Short description The Procedural rules concerning enrolment and tuition fee set out the rules
for enrolment for study programmes of NHL Stenden, the required tuition
fees, and the options for and consequences of terminating enrolment.

INTRODUCTION
To be allowed to take part in education of a study programme at NHL Stenden, a student has to
enrol. For this, they owe a tuition fee. A person may enrol as extraneus if they only want to take
assessments and examinations. For this, they owe an examination fee.

In principle, enrolment applies for an entire academic year. In certain cases, enrolment during an
academic year is allowed. Enrolment can usually be terminated early, which also often terminates
the obligation to pay tuition fees or examination fees for the remaining part of the academic year.

The Higher Education and Scientific Research Act (WHW) provides for a mandatory legal framework
for enrolment, its termination, and tuition fees. NHL Stenden is bound to comply with this framework.
Where required and desirable, NHL Stenden has set additional rules.

CHAPTER 1 GENERAL PROVISIONS

Article 1.1 Definitions of terms


1 The terms used in these rules have the same definitions as the terms in the Higher
Education and Scientific Research Act, unless explicitly determined otherwise.
2 The following definitions also apply in these rules:
a CSA: Central Student Administration, which is part of the Educational Logistics & Student
Support department.
b Tuition fee: statutory tuition fee and institutional tuition fee, unless explicitly determined
otherwise.
c Executive Board: the Executive Board of NHL Stenden;
d NHL Stenden: NHL Stenden University of Applied Sciences and, where appropriate,
Stichting NHL Stenden Hogeschool.
e IBAN: International Bank Account Number.
f academic year: the period that starts on 1 September and ends on 31 August of the
next calendar year.
g Studielink: the electronic enrolment system for study programmes of higher education.
h Subsidy regulations: the subsidy regulations for funding on demand in higher
education and the Decision on experiments with funding on demand in higher
education.
i WHW: Higher Education and Scientific Research Act.

Article 1.2 Scope


1 These rules apply to any enrolment as a student or extraneus for a full-time, part-time
or work and study associate degree, bachelor’s or master’s programme at NHL
Stenden, unless explicitly determined otherwise.
2 The term enrolment in these rules also applies to re-enrolment, unless explicitly
determined otherwise.

Article 1.3 Code of Conduct for international students in higher education


The Code of Conduct for international students in higher education applies to enrolment of
international students within the meaning of this code of conduct as student or extraneus for a study
programme at NHL Stenden.

