AFFIDAVIT

I, Criselda De Gabriel Labanancia, married, of legal age, Filipino, and a

resident of Brgy. Magsaysay, Lope De Vega, Northern, Samar, under oath,
depose and state: that-

1. On May 6, 2023, around 5 pm, while my husband Daniel

Labanancia (Daniel) and I were outside our house, Marvin Labanancia
asked us whether Andrew Labanancia was still there. Unfortunately, we
told him that he already left since he needed to complete his physical
and medical examination. Daniel then invited Marvin to continue their
talk inside our house to eat, drink, and relax since it was the weekend.
They together with my nephew Jonel Calimutan, eat, drink, and sing at
home, enjoying the weekend;

2. Moreover, around 8:00 pm, we were all shocked when a group

of policemen accompanied by our barangay captain Raquel A. Mabao
suddenly arrived looking for Marvin and Andrew. When I asked them,
they replied that our barangay captain Raquel Mabao reported that
Marvin and Andrew destroyed the house and the properties inside. We
were all stunned since from the afternoon until evening, Marvin was
with us, while Andrew already left at 3:30 in the afternoon.

3. I executed this affidavit to attest the truthfulness of the preceding facts,

the dismissal of the instant case, and for another legal purpose it may serve.
