung dafür ist, dass der:die Studierende das VISA-
Antragsverfahren in Gutem Glauben betrieben hat und dies durch die
Vorlage geeigneter Dokumente nachweist. Falls der/die Studierende
diese Pflicht nicht erfüllt, besteht kein Anspruch auf Rückzahlung der
bereits gezahlten Campus-Registrierungsgebühr.
Unter diesen Voraussetzungen erhält er/sie die bis dahin gezahlte
Campus-Registrierungsgebühr und Studiengebühren abzüglich einer
Bearbeitungsgebühr von 500,- € zurück. Bei einer Ablehnung des Visums
wird der Studierende der IU alle Unterlagen zusenden, die bei der
deutschen Botschaft eingereicht wurden.
7. Weit ere Informat ionen zu On-Campus in Deut schland
7.1 Semest ert icket
Für volle Semester, in denen die/der Studierende an einem Campus der
IU in Deutschland besucht, ist die/der Studierende verpflichtet, das
Semesterticket des öffentlichen Verkehrsverbundes am jeweiligen
Hochschulstandort abzunehmen. Dies gilt nur, wenn und solange es am
Hochschulstandort ein Semesterticket gibt. Die Kosten für das
Semesterticket sind jeweils im Voraus für ein Semester bis spätestens
einen Monat vor Beginn eines Semesters zu bezahlen. Die jeweiligen
Kosten legt der Verkehrsverbund jährlich fest. Die aktuellen Preise

Die rechtzeitige Bezahlung des Semestertickets gilt während der
regulären Vertragslaufzeit als Rückmeldung für das jeweilige Semester
und ist Voraussetzung für die Aushändigung der
Studienbescheinigungen. Bei einigen Studiengängen ist der Studienstart
vier mal pro Jahr möglich, also auch zur Mitte eines Sommer- oder
Wintersemesters. Wenn die/der Studierende in der Mitte eines Sommer-
oder Wintersemesters das Studium aufnimmt, kann sie/er bestimmen,
ob sie/er das Ticket rückwirkend für das gesamte Semester beziehen
möchte, oder das Ticket erst ab dem nächsten Semester bezieht. Im Falle
einer Entscheidung für die Inanspruchnahme des Semestertickets ist
der volle Semesterbeitrag zu entrichten.
7.2 Nut zung der Einricht ung en des St udent enwerks Berlin (Campus Berlin)
Jeder Studierende am Campus Berlin ist verpflichtet pro Semester einen
Beitrag für die Nutzung der Einrichtungen des Studentenwerks zu
zahlen. Dieser Betrag wird zusätzlich zu den regulär zu zahlenden
Studiengebühren in Rechnung gestellt und ist spätestens einen Monat
vor Beginn des jeweiligen Semesters fällig. Die aktuellen Preise können

Wird die Höhe der Sozialbeiträge durch die Senatsverwaltung geändert,
so erfolgt eine entsprechende Anpassung des vorgenannten Betrages.
Der Umfang der Nutzung der Einrichtungen richtet sich nach den
Kapazitäten des Studentenwerks. Die IU hat hierauf keinen Einfluss.
Sofern aufgrund der Auslastung Einrichtungen des Studentenwerks
nicht verfügbar sind, oder das Studentenwerk zum Vertragsschluss
bestehende Einrichtungen schließt, besteht kein Anspruch auf Ersatz
jeglicher Art oder Minderung des zu zahlenden Beitrags.
7.3 Campus Card Bad Honnef (für St udierende auf Bad Honnef)
Studierende des Campus Bad Honnef sind berechtigt, einmalig
Leistungen Ihrer Wahl in allen gastronomischen Einrichtungen auf dem
Campus in Bad Honnef bis zu einem Betrag in Höhe von 100,00 EUR in
Anspruch zu nehmen. Das Angebot hängt von der Ausstattung des
Campus und der Verfügbarkeit der gastronomischen Einrichtungen ab.

Eine Auszahlung dieses Betrages ist nicht möglich. Für die
Inanspruchnahme der Leistungen der gastronomischen Einrichtungen
benötigen die Studierenden eine Campus Card. Die zu hinterlegende
Kaution für die Campus Card beträgt 10 ,- EUR.
7.4 Weit ere Pflicht en
Der Studierende erkennt die jeweils geltenden Campusregeln sowie die
Bibliotheksbenutzungsordnung der IU (LIS-Ordnung)) und die jeweils
gültige Allgemeine Prüfungsordnung sowie die Studien- und
Prüfungsordnung der IU für den genannten Studiengang als für sich
verbindlich an.