CHAPTER 2 APPLICATION AND STUDY CHOICE ACTIVITY

Article 2.1 Application for study programme no later than 1 May


1 Anyone wishing to enrol as a student for the first period of an associate degree programme
with a study load of 60 credits or the propaedeutic phase of a bachelor’s programme applies
by 1 May of the relevant academic year at the latest. If a person wishes to apply for more
than one study programme, the obligation applies to a single study programme.
2 The term study programme as used in Articles 2.1, 2.2 and 2.3 refers to an associate
degree programme and a bachelor’s programme.
3 Paragraph 1 of this article does not apply to students who apply after 1 May to a study
programme other than the one in which they had originally enrolled but can demonstrate that
the new application is the result of termination of the enrolment under Section 7.8b
subsection 5, WHW, at such a time that they could not apply before 1 May prior to the
academic year for which they wish to enrol.
4 A person who has applied for one or more study programmes as referred to in paragraph 1
of this article by 1 May at the latest is obliged to take part in the study choice activity as
referred to in paragraph 5 under a of this article and is entitled to take part in the study
choice activities as referred to in paragraph 5 under b, c, d and e of this article.
5 The study choice activities of NHL Stenden comprise:
a taking a matching test;
b taking a study choice test;
c participating in trial study;
d shadowing a student of the study programme;
e conducting a study choice interview;
f participation in information activities.
The study choice activities referred to in this paragraph are offered free of charge and may
differ for individual study programmes. The NHL Stenden website states which study choice
activities a study programme offers and what the matching test entails.
6 The Executive Board publishes a positive or negative study choice recommendation by
means of an electronic message within two weeks after completion by the relevant
person of the study choice activity as referred to in paragraph 5 under a of this article.
7 The Executive Board rejects the enrolment if a person failed to participate in the study
choice activity as referred in paragraph 5 under a of this article. A valid reason for inability
to participate is an exceptional circumstance as a result of which the person in question
could not reasonably take part in the mandatory study choice activity. Exceptional
circumstances at least include illness and exceptional family circumstances.
8 If the distance between the domicile or residence and the location of the study choice
activities would cause substantial objections for a prospective student, the Executive Board
will take the necessary measures to enable this prospective student to participate in the
study choice activities without requiring their physical presence.
9 Paragraphs 4 up to and including 7 of this article do not apply to enrolment in a
bachelor’s programme for which a selection procedure has been set up.
Article 2.2 Application for a different study programme after 1 May
1 A person who has met the obligation under Article 2.1, paragraph 1 for another study
programme and applies for a study programme at NHL Stenden other than the study
programme referred to in the said provision after 1 May is obliged to take part in the study
choice activity as referred to in Article 2.1, paragraph 5 under a and is entitled to take part in
the study choice activities as referred to in Article 2.1, paragraph 5 under b, c, d and e.
Paragraphs 6 up to and including 9 of Article 2.1 apply accordingly.
2 This article also applies to students who apply after 1 May for a study programme other than
the one for which they had originally enrolled but can demonstrate that the new application is
the result of termination of the enrolment under Section 7.8b subsection 5, WHW, at such a
time that they could not apply before 1 May prior to the academic year for which they wish to
enrol.

Article 2.3 First application for a study programme after 1 May


A person who has not met the obligation under Article 2.1, paragraph 1 and applies for a study
programme after 1 May is obliged to take part in the study choice activity as referred to in Article 2.1,
paragraph 5 under a and is entitled to take part in the study choice activities as referred to in Article
2.1, paragraph 5 under b, c, d and e. Paragraphs 6 up to and including 9 of
Article 2.1 apply accordingly.

CHAPTER 3 ENROLMENT

Article 3.1 Enrolment and unauthorised participation in education


1 Anyone wishing to use the educational facilities, examination facilities or other facilities for
initial education provided by NHL Stenden must enrol as student or extraneus through the
Executive Board. Enrolment applies to a study programme and is valid for the entire academic
year, save for the provisions of Article 3.5 and Chapter 3A.
2 A person participating in educational or examination facilities for initial education provided by
NHL Stenden is obliged on that occasion or immediately after the first demand by or on behalf
of the Executive Board to inform the Executive Board or a person or persons appointed by the
Executive Board of their name and address and properly provide proof of their entitlement to
participate.
3 A person who is not enrolled and uses the educational or examination facilities of NHL Stenden
owes NHL Stenden compensation to the amount of the tuition fee that they would have had to
pay if they had enrolled as of 1 September of the academic year, unless they prove they did
not start using the educational or examination facilities of NHL Stenden until later.
4 NHL Stenden may report or file a complaint about use of the educational and
examination facilities of NHL Stenden without the required enrolment.
5 A person cannot be enrolled for more than one study variant of a study programme at the
same time.
6 Enrolment in a work and study programme is only possible as a student.

Article 3.2 Enrolment and residency status


1 Without prejudice to the other terms and conditions of enrolment, enrolment as a student
or extraneus is only open to persons whose parents, guardians or carers demonstrate that
they are, or who, if they are of age and legally competent, demonstrate that they:
a have the Dutch nationality or are treated as a Dutch citizen under a statutory provision,
b are a foreign national and are younger than 18 years of age on the first day on
which the study programme starts to which the initial enrolment applies,
c are a foreign national and are 18 years of age or older on the first day on which the study
programme starts to which the initial enrolment applies, and on that day legally reside
within the meaning of Section 8 of the Aliens Act 2000,
d are a foreign national and reside outside the Netherlands on the first day on which the
study programme starts to which the initial enrolment applies, or
e are a foreign national, no longer meeting any of the provisions under b, c or d, and were
previously enrolled in a study programme at NHL Stenden in accordance with any of these
points, which study programme is still being attended and has not been completed yet.
2 If, after enrolment, it is established that such enrolment was not in accordance with
paragraph 1 of this article for any reason whatsoever, enrolment of the student or extraneus
will be terminated with immediate effect.

