ADDENDUM TO TITLE NOTE

This addendum to title note dated 20 June 2001 in respect of the property
bearing C.T.S No. 36 Shukrawar Peth Pune. This addendum is restricted
to Flat No. 11 on the third floor of the building constructed on the property
which flat admeasures about 1168 Sq. Ft. or 108.5 Sq. Mtrs. presently
held by Shri Nandakumar Vasant Pawgi, Shri Dhananjay Nandakumar
Pawgi.

1) As stated in my original title note June 20 2001, the said property is


owned by Shri K. B. Sathe Memorial Trust (Public Trust duly
registered under Bombay Public Trust Act 1950) and M/s United
Constructions had sole and absolute rights to demolish the old
building and to re-develop the said property.
2) M/s United Constructions by articles of agreement adequately
stamped and executed on 12/04/2001 and registered on the even
date in the office of sub-registrar at sr. no. 3028/2001 agreed to sell
Flat No. 11 on the third floor of the then proposed building to Shri
Vasant Damodar Pawgi and Shri Nandakumar Vasant Pawgi, Shri
Dhananjay Nandakumar Pawgi at and for a consideration of Rs.
7,89,000/-.
3) By Gift Deed dated 11/09/2002 Shri Vasant Damodar Pawgi gifted
his 1/3rd undivided right, title and interest in the said Flat in favour of
Shri Dhananjay Nandakumar Pawgi, which Gift Deed is registered
at the Office of the Sub – Registrar Haveli No. – I at Sr. No.5512 on
11/09/2002. Shri Nandakumar Vasant Pawgi had joined in the said
Gift Deed as consenting party.
4) The said M/s United Constructions have completed the construction
of the building on the said property and Pune Municipal Corporation
is pleased to grant completion certificate-bearing number
BCO/14/4/31/2868 dated 27/06/2005 for the completed
construction inclusive of the said flat number 11.
5) The said M/s United Constructions have formed a society of the flat
purchasers in the building constructed by them under the name and
style Dhondumama Sathe Sankul Co- Operative Housing Society
Ltd. bearing number PNA/(PNA) (1)/HSG (TC)/6824/2004-2005
Dated 17/06/2004 and I am instructed that Mr. Nandakumar Vasant
Pawgi has become member of the said society.
6) Shri Tushar Kale, Advocate, has carried out the searches in respect
of flat No. 11 from the year 2001 to 2005 both inclusive however he
has not come across no entry evidencing any charge or
encumbrance on the said flat.
7) The said Pawgis have paid to M/s United Constructions the entire
amount of consideration mentioned in the agreement dated
12/04/2001 and the said the possession of the said Flat has been
delivered to said Pawgis. M/s United Constructions by its letter
dated 28/05/2005 permitted the transfer of the said flat by Pawgis.
8) From the perusal of the documents referred above, I have no
hesitation to come to the conclusion that Mr. Nandakumar Vasant
Pawgi and Mr. Dhananjay Nandakumar Pawgi have made out
sufficiently marketable title to the said Flat No. 11 free of any
charge or encumbrance.
Hence this addendum to title note Dated 20 June 2001.