Anwesenheit:
Für Studierende, die mit einem Visum zu Studienzwecken nach
Deutschland einreisen, ist die Teilnahme an den
Präsenzveranstaltungen verpflichtend. Zur Kontrolle wird eine interne
Anwesenheitsliste geführt.
Notebook:
Für das Studium benötigen Studierende ein Notebook mit WLan Funktion
in einer Konfiguration, die eine Installation von Microsoft Office 365,
Zoom und andere aktuelle Produktivitäts-Anwendungen zulässt. Um an
den Lehrveranstaltungen erfolgreich teilnehmen zu können, ist es
darüber hinaus notwendig, dass das Notebook in das Funknetzwerk der
IU integriert ist.
Internetzugang:
Studierende benötigen einen externen jederzeit verfügbaren
Internetzugang, um eine vollständige Nutzung der elektronischen
Ressourcen der IU und der Bibliothek sowie die Kommunikation mit der
Verwaltung der IU zu gewährleisten. Studierende sind verpflichtet,
regelmäßig ihren Email Eingang zu ihrer von der IU eingerichteten
Email-Adresse zu prüfen sowie die Nachrichten im Intranet der IU
Campus Management System zu lesen.
8. Widerrufsrecht
Der Studierende hat das Recht, diesen Vertrag binnen eines Monats
ohne Angabe von Gründen zu widerrufen. Die Widerrufsfrist beträgt
einen Monat ab dem Tag des Vertragsabschlusses. Um das
Widerrufsrecht auszuüben, muss der Studierende die IU mittels einer
eindeutigen Erklärung (z. B. ein mit der Post versandter Brief, ein Telefax
oder eine E-Mail) über seinen Entschluss, diesen Vertrag zu widerrufen,
informieren. Es gibt ein digitales Muster-Widerrufsformular, das hierfür
verwendet werden kann (aber nicht vorgeschrieben ist), das über das
Campus-Management-System oder über den folgenden Link abgerufen
werden kann. Zur Wahrung der Widerrufsfrist reicht es aus, dass er die
Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der
Widerrufsfrist absendet.
9. Dat enschut z
Die Einzelheiten zur Verarbeitung personenbezogener Daten und die
Rechte des Studierenden in diesem Zusammenhang sind in dem
gesonderten Informationsschreiben zum Datenschutz erklärt, welches
den Studierenden auf der Homepage der IU zugänglich gemacht wird.
Die IU verwendet zur Durchführung des Studienvertrags Software
verschiedener Anbieter, durch die eine Verarbeitung von
personenbezogenen Daten auch außerhalb der Europäischen Union
erfolgt. Der Studierende willigt ein, dass die IU im erforderlichen Umfang
persönliche Daten, die sich aus den Antragsunterlagen oder der
Vertragsdurchführung ergeben, speichert, erhebt und verarbeitet.
Ferner erklärt sich der Studierende damit einverstanden, dass in
gesetzlich festgelegten Fällen seine Daten an die zuständigen Behörden
weitergeleitet werden.
10. Haftung der IU
Die IU haftet für Schäden, die auf einer vorsätzlichen oder grob
fahrlässigen Pflichtverletzung eines ihrer gesetzlichen Vertreter oder
Erfüllungsgehilfen beruhen. Die IU haftet weiterhin für Schäden aus der
Verletzung des Lebens, des Körpers oder der Gesundheit, die auf einer
vorsätzlichen oder fahrlässigen Pflichtverletzung eines ihrer gesetzlichen
Vertreter oder Erfüllungsgehilfen beruhen. Im Übrigen ist die Haftung
für Schäden, die auf einer einfach oder leicht fahrlässigen
Pflichtverletzung oder einer einfach oder leicht fahrlässig begangenen
unerlaubten Handlung eines gesetzlichen Vertreters oder
Erfüllungsgehilfen beruhen, ausgeschlossen, es sei denn, es sind
wesentliche Pflichten verletzt, deren Einhaltung zur Erreichung des
Vertragszweckes geboten ist oder die aus berechtigter
Inanspruchnahme besonderen Vertrauens erwachsen. In diesen
Ausnahmefällen ist die Haftung auf den Ersatz vorhersehbarer Schäden
beschränkt.
11. Gericht sst and und Schlussbest immung en
Für alle Ansprüche aus und im Zusammenhang mit diesem Vertrag gilt
deutsches Recht.
Für den Fall, in dem der Studierende nach Vertragsschluss seinen
Wohnsitz oder gewöhnlichen Aufenthalt aus der Bundesrepublik
Deutschland verlegt oder sein Wohnsitz oder gewöhnlicher Aufenthalt
im Zeitpunkt der Klageerhebung nicht bekannt ist, wird gemäß § 38 (3)
ZPO für alle Streitigkeiten aus oder im Zusammenhang mit diesem
Vertrag die Zuständigkeit des für den Sitz der IU zuständigen deutschen
Gerichts vereinbart (Amtsgericht Erfurt, Landgericht Erfurt).