Article 3.3 Enrolment as extraneus


Enrolment as extraneus is only possible if, according to the Executive Board the nature or interest of
education does not oppose it.

Article 3.4 Enrolment procedure and enrolment date


1 Enrolment in a study programme at NHL Stenden is only possible by means of Studielink.
NHL Stenden will only enrol persons after it has been ascertained that they meet the terms
and conditions of enrolment set out in or pursuant to the WHW and the rules of NHL
Stenden.
2 A person must provide their personal number to NHL Stenden upon enrolment. NHL
Stenden will include the personal number in their records.
3 Enrolment in a study programme at NHL Stenden is only possible prior to 1 September of the
current academic year, save for the provisions of article 3.5.
4 A person will be enrolled on the first day of the month to which the request applies if they
have met the terms and conditions of enrolment on the last day of that month at the latest
and enrolment is possible in this month.

Article 3.5 Enrolment after 1 September of the academic year


1 Enrolment in a study programme at NHL Stenden as student or extraneus for the remaining
part of the current academic year after 1 September is only possible if the Student Charter
(programme-specific section) determines that enrolment after 1 September of the academic
year is possible in the relevant month. Enrolment will take place on the first day of the month
in question.
2 In addition to the provisions of paragraph 1 of this article, the Executive Board may enrol a
person in a study programme at NHL Stenden after 1 September of the academic year if they
have terminated their enrolment for this study programme at NHL Stenden because of
exceptional personal circumstances as referred to in Section 7.8b, subsection 3, WHW,
discussed this in advance with a study counsellor, and, in the Executive Board’s opinion, the
nature or interest of education does not oppose it.
3 In addition to the provisions of paragraph 1 of this article, the Executive Board may enrol a
person who is enrolled for a study programme at NHL Stenden in a different study
programme at NHL Stenden after 1 September of the academic year if they discussed this in
advance with a study counsellor, and according to the Executive Board the nature or interest
of education does not oppose it.
4 Replacing the provisions of paragraphs 1, 2 and 3 of this article, the Executive Board may at
all times decide, based on substantial interests of NHL Stenden, that no enrolment in one or
more study programmes, one or more groups of students or extraneï, or one or more months
is possible after 1 September.
5 Following this article, enrolment in the month of October is not possible.
Article 3.6 Proof of enrolment
NHL Stenden will provide a person a free digital proof of enrolment upon enrolment.

Article 3.7 Report to the Minister for Education, Culture and Science
The Executive Board will report the enrolment to the Minister for Education, Culture and
Science.

Article 3.8 Refusal of enrolment for reasons of unfitness


1 In special cases and after obtaining the advice of the examination committee for the study
programme in which a person wants to enrol and following careful weighing of the interests
involved, the Executive Board may refuse enrolment of that person for this study programme
if that person, through their behaviour or remarks, has demonstrated unfitness for the
performance of one or more occupations for which the study programme trains the person in
question or for the practical preparations for professional practice.
2 The Executive Board may decide to not re-enrol the person whose enrolment in the same
or a related study programme has been refused or terminated at a different institution for
higher education under Section 7.42a, WHW, or to not enrol them for that study
programme.

Article 3.9 Refusal of enrolment for failure to respect basic principle


1 The Executive Board may refuse a person’s enrolment if:
a this person fails to respect NHL Stenden’s basic principle and objectives, or
b if there is a legitimate reason to fear that this person will abuse the enrolment and the related
rights by seriously damaging NHL Stenden’s individual nature, or if it has been demonstrated
that this person has abused the enrolment and the related rights.
2 The refusal as referred to in paragraph 1 of this article is given in writing and is
substantiated.

