Recommendation of Revised Variation – III proposal as per the clause 36 of Contract
Agreement - Reg.

Dear Sir,
This is in the reference of Contractors letter no 082; dated: 30.06.2023, wherein the
Contractor has resubmitted variation proposal-III with considering amount of additional
safety requirement as per the direction of Hon'ble Commissioner & Collector Indore and as
per the condition of Site with Saving of the Rs. 1,97,44,786/- (including Tender discount) for
accord approval of the Authority.

In this Context, the Engineer has reviewed the matter as per the provisions of contract
agreement and following for your kind perusal: -

1. The above cited work has awarded by the Competent Authority vide letter no.
46646; dated: 13.05.2022 to Contractor M/Mahavir Sharma at amounting to Rs.
19,61,47,057/- after 2nd variation on dated 12.01.2023 revised contract value is
19,87,94,550/- (Contract price Rs. 19,61,47,057/- + 1st Variation amount of Rs.
1,95,35,855/- (-)2nd Variation amount of Rs. 1,68,88,376/-)

2. In Pursuant to the clause 36.1 of Contract agreement “All variations shall be

included in updated programmes produced by the Contractor. The
Authority/Employer shall, having regard to the scope of the Works and the

 sanctioned estimated cost shall order variation as per extent Policy Guidelines of
NHAI and after approval from Authority.”

3. In Pursuant to the clause 36.2 of Contract agreement “Such variation may be for any
change in quantity of any item in the Bill of Quantities.”

4. The Contractor vide letter no. 082; dated: 30.06.2023 has submitted variation
proposal-III as per the condition of Site with Saving of the Rs. 1,97,44,786/-
(including Tender discount) for accord approval of the Authority as per the clause
39.2 of the contract Agreement.

5. Accordingly, the Engineer has reviewed the proposal and Following for your kind
consideration:

A. Saving Quantity in Paver Block, GSB & DLC :-

As per provision of the Contract Agreement and after variation 2nd, the
Contractor have to provide Shoulder widening with paver block in Ghat portion &
Built-up area Simrol village, Baigram village, Gwalu Village, Balwara Village,
saving paver block Qty. in ghat portion due to many locations required width not
available in ghat section and Gwalu village in reconstruction area so paver block
not required in this location.

B. Saving Qty. in Tack coat, DBM, BC :-

As per provision of the Contract Agreement provision of DBM & BC tentative
quantities for Major & Minor Junction work but as per site condition major,
Minor junction not constructed, Hence DBM & BC Quantity is saved.

C. Safety requirements at site location, some of the additional sign Boards, Road
marking and Parapet walls height increasing with painting, PA System, Convex
mirror, and reflector for enhancement of Safety as per direction of Hon'ble
Commissioner & Collector Indore: -

As per MORTH black Spot list Bherughat & Choral Ghat are black spot zone,
additional safety
measures required as per site condition.

Whereas PD-Indore has been conveyed that the Hon'ble Commissioner &
Collector Indore has directed for enhancement of the safety provisions in Ghat
section for avoidance of any mishappening at Road Highways during heavy traffic
volume on the subjected project. According, to the enhancement of safety
requirement at site wherever some of the additional sign Boards, Road marking,
PA System, Convex mirror, and reflector has proposed as per the IRC – 67- 2022
for fulfillment of additional safety requirement and smooth functioning of the
Highway during heavy traffic volume towards the subjected project.

D. Existing Structure repairing requires as per site condition: -

As per site condition there are 45 no. of Structures on the existing road i.e.,
Culverts, Minor bridge etc. out of 45, 34 Nos. of structures are found in damage
condition (e.g., Cracks in culverts, falling out stones from stone masonry, damage

 of wing/returning wall etc.) Hence, conceding the heavy traffic plying on the
existing road, repair of structures is required to avoid any mishappening due to
collapse of the structure ensuring safety of road users.

In Continuation of the above, the Existing contractor vide letter no. 082; dtd:
30.06.2023 the additional work as per the clause 36 of Contract Agreement and
submitted the revised Variation proposal – III with considering the additional
safety.

6. In continuation of the above, as per BOQ the total Saving amount Rs. 2,61,48,134/-
and use for safety work additional amount Rs. 67,82,429/- after view of positive and
negative variation total remaining Saving amount is Rs. 1,93,65,706/-

7. As per site visit and meeting held on PIU Indore deciding that the Existing structure
repairing required as per site condition so remaining saving amount Rs. 1,93,65,706
+ 10% amount delegation power of emergent repair work will be use in repairing
work of existing structures in ghat section, it is a tentative amount final amount of
repairing work will be submit after submission by the Contractor. Hence this office is
herewith recommending the same for accord the principal approval of authority.