Für jene Personen die zum Vertragsschluss sowie während des
Vertragszeitraumes über keinen Gerichtsstand in der Bundesrepublik
Deutschland verfügen wird gemäß §38 (2) ZPO ebenfalls die
Zuständigkeit des für den Sitz der IU zuständigen Gerichts vereinbart
(Amtsgericht Erfurt, Landesgericht Erfurt).
Für Zeiträume in welchen die betreffende Person beispielsweise
aufgrund der Absolvierung eines Präsenzsemesters über einen Wohnsitz
oder Ort des gewöhnlichen Aufenthalts in der Bundesrepublik
Deutschland verfügt, entfaltet diese Gerichtsstandvereinbarung keine
Wirkung.
Die IU beteiligt sich nicht an einem Streitbeilegungsverfahren im Sinne
des Verbraucherstreitbeilegungsgesetzes (VSBG).
Die IU hat entsprechend den gesetzlichen Vorgaben eine
privatwirtschaftliche Bürgschaft gestellt, welche unabhängig von der
wirtschaftlichen Lage des Trägers, allen Studierenden den Abschluss
ihres Studiums garantiert. Aus rechtlichen Gründen weisen wir darauf
hin, dass der Freistaat Thüringen keine zusätzliche Sicherung gewährt.
Nebenabreden zu diesem Vertrag bestehen nicht. Änderungen oder
Ergänzungen dieses Vertrages bedürfen zur Wirksamkeit der Textform.
Auch die Änderung oder Ergänzung dieser Bestimmung selbst bedarf
der Textform. Sollten einzelne oder mehrere Bestimmungen dieses
Vertrages unwirksam sein oder werden, bleibt die Wirksamkeit der
übrigen Bestimmungen davon unberührt. Im Fall einer Lücke dieses
Vertrages ist eine Regelung zu finden, die dem Sinn, Zweck und
wirtschaftlichen Gehalt des Vertrages im Übrigen entspricht.
Die englische Version dieses Vertrages ist ausschließlich eine keine
Bindungswirkung entfaltende Übersetzung, welche lediglich zur
Information vorgelegt wird. Bei dem in deutscher Sprache verfassten
Vertrag handelt es sich um den beide Parteien bindenden
Vertragswortlaut.

General terms and conditions
The English version of the terms and conditions is a non-binding
translation of the original, binding German terms and conditions
1. Conduct ing t he st udy prog ramme
1.1. Prog ramme Desig nat ion and Deg ree
The IU Internationale Hochschule (hereafter: IU) hereby commits itself to
conducting the "myStudies" study programme mentioned on page 1 of
the study contract in accordance with the currently valid study and
examination regulations. For participants and for the period in which the
participant does not yet have official student status, the currently valid
study and examination regulations of the underlying source study
program apply. The contract is concluded by IU’s acceptance in the form
of a confirmation letter, or at the latest on the day on which the
participant receives access to the teaching materials.
Upon successful completion of the myStudies programme, according to
the currently valid study and examination regulations, the student
acquires the academic degree based on the chosen study programme.
The content of the offered courses, as well as the respective time frame
provided, are derived from the module handbook and curriculum, which
is made available to the student in an accessible form.
IU points out that in the case of newly introduced degree programmes,
there may be a restriction regarding availability of study content from
higher subject semesters. Nevertheless, IU guarantees that the contents
of the respective study programmes can be completed within the
underlying standard period of study.
1.2. Chang es t o t he Course Plan
IU has the right to carry out organisational and academic changes in its
study programmes; to modify study plans or redistribute modules
(whether on-campus or online), provided that these changes do not alter
or harm the goal of the study programme.
1.3. Admission t o t he St udy Prog ramme
Enrolment and admission to studies shall be in accordance with the
provisions of the Admission Examination Regulations (AZE), and other
applicable regulations of the IU, that are in force at the time.
Applicants who start their studies virtually begin their studies with the
status of a participant and become enrolled students once they have
successfully completed up to 50 percent of the credit points (Credits)
required for graduation from the chosen program, as well as fulfilled all
admission requirements and submitted all required documents in
accordance with the Admission Examination Regulations (AZE). With
participant status, the applicant will not formally gain ECTS credits until
the student status is achieved. Once the student status is achieved, all
examination achievements previously taken in participant status are
fully recognised as part of the study programme and ECTS credits will be
gained for these achievements accordingly.