CHAPTER 3A ENROLMENT IN FUNDING ON DEMAND

Article 3a.1 Scope and order of priority


1 The rules of this Chapter apply in addition to and contrary to the rules in Chapters 2 and 3 to
all enrolments as a student or extraneus for a study programme at NHL Stenden that
participates in the experiment with funding on demand under the subsidy regulations, unless
explicitly determined otherwise.
2 In the event of contrariety of these rules with other rules of NHL Stenden, these rules will prevail.

Article 3a.2 Enrolment


A person can only enrol in a study programme if they meet the following terms and conditions,
without prejudice to the other provisions of these rules:
a they are a new entrant to a bachelor’s programme or associate degree programme from the
start of the experiment with funding on demand until 31 August 2019 inclusive,
b they do not attend more than one study programme for which they owe the statutory tuition
fee or a reduced tuition fee,
c they meet the requirements set out in Section 7.45a, subsection 1, WHW, without
prejudice to Section 7.45a, subsection 2, WHW, and
d they have paid the tuition fee due for a module.

Article 3a.3 Module


A person:
a will be enrolled in a study programme to attend a single module,
b concludes an educational agreement with NHL Stenden for each module, which
educational agreement NHL Stenden will keep at least until 1 February 2025,
c may only attend eight modules for a bachelor’s programme with a voucher until 31 August
2024,
d may only attend four modules for an associate degree programme with a voucher until 31
August 2024,
e may not undo the use of a voucher,
f when changing study programme, is entitled to the total number of vouchers minus the
number of vouchers already used,
g may attend a subsequent module if:
1 he has obtained the credits for the previous module of the relevant bachelor’s
programme or associate degree programme, or
2 he, according to NHL Stenden, has made sufficient study progress and has only failed to
obtain all credits in no more than one module of the same bachelor’s programme or
associate degree programme.

CHAPTER 4 DETERMINATION AND PAYMENT OF TUITION FEE AND


EXAMINATION FEE

Article 4.1 Determination and announcement of tuition fee and examination fee
1 Before 1 March prior to the academic year, the Executive Board determines:
a the partial statutory tuition fee for part-time and work and study programmes as referred to
in Section 7.45, subsection 2, WHW;
b the institutional tuition fee as referred to in Section 7.46, subsection 2, WHW;
c the examination fee as referred to in Section 7.44, subsection 2 WHW.
2 The Executive Board may determine different partial statutory and institutional tuition fees per study
programme or group of programmes or group of students.
3 The Executive Board will announce the statutory tuition fee, the institutional tuition fee
and the examination fee before 1 April prior to the academic year on at least the NHL
Stenden website and intranet.

Article 4.2 Reporting tuition fee and examination fee


The Executive Board informs the Minister for Education, Culture and Science about the amount of
the tuition fee set as referred to in Article 4.1, paragraph 1 under a and b of these rules.

Article 4.3 Determining tuition fee due


The Executive Board determines the tuition fee payable by a person no later than upon enrolment,
based on the information about the student known to the Executive Board.

Article 4.4 Change in tuition fee due


1 If a student pays or has paid the institutional tuition fee for an academic year and, later during
that academic year, meets the conditions to be charged the statutory tuition fee as referred to
in Section 7.45a, paragraphs 1, 2, 3 or 6, WHW, they will owe, at their request, the applicable
statutory tuition fee for the remaining part of the academic year.
2 The Executive Board will refund the student as referred to in paragraph 1 of this article the
institutional tuition fee already paid by the student for the remainder of the academic year after
set-off against the statutory tuition fee payable by the student.

Article 4.5 Reduction in statutory tuition fee and institutional tuition fee due to enrolment
during the academic year
Anyone enrolling after 1 September of the academic year owes the statutory tuition fee or institutional
tuition fee payable by them in proportion to the number of months remaining in the current academic
year.

