FULL & FINAL SETTLEMENT

This Final Account Summary confirms the agreement of the Company and the Contractor that the Contractor shall accept the
amounts set forth above as the full and final settlement of any and all claims, charges, costs, invoices or any other matters of any
nature whatsoever pertaining to the Agreement or the Commercial Terms that are, have or could be asserted by Contractor with
respect to the Work completed under these Commercial Terms, irrespective of whether known or unknown as of the date hereof,
and Contractor agrees that it will not submit any further requests for additional payment of any kind under the Agreement with
respect to the Work completed under these Commercial Terms; further, it is expressly agreed that such matters set forth above
shall include, but not be limited to, any and all putative claims or demands by Contractor whether past, present or future, for
extension of time, acceleration, early completion bonus(es), and/or penalties by Contractor.
For the avoidance of doubt, this agreement DOES NOT pertain to, nor shall it in any way serve to alleviate or otherwise mitigate,
Contractor’s ongoing obligations under the Agreement or the Commercial Terms, including, without limitation, any obligations
pertaining to warranty, warranty repair, and/or security therefor, under the Agreement.

Upon signature hereof by both parties, the agreement set forth in this Final Account Summary will be the agreed-to basis for the
final amendment that will be required to formally close these Commercial Terms.