Student status is a requirement to come on campus. Applicants who
begin virtually and fulfil all admission requirements and have submitted
all required documents in accordance with the General Enrolment and
Admission Regulations (AZE) and the "Regulations for Examinations for
Admission to Bachelor's and Master's Programs (OZBM)” may obtain
student status prior to completing 50 percent of the credits while in
participant status should they decide to transfer on campus before
reaching the 50 percent credit completion rate.
To obtain a student visa, additional country-specific requirements may
also apply from the issuing authorities.
Applicants who begin virtually but who do not meet all admission
requirements and who have not submitted all required documents in
accordance with the General Enrolment and Admission Regulations (AZE)
and the "Regulations for Examinations for Admission to Bachelor's and
Master's Programs (OZBM)” may not be eligible for a student visa and
therefore cannot transfer to a campus in Germany.
The provisions of this contract also apply to those with a participant
status, even if the term “student” is used.
During each semester that is carried out on-campus in Germany, the
student is obligated to be insured by a statutory German health
insurance provider. The proof of such health insurance, or a legal
exemption from it, must be provided by the student.
1.4. In-Person Seminars
The corresponding dates for the in-person seminars are usually based
on the model and location selected on page 1 and are published in the
Campus Management System. IU reserves the right to make changes
both in regard to the location and the implementation of the dates,
locations, and intervals of the attendance appointments. This right also
includes the relocation of in-person appointments to an online setting.
In such cases, the university will notify the student at least two weeks
before the planned attendance date. The university will not reimburse
costs associated with such changes.
Students who enter Germany with a visa for the purpose of attending IU
are required to attend in-person seminars at IU that are prescribed for
the respective degree programme. In order to verify the obligatory
attendance, the IU keeps attendance lists, which the students are
obliged to sign at each attendance event.
2. Cont ract Durat ion
2.1. Cont ract Durat ion
The contract has a defined duration, which is stated on page 2 of the
study contract. The contract starts based on the receiving of a
confirmation letter, or at the latest upon receiving the access data to the
Campus Management System, and ends after the duration stated on
page 2, without any need for a notice of termination.
In order to fulfil the university application qualification requirements at
IU, the student must meet both the admission requirements set by the
higher education law (which applies to the seat of the university in its
currently valid version), as well as the study and examination regulation
set by IU.
For applicants who begin their studies in the virtual campus, meaning
online, or who are not required to obtain a visa in order to come on
campus in Germany: if they cannot provide the documents proving their
university entrance qualification, as well as the documents proving their
eligibility for admission to their chosen study programme according to
the General Admission and Enrolment Regulations (AZE) before the start
of their study contract period, access to the programme study materials
will be granted on a temporary basis and tuition charges apply. This
does not alter the contract period as stated on page 2 of the study
contract. In such case, however, the student must submit his/her
aforementioned documents to IU within six months of the date specified
in section 2.1., in the form required by the university. If this is not done
in this specified timeframe, the study contract ends at the end of the
sixth month without the need for notice.
If the student is unable to provide proof of a valid visa and a residence
permit by the start date specified on page 2 of the study contract or if
there are other reasons that postpone the start of studies, the student
will be informed by the IU with the Letter of Admission when the
deferred start date is set. The study start date specified in the Letter of
Admission is binding for the student as long as he/she does not contact
IU before the study start date to further postpone the study start date.
2.2. Cont ract Ext ension for St udent s Lacking Performance Records
If the student does not acquire all the required credits within the
contract period agreed upon on page 2, the student may request a fee-
based contract extension. During the fee-based extension period, tuition
fees must be paid in return for the continued use of IU’s facilities,
equipment, offers, and services. Details are regulated by a separate
agreement to be finalized for the contract extension.
The online or on campus tuition fees and discounts that were valid at
the time of the start of the study programme and specified in the
confirmation letter will apply to the extension period.
2.3. Ordinary Terminat ion of t he Cont ract
During the first five months the contract can be terminated with a notice
period of one month to the end of a full month in relation to the
beginning of the contract.
After the end of the first five months, the contract may be terminated at
any time with three months' notice to the end of a full month in relation
to the starting date of the contract.
Notice of termination must be given in text form (e.g. by request for
termination in the Campus Management System or by e-mail).
2.4. Immediat e Terminat ion of Cont ract
The right to an immediate termination of the contract for a reasonable
cause remains unaffected. Important, justified causes for the student to
qualify for immediate termination particularly include life-threatening
illnesses as well as the death of a student. A change in the study
programme, relocation, failed exams, financial or family reasons are not
justified causes for immediate termination.
If, after conclusion of the contract, admission to the program expires, is
revoked, or gets cancelled, the student can terminate the contract within
two weeks without observing a notice period.