Article 4.6 Reduction in and exemption from statutory tuition fee because of paid statutory tuition fee
1 If a person as referred to in Section 7.45a, WHW, is enrolled in NHL Stenden or another
funded institution wishes a second enrolment in NHL Stenden, they will be exempt from
paying the tuition fee for the latter enrolment, unless the amount paid or to be paid for the
first enrolment is lower than the full statutory tuition fee as referred to in Section 7.45,
subsection 1, WHW. In that case, they will owe the difference.
2 A person entitled to statutory tuition fee under Section 7.45a, subsection 2, WHW, will not
be exempt from paying the statutory tuition fee as referred to in Sections 7.45 and 7.45a
and 7.46, WHW, for another enrolment.
3 A person wishing to qualify for a reduction in or exemption from the tuition fee as referred to in
paragraph 1 of this article based on an initial enrolment with a funded institution other than
NHL Stenden must submit to NHL Stenden proof of paid tuition fee to the other funded
institution.

Article 4.7 Reduction in and exemption from statutory tuition fee because of paid school fees and
course fees
1 Anyone who, in order to attend education financed from public funds, owes school or course
fees under the Class and Course Fees Act and who, instead of this or in addition to this
wishes to be enrolled in the same academic year and owes the statutory tuition fee as referred
to in Section 7.45, subsection 1, WHW, will owe a tuition free for enrolment in a study
programme at NHL Stenden equalling the difference between the fee already paid and the
said statutory tuition fee. If they owe a tuition fee that is lower than the amount already paid,
they will be exempt from paying the tuition fee.
2 A person wishing to qualify for a reduction in or exemption from the tuition fee as referred to in
paragraph 1 of this article must submit to NHL Stenden proof of paid school or course fees
together with the request for enrolment, as well as a written confirmation from the Dienst
Uitvoering Onderwijs that no refund of the school or course fees has been granted.

Article 4.8 Reduction in and exemption from statutory tuition fee for other reasons
There will be no reduction in and exemption from the statutory tuition fee for reasons other than referred to in
Articles 4.6 and 4.7.

Article 4.9 Reduction in and exemption from institutional tuition fee


There will be no reduction in and exemption from the institutional tuition fee.

Article 4.10 Reduction in and exemption from examination fee


There will be no reduction in and exemption from the examination fee.

Article 4.11 Payment of tuition or examination fee by or on behalf of student or extraneus


The tuition fee or examination fee is payable by the student or extraneus and will be paid by:
a the student or extraneus; or
b a third party on behalf of the student or extraneus, provided the student or extraneus have
agreed to this in writing or through Studielink.

Article 4.12 Methods of payment


1 The tuition fee or examination fee due is paid by means of:
a single payment;
b payment in instalments. The tuition fee or examination fee due will be collected in nine equal
monthly instalments from September until May of the academic year on or around the dates
indicated by CSA, unless determined otherwise by CSA in writing upon enrolment, without
prejudice to a person’s right to pay the tuition fee or examination fee in five instalments at their
request. In case of payment in instalments, a fixed amount of EUR 24 in administration
charges will be payable with the first instalment. In case of enrolment for part of the academic
year, the tuition fee or examination fee due will be paid in equal remaining monthly instalments
until May of the academic year and a fixed amount of EUR 24 in administrative charges will be
due.
2 In case of lump-sum payment, payment is made by transfer into the IBAN indicated by NHL
Stenden or by a one-off and irrevocable direct debit to NHL Stenden from a bank account in
the European Economic Area (EEA). In the event of direct debit, the debtor is obliged to have a
sufficient balance in their account for collection to take place.
3 In case of payment in instalments, payment is made exclusively by means of a one-off and
irrevocable direct debit to NHL Stenden in instalments from an IBAN in the European
Economic Area (EEA). The debtor is obliged to have a sufficient balance in their account for
collection to take place.

