GREETINGS;

WHEREAS, a Decision dated 2 October 2018 was rendered by this court


in the above-entitled case, portion of which reads as follows:

“With the conformity of the public prosecutor and finding


the same not contrary to law, morals, good customs and public
policy, the Court APPROVES the same to form part of the
Decision in so far as the civil aspect is concerned.

As further prayed by the defense, and there being no


objection on the part of the public prosecutor, let this case be
PROVISIONALLY DISMISSED.

This judgment of PROVISIONAL DISMISSAL shall


become permanent if and when the prosecution will not move
for its revival within a period of one (1) year from today, the
2nd day of October 2018.

SO ORDERED.”

WHEREAS, paragraph 4 of the Compromise Agreement dated 2 October


2018 states: “That in case of default and/or violation of any of the terms
herein stipulated, the aggrieved party shall be entitled to a Writ of
Execution to the amount of the balance, and/or revival of the instant case”;
WHEREAS, on 12 January 2021, the Court granted the “Motion to Revive”
with prayer for the issuance of writ of execution filed by the private
complainant on 18 July 2019 and ordered the issuance of writ of execution

NOW THEREFORE, by this Writ, you are hereby commanded to


implement the Order dated 12 January 2021 of this court as against the
accused pursuant to the Compromise Agreement.

Make a return of this Writ immediately after the order has been satisfied in
part or in full. If the order cannot be satisfied in full within thirty (30) days
after receipt of the Writ, the officer shall report to the court and state the
reasons therefore. Such writ shall continue in effect during the period
within which the order may be enforced by motion. The officer shall make a
report to the court every (30) days on the proceedings taken thereon until
the order is satisfied in full, or its effectivity expires. The return or periodic
shall set forth the whole of the proceedings taken, and shall be filed with
the court and copies thereof promptly furnished the parties.