Justified causes for IU to qualify for immediate termination may include
tuition fees tuition fees not paid on time and outstanding, breaches of
IU's examination regulations, criminal acts of the student at the expense
of IU, if the participant does not meet all admission requirements for the
chosen study program and is unable to provide evidence of these in the
required form in accordance with the General Admission and Enrolment
Regulations (AZE), or if it is foreseeable that a necessary (re)accreditation
or approval of a study program will not be granted.
2.5. Consequences of Not Reaching t he Minimum Number of Required
Part icipant s at t he Chosen Campus Locat ion
IU reserves the right to move specific modules to a virtual format (in-
person lectures in a virtual campus), with declaration in text form

provided to students no later than four weeks before the start of the
programme. This might occur if, up to that point, the minimum number
of participants (nine – 9) for a selected study programme is not reached
at the respective campus location.
Furthermore, IU reserves the right to terminate the study contract, by a
declaration in text form provided no later than four weeks before the
start of the programme, if, up to that point, the minimum number of
participants (nine – 9) for a selected study programme is not reached at
the selected campus location. Prepayments already made will be fully
reimbursed in such cases.
2.6. Leave of Absence
In the case of illness or for other proven personal reasons, students may
apply for a leave of absence for a period of six months. In principle, the
leave of absence can take place at the beginning of the second semester
at the earliest, that is six months after the study start. The bilateral
rights and obligations of this contract lapse in this case for the duration
of the leave of absence. The obligation to pay the total tuition fees in
accordance with section 3.1 remains in place after the granting of the
leave of absence to the student. If a six months’ leave of absence is
granted to the student, the monthly rates stated on page 2 of the
contract must be paid beyond the agreed duration of the contract, stated
on page 2, until the total amount of the monthly fees stated on page 2
are paid in full.
To request a six-month leave of absence, a written application must be
made. This application needs to be presented a minimum of two weeks
prior to the commencement of the quarter. The study contract cannot be
terminated during a granted leave of absence. When applying for a leave
of absence, the “Information for a leave of absence” and/or the
“Information for a leave of absence due to maternity leave or parental
leave” becomes an integral part of the study contract. With the
resumption of studying following a leave of absence, there is no
guarantee made by IU that the modules described in the programme
handbook or curriculum will be available again to the student. It is
therefore possible that the studies carried out following a leave of
absence will be, at least temporarily, purely on an online basis.
2.7. Failing Essent ial Examinat ions
In the event that a student definitively fails an exam required for the
successfully completion of the study programme, the teaching contract
ends, without having to be terminated upon final failure.
In such cases, the student will be deregistered.
3. Tuit ion Fees
3.1. Tuit ion fees for t he st udy prog ramme
The total costs for the chosen study programme are stated in the
confirmation letter and on page 2 of the study contract.
3.2 Hybrid St udy Fees
Total costs for hybrid studies are calculated based on the estimated
transfer date to campus. During the virtual study time, the virtual tuition
fees apply and during the time on campus, campus tuition fees apply.
Final costs are determined according to when the transfer to campus
happens, meaning that the cost estimate listed on page 2 of the study
contract may differ from the final cost.
Hybrid students who have not made a switch from another IU product to
Hybrid or have not already paid a Campus Registration Fee are required
to pay a Hybrid Registration Fee of 500 Euros prior to attending a study
on any campus location at IU in Germany. Hybrid students are required
to pay a Hybrid Registration Fee of 500 Euros prior to attending any
campus location at IU in Germany. The fee will be issued along with the
initial payment of the first monthly campus tuition fee. Reimbursement
of the Hybrid Registration fee is excluded. All tuition invoices are
generated with a 30-day payment deadline.
3.3. Addit ional Campus Reg ist rat ion Fee
The student is required to pay a campus registration fee of €1500 if
he/she attends at least one quarter on-campus in Germany. The fee
must only be paid once, regardless of how much time is taken on
campus in Germany. The campus registration fee must be paid out to IU
in advance, no later than one month before the beginning of the
planned start on campus.
Students are exempt from paying the campus registration fee if, at the
time of application for study, they hold the citizenship or a valid passport
of an EU member state or have a valid visa and are therefore legally
entitled to reside in Germany and study at a German campus of IU.
Additionally, students who have completed the Pathway Programme and
have already paid the campus registration fee, do not have to pay the
campus registration fee again for the "myStudies" programme. Hybrid
students who are enrolled in Hybrid from their first semester and have
not made a switch from another IU product to Hybrid are also exempt
from the campus registration fee.
The payment must be made cashless to the IU account. In case of a cash
payment, IU reserves the right to charge a processing fee.
The upholding of this contract by IU is dependent on the timely payment
of the campus registration fee by the student. If the student defaults on
his/her campus registration fee, IU is entitled to terminate the contract
immediately.