Article 4.13 Time of payment


1 In the event of lump-sum payment by means of transfer, the tuition fee or examination fee due
must have been credited to an IBAN indicated by NHL Stenden within 30 days after the date of
the payment request, provided that, if enrolment occurs as of 1 September of the academic
year, the tuition fee or examination fee due must have been credited to an IBAN indicated by
NHL Stenden no later than on 30 September of that academic year. These terms are
considered deadlines.
2 In the event of lump-sum payment and payment in instalments by means of direct debit, the
direct debit must have been issued to NHL Stenden within 30 days after the date of the related
request, provided that, if enrolment occurs as of 1 September of the academic year, the direct
debit must have been granted to NHL Stenden no later than on 30 September of that academic
year. These terms are considered deadlines.
3 In the event of a direct debit, the debtor will not be discharged from payment until collection has
taken place and the reversal period has expired without reversal of the money.

Article 4.14 Allocation of payment


1 If payment can be allocated to one or more debts, allocation will be to the oldest
debt.
2 Payment will initially be used to pay costs, subsequently to pay interest due, and finally to
pay the principal sum and current interest.

Article 4.15 Consequences of non-, late or incomplete payment


1 A person will not be enrolled in NHL Stenden until after the tuition fee and
examination fee due have been paid in accordance with these rules.
2 In the event of non-, late or incomplete payment of the tuition fee or examination fee or if it
cannot be collected:
a the person will owe, in addition to the principal sum and the interest, collection costs as referred
to in Section 6:96 subsection 1 under c of the Dutch Civil Code. These costs amount to 15% on
the first EUR 2,500 of the principal sum of the claim, 10% on the next EUR 2,500 of the
principal sum of the claim, 5% on the next €5,000 of the principal sum of the claim, and 1% on
the remainder of the principal sum, with a minimum of EUR 40. Collection costs will be
increased by a percentage equalling the percentage as referred to in Section 9, first
subsection, of the Dutch Turnover Tax Act 1968 if NHL Stenden, in order to obtain payment out
of court, uses a service as referred to in the Turnover Tax Act 1968 for which turnover tax is
due under that act and NHL Stenden cannot settle turnover tax charged to it under the said act,
and/or
b the Executive Board will, in case of direct debit, be entitled to collect the uncollected
instalments with a next instalment, and/or
c the Executive Board will be entitled to claim lump-sum payment of the remaining tuition fee or
examination fee and the tuition fee or examination fee for enrolment for a subsequent
academic year.
3 In the event of non-, late or incomplete payment of the tuition fee or examination fee due for
the academic year or a previous academic year, the Executive Board may, without prejudice
to the person’s obligation to pay the tuition fee or examination fee due:
a exclude the student or extraneus from further participation in education and use of the
facilities of NHL Stenden, and/or
b refuse re-enrolment of the student or extraneus, and/or
c refuse issue of a diploma to the student or extraneus, and/or
d terminate enrolment of the student or extraneus after the student or extraneus has
been admonished.

Article 4.16 Termination of payment and refund of statutory tuition fee upon termination of enrolment
1 Upon termination of enrolment, a student does not owe the statutory tuition fee for the period of the
academic year after termination of enrolment. For every month following termination, the Executive
Board will refund, within 30 days after termination of enrolment, the relevant statutory tuition fee
paid by the student to the party that actually paid the statutory tuition fee, without prejudice to the
provisions of paragraph 2 of this article.
2 Upon termination of enrolment as of the month of July or August of the current academic
year, the statutory tuition fee for the period of the academic year after termination of
enrolment will remain payable and a student is not entitled to a refund of the statutory tuition
fee or termination of payment of the statutory tuition fee instalments.
3 Students are not entitled to a refund of the administrative charges.

