A BILL
To prohibit the Secretary of Labor from finalizing, imple-
menting, or enforcing a proposed rule with respect to
the salary threshold for overtime eligibility.

1 Be it enacted by the Senate and House of Representa-

2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE.

4 This Act may be cited as the ‘‘Overtime Pay Flexi-

5 bility Act’’.

1 SEC. 2. PROHIBITION AGAINST FINALIZING, IMPLE-

2 MENTING, OR ENFORCING A PROPOSED RULE

3 WITH RESPECT TO THE SALARY THRESHOLD

4 FOR OVERTIME ELIGIBILITY.

5 The Secretary of Labor may not finalize, implement,

6 or enforce the proposed rule titled ‘‘Defining and Delim-
7 iting the Exemptions for Executive, Administrative, Pro-
8 fessional, Outside Sales, and Computer Employees’’ pub-
9 lished by the Wage and Hour Division of the Department
10 of Labor in the Federal Register on September 8, 2023
11 (88 Fed. Reg. 62152).