3.4. Payment Met hod and Payment Period
The tuition fees are payable monthly and are due at the end of each
month. If a SEPA direct debit mandate is in place, the tuition fees will be
debited retrospectively at the end of each month. Otherwise, students
are obliged to transfer the tuition fees to IU retrospectively at the end of
each month. Payment of tuition fees shall be made for the first time after
expiry of the withdrawal period. The graduation fee must be paid by the
student by the date of the final exam. The graduation fee is due upon
registration for the final examination and has to be paid within fourteen
(14) days after registering for the final examination. If the student wants
to take the final examination before the end of the contract duration
decided upon in section 2.1. of this contract, the outstanding tuition fees
until the regular end of the study programme have to be paid in full
before the date of the final exam. Variations in the amount of tuition fees
may be the result of discount campaigns in effect at the time of
registration.
In the event that students have chosen to pay tuition fees for a certain
period of time or in full in advance, the method and period of payment
of tuition fees may differ.
3.5. Recog nit ion of Prior Learning and Qualificat ion
Upon application and receiving student status, prior learning and
qualifications can be recognized within the framework of the study and
examination regulations. The purpose of recognition of prior learning
and qualifications is that recognized modules do not need to be taken
again by the student. All other parameters of the contract remain
unchanged. The student will be informed about recognition of prior
knowledge and qualifications within the framework of the study and
examination regulations by means of a notice of recognition.
3.6 Refund Policy
If the applicant cancels the study contract by ordinary termination prior
to the start of the study period specified on page 2, IU shall refund to the
applicant all tuition fees already paid to IU in advance. A refund of the
campus registration fee will not be made in these cases.
If the applicant terminates the study contract extraordinarily in
accordance with §2.4 prior to the start of studies specified on page 2, IU
shall refund to the Applicant all campus registration and tuition fees
already paid in advance to IU minus a processing fee of EUR 500.00 in
total. If the extraordinary termination on the part of the student
according to §2.4 takes place after the start of the study programme,
he/she will receive a pro-rata refund of the fees already paid in advance
for the study programme. In this case, the campus registration fee will
not be refunded.
If the IU terminates the study contract with the student extraordinarily
according to §2.4, the same applies with the difference that in these
cases the IU will not refund the campus registration fee.
4. Dut ies of t he St udent
4.1. Paying t he Tuit ion Fees
If the tuition fees are not paid by the due date, IU is entitled to charge
the student for any fees incurred. Irrespective of this, IU is entitled to
extraordinary termination of the study contract if the student is delayed
with the payment of the tuition fees. If the student decides to make a
partial or full prepayment of tuition fees prior to the start of studies, the
student is only entitled to a prepayment discount if the full amount of
the respective prepayment of tuition fees has been received in an IU
account before the expiration of the right of withdrawal.
4.2. Exams
If the student has to repeat an examination due to attempted cheating
or plagiarism, an additional payment of €300 incurs for every
examination that has to be retaken.
Within 24 months of enrolling in the corresponding course, the student
must take the respective examination listed in the module handbook,
even if just as a first attempt. If the student does not take the
examination or even attempt them for the first time within the 24
months after taking the course, all assessments taken up until then are
void and have to be taken again within 12 months. Furthermore, the
course will have to be taken again, which is subject to charges.
4.3. Consent t o Submit Academic Achievement s via Online-Tools
In some cases, the submission of academic achievements within certain
modules or courses has to be undertaken via the usage of online tools,
which need to process data also outside of the EU. The details of the
data processing are explained in separate information sheets.
4.4. Verificat ion by Plag iarism Software
The student is obligated to provide an electronic version of his/her
examination in a format that can be electronically copied and read (e.g.
DOC, DOCX, PDF, RTF) and must not contain any personal details (without
cover sheet, personal declarations, dedications, signature, etc.) in order
to allow IU to check his/her examination paper using plagiarism
software. The student grants IU and third parties specifically authorized
by IU the right to use the examination paper for this purpose.

4.5. Copyrig ht Prot ect ion
All study content and media are protected by copyright laws. Any use for
purposes other than contractually permitted is prohibited and requires
the prior written consent of the copyright owner. This applies in
particular to making these available via the internet, duplication and
sharing to third parties. Saving and printing the study content and
media for personal purposes is permitted.
4.6. Ot her Dut ies
The student agrees to be bound by the valid General Examination
Regulations as well as IU’s study and examination regulations of the
study programme stated on page 2, the IU library user code (LIS Rules
and Regulations) and the guidelines for online-examinations and online-
presentations.