Article 4.17 Termination of payment and refund of institutional tuition fee upon termination of
enrolment
1 Upon termination of enrolment, a student does not owe the institutional tuition fee for the period of
the academic year after termination of enrolment. For every month following termination, the
Executive Board will refund, upon the student’s written request, the relevant institutional tuition fee
paid by the student to the party that paid the institutional tuition fee, without prejudice to the
provisions of paragraph 2 of this article.
2 Upon termination of enrolment as of the month of July or August of the current academic
year, the institutional tuition fee for the period of the academic year after termination of
enrolment will remain payable and a student is not entitled to a refund of the institutional
tuition fee or termination of payment of the institutional tuition fee instalments.
3 Students are not entitled to a refund of the administrative charges.
4 A request for refund of the institutional tuition fee as referred to in paragraph 1 of this article
must be submitted to CSA. The Executive Board will inform the student of its decision on the
student's request within three weeks after receiving the student's request. If the student is
entitled to a refund of the institutional tuition fee, this will be repaid within 30 days after
announcement of the decision.

Article 4.18 Termination of payment and refund of examination fee upon termination of enrolment
Termination of payment and refund of the examination fee will take place in accordance with the
provisions of article 4.16.
Article 4.19 Decision on termination of enrolment and decision on refund of tuition fee upon
termination of enrolment
1 The Executive Board will properly substantiate its decision on termination of enrolment and its
decision on a refund of the tuition fee, announce its decision to the student, and inform them of
any consequences.
2 In its decision to terminate enrolment, the Executive Board will indicate who, within what term and
to which body an objection can be lodged.

CHAPTER 4A TUITION FEE FOR FUNDING ON DEMAND

Article 4a.1 Scope and order of priority


1 The rules in this Chapter apply in addition to and contrary to the rules in Chapter 4 to all
enrolments as a student or extraneus for a study programme at NHL Stenden that
participates in the experiment with funding on demand under the subsidy regulations,
unless explicitly determined otherwise.
2 In the event of contrariety of these rules with other rules of NHL Stenden, these rules will prevail.

Article 4a.2 Tuition fee


1 Before 1 March prior to the academic year, the Executive Board determines the tuition fee of a
study programme per module, with and without settlement of a voucher.
2 The Executive Board will announce the tuition fee as referred to in paragraph 1 before 1
April prior to the academic year on at least the NHL Stenden website and intranet.
3 The Executive Board will report the amount of the tuition fee of a study programme per
module in the academic year that starts on 1 September of that year to the Minister for
Education, Culture and Science before 1 September of a year.

Article 4a.3 Refund of tuition fee


No tuition fee is refunded in the event of interim termination of enrolment in a study programme for
attending a module.

Article 4a.4 Right of recourse


If it is demonstrated that a student has wrongfully used a voucher, NHL Stenden may recover the
amount reclaimed on that basis by the Minister for Education, Culture and Science from the
student.

CHAPTER 5 TERMINATION OF ENROLMENT

Article 5.1 Termination of enrolment for non-compliance with statutory provisions for enrolment
The Executive Board immediately terminates the enrolment of a student or extraneus if it is established after
enrolment that it was not in accordance with Section 7.32, subsection 5, WHW, for whatever reason.

Article 5.2 Termination of enrolment upon request


1 Students and extraneï may only request termination of their enrolment through Studielink.
2 The Executive Board will confirm receipt of the request to the student or extraneus, indicating
the day of receipt of the request.
3 The Executive Board will terminate the enrolment of a student or extraneus as of the first day of
the month following the month in which the request for termination was received.

