FORM OF UNDERTAKING TO BE EXECUTED BY CHENGALPATTU DIVISION,

CONSTRUCTION AND MAINTANANCE, HIGHWAYS DEPARTMENT FOR SHIFTING THE

EB Poles at Echur – Thiruporur Road

The undertaking executed at Chengalpattu on this the by Chengalpattu Division,

Construction and Maintanance, highways department represented by the Assistant
Engineer (H), Thirukalukundram Section AND IN favor of the TANGEDCO a body
corporate constituted under the Electricity (Supply) Act, 1948 (CA 54 of 1948) and
validity continuing as an Utility and a License after the coming into force of the
Electricity Act 2003 (CA 36 of 2003)

And WHEREAS the Chengalpattu Division has undertaken the work of “Widening
from Intermediate Lane to Two Lane with Paved Shoulders and Strengthening in Km
4/0 - 6/2, 7/4 -10/2, 13/6 - 14/2 and Strengthening with Paver Block for Shoulders
from km 6/2 - 7/4 & 10/2 - 13/6 of Echur - Thiruporur Road inculding CD Works in Km
4/6(i), (ii), 4/8, 5/2,4,6, 6/8,10, 7/6,10, 8/4,6,10, 9/2, 10/2,4, 10/8(i), (ii), 11/8,10,
13/4 & 13/8” and has requested the TANGEDCO to shift the EB Poles at Echur –
Thiruporur Road Km 4/0 -14/2 that fails in the above said work.

WHEREAS it has been agreed to by the Chengalpattu Division to undertake the

above shifting work through the Registered Contractor under the direct supervision of
the TANGEDCO subject to paying establishment and supervision charges at 2.5% of the
shifting estimate to the TANGEDCO and furnishing an undertaking.

IN CONSIDERATION OF THE TANGEDCO having agreed to the said proposal, the

Projects Division hereby undertakes the following:

1. Chengalpattu Division shall entrust this work only to the registered

contractors who is well acquainted with electrical works so to maintain
the TANGEDCO standards.

2. Chengalpattu Division and their appointed authorities shall only use high
quality materials conforming to the standards approved by the
TANGEDCO and as per relevant ISS.

3. Chengalpattu Division and their appointed authorities shall intimate in

advance, their plan of action to carry out the work to the local TANGEDCO
officer.

4. All the work shall be carried out under direct supervision of TANGEDCO
officials and their decisions in this regard shall be final and binding on
Chengalpattu Division.

5. Chengalpattu Division agrees to pay the further amount, if any as

demanded by the TANGEDCO over and above the establishment and
supervision charges already paid.

6. The work shall be carried out without causing any incontinence to the
operation and maintenance of Sub-Station and other Department works of
the TANGEDCO in all matters.

7. Chengalpattu Division through the Registered Contractor shall execute

and complete the work in strict adherence of time schedule and to
satisfaction of the TANGEDCO Engineers and adhere strictly the directions
of the TANGEDCO in all matters.
8. Chengalpattu Division and their appointed authorities shall be
responsible to protect the public and the employees of the TANGEDCO
against any accident that may raise in the course of execution of the works
and shall indemnify the TANGEDCO for any claim for damages / injuries
to person / Property resulting from any such accident and also where the
provision of workmen’s compensation Act, apply shall take steps to
property insure against the claims there under by way of accidents risk
insurance to meet all purpose of relief, falling which the same of
otherwise the Projects Division and there appointed authorities shall be
responsible to meet the compensation awarded under the said Act.

9. Chengalpattu Division undertakes that the authorised contractor shall

undertake to employee qualified technical men to carry out the work.

10. Chengalpattu Division through the Registered Contractor shall undertake

to apply line clear well in advance carrying out the works. The TANGEDCO
shall

consider their request and arrange for LC (Line Clear) depending upon
the exigencies. This has to be strictly adhered to.

11. Chengalpattu Division shall undertake to handover all the relevant /

unused material to TANGEDCO. Also Projects Division shall under take
that all the materials dismantled but not utilized in the same site should
be accounted and devaluated to stores of TANGEDCO without any
expenditure to TANGEDCO.

12. Chengalpattu Division through the Registered Contractor shall give to

TANGEDCO full and complete particulars of the work to be done well in
advance and the period required completing and also providing free
access by the offers of the TANGEDCO and workman for inspection and
supervision.

13. Chengalpattu Division and there appointed authorities are responsible for
smooth execution of work and if any dispute arises during execution of
the work in regard to property / passage and labours, TANGEDCO shall
not be responsible or involved in such dispute.
14. Chengalpattu Division undertakes to ensure free flow of traffic during

execution of the works and shall also be responsible for any accident /

loss of lives / property.

15. The source of supply materials used and the guarantee for the materials

used shall be furnished to the TANGEDCO. Any failure of cost by Projects

Division through their appointed authorities.

16. The cost of irretrievable material will be borne by Chengalpattu Division

by their appointed authorities if the materials replaced by Chengalpattu

Division are less than that was originally erected.

17. Authorities undertake to compensate any loss or damage caused to

TANGEDCO/TAN TRANSO properties / equipments during shifting of

lines.

18. Authority undertake to resolve all local problem and connected legal issue

at their own cost during shifting of line.

The “Chengalpattu Division” further undertakes not to be revoked this

undertaking till the completion of shifting work.

The expression “Chengalpattu Division” and “TANGEDCO” hereinafter

used shall include their respective successors and assignees in office.

acting for and on behalf of Chengalpattu Division has signed this

undertaking on the day, month and year first above written.
