HIV AND AIDS POLICY REVISION NO: 3

REVISION DATE: 2024-02-01

Policy Statement
AG DRILLING acknowledges the seriousness of the HIV/AIDS epidemic in South Africa and seeks to minimize the social and
economic consequences to AG DRILLING and its employees. We are fully committed to protect employees and create
awareness where necessary to ensure that all employees are treated with the necessary dignity, fairness and equality.
AG DRILLING commits to the following:
 Employees with HIV/AIDS will be governed by the same contractual obligations as all other employees;
 HIV/AIDS awareness training will be made available to all employees;
 AG DRILLING will ensure that where necessary, affected employees and their colleagues receive appropriate guidance
should such a colleague wish to disclose their status.
Confidentiality
Employees with HIV/AIDS have the legal right to confidentiality concerning their HIV status. Under no circumstances will
employees be obligated to disclose their status. Where an employee chooses to voluntarily disclose their status to AG
DRILLING , this information may not be disclosed to any other party without the employee's consent.
All medical information regarding employees with HIV/AIDS will be kept confidential, except where the law requires AG
DRILLING to disclose it to specified people. Should any person within AG DRILLING disclose such confidential information
without legal authority or consent from the employee, disciplinary action will be taken.
Testing
No AG DRILLING employee shall be required to undergo HIV testing, unless undertaken with the explicit consent of the
employee. HIV testing will not form part of the recruitment and selection process.
Non-discrimination
HIV/AIDS is a disease that shows no racial or gender boundaries. AG DRILLING believes that a person with the HIV/AIDS must be
treated the same as any other employee suffering from a life-threatening disease. As such, employees who have HIV/AIDS will
not be subjected to any form of victimisation or discrimination.
Current Employees
AG DRILLING acknowledges that employees with HIV/AIDS as well as other life-threatening diseases may sometimes need
continued medical assistance in order to continue performing their duties. AG DRILLING commits itself to assisting employees
wherever possible and necessary.
When an employee's disease starts to impact his/her ability to perform their duties, the normal incapacity procedures will apply.
Employees identified with HIV/AIDS
Colleagues of an HIV positive employee cannot become infected through normal contact in the workplace. Unless the HIV
positive employee is acting in an inappropriate manner, it is not acceptable for colleagues to refuse to work with that person.
Should an employee, after reassurance and with all appropriate health & safety & precautions being taken by the company,
remain unwilling to work with the HIV positive employee, he/she will be warned that their reaction is medically unjustified and
that disciplinary action may be taken against them. Any colleague of an HIV positive employee who embarks on any form of
discrimination towards that particular employee may be subjected to the company's disciplinary procedure.

We will review this policy annually to ensure that it remains relevant to the nature of our work and those affected by it.

Signed at _PRETORIA_ on the day of January 22 2023