Article 5.3 Termination of enrolment due to unfitness


1 In exceptional cases and after obtaining the advice of the examination committee for the study
programme in which a student has enrolled and the director of the academy of which the study
programme is part, and following careful weighing of the interests involved, the Executive Board
terminates the enrolment of a student for a study programme if the student, through their
behaviour or remarks, has demonstrated unfitness for the performance of one or more occupations
for which the study programme trains the person in question or for the practical preparations for
professional practice.
2 The Executive Board terminates the enrolment as of the first day of the month following the
month in which the decision was announced to the student.
3 The Executive Board may decide not to enrol the student again for that study programme.
4 If the student as referred to in paragraph 1 of this article is enrolled in a different study
programme and takes courses of a specialisation in that study programme that are in accordance
with or, in view of practical preparation for the practice of the profession, are related to the study
programme for which enrolment has been terminated with application of paragraph 1 of this
article, the Executive Board may, following the advice of the examination committee for the study
programme in which a student has enrolled and the director of the academy of which the study
programme is part, and after careful consideration of the interests involved, decide that the
student may not study that specialisation or may not study other components of that study
programme.
5 An examiner or other involved party reports an incident that may result in application of this article
to the examination committee and the academy director as referred to in paragraph 6 of this
article.
6 The examination committee of the study programme in which the student is enrolled or the director
of the academy to which the study programme in which the student has enrolled belongs may
submit a substantiated request to the Executive Board to apply this article.
7 The Executive Board does not take a decision on the basis of this article until after the student
has been given the opportunity to be heard. The Executive Board may decide of its own accord
to hear witnesses and experts. A report will be made of the hearing.
8 The Executive Board will take a decision within four weeks after the student is heard. The
Executive Board can postpone the decision once by no more than four weeks. The student will be
notified of this.
9 In order to prepare its decisions, the Executive Board may establish a committee consisting of
three persons tasked with supporting in hearing individuals.

Article 5.4 Termination of enrolment for failure to respect basic principle


1 The Executive Board may terminate the enrolment of a student or extraneus if:
a he fails to respect NHL Stenden’s basic principle and objectives; or
b if there is a legitimate reason to fear that they will abuse the enrolment and the related rights
by seriously damaging NHL Stenden’s individual nature, or if it has been demonstrated that
they have abused the enrolment and the related rights.
2 The termination is given in writing and is substantiated.
3 The enrolment cannot be cancelled pursuant to paragraph 1 under a of this article if there is no
opportunity for the student or extraneus to study the study programme at another institute.

Article 5.5 Termination of enrolment due to death


The Executive Board terminates the enrolment as of the first day of the month following the month in
which a student or extraneus passed away.

Article 5.6 Termination of enrolment due to non-payment


If a student or extraneus fails to pay the tuition fee or examination fee due after a demand for payment,
the Executive Board will terminate the enrolment of a student or extraneus as of the first day of the second
month following the demand for payment.
Article 5.7 Termination of enrolment for other reasons
The Executive Board will terminate enrolment as of the first day of the next month in the cases set out in
Section 7.8b subsection 5, Section 7.12b, Section 7.37 subsection 5 or 6, Section 7.42a, or Section 7.57h
subsection 1 or 2, WHW.

Article 5.8 Report to the Minister for Education, Culture and Science
The Executive Board will report termination of enrolment to the Minister for Education, Culture and Science.

CHAPTER 6 OTHER FEES

Article 6.1 Other fees


1 Enrolment is not made subject to any fee other than the amounts referred to in Chapters 3 and 3A,
without prejudice to the costs that, pursuant to statutory provisions, are payable by the (prospective)
student or extraneus or for which the Executive Board has determined that they must be borne by
the (prospective) student or extraneus pursuant to statutory provisions. These costs are listed in the
Student Charter (programme-specific section).
2 The Executive Board makes provisions for financial support of those persons for whom the fee as
referred to in the second paragraph of this article proves an insurmountable obstacle for enrolment.
The Executive Board sets more specific rules for the application of paragraph 2 of this article and
related to financial support as referred to in the first sentence.

CHAPTER 7 FINAL PROVISIONS

Article 7.1 Hardship


If permitted by law, the Executive Board may waive application of a provision in these rules or
deviate therefrom if application would lead to substantial unfairness. If the Executive Board uses this
option, it will take a decision with due regard for the nature, content and purport of that provision and
these rules.

Article 7.2 Commencement and citation reference


1 These rules will come into force on 1 February 2020.
2 These rules will be cited as: Procedural rules concerning enrolment and tuition fee.

Article 7.3 Miscellaneous


In case of contradictions between the Dutch version and the English translation of these rules, the
Dutch text shall prevail.
