actual realization of the outstanding amount by the opposite
parties.

8. Brief synopsis of commercial Dispute
a. That the Applicant is authorized person of M/s Bharat Pet
Limited. M/s Bharat Pet Limited is registered at ROC-Delhi,
having address R/o Plot No. I-12,IInd Floor, Near Udyog
Nagar Metro Station DSIDC Industrial Complex, Nangloi,
New Delhi-
110041, inter alia engaged in business of manufactures, designers,
processors, buyers, sellers, exporters, importers, and/or
otherwise dealers in all kind of packaging items including tin
containers, all kind of bottles corrugated boxes, barrels, drums,
glass packing items, pouches, jars, cartons, plastic and PVC
packing, all kind of PVC and plastic films, polythene packing, all
kind of bags, plastic liners and sacks, hollow wares, crown, caps,
corks, all kind of seals, PVC and other corks, wooden and
metal boxes etc., and its one branch/Unit is situated at Kila No.
12/1-3, Village Josi Jat 42 KM., Stone NH-1, Sonepat, Haryana.

b.That the opposite party is proprietorship concern firma and

Mr. Narinder Sharma being the proprietor has been running
its business namely M/s Banke Bihari Mineral Water and it
has been managed and controlled by him and is responsible
and authorized person.

c. That the opposite party has been having business with

applicant since long back years and in time to time requested
for services from the applicant for its business requirements.
That the applicant provided the said services as per demands
by M/s Banke Bihari Mineral Water, further the applicant
raised the bills. That the said bills were duly delivered and
received by M/s Banke Bihari Mineral Water and its
authorized person in time to time. M/s Banke Bihari Mineral
Water & Auth. Person also made/credited part outstanding
bills amount of applicant in time to time but as per records
maintained by the firm of applicant total of Rs.
 25,25,601.55/-(Rs. Twenty Five Lac Twenty Five Thousand
Six Hundred One & Fifty Five Paise Only) is still
outstanding to be receive from the opposite party. And the
applicant requested several times to the opposite party and
demanded his outstanding amount but the opposite party
became failed to pay.

d. As on date 31.10.2023 a sum of Rs. 25,25,601.55/-(Rs.

Twenty Five Lac Twenty Five Thousand Six Hundred One &
Fifty Five Paise Only) along with future interest @ 18% per
annum on principal amount since 01.12.2023 till realization
is due against opposite parties without any justified reason.

e. Despite the repeated requests, reminders and

communications by applicant and its staff, opposite parties
have failed to pay the principal amount and found no
response. Hence the present application.