5. Virt ual Campus and Dig it al Learning Mat erials
The central learning processes and the organisation of the study
programme will be handled online via the Campus Management
platform. IU does not provide students the required technical
equipment, and it is not included in the course fees. The student is
solely responsible for providing technical study equipment (hard- and
software) of her/his choice which needs to be compatible with IU’s
requirements, and is obligated to independently verify if the online tools
and technology utilized by IU, which are necessary for the execution of
the study contract, are available in their country. An overview of the
necessary online tools and the necessary technical equipment (software
and hardware) can be viewed here: https://www.iu.org/start-studying/.
IU’s virtual campus is password protected. The login details will be given
to the student at the beginning of his/her study programme, and (s)he
must ensure that (s)he does not give these details to others. The student
has to make sure that unauthorised third parties cannot access the
virtual campus or the programme’s learning materials.
6. Informat ion Reg arding t he Residence Permit and Visa for Non-EU
cit izens
The student is made aware that a visa and residence permit are
required in order to attend one of IU’s campuses in Germany for the
duration of the studies, if they are not a citizen of an EU member state.
This visa must be obtained before arriving in Germany, and proof must
be provided to IU that the student is entitled to stay and study in
Germany. The student has been informed of the legal formalities for
foreign students.
The student is aware that she/he is solely responsible for complying with
these formalities, and for submitting all required relevant documents;
this also applies to any extension of his/her visa (or another form of
residence permit) that may be required.
If he/she cannot provide proof of a valid visa and/or residence permit,
the IU is entitled to withdraw from the study contract. An applicant
without a valid visa or residence permit therefore cannot be enrolled to
an on-campus semester, and consequently cannot attend on-campus.
The student can then continue his/her studies online.
If the student has enrolled at an IU campus in Germany, and their visa
request is denied by the authorities or official service providers, the
student can withdraw from the contract if it is the first semester of the
study programme. If the visa or residence permit is revoked, or not
extended, during a later study semester, there is no right of withdrawal
or extraordinary termination of the study contract; in this case, the study
programme can be continued fully online.
The prerequisite for this is that the student has carried out the visa
application process in good faith and can prove this by submitting the
application documents to IU if requested to do so. If the student does
not fulfil this obligation, there is no entitlement to a refund of the
campus registration fee.
Under these conditions, the student will receive the campus registration
fee and tuition fees paid up to that point, minus a processing fee of
€500. If the visa is denied, the student will send IU all the application
documents that have been submitted to the German embassy.
7. Furt her Informat ion Reg arding On-Campus in Germany
7.1 Semest er Ticket
For any full semester the student attends on-campus in one of IU’s
campuses in Germany, the student is obliged to purchase the semester
ticket for the public transport network at the respective university
location. This only applies if, and as long as, there is a semester ticket
option at the university location. The costs for the semester ticket are to
be paid in advance for one semester, no later than one month before the
beginning of a semester. The cost of a semester ticket is set each year by

The timely payment of the semester ticket during the regular contract
period is regarded as re-registration for the respective semester and is a
prerequisite for the issuance of the certificate of study. In some study
programmes, students can start their studies four times a year, even in
the middle of a summer or winter semester. If the student starts
studying in the middle of a summer or winter semester, he/she can
decide whether he/she wants to purchase the ticket retroactively for the
entire semester, or whether to purchase the ticket from the next
semester onwards. In the event of a decision to use the semester ticket,
the full semester fee must be paid.
7.2 Use of t he Facilit ies of t he St udent enwerk Berlin (for Berlin Campus
St udent s)
Every student at IU’s Berlin Campus must pay a fee per each semester
for the use of the facilities of the Studentenwerk. This amount is billed in
addition to the tuition fees and is due no later than one month before
the start of the respective campus semester. In order to see the most up-

If the costs are changed by the Local Government Administration, said
amount will be adjusted accordingly. The extent to which the facilities
are used depends on the capacities of the Studentenwerk. IU has no
influence on this matter.
If the Studentenwerk facilities are not available to the student, or if the
Studentenwerk closes existing facilities, there is no entitlement to
compensation of any kind or a reduction in the fee to be paid.
7.3 Campus Card Bad Honnef (for Bad Honnef Campus st udent s)
Students enrolled at the Bad Honnef campus are entitled to utilise a
one-time offer on all diverse food and beverage facilities and services up
to an amount of €100. This offer is dependent on the current supplies
and availability of the respective caterers on campus. The benefit sum is
not able to be claimed in cash, or to be paid out to the student. In order
to take advantage of the food and beverage services on campus the
student must be in possession of a valid campus card. A €10 deposit for
said campus card will be charged.
7.4 Ot her Oblig at ions
The student acknowledges that the campus rules, the library usage rules
(LIS Rules and Regulations) and the academic regulations of IU are
binding.
Attendance:
Attendance in the in-person lectures is mandatory for students entering
Germany with a visa for study purposes. An internal attendance list is
kept for monitoring this.
