Could you review this denial of a request for FMLA. If I should be addressing this matter with Mei Truong or someone else, please so advise.
child, age 4 years old, was admitted to the hospital through the Emergency Department on October 2 and stayed there
until October 6, 2022. He called in daily and spoke to his Chief about his child’s hospitalization, etc.
In accordance with Article 18 , requested FMLA so that he could be with his son. He requested the FMLA forms during the
week of October 3 and received the correct forms during the week of October 24. He submitted them on October 26, 2022.
Mei Truong denied the request because “it was not a serious health condition”. See below and attached.
requested that I look into this as he seemed to have met the legal requirements as outlined in County policies regarding the FMLA
-- conditions requiring an overnight stay in a hospital or other medical care facility.
This request for FML was not a frivolous request. His four-year-old son was required to be hospitalized for four days and as a parent, he
needed to be with his child. The Doctor considered the child’s illness to be of a serious nature and admitted him to the hospital. How did Mei
Truong draw her conclusions that what his son was undergoing “was not a serious health condition.”