Laptop:
By the start of the programme, students need a laptop with the ability to
connect to Wi-Fi as well as other required applications such as Microsoft
Office 365 and Zoom. To be able to participate successfully in the study
programme, it is also necessary that the laptop is properly connected to
IU’s IT network. Students are therefore required to have their laptops
integrated to the network via IU’s internal IT department.
Internet access:
Students need external internet access to be available at all times to
ensure full use of the electronic resources of IU and its library, as well as
to maintain communication with the administration of IU. Students are
required to regularly check their IU email inbox, and to read the
messages on the IU Campus Management System.
8. Rig ht of Wit hdrawal
The student has the right to revoke this contract within one month
without providing a cause.
The withdrawal period is one month from the day of the conclusion of
the contract. To exercise the right of withdrawal, the student must
inform IU in a clear declaration (e.g. a letter sent by post, fax or email) of
his/her decision to revoke this contract. There is a digital sample
withdrawal form which can be used for this (but is not mandatory), that
can be accessed via the campus management system or via the following
link. The student can ensure the withdrawal period by sending the
notification of his/her choice to exercise his/her right of withdrawal
before the withdrawal period expires.
9. Dat a Privacy
The details for the processing of personal data and the rights of the
student related to this are explained in the information notice regarding
data privacy, which can be obtained by the student via the IU website. To
carry out the study contract, IU uses the software of different providers,
which processes personal data outside the European Union. The student
declares consent that IU may store, collect and process the student’s
data collected during the application process and during the contract
period. The student also agrees that his/her data may be forwarded to
the authorities in cases required by law.
10. IU’s Liabilit y
IU is liable for damages resulting from a breach of obligations due to
intentional or gross negligence on the part of its legal representatives or
agents. IU is also liable for damages resulting from harm to life, body or
health arising out of a breach of obligations due to the intentional or
negligent breach of obligations on the part of the university’s legal
representatives or agents.

Apart from this, the liability for damages arising out of a breach of
obligations due to ordinary or slight negligence or due to an act
committed with ordinary or slight negligence on the part of its legal
representatives or agents is excluded, except for damages arising out of
a breach of fundamental obligations whose compliance is necessary to
achieve the goals of the contract or which arise out of the justified
reliance upon the relationship set forth herein. With respect to these
exceptions, the liability is limited to the compensation for predictable
damages.
11. Place of Jurisdict ion and Final Provisions
For all claims referring to or in connection to this contract German Law is
applicable. If the student changes his/her legal domicile or habitual
residence to a location outside of Germany after the conclusion of the
contract or their domicile or habitual residence is unknown at the time
of a filing of a lawsuit, in accordance with § 38 (3) ZPO, it is agreed that
any dispute arising out of this contract or in connection with this
contract, the court presiding over the headquarters of IU (Erfurt District
Court, Regional Court Erfurt) will have jurisdiction.
For persons who do not have a place of jurisdiction in the Federal
Republic of Germany at the time of the conclusion of the contract, or
during the contract period, the jurisdiction of the court presiding of the
headquarters of IU (Erfurt District Court, Erfurt Regional Court) is also
agreed to by both parties, in accordance with §38 (2) ZPO. For periods in

which the person concerned has a place of residence or a habitual
residence within the Federal Republic of Germany, for example during
an in-person semester in Germany, this jurisdiction agreement has no
effect.
IU will not participate in a dispute settlement procedure within the
frame of the Consumer Dispute Settlement Act (VSBG).
In accordance with legal demands, IU has provided a private-sector
guarantee, which guarantees all students will be able to complete their
studies regardless of the economic situation of the executing institution.
For legal reasons, we would like to point out that the Free State of
Thuringia does not provide any additional security.
There are no subsidiary agreements to this contract. Modifications or
amendments to this contract must be made in written form.
Modifications or amendments to this provision must also be made in
writing. Should one or more provisions of this contract be or become
invalid, the remaining provisions remain unaffected. In the case of a
regulatory gap within this contract, the contracting parties shall find a
resolution that corresponds to the purpose and economic intent of the
remaining contract.
The English version of this Agreement is a non-binding translation which
is provided for information purposes only. The German version of the
Agreement is the binding text of the Agreement for both parties.

can ensure the withdrawal period by sending the notification of his/her
choice to exercise his/her right of withdrawal before the withdrawal
period expires.

If you revoke this agreement, we will refund all payments we have
received from you, including delivery costs (except for the additional
costs resulting from your choosing a delivery method other than the
cheapest standard delivery offered by us), immediately and at the latest
within fourteen (14) days from the day we receive notice of your
withdrawal of this agreement. We will use the same means of payment
for this refund as you used for the original transaction, unless otherwise
expressly agreed with you; in no event will you be charged any fees for
this refund.
